Renowned Federal Judge Retains NCLA to Oppose CAFC Chief Judge's Unlawful Efforts to Oust Her NCLA has written to Chief Judge Kimberly A. Moore of the U.S. Court of Appeals for the Federal Circuit expressing concern with her efforts to remove fellow U.S. Circuit Judge Pauline Newman. Chief Judge Moore claims that Judge Newman “is unable to discharge all duties of the office by reason of mental or physical disability.” Moore has appointed a three-judge special committee—including herself—to investigate the matter. Mark, Vec, and NCLA Senior Litigation Counsel Greg Dolin discuss the move to remove Judge Newman from the bench. Challenging SEC's ‘Hotel California' Administrative Adjudication Regime Since 2014, the U.S. Securities and Exchange Commission (SEC) has been inspecting, investigating, and prosecuting Marian Young and her former investment business Saving2Retire, LLC, with no end in sight. SEC's adjudication regime has deprived them of a jury trial and the Commission itself is now willfully refusing to decide their appeal from an administrative law judge's (ALJ) initial decision issued back in August 2019, effectively blocking them from access to federal court review for nearly four years. NCLA has filed a petition on behalf of Ms. Young and her company, asking the U.S. Court of Appeals for the Fifth Circuit to issue a writ of mandamus against the SEC Commissioners in In re Marian P. Young and Saving2Retire, LLC that would compel them to either dismiss the case or else promptly decide the appeal in the agency's eight-year-old administrative matter. Michael Seeraj Title: Head of Equality, Diversity and Inclusion at Charlton Athletic FC Michael's early passions led him to studying social inclusion and exclusion in inner city urban areas. He was constantly interested in the impact that exclusion had on people considered as different or as “the other”. Michael himself has a mixed ethnic background and at an early age marked out that he was “different”. Growing up as somebody considered as “other” has been a dimension of his own personal character and marked his outlook on life. After working on projects with Charlton Athletic FC and the local authorities surrounding social integration and cohesion with different communities in the area, he was asked to lead the first ever Equality and Diversity Department in professional football in 2013. In focusing on the LGBTQ community Michael partnered with Bexley Invicta FC (now formally known as Charlton Invicta FC) to created the first formally affiliated partnership between a professional football club and an LGBTQ football club. This ground-breaking partnership created Charlton Invicta and was the first time an LGBTQ football club had the full backing, support, and affiliation with a professional football club. March is Fraud Prevention Month. Hold you applause. If you made it without being accosted by someone trying to con you, count your blessings, but don't let your guard down! Scammers are out for your money, and your personal information, all 12 months of the year, and some people want us more prepared for that eventuality. In all, there were 59,009 reports of fraud from Canadian consumers and businesses last year costing us approximately $97,654,160.35. That covers extortion, phishing, counterfeit merchandise, identity theft, romance fraud, and a wide variety of other schemes, and on top of that, only five per cent of fraud victims make a report. The real price of fraud is likely hundreds of millions more. That's why the the Canadian Anti-Fraud Centre (CAFC) wants us talking more about fraud. The CAFC is the central agency in Canada that collects information and criminal intelligence on such matters as mass marketing fraud, advance fee fraud, Internet fraud and identification theft complaints. They're not a police force, but they work with police forces across the country, including the Guelph Police Service, to raise awareness about fraud, and educate the public about how to combat it. This week on the podcast, we're joined by Jessica Gunson, the Acting Call Centre & Intake Unit Manager of the CAFC. Gunson shares her expertise about combating fraud by phone, online, and in-person. How do scammers get your personal information? How you know you’re talking to who you think you’re talking to? Gunson has those answers and she will also talk about how much fraud is going on right now, why you can just say 'No' to anyone that’s trying to sell you something, and what your best strategy should be when dealing with people who will do or say anything to get your money. So let's get smarter about fraud on this week's edition of the Guelph Politicast! If you are the victim of fraud, CAFC recommends that you is gather all information, report the incident to local law enforcement, and contact the Canadian Anti‐Fraud Centre toll free at 1‐888‐495‐8501 or through the Fraud Reporting System on the CAFC website. Also, report the incident to relevant financial institutions, websites, and report it to both Credit Bureaus: Equifax and TransUnion. You can get more tips on how to prevent fraud at the Better Business Bureau, Equifax, the Ministry of Consumer and Business Services, the Ontario Securities Commission, Registered Charities, Trans Union, and, of course, the Guelph Police Service. In 2016 the Canadian Anti-Fraud Centre (CAFC) received 77,348 mass marketing fraud complaints with a total reported dollar loss of $99,198,188. That's a big number, but CAFC believes that fewer than 5% of victims file a report. It's likely that because of the unreported instances, victims lost approximately $2 billion in Canada due to mass market fraud in 2016. Fraudsters keep coming up with new scams, so it's important to be aware of the new scams, and understand how to protect yourself and your loved ones. To find out how to recognize the new scams and protect yourself, I'm pleased to welcome Kelley Keehn back to our show. Kelley was my guest back on show #75 where we discussed a book she wrote for the CPA Institute Protecting You and Your Money: A Guide To Avoiding Identity Theft and Fraud. Kelley has published eight books, co-hosted a TV show, regularly contributes to publications like The Globe & Mail, and has had numerous TV appearances including as the personal finance expert on The Marilyn Denis Show. On today’s show we discuss the most dangerous frauds of 2017, including the romance scam, phishing frauds, and the CRA scam.

前回は特許制度の国際的なハーモナイゼーションについてお話しました。各国の出願基本原則や特許期間などの制度的な枠組みは、国際的な協議を経て次第に統一されてきたわけですが、一方、特許制度を科学技術や産業を振興する上でどのように活用していくのかに関する政策は、国ごとに異なります。そのことが、企業間の国境を越えた競合関係において特許紛争を激化させる要因にもなります。今回は、この問題を取り上げてみます。 米国の政策は、企業間の国際的な特許紛争に大きな影響を及ぼしてきました。米国は、1970年代の末から新たな特許重視政策--プロパテント政策と呼ばれることがあります--の時代に入ったと言われています。特許制度を憲法によって根拠付けていることが端的に示しているように、もともと米国の政策は特許を重視する傾向を強く持ってきたのですが、この頃、日本企業の国際競争力が次第に台頭してくる中にあって、米国産業の優位性が脅かされるようになったことを背景として、特許政策は産業競争力の回復を目的とした国家戦略としての性格を明らかにするようになります。 このため1980年代以降は、特許政策と通商政策の連携が強化されます。例えば1988年代に発効した包括通商競争力法には、知的財産権を侵害する国を特定し、通商制裁を加えることを定めた「スペシャル301条」が盛り込まれることになります。米国の通商代表部は、その調査と制裁決定に当たることになりました。 これより先、1982年には、特許関係の紛争を扱う控訴裁判所(CAFC)が設立されていました。これ以後、特許侵害が認められるケースが増加し、賠償金額も上昇したと言われています。 このような特許重視政策を背景として、1980年代には米国企業が日本企業を相手取って特許侵害訴訟を起こすということが相次いで発生しています。中でも、日本企業に衝撃的な印象を与えた事件として、米国企業のハネウェルが、1987年に日本のカメラメーカーであるミノルタを提訴した事件を挙げることができるでしょう。この訴訟は、ミノルタが1985年に発売したα7000という一眼レフ・カメラのシリーズに登載されていた自動焦点機構が、ハネウェルの技術を侵害しているとして起こされたものです。 この訴訟の経緯については、メディアに大きく報じられましたし、特許に関する様々な文献に取り上げられていますが、結局、1992年に連邦地裁における陪審評決は、ミノルタに9,635万ドルもの損害賠償を命じるものになりました。同年、ミノルタは、この損害賠償金に、以後の特許使用料などを上乗せした1億2,750万ドルを支払うことで和解したということです。 この結果は、両社の財務上の明暗をはっきりと分けることになりました。ミノルタの経常利益は、91年3月期の46億6,000万円から、92年3月期には84億7,000万円の赤字に転落し、一方、ハネウェルは92年第一四半期決算の純利益のうち9割以上を和解金収入によって稼ぎ出したと伝えられています。 ところで、ハネウェルはカメラを製造していたこともあったようですが、この当時、制御機器を主力事業とするメーカーでしたから、ミノルタの新製品によって自社事業の利益が損なわれる可能性はほとんどなかったわけです。それだけに、この事件は日米の企業に対して、特許はそれ自体、巨額の利益をもたらし得る資産になるという強い印象を残すことになったと思います。また、従来、日本企業は、しばしば特許戦略における脇の甘さを指摘されることがあったのですが、90年代以降、大企業では次第に特許戦略に対する組織的な取り組みが強化されるようになりました。さらに日本の政府も、米国に20年近く遅れて、特許を重視する政策指向を打ち出すに至りました。 しかし、国が特許政策を重視し、企業が特許戦略を強化するという傾向は、そもそもイノベーションに基づく競争優位の確保という目的から見て、正しい選択肢なのでしょうか。次回は、この点について考えてみたいと思います。 今回のまとめ:米国政府の特許重視政策を背景として、80年代以降、特許紛争が頻発するようになり、日本企業にも特許戦略の重要性に対する認識が高まりました。
