To help keep hope, we must remember and celebrate recent wins. One of those wins is the Pregnant Workers Fairness Act, which took effect on June 27, 2023. This is a landmark piece of legislation that prohibits discrimination and ensures workplace accommodations related to pregnancy for workers. But is the PWFA safe, or will it be threatened by the Trump Administration's crusade against reproductive rights and justice?Joining us to discuss the history and significance of the PWFA is our very special guest, Dina Bakst: Dina Bakst is the co-founder and former co-president of A Better Balance, a national nonprofit legal advocacy organization that uses the power of the law to advance justice for workers. Bakst was awarded the prestigious Heinz Award for the Economy for A Better Balance's successful work advancing work-family justice in 2021, and the first-ever Visionary Women Award for Women's Economic Empowerment in 2022.  In 2020, she was named one of “16 People and Groups Fighting For a More Equal America” by Time Magazine. Synopsis: John LaMattina is the former President of Global R&D at Pfizer and is currently a Senior Partner at PureTech Health. A self-proclaimed defender of the pharmaceutical industry, Dr. LaMattina worked at Pfizer for 30 years before joining the biotech industry as a board member for a variety of different biotech companies. His recently published book, “Pharma and Profits”, talks about the misconceptions around COVID-19 vaccines and other areas including the cost of drugs, and the impact that the passing of the IRA Act will have on R&D going forward. In this episode he also discusses how biotech leaders should be thinking about the new IRA Act legislation and what changes they should anticipate. Biography: Dr. John L. LaMattina is the former Senior Vice President, Pfizer Inc and President, Pfizer Global Research and Development. In this role, Dr. LaMattina oversaw the drug discovery and development efforts of over 13,000 colleagues in the United States, Europe and Asia. He retired from this position in December, 2007. Dr. LaMattina spent 30 years at Pfizer Inc having joined as a medicinal chemist in 1977. Over the years, he held positions of increasing responsibility for Pfizer Central Research, including Vice President of US Discovery Operations in 1993, Senior Vice President of Worldwide Discovery Operations in 1998 and Senior Vice President of Worldwide Development in 1999. Dr. LaMattina graduated cum laude from Boston College in 1971 with a B.S. in Chemistry. He attended the University of New Hampshire receiving a Ph.D. in Organic Chemistry in 1975. He then moved on to Princeton University as a National Institutes of Health Postdoctoral Fellow in the laboratory of Professor E. C. Taylor. During his tenure as head of global R&D, Pfizer produced new treatments for cancer, smoking cessation, rheumatoid arthritis and AIDS. Dr. LaMattina is the author of numerous scientific publications and holds a number of U.S. patents. In addition, he is the author of Drug Truths: Dispelling the Myths About Pharma R&D and Devalued and Distrusted – Can the Pharmaceutical Industry Restore Its Broken Image? He is also a Forbes contributor. Dr. LaMattina has received a number of awards including the 1998 Boston College Alumni Award of Excellence in Science, the 2007 Equal Opportunity Award from Legal Momentum, an Honorary Doctor of Science degree from the University of New Hampshire and the 2010 American Chemical Society Earle Barnes Award for Leadership in Chemical Research Management. Dr. LaMattina is a Senior Partner and a member of the Board of Directors of PureTech Health. He serves on the Board of Directors of Ligand Pharmaceuticals, Immunome and Vedanta. These barriers intersect, add up, and reinforce each other in ways that profoundly undermine women's ability to achieve equal opportunity in the workplace. The resulting imbalance of power is often exploited, which further undermines women's pursuit of economic security.To break this cycle, LegalMomentum and the Women's Legal Defense and Education Fund have created an integrated solution with meaningful protections, accommodations, and services that eliminate existing gender-based penalties. Those who follow the Brave Educator podcast likely noted when a week ago, June 15, 2020 there was no Monday episode. I called it "taking a week off," but the truth is, the episode was already recorded. Not unlike the poem or prose I skip over in memoirs about the sexual violence, the rape, that I survived as a child, it's sometimes easier to just try to forget. I met Amita Swadhin back in January 2016 at USC during an Education Summit I directed. It was the first time in an education space I heard someone talk about sexual trauma. It was uncomfortable, but it was among a few moments when I felt I'd encountered someone more brave than me; and so it pushed me to consider those strategic silences I held onto. I could talk about being queer, about being HIV positive, about racial trauma...but not that. The reality is that it's still scary; and the scars that the experience had on me as a young child, has been not just a part of my struggle, but my story. I'm not who I am today without it. In Season 1, Episode 7, Amita and I talk about why the sexual violence we survived as children, far from making us less capable as professionals, makes us better at what we do. It's 10:15 pm on the day I generally share the new podcast first in the morning. Maybe I'm still nervous about releasing it. Perhaps a part of me fears what exposing this may mean for how others view me going forward. Maybe they will see me as all the more brave. Maybe they will understand what it feels like to be on a life-long journey ... to be protected.Amita Swadhin is an educator, storyteller, activist and consultant dedicated to fighting interpersonal and institutional violence against young people. Her commitments and approach to this work stem from her experiences as a genderqueer, femme queer woman of color, daughter of immigrants, and years of abuse by her parents, including eight years of rape by her father. They are a frequent speaker at colleges, conferences and community organizations nationwide, and a consultant with over fifteen years of experience in nonprofits serving low-income, immigrant and LGBTQ youth of color in Los Angeles and New York City. Amita has been publicly out as a survivor of child sexual abuse since she interned at the U.S. Department of Justice Office of Violence Against Women in 1997. In 2016, Amita received a two-year Just Beginnings Collaborative Fellowship, allowing them to work full-time to end child sexual abuse and to help survivors heal. From March 2012 to September 2015, Amita was the Los Angeles Executive Director of Peer Health Exchange, a national nonprofit empowering teens to make healthy decisions. In the fall of 2015, they were the Interim Executive Director of API Equality-LA, whose mission is to build power in the Asian and Pacific Islander community to achieve LGBTQ equality and racial and social justice. Amita is also a published author. Lucy Helm is Starbucks Executive Vice President and Chief Partner Officer. A partner (employee) since 1999, Lucy previously served as Starbucks Executive Vice President, General Counsel and Secretary for more than five years, and served as the interim leader of the Partner Resources organization (PRO) from March to July 2017. She is part of the senior leadership team, reporting directly to CEO Kevin Johnson.   In her work in Law & Corporate Affairs, Lucy proved to be a trendsetter in the legal profession through diversity and pro bono work, and gained a reputation as an incomparable leader and advocate for the communities Starbucks serves. She is the former President and CEO of Legal Momentum, the leading legal defense fund for women's equality in the US. She served as Deputy Mayor under Mayor Michael Bloomberg for 12 years and is a former Trustee of the City University of New York. In this podcast Roman said that when she was leaving the Office of Mayor, she saw a “tsunami coming towards us in the world of women's rights. On this episode of en(gender)ed, our guest is Lisa Fischel-Wolovick, an attorney who has represented battered women for almost thirty years. She is also the author of numerous publications including her recent book: Traumatic Divorce and Separation:  The Impact of Domestic Violence and Substance Abuse in Custody and Divorce, just recently published by Oxford Univ. Press, this past March.  Lisa also helped to organize the first Criminal Court that specialized in domestic violence. Before becoming an attorney, Lisa obtained her Master's in Social Work and worked in hospital social work which included advocacy and counseling for battered women. Lisa also currently teaching courses in Family Violence and Child Maltreatment at the City University of New York, in John Jay's Graduate Program in Forensic Psychology. Lisa speaks with us about her new book and how divorce impacts families differently, especially for those experiencing high-risk factors of domestic violence, mental illness, and/or substance abuse and the risks and harms that they face in the process.  We will also explore the recommendations and conclusions she has to improve our family and criminal court systems and practices and policy reforms she believes is necessary to see real, significant, positive change.     Jennifer Becker: Confronting Tech-Enabled Domestic Violence (Ep. 148) Legal Momentum's Jennifer Becker joined Joe Miller for Part 2 of our series on how perpetrators use technology to engage in domestic violence. Bio Jennifer Becker is Deputy Legal Director and National Judicial Education Program (NJEP) Senior Attorney. At Legal Momentum, Jennifer is engaged in a range of litigation, education, and policy on issues of gender-based discrimination and violence, including efforts to strengthen state gender-based violence statutes and reauthorization of the federal Violence Against Women Act. Jennifer has presented nationally and internationally on issues related to gender equality and gender-based violence. Jennifer is engaged in NJEP’s judicial training and technical assistance efforts and has developed and presented information about sexual assault and the intersection of sexual assault and domestic violence at national and state judicial conferences and multidisciplinary conferences. Jennifer is a former sex crimes and child abuse prosecutor, having served for seven years in the Bronx County District Attorney’s Office in Bronx, NY. During that time she handled hundreds of such cases throughout all stages of the criminal justice process. Prior to joining Legal Momentum, Jennifer was the Title IX Coordinator for the New York City public school system, a district of more than 1 million students and 135,000 employees. In that role she was responsible for overseeing gender equity compliance, including responding to and investigating sexual harassment and sexual misconduct in schools. Jennifer has developed and conducted trainings for attorneys and non-legal staff on substantive issues related to gender equity laws, discrimination, criminal law, and litigation techniques and strategies.  Jennifer is an active member of the New York City Bar Association Sex and Law Committee and co-chair of the New York County Lawyers Association Women in Law Committee. Times, June 23, 2018) News Roundup Facebook posts biggest single-day loss in stock market history Facebook’s market value dropped $119 billion Thursday after the company released a poor quarterly report.  The single-day drop was the biggest in stock market history and represented 19% of Facebook’s market cap , taking it down to $510 billion. In its quarterly report, Facebook reported usership that fell short of expectations by 20 million active daily users, and its  revenue fell short of analyst estimates by some $130 million for the second quarter. And at $1.72 Facebook’s earnings per share was also two cents lower than Thompson Reuters had estimated. Facebook and Amazon set lobbying records in 2Q18 Facebook and Amazon set new lobbying records for themselves in the second quarter, spending over $7 million combined on its lobbying efforts. This is according to lobbying disclosure records. Facebook spent $3.6 million to deal with the Cambridge Analytica and Russian hacking debacles. Amazon spent some $3.47 million.  Google spent its fair amount on lobbying as well, coming in at $5.9 million for the second quarter alone. Ali Breland reports in Politico. Is Trump doing enough to stave off Russian attacks on the midterms? President Donald Trump met with members of the National Security Council on Friday to discuss cyber threats to the rapidly approaching midterm election. The White House released a statement that said in part, “The president has made it clear that his Administration will not tolerate foreign interference in our elections from any nation state or other malicious actors.” The statement made no specific mention of Russia.   But the president tweeted that he is concerned that Russia might help Democrats—even though Russian President Vladimir Putin stated during the infamous Helsinki Summit that he wanted Trump to be re-elected in 2020. In addition, the Daily Beast reported that Russian hackers recently attempted to access Senator Claire McCaskill’s emails as she launched her 2018 re-election bid. Senator McCaskill acknowledged the attempt, saying it was “not successful”. House Democrats said that the White House’s effort to prevent election interference is insubstantial. They want a more robust action plan from the White House. And Politico reported that most states are unprepared for cyberattacks. Even though Congress appropriated $380 million back in March to help states replace their voting machines, Politico reports that only 14 states and DC plan to do so before he 2020 presidential election. Over in the UK, British lawmakers are proposing that tech companies be held liable for publishing fake news on their sites. Facebook signs binding agreement with Washington State not to help advertisers target customers on the basis of race Facebook signed a binding agreement with Washington State Attorney General Bob Ferguson last week in which the company promised not to allow advertisers to target users on the basis of race. This would include ads for housing, employment, credit, insurance and “public accommodations”. However, advertisers may not need to target race directly. They could target and exclude on the basis of race using non-racial proxies for race. Facebook could potentially still have the ability to cross-reference facial recognition data and users’ likes and dislikes to build psychometric profiles that show trends that correlate with race, which advertisers could then use without creating a paper trail.   DOJ Investigates Sinclair Finally, the Justice Department is now investigating whether Sinclair, Tribune and others engaged in anticompetitive behavior that affected advertising sales rates. The Wall Street Journal reports that the DOJ is looking into whether Sinclair and Tribune coordinated in such a way as to generate higher rates for tv ad spots. The DOJ had stumbled upon potential evidence of coordination practices as it was reviewing Sinclair’s proposed $3.9 billion acquisition of Tribune, which is now in the hands of administrative law judge after the FCC voted unanimously not to approve the acquisition.

Legal Momentum Gender Justice Fellow Seher Khawaja focuses on developing strategies to address employment discrimination and to advance gender equality in the workplace. She served as an attorney for the New York City Housing Authority, where she developed policy on affordable housing, advised on legislative and regulatory reform, and ensured legal compliance, including implementing the Violence Against Women Act, and worked with organizations in Burma, Haiti, Iraq, Israel, South Africa, and the United States on a range of human rights issues, including gender-based violence. Seher is an active member of the New York City Bar Association’s Human Rights and United Nations Committees, has served as an editor on several academic journals. And what can this mean for women who immigrate to the US and have experienced both?  What are the connections, what are the commonalities, and what are the realities for women of all cultures when it comes to victimization by intimate partners? Jessica Winegar says the 18,000 women killed by abusers in the US between 2003 and 2014 are no different from the women killed in the Middle East or South Asia. She is the Harold H. and Virginia Anderson Chair in Anthropology at Northwestern University. Her research specialization is in the Middle East, and she has written widely on issues of gender, Islam, and global politics.  Penny Venetis is Executive Vice President and Legal Director of Legal Momentum and as Clinical Professor of Law, and Director of the International Human Rights Clinic, at Rutgers, she specialized in civil rights and international human rights impact litigation.
