Even though Sen. Kevin Cramer is a former member of the House, and knows a thing or two about how that chamber operates, he isn't currently a member. Still, the drama in the House, which is currently paralyzed for want of the leadership of an elected Speaker, is impacting his job as a Senator. Congress can't do anything if one of its component houses cannot do its work. Cramer also talked about the ugly new war between Israel and Hamas, how America should respond to it, as well as to criticism he's received from an anti-marijuana group over his support for the SAFE Banking Act. Also on this episode, Wednesday co-host Chad Oban and I discussed the most recent Supreme Court ruling on a major spending and policy bill which has been declared unconstitutional. Until the SAFE Banking Act passes, the number of banks across the country that will service the Cannabis industry remains desperately low. Cannabis is currently classified as a Schedule 1 drug, and most banks won't do business with Cannabis companies because of this. Not being able to open payroll or checking accounts (or borrow money to scale their business) leads most Cannabis businesses to constantly have massive amounts of cash on-hand. Cannabis businesses have to watch their cash flow very closely if they want to stay in business. Most companies are flying blind and making purchasing decisions based on what they see in the safe (or in the bank account if they are lucky enough to be able to open one). Relying on the cash you have in-hand, rather than the business' cash flow, can make it difficult to properly plan and forecast payroll and pay taxes. Paying taxes with big bags of cash is not only a terrible business practice, but it leaves them more vulnerable to theft or burglary. Congress – Senate Committee voted to advance a cannabis bill – The Secure and Fair Enforcement Regulation Banking Act – SAFER Bill – Now this bill moves to the Senate Floor House committees have voted on Safe Banking Act – and was never given a vote on the house floor. This announcement had some cannabis stocks rise 1-3% Next this has to go to the Senate Floor and Pass – then the house and pass and then would go to the white house for Biden to sign. There have been other bills – safe banking and others – and none went to a vote on the floor. Durbin and the Credit Card Competition Act – MasterCard finally spoke up and sent a letter to Senators and Representatives. Electronic Payments coalition – has been in the battle – with Keep your hands off our rewards and getting consumers and businesses to oppose the CCCA – Visa and Mastercard both spoke Wednesday on the Senate Floor. This bill makes no sense – Durbin has had since 2010 to get a 3rd network and no business has stepped up to be the 3rd network – this action failed in Europe and Australia The result of passing credit card caps on interchange had done away with rewards, cash back etc in Canada, EU and Australia Now in Canada most people pay with Debit – same In EU and AU – Credit cards are impossible to get – and buy now pay later was born in Austraiia as a word around to the public having the lack of credit card options In the EU – there are a few companies that offer buy now pay later to help businesses – because of the lack of credit there as well. Square had an outage that lasted almost 2 days Jack Dorsey is taking the company back over – and restructuring sales And adding more services to the Square – Block offering They want to focus on larger clients – the issue they will face is that there will be margin compression Because larger companies will want cost plus pricing not the usual pricing from Square – X is trying to be a payment app – Elon Musk going out and getting money service license in a few states in preparation for this – paypal like service Chase Bank – Banning Crypt payments in EU and its rumored to be coming to the usa as well Binance shut down it's crypto payment services FTC going after Amazon – saying they have a monopoly on how people pay during checkout. Amazon is going to fight this - Paze a service by Zelle to help make e-commerce payments more secure – by using texts to confirm the card holder has delayed the launch until 2024 – maybe quarter 2

Federal Cannabis Legalization News | Safter Banking Act Update This week we saw a major push by Senate Majority Leader Chuck Schumer to legalize cannabis at the federal level when he circulated a petition, asking for signatures from supporters. These types of email campaigns are often used to build up their own email lists for political fundraising; however, Schumer has been an outspoken proponent of allowing banks to do business in the cannabis industry. On Wednesday, Schumer and a bipartisan group of cannabis supporters introduced a revised version of the SAFE Banking Act called the SAFER Banking Act. This updated version has some new provisions and is set for mark-up in the Senate next week. Meanwhile, two republican supporters of the SAFER Banking Act introduced their own bill to impede the proposition of rescheduling cannabis to a less regulated class. The DEA Act, as it's known, would require congressional approval to propose a change to any federal drug law, adding another hurdle to the prospect of cannabis legalization if it were to pass both chambers of Congress. The MORE Act was also refiled again this week, making its way to the House for a third time. The bill is solely sponsored by Democrats and faces an uphill battle to make it through while the House is under GOP majority. New York continues to make headlines for their calamitous roll out of the adult-use industry in the state. Leafly, Ron DeSantis, and the NCAA also get some of the spotlight this week. Senate Banking Committee to Vote on Marijuana Banking Bill in Two to Three Weeks The Senate Banking Committee is expected to vote on a bipartisan marijuana banking bill in the next two to three weeks. The bill, known as the Secure and Fair Enforcement (SAFE) Banking Act, would protect banks and credit unions from being penalized by federal regulators for working with state-licensed cannabis businesses. #Federal #Cannabis #Legalization News June 2023 Cannabis legalization is a hot topic across the world. In recent news, Mexico and Canada have both passed legislation that will legalize recreational use of cannabis. The move marks the first time in history that two of North America's largest countries have taken such action to regulate the drug's use. Other countries and regions are taking notice and considering their own measures for legalizing marijuana. In Europe, Switzerland recently declared its intention to allow limited sale of cannabis in pharmacies starting in 2021. Meanwhile, South Africa is looking set to become the second African country (after Lesotho) to legalize medical marijuana. These moves come after decades of criminalization and social stigma surrounding the drug - both as a recreational substance and medicine. With these new laws, advocates believe more research can be conducted into potential medical uses for cannabis, which could lead to further breakthroughs in treatment and therapy. Today we dive into the past and what we discussed and predicted in 2022 as payment, fintech, and business trends. There were plenty of winners, some that won that we don't like, and some losers on the list of things we wish would have happened but did not. One popular subject on the podcast is Cannabis, and I can say that it is disappointing that Congress has not acted and passed the SAFE Banking ACT. This needs to get passed in 2023!!! CBD, HEMP, and Kratom continue to struggle with banking and merchant services - there are too many Government agencies on top of these industries. The list for 2022 included QR Codes made a huge comeback, and that continues; alternative payments didn't happen yet, but we are hopeful for 2023 on that one. Self Service Kiosks and Self-checks out are a pain and are going to cause a lot of strife for jobs for our young people, but it is a train that is not going to stop - and we saw Mcdonald's open a new restaurant with no human contact - Crypto had its ups and down in 2022 and ended in a crash and burn with FTX and SBF. - Let's see if in 2023 - if it can make a comeback! E-commerce continues to grow, grow and grow - the future is strong, and bringing alternative international payments to these merchants could make 2023 an exciting year. E-invoicing and Payment Portals were popular in 2021 and 2022 and will continue to grow in the B2B sector. ATM's going away - that did NOT happen, and the ATM industry is strong as ever and growing; cashless ATMs are in trouble, and Visa is threatening businesses with a $50K fine. Other exciting products are coming to the ATM market that will turn machines into Financial Kiosks. 2023 looks to be very exciting, with many developments in these areas. Real-Time Payments, Pay by Bank, Alternative Payments, Cryptocurrency, Omni Channel Solutions for the SMB Market, Business specific software market will continue to see rapid growth, Banks partnering with Fintech Companies, Passing the fee to the cardholder, Faster Approvals for merchant accounts - will that be a huge trend - we say YES. We see High-Risk Merchant services going thru some changes as companies merge, and there are fewer choices for these merchants. So 2022 is almost over, and we covered many subjects on the podcast over the year. This past month was busy with all sorts of crazy news stories, and we were active at the office with many different projects. Here are the topics we talked about in the last month: We thought "Cannabis" would rise and Congress would pass the Safe Banking Act - only to find out that they kicked the can down the road again. Then we get notices from Visa and the Banks that we deal with about Cashless ATMs and that they are shutting it all down and fining business and the companies who placed them $50K per device. Cryptocurrency has been in the news the last month with the FTX debacle. Congress, CFPB - Consumer Financial Protection Bureau, SEC Security, Exchange Commission, and FinCEN are all cracking down on the "Digital Asset" industry. Making stiff laws regulating Anti Money Laundering Rules and Regulations and Crypto companies have until Feb or March 2023 to finish up audits. In our opinion, the law regarding how Crypto is handled needs to be changed to what Japan is doing; there, you can purchase, then the crypto/tokens are moved to another platform that acts as a bank to hold the Crypto/Tokens. This way, what happened at FTX can't occur; Coinbase has a setup similar to that - where you purchase on Coinbase, and then the crypto/tokens are held in the Coinbase wallet. We talked about our community giving project. https://nationwidepaymentsystems.com/community-giving-project/ We talked about how scams are on the rise right now, especially during the holiday season; everything from check fraud (watch for future podcast), shoplifting, and friendly fraud in retail and restaurants, along with fraud on the internet with e-commerce and Identity Theft. We covered how to Thrive in a Recession and down economy and provided some excellent advice and lessons from the past about things we had had to deal with when it came to business and experiencing similar circumstances. Digitizing your business and marketing needs to be on your list of things to do for 2023! We talk about the need for companies to use Social Media, Google my business page, reviews, upgrade your website, look at the technology you are using in your business today, and see how you can update that. Businesses all need to embrace the new way to do business - OMNI Channel or Compete Business Solution and offer your customers the services that the big companies offer - we have it all available for you! Have a website that provides delivery, in-store pickup, and curbside pickup so you can compete in 2023! Level up your technology! We also explain what the F is a Merchant Account and What the difference is between a bank account and a merchant account. Also, we explain why you need separate business bank accounts to save money on taxes and more! And we describe a simple formula of how to figure out how to calculate what you pay for credit card processing. You have to listen to get that GEM.
