The job of a defense attorney is to use all of his or her skill to get their client acquitted. It is NOT to stand in front of a judge and demand that the entire legal structure of Western law — a unanimous verdict by a jury of one's peers — be trashed because they didn't like the outcome.

The jury foreperson has a name now. Roni Carlson. She and two other women from that panel sat down with NBC10 this week and told everybody what actually went on in there for seven days, and one detail has been rattling around my skull since.The holdout admitted he had reasonable doubt.Out loud. To the room. She was so relieved she started filling out the verdict forms, all three of them, signed her name on each one. And then he said, "But I'm still not going to say that she's not guilty by reason of insanity."He wasn't confused. He got there. He walked all the way to the answer and then just declined to be moved by it, and that's the thing I can't put down, because it's the whole summer in one sentence.The rest of what those women described isn't much prettier. They said he was arrogant. Said he wouldn't engage. Said he brushed off the nurses on the panel when they walked him through the medications and the toxicology, which, if you're a woman who has ever been in a meeting, you already knew was coming.Meanwhile Kevin Reddington had a week.He went on Good Morning America and asked the President to pardon a woman facing state charges, which the President cannot do and which Reddington later admitted he knows perfectly well. I break down what that stunt was actually for and who it was actually aimed at, because it wasn't Trump.He floated a plea. He said he'd like to chat with the jurors, which is a normal thing for a lawyer to say and a slightly less normal thing to say five days after accusing one of them of perjury in open court.And before the courthouse doors shut, he announced his next client. She's charged with murdering her grandmother in North Adams and she's been sitting in a cell for nearly four years waiting for a trial. A Massachusetts jury spent five weeks, heard from more than eighty witnesses, and still couldn't agree on what to do with Lindsay Clancy. Now her attorney's own attempt to fix that has become its own story.  Clancy, 34, of Duxbury, stood trial for the January 24, 2023 killings of her three children — Cora, 5, Dawson, 3, and Callan, 7 months — inside the family's Summer Street home, where prosecutors say she strangled them with exercise resistance bands. She's charged with three counts of murder and three counts of strangulation and has pleaded not guilty. Her attorney, Kevin Reddington, argued an insanity defense centered on severe postpartum psychosis and psychiatric overmedication — the idea that the medical system meant to help her instead helped set the tragedy in motion. Reportedly, Clancy tried to take her own life afterward by jumping from a second-story window and has been paralyzed from the waist down ever since. Her husband, Patrick Clancy, was out running errands at the time and has since relocated to Manhattan.  Nine women and three men deliberated across thirty-nine-plus hours and told Judge William Sullivan three separate times they were deadlocked. With no verdict in sight, Reddington tried to have a holdout juror removed, then took an emergency appeal straight to the state's highest court. It didn't work. Sullivan declared a mistrial.  Plymouth County's district attorney now has to decide whether to put this case in front of a jury again, with a status hearing already scheduled. A woman doesn't call someone back if she's being controlled by a voice in her head. That's the argument prosecutors made to a Plymouth County jury weighing whether Lindsay Clancy is criminally responsible for killing her three children.  Twenty minutes. That's how long Clancy was alone with Cora, Dawson, and Callan while her husband Patrick ran to CVS and picked up Thai food. ADA Jennifer Sprague told jurors Clancy chose the basement, chose strangulation with exercise bands, and repeated it three times — then missed a call, phoned back, held a conversation, and hung up. Prosecutors say that isn't what a puppet does.  The defense says it's exactly what happens once a hallucination has already finished its work. Clancy described a male voice that appeared once, on the afternoon of January 24, 2023, and told her this was her last chance. It lasted roughly eighteen minutes. It stopped the second her children were dead. Defense experts Paul Zeizel and Phillip Resnick both testified she had no appreciation that what she was doing was wrong. Resnick, who evaluated Andrea Yates after her own children's deaths, used the word puppet too — just aimed the other direction.  The prosecution's forensic psychiatrist Gregory Saathoff pushed back hard on the timing, calling a hallucination that vanishes the instant the act is done clinically unusual. Defense attorney Reddington countered in closing with a different number: thirteen psychiatric medications, prescribed by providers who never spoke to one another.  Criminal defense attorney Bob Motta was inside that Plymouth courtroom. Eighteen minutes of a voice nobody else ever heard. Twenty minutes alone with three children. Those two windows of time are the entire case against — and for — Lindsay Clancy, and a Plymouth County jury is now deciding which one actually explains what happened in that Duxbury basement.  Patrick Clancy left for CVS and Thai food. When he came back, Cora, Dawson, and Callan were gone. Prosecutors say Lindsay used exercise bands, used the basement, and did it three separate times — once for each child — before missing a phone call, calling back, and having a completely ordinary conversation. ADA Jennifer Sprague argues that isn't consistent with a woman who wasn't in control of herself, and told the jury exactly that in closing.  Lindsay told forensic evaluators otherwise. Seven days. Thirty-nine hours. Twelve people who could not agree on what happened inside a house on Summer Street — and in the end, that's the verdict. There isn't one.Lindsay Clancy, 34, of Duxbury, Massachusetts, stood trial for the January 24, 2023 killings of her three children — 5-year-old Cora, 3-year-old Dawson, and 7-month-old Callan — inside the family's home on Summer Street. Prosecutors allege she strangled the children with exercise resistance bands. She's charged with three counts of murder and three counts of strangulation and pleaded not guilty. Her defense, led by attorney Kevin Reddington, argued severe postpartum psychosis and psychiatric overmedication left her not criminally responsible. After the killings, Clancy allegedly attempted suicide by jumping from a second-story window and has been paralyzed from the waist down ever since. Her husband, Patrick Clancy, was out running errands when it happened; he's since relocated to Manhattan and spoken publicly about her mental health.After five weeks of testimony covering more than 80 witnesses and 300 exhibits, the jury — nine women, three men — told Judge William F. Sullivan three separate times they couldn't reach a unanimous verdict. Reddington made a last-minute push to swap out a holdout juror, then filed an emergency appeal to the state's highest court when Sullivan refused. The court said no. If a mistrial is declared in the Lindsay Clancy murder trial, the next chapter is not automatic. On Thursday, the jury foreperson sent Judge William Sullivan a note on behalf of 11 jurors according to Reuters, the note said the remaining juror had acknowledged doubt but was refusing to apply that doubt to the verdict. Reddington’s argument is that this is no longer simply one juror disagreeing with everybody else.
