The day after Halloween, all of the proposed guideline changes went into effect!  We've talked about many of them in detail on previous podcasts, but here, we do a quick run-through of all eigiht categories of amendments.  So what's in our candy bags the day after?  Well, in truth, most of what we got were TREATS, but we have a few TRICKS as well.   There's plenty to love here, but there are also a few catagories of offenses that could result in increased guideline calculations.   Helping us get Set for Sentencing, our returning champion, guidelines guru Mark Allenbaugh to help run through all of it.    IN THIS EPISODE: The EIGHT categories of guidelines changes that went into effect on 11/1/23 Some practical tips and tricks for dealing with them:  Compassionate release (treat) Criminal History (treat) Acceptance of Responsibility (treat) New enhancement under the firearms guideline (trick) Career Offender guidelines (trick) Safety Valve (treat, but a lame circus peanut cleanup treat) Fentanyl enhancement (another weak treat) Sexual Abuse of a Ward Enhancement (it's a trick for the staff of the Federal Bureau of Prisons, who seem to have a sexual abuse problem in their facilities, and most definitely a treat for their many victims.) Why the commission is starting to move “commentary” into the guideline itself, in order to bypass new law (Kisor) that renders commentary non-binding on judges. Do a video on Barima “Bleu Davinci” McKnight and J Diggs touching on what a “safety valve” means in the federal system.Back in 2008 Bleu Davinci was sentenced to 5 years 4 months in federal prison for his role in a BMF drug related case. What does it mean to have a “safety valve”? Mara Shalhoup wrote a book called “The Rise and Fall of Big Meech” in 2010 and claims that Bleu cooperated in some way. According to her, “McKnight received a five-year sentence — eight months less than the government's recommendation, due in part to the fact that he agreed to share information with authorities. That information was not useful, however, because the government already had built most of its case against BMF. McKnight also was not willing to testify against other defendants."He would have liked to have cooperated if he could have," his attorney, David MacKusick, said. "But he didn't have any useful information."2. Keke Palmer publicly responds to her man, who had tweeted “It's the outfit, you are a mom” after she was seen out with Usher. In 1967, a Cleveland talent agent named Sid Friedman decided to capitalize on the popularity of football in the rust belt by launching a women's football league, which he envisioned as entertainment, complete with mini-skirts and tear-away jerseys. The women he recruited had other ideas, and soon they were playing competitive tackle football, not in skirts but in football uniforms.  In 1974, the owners of several teams around the country, some from Friedman's WPFL and some independent of it, formed to create their own league: the National Women's Football League, the NWFL, which started with 7 teams and grew within a few years to 14 teams across three divisions. The league faced financial difficulties from the beginning and finally folded in 1989, but the desire of women to play professional football lives on. I'm joined in this episode by Britni de la Cretaz and Lyndsey D'Arcangelo, authors of Hail Mary: The Rise and Fall of the National Women's Football League.
