Guest host David Horton interviews Thomas Jefferson, the third President of the United States, about his life as a diplomat. Jefferson served for five years as the American minister to the court of Louis XVI just before the French Revolution. Then, he served three years as America's first Secretary of State — trying to keep the United States from being drawn into the chaos of the French Revolution and the Napoleonic wars. As president, Jefferson “solved” the problem of the Mississippi River by buying the Louisiana Territory from Napoleon in 1803, which doubled the size of the United States. Jefferson then sent his protégé Meriwether Lewis to inventory that vast territory. Jefferson was an admirer of Adam Smith. He believed that the less governments intruded into the free flow of goods and services in the world, the more efficient economies would be, and more prosperity would result. In the third segment of the program, Clay and David talked carefully about the trade, tariff, and foreign policy situation that has unfolded in the first months of the second Trump term. Our special guest is David Horton, Professor of Law at the University of California, Davis, who has written a creative and thought-provoking article analyzing how courts should interpret certain key provisions that are frequently used in consumer arbitration agreements. The article may be accessed online at SSRN and will be published in the Washington University Law Review later this year. Prof. Horton first contends that courts have misinterpreted the Federal Arbitration Act (FAA) as requiring arbitration clauses to be construed broadly, which in many cases forces consumers to arbitrate disputes they never agreed to because the dispute is not causally related to the consumer's original transaction with the company. Instead, he argues, courts should be guided by the literal text of the FAA, which limits the statute's application to disputes that “arise out of” the contract containing the clause. Such an approach would narrow the scope of the arbitration clause to disputes that were contemplated by both parties at the time of contracting. Second, Prof. Horton addresses the issue of third parties who are not signatories to the consumer arbitration agreement but are nevertheless defined as “parties” in the agreement. According to Prof. Horton, such “artificial privity” unduly broadens the scope of the arbitration clause because many courts automatically permit the third parties to enforce the agreement without satisfying more rigorous state law requirements for establishing third-party beneficiary status. Third, Prof. Horton argues that arbitrability questions concerning whether a dispute “arises under” the contract and whether a third party properly has enforcement rights should be decided by a court even if the arbitration clause purports to delegate such issues to the arbitrator. Mark Levin, Senior Counsel in the Consumer Financial Services Group, who helped pioneer the use of arbitration agreements and class action waivers in bank, credit card and other consumer contracts, provides the industry response to each of the arguments asserted by Prof. Horton. Alan Kaplinsky, Senior Counsel and former chair for 25 years of the Consumer Financial Services Group, hosts the discussion.

Disney recently backtracked on its attempts to force arbitration on a widower who who filed a wrongful death lawsuit but, it said, had agreed to not take the company to court when he signed up for a free trial of its streaming service. This about-face, which followed a wave of bad publicity for Disney, may be the exception, not the rule, according to a law professor who specializes in arbitration. David Horton calls these agreements "infinite arbitration" clauses because they force consumers to arbitrate all claims against a company—even claims that have no connection to the original agreement. And the University of California, Davis, professor says infinite arbitration claims are everywhere now, especially tucked into the online terms-of-service agreements that consumers rarely, actually read. Guest host David Horton of Radford University and Clay Jenkinson discuss the origins and varieties of satire. With its roots in the ancient world and particularly Rome, satire exists in two broad categories: genial, bemused satire, identified with the Roman poet Horace; and biting, severe, take-no-prisoners satire best represented by another Roman poet Juvenal. The discussion explores satire in American history; Thomas Jefferson's humorlessness and his immunity to satire; classical American satirists such as Mark Twain and Will Rogers; and satire of the modern age with Johnny Carson, Bill Maher, Stephen Colbert, and Garrison Keillor. David and Clay reflect on the silo effect and media echo chambers of our time, which have made it nearly impossible for all to meet in some form of the public square to laugh at human foibles and find ways to tolerate each other.

Here's my Post from Facebook after Hellbender: I've learned something over the 3 decades I've been running. When we line up for a race, no matter how much we've trained and prepared, the race and life in general owes us nothing. The reality is we owe running & life a tremendous amount for what it does for & to us! Running and many coaches, friends, family members, and mentors have transformed me to find my current mindset. A DNF does not diminish or define who I am or what I can accomplish. It makes me take a deeper dive into a. What happened? b. What can I do better? & c. How can I train smarter (not necessarily harder)? It also makes me reflect upon life, the choices I make, my priorities, and what I'm doing to make this world a little better. Running Is Life is a mantra. I live it, I breathe it, and I grasp to understand and apply it on a daily basis. Keep moving forward my friends! Essay for Badwater 135: It's hard to create a story that's still in progress! It's also tough to tell a story that's pretty darn common. Sure, I've done and experienced some amazing things in my life, but to be honest, so have many others. So I had to ask myself, what separates me from everyone else? Let me go back to 2016, and humor me for a moment with a flashback. In said year, I was running Dr David Horton's now defunct Beast Series. I had completed 3 50k's by April and the remainder of my calendar for that year was as follows: June - Cayuga 50-miler & the Manitou's Revenge 50-miler July - Canadian Death Race 125k Oct. - Grindstone 100-miler Nov. - Mountain Massochist 50-miler Dec. - Hellgate 100k A Daunting & challenging schedule with the hope of winning both the Lynchburg Ultra Series & the Beast Series (which I did). But that's only part of the 2016 story. In the midst of all of this, I was in The Runner's World Magazine Cover Contest. A finalist no less. A panel of judges had selected 5 male & 5 female contestants for the honor of being the winner of this contest and having their picture on the front of the magazine. I know for some, print media is dead, but I grew up with this magazine and eagerly read every article. To be a finalist for this was a dream come true! So how did I get to that point? Everything about my running stems from love. With and through running, I can do so much more than just go for a run. I can take an individual sport, and at times selfish activity, and make it about others. I created races that raised money for nonprofit organizations, I donated & sponsored races that did the same. I became a coach and mentor to younger and older runners. The point being is I tried to share my love for running and life with others so that they might do the same. To give the idea that life is about others and the change we can make and impact we can have when we put others first and use our talents and abilities to make a difference. As the internet will show, I didn't win, but I experienced something that changed my life and way of thinking. I met some truly amazing friends that have much more amazing stories than my own. And that's what makes running so amazing. Each race we run has a limited number of runners. Those runners all have stories of how that got to that starting line. Badwater has shown this each year it's run. Since the Runner's World Contest, my professional life has gone from Running Store owner and race director to a running coach and podcaster. It took me a number of years to find a name for my brand that felt suitable for who I am, what I do, and what I represent. It wasn't until I watched Ted Lasso and saw the joy the character Danny Rojas exhibited for life and fútbol that I understood and found a name that resonated with me… “Running is Life”! That simple phrase/name struck a cord so deep that it's hard to express how much it reflects my love for it and how it affects my thoughts, actions, and deeds. How such a simple few words can say everything. Running is Life! My story may not be the most compelling, but instead of remaining an individual, I've become part of the community. I serve that community with my experience. As I try to reach each finish line, I know that I will help countless others do the same by learning from my own experiences. All I need is the opportunities to continue to grow, to learn, and to evolve. I believe Badwater is one of those experiences that will do so! As I mentioned earlier, my story is incomplete. Will one of those blank chapters be filled with pages about the Badwater 135? Again, it's up to a committee to decide what's added to my story. In races, we don't deserve anything but the experience of what the day gives us. All we ask is for that opportunity to see what that day has in store for us. I know running Badwater is in part for my own sake, but I realize, and I hope I've conveyed, that it will impact many other lives in the process and aftermath as well. Guest host David Horton of Radford University discusses America's trees and forests with Third President Thomas Jefferson. Jefferson said, “No sprig of grass grows uninteresting to me.” He told his friend Margaret Bayard Smith that any unnecessary cutting down of a tree should be regarded as silvicide, the murder of a majestic living thing. Jefferson wanted future cities to be planned in a checkerboard pattern with every other square permanent parkland. One of his last requests, just months before his death, was that the University of Virginia plant an arboretum. Jefferson's protégé Meriwether Lewis was so startled by the treelessness of the Great Plains that he wondered if they could ever be settled. Later in the program, Clay and David talk about the origins of the Soil Conservation Service and FDR's idea of a single endless shelter belt down the hundredth meridian from Canada to the Gulf of Mexico.
Guest host David Horton of Virginia leads a discussion with Clay Jenkinson about the difference between Constitutional requirements and what are called presidential norms. George Washington, for example, did not shake hands with the American people. He held formal levees once a week. Jefferson regarded those as monarchical habits and he performed a series of acts of political theater to tone down the presidency during his two terms. Nothing in the Constitution requires the outgoing president to attend his successor's inauguration, but it is an established American norm, and when that norm and others are violated, it weakens the fabric of the American republic. David and Clay talk about the presidencies of the two Roosevelts, both of whom enjoyed expanding the powers of the presidency, and of course the disruptive events of the last ten years.
Clay Jenkinson and guest host David Horton discuss the history of executive orders. Even though they are not authorized by the U.S. Constitution, every president except William Henry Harrison has issued at least one. David and Clay review the most important executive orders in American history: the Emancipation Proclamation in 1863; the Japanese internment camps brought on by FDR in 1942. Truman integrated the U.S. military and JFK created the Peace Corps using executive orders. Clay argues that they should not be used by the president in lieu of letting Congress hammer out public policy, particularly when tax dollars are at stake. And now, in this disruptive age, each president rescinds some of the executive orders of his predecessor, and the process repeats itself at the next election.
