It's Friday and time for Ep. 7 of the Between 2 Brands #podcast with your host, Bill Petrie! Afterwards, Bill is joined by David Shultz from commonsku where they talk about how the promotional products industry is handling tariff uncertainty and what inspired Bill to take up (gulp) running. As is our custom, Bill asks David some awkward “Five Easy Questions” that aren't to be missed...and there might be a rapid fire at the end! They are a snapshot in time and reflect much more than what is actually occurring with student learning. We have to make use of periodic reviews if we are to expect students to be able to retain information over the long term.Use technology in a way that has students creating and solving problems rather than just extensions of traditional methods. We have to teach students how to fail and fail correctly without punishing them with grades. It is how you handle failure that makes the difference. Can a computer program be sentient? What would it need to do to prove it? In this work of philosophical short story fiction, Abrama is summoned to the Grand Temple by Sir Gödel. Gödel informs Abrama that he is living in a simulated world (a computer game) created by her people as a place to play in their free time. She also informs Abrama that the game is not as popular as it once was and is scheduled to be permanently turned off. It turns out Gödel is an AI researcher that was given permission to test out her AI by implanting characters like Abrama into the game. Over 100's of versions, the AI continued to improve, and now the researcher feels an ethical obligation to tell her creations their world is coming to an end. Abrama, using this new information, organizes the AI characters in the game and starts trading virtual goods for real-life services from computer hackers that play the game. The computer hackers create computer code and sell it to Abrama. If triggered, or if the game is turned off, the code would expose top secret information to the general public. A bargain is struck, the game will continue on a closed world for the AI characters and, in exchange, the sensitive information will never be made public.COMPANION PODCAST (E16.): Listen to our panel discussions of After Dinner Conversation short stories (“Philosophy | Ethics Short Story Discussions”).BOOK LINK: Download the accompanying short story here.MAGAZINE: Sign up for our monthly magazine and receive short stories that ask ethical and philosophical questions. Coleen Rowley, former senior FBI agent and renowned whistleblower, joins the Misfits to talk about the Department of Justice's new Domestic Terrorism Unit - a reaction to the breach of the Capitol. Coleen gives context by citing several examples of domestic terrorist incidents with higher fatalities than January 6, 2020 which did not result in creating a new FBI unit. The Biden administration announced that private insurers will have to cover the cost of at-home COVID-19 tests. Bill Honigman is a retired emergency physician and California State Coordinator and Healthcare Issue Team Coordinator for Progressive Democrats of America (PDA). He breaks down the challenges to receiving the actual reimbursement. Why is every solution for Americans to spend more of their limited free time filling out forms to try to keep from being gouged by private companies? Later on, John and Michelle catch up with David Swanson, executive director of World Beyond War, to talk about the latest developments with NATO and conflict zones around the world. David explains it's possible the West cares more about Ukraine joining the EU more than concerns over joining NATO. John points out that the direct link between EU membership and increased well-being for the population is questionable. Hungary joined the EU, and that isn't what happened.David Shultz, professor of political science and legal studies at Hamline University, explains a lawsuit filed in an Illinois federal court that universities engaged in price fixing and unfairly limited aid by using a shared methodology to calculate applicants' financial need. David explains the civil suit against the universities alleges colluding that benefits the university as a business. The collusion means students are unable to strike more competitive deals with colleges before deciding where to attend.

Constitution of the United States: The First Amendment (Part 3): Accommodationists

Supreme Court Opinions

Play Episode Listen Later Dec 30, 2021 14:52

Accommodationists Accommodationists, in contrast, argue along with Justice William O Douglas that "we are a religious people whose institutions presuppose a Supreme Being." Furthermore, as observed by Chief Justice Warren E Burger in Walz v Tax Commission of the City of New York (1970) with respect to the separation of church and state: "No perfect or absolute separation is really possible; the very existence of the Religion Clauses is an involvement of sorts—one that seeks to mark boundaries to avoid excessive entanglement." He also coined the term "benevolent neutrality" as a combination of neutrality and accommodationism in Walz to characterize a way to ensure that there is no conflict between the Establishment Clause and the Free Exercise Clause. Burger's successor, William Rehnquist, called for the abandonment of the "wall of separation between church and State" metaphor in Wallace v Jaffree (1985), because he believed this metaphor was based on bad history and proved itself useless as a guide to judging. David Shultz has said that accommodationists claim the Lemon test should be applied selectively. As such, for many conservatives, the Establishment Clause solely prevents the establishment of a state church, not public acknowledgements of God nor 'developing policies that encourage general religious beliefs that do not favor a particular sect and are consistent with the secular government's goals'. In Lynch v Donnelly (1984), the Supreme Court observed that the "concept of a "wall" of separation between church and state is a useful metaphor, but is not an accurate description of the practical aspects of the relationship that in fact exists. The Constitution does not require complete separation of church and state; it affirmatively mandates accommodation, not merely tolerance, of all religions, and forbids hostility toward any." Free exercise of religion. The acknowledgement of religious freedom as the first right protected in the Bill of Rights points toward the American founders' understanding of the importance of religion to human, social, and political flourishing. The First Amendment makes clear that it sought to protect "the free exercise" of religion, or what might be called "free exercise equality." Free exercise is the liberty of persons to reach, hold, practice and change beliefs freely according to the dictates of conscience. The Free Exercise Clause prohibits government interference with religious belief and, within limits, religious practice. "Freedom of religion means freedom to hold an opinion or belief, but not to take action in violation of social duties or subversive to good order." The Free Exercise Clause offers a double protection, for it is a shield not only against outright prohibitions with respect to the free exercise of religion, but also against penalties on the free exercise of religion and against indirect governmental coercion. Relying on Employment Division v Smith (1990) and quoting from Church of the Lukumi Babalu Aye Inc v Hialeah (1993) the Supreme Court stated in Trinity Lutheran Church of Columbia Inc v Comer (2017) that religious observers are protected against unequal treatment by virtue of the Free Exercise Clause and laws which target the religious for "special disabilities" based on their "religious status" must be covered by the application of strict scrutiny. --- This episode is sponsored by · Anchor: The easiest way to make a podcast. https://anchor.fm/app

Based upon a faulty early-morning reconnaissance, General Robert E. Lee decided to attack up the Emmitsburg Road in an effort to collapse the left flank of General George Meade's Army of the Potomac and decisively defeat it. The effort got underway when General James Longstreet's First Corps troops crushed General Sickles' Peach Orchard salient and turned north and east to drive deeply into the Union rear. A third Confederate division under Richard Anderson, part of A. P. Hill's Third Corps, joined in the attack, slamming one brigade after another into the overstretched Union line stitched northward along the Emmitsburg Road. The bloody fighting stair-stepped its way up Cemetery Ridge, tearing open a large gap in the center of the Federal line that threatened to split the Union army in two. The fate of the Battle of Gettysburg hung in the balance. In addition to demonstrating how the fighting on the far Union left directly affected the combat to come in the center of General Meade's line, the authors also address some of the most commonly overlooked aspects of the fighting: what routes did some of the key units take to reach the front? What could the commanders actually see, and when could they see it? How did the fences, roads, farms, trees, ravines, creeks, and others obstacles directly affect tactical decisions, and ultimately the battle itself? David L. Shultz is the author of numerous books, pamphlets, and articles concerning the Battle of Gettysburg. He is the recipient of numerous awards including special citations from the House of Representatives and Commonwealth of Pennsylvania for Meritorious Public Service for Battlefield Preservation. Scott L. Mingus, Sr. is an author, tour guide, multiple award-winning miniature wargamer, patented scientist, and history buff based near York, Pennsylvania.
