Trump has chosen conservative federal appeals Judge Amy Coney Barrett and confirmation hearings are scheduled to begin Oct. 12. The announcement of Barrett drew immediate response from Wisconsin’s two U.S. senators. Republican Sen. Ron Johnson says he helped confirm Barrett in 2017 to the 7th Circuit U.S. Court of Appeals and he expects to support her confirmation to the U.S. Supreme Court. Meanwhile, Democratic Sen. Tammy Baldwin called Barrett an activist judge who would help overturn President Obama's Affordable Care Act — and vowed to vote against the nominee. Democratic Senate Leader Chuck Schumer has been hearing from his constituents a lot lately, and they're demanding he stand up and fight. That's the message brought by Indivisible Nation BK, which has held rallies outside of Schumer's Brooklyn home, his Manhattan office, and elsewhere demanding that Schumer unify the Democrats in standing up to Trumpism and Trump's Supreme Court nominee, Brett Kavanaugh. I spoke to Liat Olenick of Indivisible Nation BK about the group's mission, and how it came together around the idea that someone should hold elected officials accountable. Indivisible is all about holding your own elected officials accountable. As a Brooklyn group, we meet in Prospect Heights, Boerum Hill, Park Slope area, we're literally in his backyard, we're right near his house. We do have members from all over Brooklyn but because we're so close to him we kind of feel a special responsibility to continue to hold him accountable and put pressure on him to be the leader that we need right now. All elected officials are there for one reason, because they were elected by people going out and voting for them. When we signal to our representatives what we want them to do or that we are thankful for something or that we are disappointed in actions that they have taken, they pay attention because they want to, ultimately, get reelected and stay in office. The whole Indivisible model is based on that. We, especially with Chuck Schumer, take that really seriously because we are in his backyard and also because he is the most powerful Democrat in the country right now and more than anybody else, we need really strong consistent clear leadership coming from him and his office. Here to explain everything from a libertarian perspective is Allen Mendenhall, a lawyer, PhD, and director of the Blackstone and Burke Center. How will Gorsuch likely rule on important issues, given what we know about him? Is he an activist, an authoritarian, an originalist, or a positivist? Is he too cozy with federal power, or does he show a libertarian Coloradan streak? And, if confirmed, will he occupy a "stolen" seat?
The NRA has put its stamp of approval on President Trump's Supreme Court nominee Judge Neil Gorsuch. FOX's Eben Brown has this week's "Bullet Points": I'm Eben Brown. A controversial Kansas State law aimed at protecting people from federal prosecution on certain gun crimes is now ruled out-of-bounds. A federal court says a gun shop owner can't claim to be protected by the state for violating the National Firearms Act by building his own short-barreled rifles and suppressors. Next time you go deer or bear hunting in Pennsylvania, you can take a semi-automatic rifle with you! The state's game commission approved it this week. And President Trump's pick for the Supreme Court gets a big nod from the National Rifle Association. The nomination of Judge Neil Gorsuch was barely announced when the NRA called Gorsuch an 'outstanding choice', citing rulings the judge has made in support of self-defense protected by the Second Amendment. Gorsuch also gets a thumbs up from the National Shooting Sports Foundation. And those are your Bullet Points! I'm Eben Brown, FOX News!

In today's episode, we take a look at President Trump's Supreme Court nominee, Neil Gorsuch. The main segment was recorded before the announcement and reflects our guess (correctly!) that he would be the nominee, so you'll hear some speculative language. We begin, however, with a question from David Durman who wants to know if a citizen can bring a private civil suit against President Trump while he's in office. The answer may surprise you! During our main segment, we also discuss Gorsuch's originalism and some of the opinions and dissents he issued while serving on the U.S. Court of Appeals for the 10th Circuit. Oh, and he also wrote a snottly little editorial for the right-wing mag National Review. After our main segment, "Closed Arguments" returns with a question about Jared Kushner and the anti-nepotism law. Is Trump violating the law? The answer will probably not surprise you. Finally, we end with a brand new Thomas Takes the Bar Exam question #9 which is the single hardest question so far, in that it involves real property.
