September 17 is Constitution Day in America because on that day in 1787, after 4 months of deliberations, the delegates at the Constitutional Convention in Independence Hall in Philadelphia proposed the Constitution they had drafted to become the Supreme Law of the land. This was the end of one historic deliberation, but it was the beginning of another. The Constitution would be “of no more consequence than the paper on which it is written,” until it was ratified by the people of the United States.
This show has always been about the once-obvious connections between the "Supreme Law of the Land" in the once-free united States, and the True Supreme Law. It's also what this nation's Founders did, when they wrote about, and WITHDREW, the "consent of the governed," after a "long train of abuses and usurpations, having in direct object the establishment of an absolute Tyranny..." This week's show looks at the undeniable "escalation" of that train of abuses, and suggests that (while I've always said I "don't do dates", nor predict WHEN) the inevitable ultimately happens -- it will be "suddenly." What is Washington thinking when it comes to the Supreme Law of the Land, the Constitution?
Does the First Amendment of the Constitution Cover Freedom of Speech?The United States of America is the freest nation on Earth, for the time being. The Supreme Law of the land continues to be the Constitution. The founding document of our great nation on its own is the crowning achievement of the Founding Fathers, but before its ratification, ten articles were included as amendments.These ten articles became known as the Bill of Rights. The first of those rights, called the First Amendment, is:"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."Today, we are going to provide Free Speech 101: The Essential Guide. There are many things which ought to be said in the realm of freedom of speech, but these things are the roots, the essence of the topic.What is Freedom of Speech?The Constitution's First Amendment protects the nation from Congress attempted to make laws abridging the freedom of speech, or of the press. This is the cornerstone of a healthy democracy.Geoffrey Stone and Eugene Volokh, in conjunction with the National Constitution Center, provide a fantastic layman's version of this freedom: "Generally speaking, it means that the government may not jail, fine, or impose civil liability on people or organizations based on what they say or write, except in exceptional circumstances."The Supreme Court has interpreted the Constitution as protecting speakers from any and all government agencies and officials. Further, "speech" and "press" refers to talking, writing, printing, broadcasting, the Internet, and other forms of expressing oneself. Much to the chagrin of some, "freedom of speech also applies to symbolic expression, such as displaying flags, burning flags, wearing armbands, burning crosses, and the like (Stone, Volokh)."What Circumstances Are Not Covered as Free Speech Under the First Amendment?The American Civil Liberties Union (ACLU) has a reputation as a liberal organization, to put it mildly. However, in an article regarding free speech, the ACLU wrote:"Over the years, the ACLU has represented or defended individuals engaged in some truly offensive speech. We have defended the speech rights of communists, Nazis, Ku Klux Klan members, accused terrorists, pornographers, anti-LGBT activists, and flag burners. That's because the defense of freedom of speech is most necessary when the message is one most people find repulsive. Constitutional rights must apply to even the most unpopular groups if they're going to be preserved for everyone."Quite right! So, when is freedom of speech NOT covered by the First Amendment of the Constitution?First, certain types of speech are considered "low" value to the Supreme Court and thus provide circumstances under which the First Amendment barely applies or does not apply. These are outlined, with references to specific cases by Stone and Volohk:DefamationTrue threats"Fighting words"Hard-core obscenity (such as highly sexually explicit pornography)Child pornographyCommercial Advertising which is misleadingSecond, if the speaker is in a special relationship to the government, they are less protected. Government employees, such as public school employees can be restricted, even in the content of their speech.Third, the government can restrict speech under certain circumstances which are irrespective of content. For example, restrictions on noise, blocking traffic, and large distracting signs are constitutional, if they are reasonable. However, a law prohibiting demonstrations in public parks or handing out leaflets on public streets would be unconstitutional.Who was John Stuart Mill and What Did He Believe About Speech?Where did the American notion of freedom of speech which we possess come from? The lion's share of that work belongs to the British philosopher John Stuart Mill. In his 1859 book, On Liberty, Mill provided a bold argument for freedom of speech. Mill believed in the freedom of speech to discuss any topic at all, without molestation. The fullest expression of liberty in his mind was following topics of conversation to their logical limits. Social niceties be damned. He did, however, hold to what is called the "Harm Principle." Writing on this subject, Mill says, "... the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others (Mill, J.S., 1978. However, it is important to take note of this principle because it is the default liberal position on almost everything. "Well... I'm not hurting anyone!!!"To find the most liberal position's boundaries, we need only determine if someone would be harmed by someone's else's free expression. Important to distinguish, however, is that Mill would not have argued that freedom of speech be limited simply because a person was harmed. Only when speech causes direct and clear harm should it be limited.What are the Critiques of John Stuart Mill? Do They Bear Any Merit?The extreme liberal position of John Stuart Mill was an important contribution to the debate on freedom of speech. Many topics would have remained undiscussed due to taboos and socially acceptable limits. One important critique comes from an article in the Boston Review by Jacob Stanley in 2018. Stanley rightly points out that, "Disagreement requires a shared set of presuppositions about the world. Even dueling requires agreement about the rules." In his estimation, John Stuart Mill believed that "true belief becomes knowledge only by emerging victorious from the din of argument and discussion, which must occur either with actual opponents or through internal dialogue." Stanley, therefore, argues that false claims and conspiracy theories must be defended, if we are to have a chance of achieving knowledge. Stanley, however, recognizes the limits of the idea of a "marketplace of ideas" saying that human nature does not really allow for the truth to always prevail.This pragmatic view seems to provide a tempering of John Stuart Mill's unadulterated view of freedom of speech. We must understand our own limitations, as humanity, if we are to understand what freedom of speech offers us. We also cannot forget what freedom of speech requires of us!Taking OffensePresently, hate speech and taking offense are unfortunately conflated. Hate speech is determined based on the intention of the speaker. Whereas, taking offense is based on the decision of the hearer. They are not the same. In fact, sometimes a person might say something which another person takes as offensive. Let us imagine, though, that the thing which the speaker said is absolutely true and the problem is with the hearer being out of step with the truth. At this point, we can start analyzing whether what was said needed to be said. Did it need to be said in the way that it did? Did it need to be said in the circumstances that it did? Did it need to be said by that speaker to that hearer at that time?We need to dispel this myth that we have a right to not be offended. Sometimes we need to be offended. We are not perfect, not one of us. And so, if a truth is given to us, we need to be receptive, even if it hurts. That is how we grow.So, it would seem that freedom of speech extends to being offensive? But what about offensive statements which are not based in reality and actually point to a deeper more problematic issue under the surface? True hate speech causes offense, more often than not. But it is not the offense which is the primary issue. Hate speech can do injustice to privacy, equity, and security. Speech which shows a blatant disregard for the equity of people based on skin color, religion, sexual orientation, or gender (biological sex - male or female) which intends harm, cannot be under freedom of speech. No one is free to threaten harm. The Limits of Freedom of Speech and Our God-Given RightsI have no desire to opine on every possible aspect of freedom of speech in which limitations might be appropriate. Instead, I want to call us back to seeing freedom of speech as a right which necessarily is accompanied by responsibility. Here I am going to stray into philosophy rather than legality. To be clear, I am not going to be discussing what is constitutional or not, but rather stating what I believe to be right or not. Rooted in respect for human dignity, all are called to seek the common good. An integral part of securing the common good is protecting the basic and inalienable rights of all people. This begins with the right to life. Mothers and fathers have a responsibility to protect their children (from the first moment of his or her existence) to the best of their ability. Generally, the best decision is made at the local level. And so, each family must make decisions for themselves and their neighbors. These micro-communities need to serve their macro-communities. Those communities need to serve the common good of the state, then the nation, then the world. Our rights do not come primarily from our government. They begin at home. They begin with life. Responsibility Accompanies Rights, AlwaysIn justice, as we seek the common good, we exercise these rights, but we must never lose sight of the accompanying responsibilities. Put another way: we are not given rights by the Creator to be kept for our sole use. When it comes to speech, we do not have freedom of speech so much as freedom FOR speech. Our rights are geared towards our duties and responsibilities. We have to use our gifts and powers well. As Pope John XXIII wrote well in his 1963 letter Pacem in Terris:"... in human society one man's natural right gives rise to a corresponding duty in other men; the duty, that is, of recognizing and respecting that right. Every basic human right draws its authoritative force from the natural law, which confers it and attaches to it its respective duty. Hence, to claim one's rights and ignore one's duties, or only half fulfill them, is like building a house with one hand and tearing it down with the other (30)."When we speak, we do not have a license to say whatever we would like. Certainly, we have the protected right to do so in the United States, under certain limitations. But I am arguing that we should use our freedom of speech wisely. By using it well, our words will have greater impact. Our well-chosen words will add social value and lift our neighbors up. In this program, I will be reading, and commenting on, several articles that discuss the aftermath of the January 6 demonstration while inserting my comments. Among the articles, portions of which I will read, include: “FBI confirms there was no insurrection on Jan. 6” by Conn Carroll, Commentary Editor, which appeared in the Washington Examiner on August 20, 2021. “Exclusive: FBI finds scant evidence U.S. Capitol attack was coordinated – sources” By Mark Hosenball and Sarah N. Lynch, which appeared in Reuters.com on August 20, 2021. “'Horror story': Navy vet, never set foot in Capitol on Jan. 6, but held in solitary” Accused of leading 'military-style attack' despite no evidence by Art Moore, which was published on October 5, 2021, by World Net Daily.com. The disparity in viewpoints in these articles illustrates the difference in assessment they portray of the people who exercised their First Amendment rights of Freedom of Speech, Freedom of Assembly, and Freedom to Petition for a Redress of Grievances based on whether the article's author accepts the bogus narrative that the mostly peaceful demonstration at the US Capitol on January 6 was an insurrection. This emphasizes the importance of adhering to the Biblical admonition of Psalm 1:1 “Blessed is the man who walks not in the counsel of the ungodly This program continues to discuss the response to the events surrounding the mostly peaceful demonstration that occurred at the US Capitol on January 6, 2021 in which citizens protested the fraudulent 2020 election because the treatment of these demonstrators vividly illustrates the destruction of our Constitutional Republic. The program title, Liberty and Posterity, comes from the US Constitution, the preamble of which states that one of the reasons for writing and ratifying the Constitution was to “secure the blessings of liberty to ourselves and our posterity,” our posterity being our children and descendants not yet born. As a reminder, on the Liberty and Posterity program, we view all events and activities in relation to reality, truth, and Biblical morality. If you have a problem with that, the problem is on your end, not ours. James Madison, Fourth President of the United States and one of the authors of the US Constitution wrote: “The future and success of America is not in this Constitution, but in the laws of God upon which this Constitution is founded.” Proverbs 14:34 Righteousness exalteth a nation: but sin is a reproach to any people. John Dickinson, one of the founding fathers of the United States and the author of the first draft of the Articles of Confederation, the agreement under which the thirteen colonies coordinated their actions after the Declaration of Independence in 1776, wrote: “Honor, justice, and humanity, call upon us to hold, and to transmit to our posterity, that liberty which we received from our ancestors. He had been indicted in March on charges that included civil disorder and assaulting or resisting officers. Mr. Anderson claimed that he never assaulted anyone; that he collapsed after being sprayed and was assisted by Capitol Police officers. Prosecuting attorneys had suppressed the video that would have corroborated Mr. Anderson's account; by failing to provide exculpatory evidence to Mr. Anderson and his attorney, the prosecutors in Mr. Anderson's case appear to have violated the Brady Rule, named after Brady v. Maryland, 373 U.S. 83 (1963), which requires prosecutors to disclose materially exculpatory evidence in the government's possession to the defense. It seems obvious to me that the incarceration of those involved in the mostly peaceful demonstration at the US Capitol on January 6, 2021 is meant to provide the rationale for the demonization and persecution of those who oppose the current regime in Washington, DC. September 17 is Constitution Day in America because on that day in 1787, after 4 months of deliberations, the delegates at the Constitutional Convention in Independence Hall in Philadelphia proposed the Constitution they had drafted to become the Supreme Law of the land. This was the end of one historic deliberation, but it was the beginning of another. The Constitution would be “of no more consequence than the paper on which it is written,” until it was ratified by the people of the United States.
For your heart's content,all you have to do is sit —still, and long enough.* * *Picking up from where we left off in the last segment, Master Dogen has introduced the practical, stripped-down approach to method that is unique to Zen, our upright seated meditation, zazen. After reviewing his reference to nonthinking as the natural state of mind, and his declaration that it, along with the natural sitting posture and natural breath, form the very basis for zazen, we continue:Zazen is not “step-by-step meditation.” Rather it is simply the easy and pleasant practice of a Buddha, the realization of the Buddha's wisdom.Master Dogen reminds us that, while to teach or even discuss anything, we have to break it down into distinct steps, digestible bites, zazen actually works on a holistic basis. It is better not to look for the particular stage of development, or progress, that we may be experiencing. This kind of linear thinking leads to expectations, specifically of the “next” stage, how to get there, and when we will arrive. The “final” stage being some construct of enlightenment, until we reach it we are forever frustrated. Zazen, instead, is the “seal” of Buddha, direct realization of wisdom, in real time and space. Let it go at that.The truth appears, there being no delusion. If you understand this, you are completely free, like a dragon that has obtained water or a tiger that reclines on a mountain.The Supreme Law will then appear of itself; and you will be free of weariness and confusion.Note that the truth appears; we do not come to some conclusion. And that there is no delusion, from the beginning. Otherwise the truth would not appear to us. This represents the only true freedom, that is not dependent upon circumstance. Water to the dragon quenches its terrible thirst. A tiger reclining on a mountain is, at long last, truly home. The “Supreme Law” will, and must, “appear of itself.” Nothing we can do can make it appear, but if and when it does, we will be “free of weariness and confusion.” What could be more desirable?Then Dogen returns from the inspirational to the practical:At the completion of zazen move your body slowly and stand up calmly. Do not move violently.There are practical reasons for moving carefully. Your body has adapted to the posture, and you may injure yourself by moving abruptly. But I think the larger implication is that there is really no dividing line here. Transitioning from sitting to standing or walking — or lying down, for that matter — does not divide Zen practice into compartments. We are not practicing only when sitting, and not practicing at all when not sitting. Zen practice is seamless. But all activities are not equivalent to zazen. It is truly special:By virtue of zazen it is possible to transcend the difference between “common” and “sacred” and attain the ability to die while doing zazen or while standing up.Transcending “common” and “sacred” — as attitudes projected upon reality — is illustrated by doing zazen at Eiheiji monastery in Japan, or in your basement. Same thing. Attaining the “ability to die” in any circumstance is a bit more challenging. In other translations, it is explained that many masters in the history of Zen have actually sat down and died, when the time came, as did Master Dogen. But that this would even represent a desirable attainment would raise eyebrows in skeptical America. Why would anyone want to develop such an ability? What would be the point?Moreover, it is impossible for our discriminating mind to understand either how the buddhas and patriarchs expressed the essence of Zen to their disciples with finger, pole, needle, or mallet, or how they passed on enlightenment with a hossu, fist, staff, or shout.Neither can this be understood through supernatural power or a dualistic view of practice and enlightenment.Dogen profiles the transmission of Buddhism as something that is completely beyond ordinary understanding. That the most mundane thing, or simple gesture, in the hands of a master, will do to transmit the essence of Zen — and trigger an insight in their students — beggars the imagination. It has nothing to do with supernatural superstition, but turns on the nonduality of practicenlightenment.Zazen is a practice beyond the subjective and objective worlds, beyond discriminating thinking. Therefore, no distinction should be made between the clever and the stupid.Zazen is our gate to this reality beyond so-called subjectivity and objectivity. Discriminating thinking can help us to appreciate its unique method and place in our Zen practice, but ultimately must be set aside, in the process of apprehending its effect. We cannot think our way to insight. In fact, our very cleverness may form a barrier. “Stupid” may be an inappropriate choice. Sekito Kisen's “human faculties are sharp or dull” provides a more neutral expression. The point is that insight does not play favorites.To practice the Way single-heartedly is, in itself, enlightenment.There is no gap between practice and enlightenment or zazen and daily life.A couple other distinctions pushing back against cultural definitions of enlightenment, repeating that practice itself is enlightenment, no need to attach to a goal or objective. And that daily life, just as it is, is not separate from the practice of zazen. It may make more sense to say that there is no gap between Zen and daily life, but Dogen was promoting zazen specifically, not Zen as such. In fact, he lobbied against using the contemporary term in place of Buddhism. For his students, and perhaps for lay people as well, he is making the point that sitting in zazen is entirely integrated with everyday concerns.The Buddhas and patriarchs, both in this world and that, in India and in China. have all preserved the Buddha-mind and enhanced Zen training.You should therefore devote yourself exclusively to and be completely absorbed in the practice of zazen.Although it is said that there are innumerable ways of understanding Buddhism, you should do zazen alone.As a kind of credentialing of this teaching, similar to “Thus have I heard” as a traditional introduction to a sutra recitation, Dogen reminds us that this zazen is, and was, the practice of the ancestors. And thus and therefore, you would do worse than to devote yourself to this method. Doing zazen alone, in spite of the innumerable teachings, I take to mean we should at least do zazen, making it our sole refuge.There is no reason to forsake your own sitting place and make futile trips to other countries. If your first step is mistaken, you will stumble immediately.Rephrasing the third comment-question from the beginning of the tract, Dogen makes clear that he means to point out the futility of traveling far and wide to find the Dharma. This has a touch of irony, in that he himself has just returned from a long, arduous and dangerous journey to China. But the first step toward it is a step away from it, as it is “completely present where you are.” Do what he says, not what he did.You have already had the good fortune to be born with a precious [human] body, so do not waste your time meaninglessly.We have the same basic equipment, the materials and tools to work with, that Buddha and Dogen had: birth as a human being, the necessary pivot-point (J. yoki) required for awakening. However, there is no time to waste. It has taken a long time to dig yourself into the hole that you find yourself in, and will take some time to dig your way out.Now that you know what is the most important thing in Buddhism, how can you be satisfied with the transient world?Our bodies are like dew on the grass, and our lives like a flash of lightning, vanishing in a moment.After all this commentary, he assumes we have been able to extract his main point, the most important thing. The point of Buddhism is said to be the point of existence, itself. Again the sense of urgency, the plea to stop wasting time meaninglessly. And this in a world that had no internet, no social media, no TV, no radio, no electricity. Not wasting our time meaninglessly is more problematic today than ever.Earnest Zen trainees, do not be surprised by a real dragon or spend a long time rubbing only one part of an elephant.Exert yourself in the Way that points directly to your original [Buddha] nature.Saying the same thing in different words. The “real dragon” I take to be the power of insight that we find in zazen, if we sit still enough for long enough. When we see the dragon, do we hear it roar? as the priest asked the dragon-painter, in a story related by Matsuoka Roshi. Wasting time investigating only one dimension of the whole, is Buddha's admonition on blind men feeling different parts of an elephant. Instead, we should put our full exertion into the Zen way. It can only reveal the truth that is already true.Respect those who have realized full knowledge and have nothing more to do.Become one with the wisdom of the Buddhas and succeed to the enlightenment of the patriarchs.This “full knowledge” of the truth of our existence represents the culmination of our life's work. We have “nothing more to do.” Of course, Dogen and the other ancestors of Zen did plenty more, following their insight. They re-entered the marketplace, like the oxherd, with helping hands. But as for themselves, they had nothing more to do, nothing missing, nothing extra. This is the simple “wisdom of the Buddhas” and “enlightenment of the patriarchs.” We should make mention of the matriarchs of Zen, as well.If you do zazen for some time, you will realize all this.The treasure house will then open of itself; and you will be able to enjoy it to your heart's content.Again, trust in the original mind. If you simply sit still enough for long enough, this will become clear, like Buddha's analogy of the jar of silty water, settling on the shelf until it becomes clear again. And again, you will not pry open the gate to the treasure house by might and main, or sheer willpower. But instead, it will “open of itself.” No amount of self-centered striving is going to help. There is an old saw that goes, “A hard case makes for bad law.” In simple English, it means that you shouldn’t let your passions get the better of you and pass laws that seem like they make sense today without fully considering the effect of those laws in or even on the future. Now, the Constitution being the Supreme Law, we have to consider one peculiar section that has remained, like a vestigial tail, since 1869, when it was ratified as Section 3 of the 14th Amendment. It was almost entirely the work of one man, who believed that a hard law was needed. He pushed for Section 3’s inclusion as he wrote it. Then, within two years, he died. Within a few short years, so did application of Section 3 of the 14th Amendment. By 1898 is was as utterly dead as Senator Howard had become in 1871… at least until this past week, when some intentionally ignorant politicians tried to convince the public that they could revive it…
In this paper, Hamilton defends the last clause of the eighth section of the first article of the proposed Constitution in relation to the legislatures power it reads, “to make all laws which shall be NECESSARY and PROPER for carrying into execution THE POWERS by that Constitution vested in the government of the United States, or in any department of officer thereof.” Hamilton also defends the second clause of the sixth article declaring, “that the Constitution and the laws of the United States made IN PURSUANCE THEREOF, and the treaties made by their authority shall be the SUPREME LAW of the land, any thing in the Constitution or laws of any State to the contrary notwithstanding.” Mike uses some real life examples such as the second amendment to help accentuate Hamilton's point. There were three different types of treaties that were negotiated here in the U.S. There were peace treaties …there were a land cession treaties…and there were treaties that created reservations… it says in the Constitution of the United States that treaties are “ the supreme law of the land ”…Without these land cession treaties, much of what is now in Minnesota, North Dakota, Wisconsin, Michigan, as well as many other areas throughout the country, could not legally exist…

There is so much information covering so many issues, you will probably need to separate the show in your mind by listening to the segments you define. We covered energy, military options, geopolitics, the history of the Gulf Wars, the pro-war lobby, ego, getting out at the "right time," the differences in world view between Muslim and Christian, and Shelby added the treatment of women in Muslim countries.
