Professor David Karoly (pictured) has a reputation as being the scariest professor from the University of Melbourne, but as he points out it is not he who is scary but rather the information he shares. Prof Karoly had been with the University of Melbourne before joining the CSIRO, from which he moved into retirement only about 18 months ago. However, he may be retired, at least in name, but it seems he is busier than ever as he is still involved with the university, has joined the Climate Council and regularly speaks at events such as the recent film festival. His presentation revolved around a series of slides and they will soon be available on the website of the Benalla Sustainable Futures Group. The June 17 festival attracted 150 people, which the lead organizer, Mr Ian Herbert, said was perfect as that was the maximum number planned for and fitted comfortably at the Swanpool Cinema. This week, host Rob Kovacev is joined by Miller & Chevalier colleagues Joe Rillotta and Ian Herbert to discuss tax enforcement under state False Claims Acts.   The False Claims Act has been around at the federal level since the 1860s.  It generally provides for civil penalties and qui tam enforcement in instances where there is a fraud on the government, and it was actually passed to address procurement fraud during the Civil War.  A lot of states have passed their own versions of the False Claims Act, based on the federal statute.  But tax controversy and compliance lawyers haven't had to worry too much about the False Claims Act, because the federal statute expressly says that it cannot be applied to alleged violations of the tax code.  But then in the 1990s, something interesting started happening: Some states enacted versions of the False Claims Act without any limitation on tax claims (or interpreted their acts to allow such claims). In 2010, New York made a big splash when it expressly amended its statute to allow tax-based enforcement and created a whole component within its Attorney General's office to bring and review such cases. Most recently, in 2021, DC enacted provisions modeled on New York. Some high-profile cases have been brought attempting to redress allegations of state tax evasion though False Claims Acts.  And this raises a lot of questions. ********* Questions? In December 1914 a remarkable thing happened on the Western Front: British and German soldiers stopped fighting and left their trenches to greet one another, exchange souvenirs, bury their dead, and sing carols in the spirit of the holiday season. Yesterday's results: Inter thrashed Werder Bremen 4-0 at home; Tottenham did the same to Twente on 4-1; Lyon traveled to Israel and won 3-1; Shalke got a big 2-0 win at home over Benfica; Rangers get a key home win over Turkish side, Bursaspor 1-0; Man Utd won late at Valencia thanks to Chicharito 1-0; Our buddy Rubin (Kazan) drew at home with Barcelona 1-1; FC Copenhagen went to Greece to defeat the Greek champions, Panathinaikos, 2-0. Steven and Kenny will break down each game as they saw it. Andy Brassell will join us for a complete breakdown of the Champions League from the past two days, and will also give a recap of what he has seen in the league season around Europe thus far this season. Ian Herbert from the Independent will join us to discuss the English clubs in the Champions League and give us his thoughts on the struggling Wayne Rooney. Max Patrick will join us for a look at the Italian teams in the Champions League and also give us his thoughts on the Serie A season.
