After thirty plus years in the industry, Chris Boucher knows a thing or two about hemp. These days he's the CEO of Farmtiva, a California-based hemp company that specializes in consulting, seed sales, and a hemp juice powder called JuiceTiva, but his journey with hemp started long before the Farm Bill created the pathway for the modern hemp industry. He started a business in 1990 called the Hempstead Co. that made hemp wallets, hats, bags and such. “Back then the only place you could get hemp was either in China, Hungary, Romania or Poland. And so I went over to China in '92, and we sourced the hemp there,” he said during this week's episode. Boucher wanted to source his hemp in the U.S., and so in 1994 he secured permission from the USDA and became the first person to grow hemp in the U.S. in decades. But before the crop was harvested, local narcotics agents in California destroyed it by plowing it under, and the dream of U.S.-grown hemp had to wait. Along the way he also co-founded the Hemp Industries Association, wrote an influential legal opinion about CBD, and imported the first CBD oil into the U.S. He traces his career in hemp back to a chance encounter in 1990 when he was asked to sign a petition to legalize hemp by a man who had just published a book that explained the history and potential of hemp. That man was Jack Herer, author of the seminal hemp book “The Emperor Wears No Clothes.” The two became lifelong friends. As the current director of the California Hemp Growers Guild, an advocacy group for hemp farmers, Boucher sees first hand the detrimental effect recent state legislation is having on California's hemp farmers. He said it's a big win for the marijuana industry and a big loss for the hemp industry. Hemp now falls under the jurisdiction of the California Bureau of Cannabis Control instead of the California Department of Agriculture. Boucher said that the agency's fee structure and regulations make it nearly impossible for hemp farmers to compete, and many have stopped growing hemp altogether. “We've lost 90% of hemp farmers in California. We went from 800 farmers down to 120,” he said. He said these new regulations will also make it very expensive for any out-of-state hemp companies wishing to do business in California. Marijuana Banking Legislation Update: This week, the Secure and Fair Enforcement (SAFE) Banking Act, which would prohibit financial institutions from being penalized for doing business with marijuana companies, was stripped from the National Defense Authorization Act (NDAA), the omnibus spending bill pending in Congress. In September, the House included the SAFE Banking Act as an amendment to the NDAA for the fiscal year 2022, but the Act was removed by a conference committee in the Senate this week. U.S. Rep. Ed Perlmutter (D – Colorado) confirmed the legislation's removal on Twitter.The House passed a similar cannabis banking reform bill in 2019, but the legislation has yet to make it through the Senate. The SAFE Banking Act would ease restrictions on the use of banking services by legitimate marijuana-related businesses by, among other things, prohibiting a federal banking regulator from penalizing a depository institution for providing banking services to a cannabis-related business where state law allows such businesses.According to a recent tweet by Rep. Perlmutter, the SAFE Banking Act would “strengthen the security of our financial system & keep bad actors like cartels out. Most importantly, it will reduce the risk of violent crime in our communities.”The SAFE Banking Act, along with other federal legislation such as the Marijuana Opportunity Reinvestment & Expungement (MORE) Act, which seeks to remove marijuana from the list of scheduled substances under the Controlled Substances Act, the proposed Cannabis Administration and Opportunity Act, a comprehensive de-scheduling and restorative justice proposal, and the recently announced States Reform Act, which seeks to end the federal prohibition of marijuana, all represent the latest efforts in Congress to decriminalize marijuana at the federal level. While cannabis reform legislation has been gaining momentum in Congress in recent years, thus far, these efforts have been unsuccessful.

In this episode we are joined by special guest, Jason, who worked in Washington D.C. for a House Appropriations Chairman and focused on financial services and trade issues. This week, Aleece breaks down the Cannabis Administration and Opportunity Act (CAOA), a draft legislation introduced in the United States Senate on July 14, 2021, that would legalize cannabis at the federal level, thus removing it from the Controlled Substances Act and allowing states to decide whether they want to legalize marijuana. Made possible by the CAOA, a lot of the barriers that have been problematic in the past for individual states to operate in the cannabis space (e.g., banking and insurance) will be removed. The bill, Aleece notes, won't affect how states that have already legalized adult-use cannabis operate. The bill also includes social equity provisions that seek to expunge cannabis-related criminal records, to allow incarcerated people to petition the court for resentencing on nonviolent cannabis-related crimes, and to reinvest in communities that have been disproportionately impacted by the prohibition of cannabis. Senate Majority Leader Chuck Schumer has released draft legislation aimed at decriminalizing marijuana at the federal level. Called the Cannabis Administration and Opportunity Act, it would remove weed from the Controlled Substances Act and begin regulating and taxing it. It would still give states the power to set their own laws and would also expunge non-violent cannabis related arrests. Natalie Fertig, federal cannabis policy reporter at Politico, joins us for what to expect in the marijuana debate. Next, drug overdose deaths have risen sharply in the country by 30% in 2020 with over 93,000 deaths. A large driver of those deaths were the result of the synthetic opioid fentanyl as it has been frequently mixed into other drugs. The pandemic also played a role in this as people who were receiving treatment or wanted it had difficulty accessing it early on. Isolation and other life disruptions also fueled the uptick. Betsy McKay, senior writer at the WSJ, joins us for the rise in overdose deaths. Finally, public health officials are once again worried about superspreader events as we see lagging vaccination rates and rising Covid cases. With less mask wearing and social distancing, people are going out more and attending larger gatherings. Studies have shown that 10 percent of people infected with Covid could be responsible for 80 percent of the spread. Denise Chow, science reporter at NBC News, joins us for more. Missouri Governor Mike Parson says federal door-to-door vaccination campaign is NOT welcome in the Show-Me State. A writer at The Hill actually blames the scamdemic for an increase in drownings across the States because kids were not able to be taught how to swim. WEED Senate Majority Leader Chuck Schumer, Senate Finance Committee Chairman Ron Wyden, and Senator Cory Booker are holding a press conference tomorrow (Wednesday, July 14, 2021) to unveil a preliminary version of a bill being referred to by journalists as the Cannabis Administration and Opportunity Act . It is expected to remove cannabis from the Controlled Substances Act, impose a federal tax on the herb and bring about restorative justice to communities affected by the War on Drugs while allowing states largely in control of how to approach legalization. Last week, the Cannabis Freedom Alliance backed by Charles Koch, Snoop Dogg, and Weldon Angelos (as previously discussed on Bowl After Bowl Episode 76: Thanks Your Old Pass) released a white paper urging removal of cannabis from the Schedule I classification under the Controlled Substances Act. Last Wednesday (July 7, 2021) the Nevada State Athletic Commission joined the Florida State Boxing Commission after voting to no longer discipline fighters for using cannabis. Unlike Florida, however, the NSAC - which regulates all unarmed combat including boxing, kickboxing, and MMA - will still test for marijuana to collect data over the next six months. The new policy begins tomorrow and is not retroactive. The Cannabis Control Division of the New Mexico Regulation and Licensing Department more than doubled the maximum number of plants growers can produce, boosting the cap from 4,500 plants to 10,000 in response to concerns about supply shortage among medical patients when recreational purchases being in early 2022. Solar Therapeutics is being sued for copyright infringement, false advertising, and misappropriation of Sacha Baron Cohen's right of publicity after using a picture of Borat giving the thumbs up on a Massachusetts interstate billboard while exclaiming, "It's Nice!" Cohen's attorney claims he has never used cannabis in his life, creating Ali G to mock stoner culture, and would never participate in any corporate brand deal because it would undermine his credibility as an actor and social activist. The billboard was taken down after the brand received a cease-and-desist letter but Cohen is still seeking statutory damages, actual damages, punitive damages, and disgorgement of profits attributable to the billboard. 88,000 cases have been vacated or dismissed following the decriminalization of marijuana in New Jersey. These are the first of 360,000 cases identified by the courts to be automatically expunged under the law which became effective on July 1, 2021. Warrants for failure to appear are also being rescinded as well as related probation or pretrial monitoring. There wasa huge raid in Los Angeles this past week worth $1.19 billion linked to the cartels that resulted in 22 felony arrests, 109 misdemeanor arrests, and 19 arrests from water theft enforcement teams. 200 locations were served with search warrants and law enforcement seized 375,000 plants, 33,480 pounds of nug, 65 vehicles, 180 animals, and $28,000. Grower-to-bowl sales will begin in California, bypassing dispensaries. States with home delivery will likely join in as it allows customers to peruse a grower's full catalog and helps the grower test new products while gathering consumer trend data. A lawsuit over spam text messages between two consumers and Eaze reached a settlement. It's the second lawsuit of this type that Eaze has faced. The first suit was filed in 2018 and sent to arbitration. This one was pending on a Supreme Court case regarding Facebook and auto-dialing telephone systems, where it was unanimously ruled that random or sequential number generators must be used. One plaintiff signed up for texts from Eaze while the other received messages becuase of a third-party error. In Oklahoma, Senator Jim Inhofe has requested $4 million in federal funds to create a Bureau of Narcotics and Dangerous Drugs sponsored by the Department of Justice to work with sheriffs' departments and combat the black market. Missouri Governor Mike Parson vetoed legislation last Friday (July 9, 2021) which would have allowed medical marijuana companies to deduct business expenses on their taxes, saying the decision came down to a section lawmakers included in the bill which would have provided tax relief to businesses impacted by city-or county-wide public health restrictions.
