Jean Carroll, then Nikkki Haley. Who knows what his next sleepless night might bring? Sure, we would all want Haley to stay in the Gop primary. Donald Trump might blow a blood vessel on live TV, and Nikkki is happy to remind the whole lot of them of their recent shrinkage. Alas, we don't pay her bills. On the other hand, New Hampshire was a good test of Joe Biden's support, and how many Democrats can spell Robinette. Poor Ron DeSantis, still reeling from the effects of the woke mind virus, has now found it more difficult to satisfy his wife in the manner to which she has become accustomed.   C'mon Republicans, you know Kari Lake is going to wear a wire! Lindsey Graham was born wearing one. Put the two of them in a room with Matt Gaetz and you could microwave hotdogs with the radiation. Of course, today all you need is a phone and the internet, as an Alina Habba MAGA fanboy discovered. The battle between the “Original” Michigan Gop, and the “AAAA-1” Michigan Gop rages on. In other civil war news, Greg Abbott will use the “Supreme Law of Texas” against the puny Yankee army, following the orders of his party's Commander in Chief, Donald Trump. White nationalists do prefer that Kirk Lazarus would play Othello, but otherwise are big Shakespeare fans… although they are pretty bad at quoting the lines under pressure.   Uvalde police care about what their citizens say about them, at least enough to harass them further. California is voting out “Citizens United” foreign money, with your help!

September 17 is Constitution Day in America because on that day in 1787, after 4 months of deliberations, the delegates at the Constitutional Convention in Independence Hall in Philadelphia proposed the Constitution they had drafted to become the Supreme Law of the land. This was the end of one historic deliberation, but it was the beginning of another. The Constitution would be “of no more consequence than the paper on which it is written,” until it was ratified by the people of the United States.

Does the First Amendment of the Constitution Cover Freedom of Speech?The United States of America is the freest nation on Earth, for the time being. The Supreme Law of the land continues to be the Constitution. The founding document of our great nation on its own is the crowning achievement of the Founding Fathers, but before its ratification, ten articles were included as amendments.These ten articles became known as the Bill of Rights. The first of those rights, called the First Amendment, is:"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."Today, we are going to provide Free Speech 101: The Essential Guide. There are many things which ought to be said in the realm of freedom of speech, but these things are the roots, the essence of the topic.What is Freedom of Speech?The Constitution's First Amendment protects the nation from Congress attempted to make laws abridging the freedom of speech, or of the press. This is the cornerstone of a healthy democracy.Geoffrey Stone and Eugene Volokh, in conjunction with the National Constitution Center, provide a fantastic layman's version of this freedom: "Generally speaking, it means that the government may not jail, fine, or impose civil liability on people or organizations based on what they say or write, except in exceptional circumstances."The Supreme Court has interpreted the Constitution as protecting speakers from any and all government agencies and officials. Further, "speech" and "press" refers to talking, writing, printing, broadcasting, the Internet, and other forms of expressing oneself. Much to the chagrin of some, "freedom of speech also applies to symbolic expression, such as displaying flags, burning flags, wearing armbands, burning crosses, and the like (Stone, Volokh)."What Circumstances Are Not Covered as Free Speech Under the First Amendment?The American Civil Liberties Union (ACLU) has a reputation as a liberal organization, to put it mildly. However, in an article regarding free speech, the ACLU wrote:"Over the years, the ACLU has represented or defended individuals engaged in some truly offensive speech. We have defended the speech rights of communists, Nazis, Ku Klux Klan members, accused terrorists, pornographers, anti-LGBT activists, and flag burners. That's because the defense of freedom of speech is most necessary when the message is one most people find repulsive. Constitutional rights must apply to even the most unpopular groups if they're going to be preserved for everyone."Quite right! So, when is freedom of speech NOT covered by the First Amendment of the Constitution?First, certain types of speech are considered "low" value to the Supreme Court and thus provide circumstances under which the First Amendment barely applies or does not apply. These are outlined, with references to specific cases by Stone and Volohk:DefamationTrue threats"Fighting words"Hard-core obscenity (such as highly sexually explicit pornography)Child pornographyCommercial Advertising which is misleadingSecond, if the speaker is in a special relationship to the government, they are less protected. Government employees, such as public school employees can be restricted, even in the content of their speech.Third, the government can restrict speech under certain circumstances which are irrespective of content. For example, restrictions on noise, blocking traffic, and large distracting signs are constitutional, if they are reasonable. However, a law prohibiting demonstrations in public parks or handing out leaflets on public streets would be unconstitutional.Who was John Stuart Mill and What Did He Believe About Speech?Where did the American notion of freedom of speech which we possess come from? The lion's share of that work belongs to the British philosopher John Stuart Mill. In his 1859 book, On Liberty, Mill provided a bold argument for freedom of speech. Mill believed in the freedom of speech to discuss any topic at all, without molestation. The fullest expression of liberty in his mind was following topics of conversation to their logical limits. Social niceties be damned. He did, however, hold to what is called the "Harm Principle." Writing on this subject, Mill says, "... the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others (Mill, J.S., 1978. On Liberty, Indianapolis: Hackett Publishing)." Application of this principle is the subject of not a few debates. However, it is important to take note of this principle because it is the default liberal position on almost everything. "Well... I'm not hurting anyone!!!"To find the most liberal position's boundaries, we need only determine if someone would be harmed by someone's else's free expression. Important to distinguish, however, is that Mill would not have argued that freedom of speech be limited simply because a person was harmed. Only when speech causes direct and clear harm should it be limited.What are the Critiques of John Stuart Mill? Do They Bear Any Merit?The extreme liberal position of John Stuart Mill was an important contribution to the debate on freedom of speech. Many topics would have remained undiscussed due to taboos and socially acceptable limits. One important critique comes from an article in the Boston Review by Jacob Stanley in 2018. Stanley rightly points out that, "Disagreement requires a shared set of presuppositions about the world. Even dueling requires agreement about the rules." In his estimation, John Stuart Mill believed that "true belief becomes knowledge only by emerging victorious from the din of argument and discussion, which must occur either with actual opponents or through internal dialogue." Stanley, therefore, argues that false claims and conspiracy theories must be defended, if we are to have a chance of achieving knowledge. Stanley, however, recognizes the limits of the idea of a "marketplace of ideas" saying that human nature does not really allow for the truth to always prevail.This pragmatic view seems to provide a tempering of John Stuart Mill's unadulterated view of freedom of speech. We must understand our own limitations, as humanity, if we are to understand what freedom of speech offers us. We also cannot forget what freedom of speech requires of us!Taking OffensePresently, hate speech and taking offense are unfortunately conflated. Hate speech is determined based on the intention of the speaker. Whereas, taking offense is based on the decision of the hearer. They are not the same. In fact, sometimes a person might say something which another person takes as offensive. Let us imagine, though, that the thing which the speaker said is absolutely true and the problem is with the hearer being out of step with the truth. At this point, we can start analyzing whether what was said needed to be said. Did it need to be said in the way that it did? Did it need to be said in the circumstances that it did? Did it need to be said by that speaker to that hearer at that time?We need to dispel this myth that we have a right to not be offended. Sometimes we need to be offended. We are not perfect, not one of us. And so, if a truth is given to us, we need to be receptive, even if it hurts. That is how we grow.So, it would seem that freedom of speech extends to being offensive? But what about offensive statements which are not based in reality and actually point to a deeper more problematic issue under the surface? True hate speech causes offense, more often than not. But it is not the offense which is the primary issue. Hate speech can do injustice to privacy, equity, and security. Speech which shows a blatant disregard for the equity of people based on skin color, religion, sexual orientation, or gender (biological sex - male or female) which intends harm, cannot be under freedom of speech. No one is free to threaten harm. The Limits of Freedom of Speech and Our God-Given RightsI have no desire to opine on every possible aspect of freedom of speech in which limitations might be appropriate. Instead, I want to call us back to seeing freedom of speech as a right which necessarily is accompanied by responsibility. Here I am going to stray into philosophy rather than legality. To be clear, I am not going to be discussing what is constitutional or not, but rather stating what I believe to be right or not. Rooted in respect for human dignity, all are called to seek the common good. An integral part of securing the common good is protecting the basic and inalienable rights of all people. This begins with the right to life. Mothers and fathers have a responsibility to protect their children (from the first moment of his or her existence) to the best of their ability. Generally, the best decision is made at the local level. And so, each family must make decisions for themselves and their neighbors. These micro-communities need to serve their macro-communities. Those communities need to serve the common good of the state, then the nation, then the world. Our rights do not come primarily from our government. They begin at home. They begin with life. Responsibility Accompanies Rights, AlwaysIn justice, as we seek the common good, we exercise these rights, but we must never lose sight of the accompanying responsibilities. Put another way: we are not given rights by the Creator to be kept for our sole use. When it comes to speech, we do not have freedom of speech so much as freedom FOR speech. Our rights are geared towards our duties and responsibilities. We have to use our gifts and powers well. As Pope John XXIII wrote well in his 1963 letter Pacem in Terris:"... in human society one man's natural right gives rise to a corresponding duty in other men; the duty, that is, of recognizing and respecting that right. Every basic human right draws its authoritative force from the natural law, which confers it and attaches to it its respective duty. Hence, to claim one's rights and ignore one's duties, or only half fulfill them, is like building a house with one hand and tearing it down with the other (30)."When we speak, we do not have a license to say whatever we would like. Certainly, we have the protected right to do so in the United States, under certain limitations. But I am arguing that we should use our freedom of speech wisely. By using it well, our words will have greater impact. Our well-chosen words will add social value and lift our neighbors up. During this program, I will quote from the article "Nation Writer Labels the Constitution 'Trash'" by Isaac Schorr, which appeared in National Review on March 4, 2022. The Nation is, quoting their website, "principled and progressive" and "empowers readers to fight for justice and equality for all" in order "to bring about a more democratic and equitable world." To paraphrase: The Nation is a left-wing, globalist, socialist, and anti-Biblical periodical that works tirelessly for the destruction of our God-given Constitutional liberties by focusing on, and distorting, current issues in order to undermine our social fabric and thus destabilize our country so that most of our citizens will be impoverished and subjugated. National Review is a neo-con globalist periodical, so I don't necessarily agree with everything that appears in that publication. "Elie Mystal, justice correspondent for The Nation, labeled the Constitution "trash" in an appearance on ABC's The View on Friday." "Appearing on the program to promote his new book, Allow Me to Retort: A Black Guy's Guide to the Constitution, Mystal was asked by co-host Ana Navarro-Cárdenas if the Constitution "is a living document," or a "sacred document." Mystal responded by declaring that "it's certainly not sacred, all right, let's start there. The Constitution is kind of trash." " The US Constitution is a living document in the sense that it is still the Supreme Law of the Land, per Article VI of the Constitution itself: "This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding." It is also a "living document" in the sense that it can be amended, as stated in Article V of the Constitution itself: "The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments." The second method is called the Convention of States, about which I will comment if I have time. Judges do not amend the Constitution but are bound to adhere to it. Several times the Supreme Court has modified the Constitution, such as the banishment of prayer and Bible reading from public schools and the promotion of sodomy and all forms of sexual depravity. Congress and the president should have ignored these rulings and removed the judges who usurped the position of the legislature by legislating from the bench. Per Article I of the US Constitution, all legislative powers are vested in the congress; per Article III of the US Constitution, judges can be removed from office if they don't exhibit "good behavior." Usurping the legislative powers of congress is definitely not "good behavior." The US Constitution is not a sacred document, but the principles of the US Constitution are Biblical and thus are sacred, universal, and eternal. " "It was written by slavers and colonists and white people who were willing to make deals with slavers and colonists. They didn't ask anybody that looked like me what they thought about the Constitution," continued Mystal, who proceeded to do an impression of a 18th century slave weighing in on the document." " It's true that many of the authors of the US Constitution owned slaves, but many were vehemently opposed to slavery, such as Ben Franklin and John Adams. One delegate to the Constitutional Convention was George Mason of Virginia. He objected to the Constitution and refused to sign it because he felt that it did not provide protection for the individual citizen and gave the federal government ill-defined and over-zealous powers. His objections helped the incorporation of the Bill of Rights as the first ten amendments to the US Constitution. In addition, George Mason, although he owned slaves, opposed the US Constitution because it allowed the slave trade to continue until 1808. George Mason said that "slavery brings the judgment of God down upon a nation." Thomas Jefferson wrote the Declaration of Independence but was not present at the Constitutional Convention because he was the ambassador to France at the time. His first draft of the Declaration of Independence abolished slavery, which at the time was legal in the British Empire. Unfortunately, the delegates from South Carolina and Georgia would have never signed the Declaration of Independence if slavery abolition remained in the text. The colonies needed a united front against Great Britain, so Thomas Jefferson removed from the Declaration of Independence the portion calling for slavery's abolition. Mr. Mystal's opposition to slavery is somewhat ironic, since he and his fellow globalist socialist want to make us all slaves. His ad-hominem attacks on the authors of the US Constitution are most distasteful. He attacks the authors for being who they are, not their ideas. Colonists are simply people who live in a colony rather than the main or mother country. The complexion of one's skin (dark or light) is irrelevant to any substantive discussion of the issues, unless you are a racist demagogue, such as Mr. Mystal. " "In another interview promoting his book Allow Me to Retort, Mystal was asked if he thought the Constitution should be "scrapped altogether." " Such sentiments seem to make him an enemy of the US Constitution. Article VI of the US Constitution itself states: "The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution." When I took a commission in the US Marine Corps, I took the following oath: "I, [name], do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God." "In the absence of that emerging [scrapping the Constitution altogether], however, he suggested Americans "interpret our Constitution so that we extend justice and fairness and equality to all, as opposed to whatever the heck we do now." " That is already codified in Section 1 of the Fourteenth Amendment: "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws." Leviticus 19:15 Ye shall do no unrighteousness in judgment: thou shalt not respect the person of the poor, nor honor the person of the mighty: but in righteousness shalt thou judge thy neighbour. Proverbs 24:23 These things also belong to the wise. It is not good to have respect of persons in judgment. Colossians 3:25 But he that doeth wrong shall receive for the wrong which he hath done: and there is no respect of persons. "Mystal expanded on this point in his Friday appearance on The View, "the very least we can do is ignore what those slavers and colonists and misogynists thought." " Abolishing our Bill of Rights, including freedom of religion, speech, assembly, due process, trial by jury, protection against unreasonable searches and seizures and cruel and unusual punishment, just to name a few? "Included in his proposed improvements to the Constitution was "no states' rights when it comes to healthcare, elections, policing, and guns. That's just better." " In other words, let an all-powerful federal (or global) government control our healthcare, elections, policing, and self-defense. He thinks that is better. Better for whom. We will own nothing, but the elite will own everything, and somehow, we will all be happier. Mr. Mystal wants government to be God. First, the job is not available, and second, unlike God, people are not omniscient (they don't know everything, not even the CIA or NSA), not omni present (they can't be everywhere), and they aren't omnipotent (they can't do everything). Mr. Mystal's proposal to "scrap the US Constitution altogether" is consistent with some famous conservative personalities who call for a Convention of States to revise the Constitution. When our Constitution was written and adopted, almost everyone, including the most highly educated, was a Christian or had strong attachments to Biblical ethics, including the least religious founders such as Thomas Jefferson and Ben Franklin. Today, most of the highly educated (indoctrinated) are scoffers and mockers. Any Convention of States would soon be taken over by the acolytes of such globalists and America-haters as Bill Gates, Jeff Bezos, Michael Bloomberg, and George Soros. They would put our Constitution through a paper shredder, and the document they produce would relegate our liberties to nothing more than a distant memory. We have all the mechanism we need to amend the Constitution without destroying it. The Constitutional Convention met to revise the Articles of Confederation but ended up scrapping it. The same thing could happen again with disastrous consequences. The program title, Liberty and Posterity, comes from the US Constitution, the preamble of which states that one of the reasons for writing and ratifying the Constitution was to "secure the blessings of liberty to ourselves and our posterity," our posterity being our children and descendants not yet born. As a reminder, on the Liberty and Posterity program, we view all events and activities in relation to reality, truth, and Biblical morality, the same principles stated in the first sentence of the Declaration of Independence that entitle the United States to be separate from, and equal to, other nations: The Laws of Nature and of Nature's God. The Laws of Nature are the physical laws by which the universe operates (also called reality and truth), and the Laws of Nature's God are the moral laws of God as specified in the Bible. Romans 3:4 "let God be true, but every man a liar." John 8:31-32 "Then said Jesus to those Jews which believed on him, If ye continue in my word, then are ye my disciples indeed; And ye shall know the truth, and the truth shall make you free." James Madison, Fourth President of the United States and one of the authors of the US Constitution wrote: "The future and success of America is not in this Constitution, but in the laws of God upon which this Constitution is founded." "Honor, justice, and humanity, call upon us to hold, and to transmit to our posterity, that liberty which we received from our ancestors. It is not our duty to leave wealth to our children, but it is our duty to leave liberty to them." ~ John Dickinson, known as the "Penman of the Revolution" for his twelve Letters from a Farmer in Pennsylvania, published individually in 1767 and 1768 and author of the first draft of the Articles of Confederation, the agreement by which the thirteen colonies coordinated their affairs after the Declaration of Independence in 1776 and prior to the ratification of the US Constitution in 1789. If you have a problem with that, the problem is on your end, not ours. A word of caution to those who have the urge to travel to Washington, DC: based on what happened to the peaceful protestors on January 6, 2021, neither sanity nor Constitutional liberty is observed by local or federal government officials in our nation's capitol. Washington, DC seems to have fallen to the state described of Babylon in Revelation 18:2 and has "become the habitation of devils, and the hold of every foul spirit, and a cage of every unclean and hateful bird." One of these "unclean and hateful birds" could be named "Michael" and spelled Byrd: the killer of Ashli Babbitt. The violence that occurred during the protest on January 6 was nearly all perpetrated by agent provocateurs, FBI informants, or out-of-control Capitol Police. Even an on-scene reporter for the deceitful New York Times seems to admit this. Four people died of violence during the January 6, demonstration: Capitol Offense: "The Ugly Truth Behind the Five Deaths from January 6th and 7th," by Tayler Hansen, which appeared in his newsletter on January 26, 2022. Ashli Babbitt, who was callously shot to death by Lt. Michael Byrd of the Capitol Police, and Rosanne Boyland, who, based on video evidence and witness testimony, appears to have been beaten to death by Lila Morris of the Capitol Police, and Benjamin Phillips and Kevin Greeson, who appear to have died as a result of the Capitol Police indiscriminately firing flash grenades into the crowd on January 6. In this program, I will be reading, and commenting on, several articles that discuss the aftermath of the January 6 demonstration while inserting my comments. Among the articles, portions of which I will read, include: “FBI confirms there was no insurrection on Jan. 6” by Conn Carroll, Commentary Editor, which appeared in the Washington Examiner on August 20, 2021. “Exclusive: FBI finds scant evidence U.S. Capitol attack was coordinated – sources” By Mark Hosenball and Sarah N. Lynch, which appeared in Reuters.com on August 20, 2021. “'Horror story': Navy vet, never set foot in Capitol on Jan. 6, but held in solitary” Accused of leading 'military-style attack' despite no evidence by Art Moore, which was published on October 5, 2021, by World Net Daily.com. The disparity in viewpoints in these articles illustrates the difference in assessment they portray of the people who exercised their First Amendment rights of Freedom of Speech, Freedom of Assembly, and Freedom to Petition for a Redress of Grievances based on whether the article's author accepts the bogus narrative that the mostly peaceful demonstration at the US Capitol on January 6 was an insurrection. This emphasizes the importance of adhering to the Biblical admonition of Psalm 1:1 “Blessed is the man who walks not in the counsel of the ungodly This program continues to discuss the response to the events surrounding the mostly peaceful demonstration that occurred at the US Capitol on January 6, 2021 in which citizens protested the fraudulent 2020 election because the treatment of these demonstrators vividly illustrates the destruction of our Constitutional Republic. Numerous citizens who exercised their First Amendment rights of freedom of speech, freedom to peaceably assemble, and freedom to petition for a redress of grievances because of the blatant fraud that occurred during the 2020 election have been vilified by the treasonous Bible-mocking media and by deceitful, self-serving politicians. Many of those who peacefully demonstrated on January 6 have been incarcerated and tortured without a trial, thus violating the Fifth Amendment (deprived of liberty without due process), Sixth Amendment (deprived of a right to a speedy trial), and Eighth Amendment (deprived of reasonable bail and subject to cruel and unusual punishment). As stated in Article VI of the US Constitution, the US Constitution is the Supreme Law of the Land, so the fact that various levels of government are blatantly violating the clearly stated rights codified in the Bill of Rights makes this exceptionally execrable. This outrageous criminal action by our government against law-abiding citizens is indicative of what the ruling class wants to do to any who question them or obstruct them in any way and is a message from our Deep State rulers to us to cower us into submission by giving us vivid examples of how cruel, sadistic, and criminal their behavior can be towards those who oppose them. As I said in a previous program, you are guaranteed to have friendly relations with liberals if you hand over your possessions, hand over your children, hand over your liberty, and keep your mouth shut. I intend to do none of these. The program title, Liberty and Posterity, comes from the US Constitution, the preamble of which states that one of the reasons for writing and ratifying the Constitution was to “secure the blessings of liberty to ourselves and our posterity,” our posterity being our children and descendants not yet born. As a reminder, on the Liberty and Posterity program, we view all events and activities in relation to reality, truth, and Biblical morality. If you have a problem with that, the problem is on your end, not ours. James Madison, Fourth President of the United States and one of the authors of the US Constitution wrote: “The future and success of America is not in this Constitution, but in the laws of God upon which this Constitution is founded.” Proverbs 14:34 Righteousness exalteth a nation: but sin is a reproach to any people. Psalm 9:17 The wicked shall be turned into hell, and all the nations that forget God. John Dickinson, one of the founding fathers of the United States and the author of the first draft of the Articles of Confederation, the agreement under which the thirteen colonies coordinated their actions after the Declaration of Independence in 1776, wrote: “Honor, justice, and humanity, call upon us to hold, and to transmit to our posterity, that liberty which we received from our ancestors. It is not our duty to leave wealth to our children, but it is our duty to leave liberty to them.” Five people died during the January 6, 2021 demonstration at the US Capitol, but the only death by violence was that of Ashli Babbitt, callously shot by a Capitol Police Officer.
