Nun wurde im Bundestag auf Vorlage der Grünen und der Linken darüber diskutiert, ob der Paragraf 265a des Strafgesetzbuches (StGB) gestrichen werden sollte, der das „Erschleichen von Leistungen“ und damit das sogenannte „Schwarzfahren“ unter Strafe stellt.Handelt es sich nicht eher um eine Ordnungswidrigkeit? 7000 Menschen sitzen jährlich im Gefängnis, weil ihnen das Geld fehlt, die Strafe zu zahlen. Das kostet den Staat Millionen, doch der Nutzen scheint gering zu sein. Selbst eher konservative Richter halten das Gesetz für reformbedürftig. Konservative und rechte Politiker hingegen sehen die bürgerliche Eigentumsordnung bedroht, wenn das unerlaubte Fahren im ÖPNV nur noch als Ordnungswidrigkeit behandelt wird. Mitunter wird dies sogar als Schritt zu mehr Emanzipation verkauft.Um die "Reformvorschläge" zu verstehen, lohnt es sich zunächst, die Entstehung und Entwicklung der Krankenversicherung in den Blick zu nehmen.
