Vermont has been thrust to the center of President Donald Trump's immigration crackdown.On April 14, Mohsen Mahdawi, a student at Columbia University and a legal permanent resident of the U.S. who lives in the Upper Valley of Vermont, traveled to Colchester for his naturalization interview, the final step in becoming an American citizen. Mahdawi was born in the Israeli-occupied West Bank, has lived in the U.S. for a decade and holds a green card.Mahdawi has been a Palestinian rights activist at Columbia, though he did not participate in the student protest encampment there last spring. He is set to graduate next month. He suspected that his immigration appointment was a “honey trap” meant to lure him out to be deported, as happened to his friend, Mahmoud Khalil, a green-card holder and a fellow Palestinian student activist at Columbia.Before traveling to Colchester on Monday, Mahdawi alerted his attorneys, Vermont's congressional delegation, and journalists in the event that he was arrested. When he showed up for his naturalization interview, he was taken by hooded plainclothes officers who placed him in handcuffs before he could leave the building.Mahdawi has not been charged with a crime. According to his attorneys, he was detained under an obscure law that permits foreign nationals to be deported if they pose "serious adverse foreign policy consequences." Mahdawi's attorneys argue that he is being punished for protected speech in violation of the First Amendment and his right to due process. In response to an emergency petition filed by Mahdawi's lawyers, Vermont federal Judge William Sessions ordered the Trump administration not to deport him or move him out of the state while he reviews the case.A CBS News crew interviewed Mahdawi the day before his arrest. He told them, "If my story will become another story for the struggle to have justice and democracy in this country, let it be."Also on Monday, attorneys for Rümeysa Öztürk, a graduate student at Tufts University, argued before Judge Sessions in Burlington that Öztürk's arrest on March 25 violated the law. Öztürk, a former Fulbright fellow who is from Turkey and is in the U.S. on a student visa, was grabbed off the street in Somerville, Mass., by masked plainclothes men, a scene that was captured in a now-viral video. She was whisked to Vermont that night before being flown to Louisiana the following morning. A federal judge in Boston ruled that her case should be heard in Vermont. Judge Sessions is now considering the matter.Öztürk's attorneys assert that the Trump administration secretly revoked her student visa and targeted her for co-writing an op-ed in Tufts' student newspaper that criticized university leaders for their response to demands that the school divest from companies with ties to Israel.Both Mahdawi and Öztürk have been targeted by shadowy right wing pro-Israel groups.  Mahdawi was named by the militant Zionist organization Betar US, which placed his name on a “deport list” that it gave to the Trump administration.Öztürk was targeted by Canary Mission, a right-wing group that claims that she “engaged in anti-Israel activism,” an apparent reference to her op-ed piece.Vermont's political leaders denounced Mahdawi's arrest. Rep. Becca Balint, and Senators Peter Welch and Bernie Sanders issued a statement saying that Madahwi's arrest “is immoral, inhumane, and illegal.” They demanded that he “must be afforded due process under the law and immediately released from detention.”Gov. Phil Scott stated, “Law enforcement officers in this country should not operate in the shadows or hide behind masks.”On Tuesday, Democratic leaders in the Vermont Senate demanded that Vt. Gov Phil Scott terminate an agreement that allows federal immigration authorities to lodge detainees in state prison.The Vermont Conversation spoke with two attorneys at the center of these cases.“The larger concern here is one's right to free speech,” said Cyrus Mehta, an immigration attorney based in New York and an adjunct professor of law at Brooklyn Law School. He is part of Mohsen Mahdawi's legal team.“The Supreme Court has long held … that everyone in the United States, whether they're citizens or non-citizens, including green card holders, have a First Amendment right to free speech. The free speech might not be to your liking. You may not agree with it. But as long as it's lawful, as long as you're not engaging in criminal conduct, that speech should be protected under our First Amendment.”“It is against the interests of the United States to harshly go against students, treat them like criminals -- even worse than criminals by detaining them, not giving them bond -- and their only offense has been speech that has not particularly been favored by this administration.”Mehta warned that denying rights to green card holders “will slowly extend to U.S. citizens, we will all lose this cherished First Amendment right to express ourselves.”Grabbing people off the street by masked plainclothes officers “absolutely bears many of the hallmarks of a kidnapping,” said Lia Ernst, legal director of the ACLU of Vermont, who is on Rümeysa Öztürk's legal team. (Disclosure: I serve on the board of the ACLU of Vermont).“The notion that the administration — with no due process, with no judicial review — can sneak someone around the country, as happened in our case, and then, as has happened in these other instances, out of the country, and then claim they are powerless to do anything about it, is utterly foreign to the American legal system. It's utterly foreign to the rule of law, and it is abhorrent.”"It's just horrifying, and I believe intentionally. The government is not trying to just punish Rümeysa for her speech. It's trying to tell everyone else they better only express opinions with which the government agrees. And that cannot be in the United States of America.”As President Trump and his allies stymie court orders, will the legal system hold?“I have to believe that it will, but it will not do it on its own,” replied Ernst. She cited the importance of recent protests.“There is real power in the people standing together and demanding adherence to the rule of law … and to stand up to this administration and to say that its refusal to abide by the constitution and to abide by the rule of law will not be tolerated. But the legal system can't do it by itself.”

Haejin Shim Fujimura describes her college years as rebellious. While searching for her life purpose she received a calling to raise funds and attend World Vision's® 30 Hour Famine retreat. Haejin witnessed horrific images from the civil war in Sierra Leone, which left fifty thousand dead over eleven years. She wanted to help those terrorized, vulnerable and left behind. After college Haejin pursued her calling to become an advocate for the abused, enslaved, and those born into human trafficking. Throughout law school Haejin's intense, focused, and unwavering personality gave her the resolve to intern with the International Justice Mission. Haejin shared her lowest moment after she was betrayed, stolen from, and assaulted; this soon to be generational steward of justice was completely shattered. She then embarked on a journey of healing and forgiveness. During Haejin's first trip to India, she met children born into brothels, now she had the experience as a legal justice advocate to help. As the saying goes, Kelly Kraiss has many feathers to her bow. NCAA D1 coach, advocate, professor, scholar (PhD), and an athlete. Kelly is currently an Assistant Coach with The University of Alabama's rowing crew and is a part-time professor. We spend a lot of this episode diving into her various passions in life - special education, rowing, advocacy, and family. Her personality is immeditely infectious and welcoming, and I ask how these notable traits may sometimes come in conflict with the stereotypical characteristics given to 'serious' coaches/leaders. & of course her answers are wonderful! Being feminine, intelligent and friendly, are what make her such an impactful advocate & coach. Growing up in Florida, Kelly became immersed in the rowing world which would eventually lead her to row NCAA D1 at the University of Tennessee, before moving into her role as coach for the USRowing High-Performance, and Olympic Development Camps, at Rutgers (go RU!), and for masters, highschool, novice and collegiate D1 athletes. She has consistently produced NCAA Division 1 and US National Team athletes, some going on to medal on the world stage. Alongside her rowing career, Kelly continued educating herself and working in the special education field. Earning a bachelor's degree in early childhood education, a master's in exceptional education, and a Ph.D. in education… and also graduated from Brooklyn Law School. As someone fortunate enough to know Kelly, I understand that of all her accomplishments being a sister, daughter, and friend are her most treasured. Cleveland Plain Dealer, July 28th, 1974 — CBS 'Theater's' Brown Burns about Serling "I'm proud of every minute we're on the air...and I'll stand up for every single show I do." Speaking of The CBS Radio Mystery Theater was Himan Brown, executive producer of the nationwide show that premiered January 6th and has garnered good ratings. His comments were the beginning of a rebuttal to negative remarks made about the show and The Zero Hour on these pages June 16th by Rod Serling, who narrated the latter program, which was dropped by Mutual last Friday. Brown burned. “My stories have complete relevancy to all that's going on now--exorcism, reincarnation--all stories of the moment. We're doing contemporary stories with the best writers and actors in the business. I think radio drama, contrary to what Serling says, is here forever and a day--and never will be off the networks again." Serling has written TV shows, movies, and books, but his only previous radio drama was written while he was a summer replacement at WLW in Cincinnati. "It's all sour grapes. Serling's relationship to radio has been a total failure," Brown said. “His criticism of his own show is a complete slur of his own integrity, because in the past he lent his narrative name or talents to what he wrote. The implication is that he was much involved with the stories on The Zero Hour and that's a fake.” Brown believes in Mystery Theater with all his heart. “It took me fifteen years to sell it, but it's been a happy fulfillment." The show has gone so well that Brown has a verbal renewal to go into a second year. He wouldn't discuss it, but Brown admitted that he has packaged a two-hour weekly Sunday drama series for CBS Radio that would debut early next year. Getting back to Mystery Theater, Brown admitted that he can't bat one-thousand on the series. "But I'll bat eight-hundred." He produces, directs, edits scripts, casts the shows and signs the checks. “The show has gone far beyond anything I ever hoped for. People are listening seven nights a week. The minute we put on the first repeats, the stations' switchboards lit up.” The first year's contract calls for one-hundred ninety-five new shows and one-hundred seventy repeats. Usually produced in New York, the program will invade Hollywood for talent there for the recording of eight mysteries, beginning August 5th. Born in Manhattan and with degrees from City College of New York and Brooklyn Law School--although he has never practiced law--Brown moved into TV production when radio drama fell by the wayside some fifteen years ago. Now, with The CBS Radio Mystery Theater, he's back home. "It's the greatest homecoming a man could possibly want." — Raymond P. Hart Although Rod Serling was disappointed with Mutual broadcasting's treatment of The Zero Hour, as covered in the previous episode of Breaking Walls, in 1974 Himan Brown's Mystery Theater won a Peabody Award for helping to usher in a new era of radio entertainment. It would run for eight more years until finally going off the air on December 31st, 1982. More than fifteen hundred episodes were produced. Most survive in listening quality.

Prior to joining U-Haul, Kristine was a member of the class action legal team at Greenberg Traurig LLP. Kristine talks about growing up in Phoenix, going away to college and working on the east coast before deciding to return home after 9-11 to be closer to family and friends. What do Critical Race Theory and antisemitism have in common? A lot, actually, from the roots of each movement, to the ideology, to the way they are weaponized by the left today. The overarching philosophy linking these movements together is a Manichean ordering of peoples into groups of oppressed or oppressor – usually, but not always, based on the color of one's skin. Indeed, it is no mistake that in the aftermath of WWII, Jews sought to categorize themselves as white, a move that has now fed the bizarre oppressor/colonizer trope so popular on the left. First Jews weren't white enough for the white supremacists, but now are too white for the CRT crowd. Not to mention the shifting ideological assaults on Jewish groups, once accused of being communists now accused of being capitalists. Yes, donors are pulling out of universities that harbor pro-terrorist groups; yes, the support of Hamas the past few weeks has been a PR disaster for wokeism. But it will take a lot more than that to root out the antisemitic and real race-based discrimination that has gripped America.David E. Bernstein holds a University Professorship chair at the Antonin Scalia Law School, where he has been teaching since 1995. He has also been a visiting professor at the University of Michigan, Georgetown University, William & Mary, Brooklyn Law School, the University of Turin, and Hebrew University. At the intersection of Erwin Place and Oceanside Road, 17-year-old driver Nicollette Iacone pulled to a stop and crept forward to peer beyond obstructing hedges on the Grassi, Kotter, and Piccoli property line and an inoperable control cabinet before making a left turn. Sal Passanisi, Jr., who was speeding and driving under the influence of alcohol, collided with Nicollette, resulting in life-altering traumatic brain injuries. The jury returned a verdict assigning 14% negligence to Sal and 86% negligence to Nassau County. Ultimately, all parties settled for a total of $25,425,000.   Guest Bios: Erin Hargis Erin M. Hargis received her Bachelor of Arts from Vassar College. Thereafter, she received her law degree from Brooklyn Law School. Thursday, October 5th, 2023   Jocelyn Simonson is Professor of Law at Brooklyn Law School, a former public defender, and the author of Radical Acts of Justice: How Ordinary People Are Dismantling Mass Incarceration. We discuss how certain radical acts of justice challenge the legitimacy of the criminal system and form the underpinning of a new collective legal thought.   The four pillars of this work comprise of court watching, community bail funds, participatory defense, and people's budgets. Bail funds are pulling the rug out from the system's justification for what it's doing. Defunding the system in this way shows that the combination of carceral and economic forces that we currently use to “do justice” is not inevitable. A big part of the power of these acts of justice is that they're done collectively. Abolition has two sides: breaking down and building up. Presidential Power, Standing, and Student Loan Forgiveness

This week the Supreme Court heard two separate legal challenges to a student loan forgiveness program proposed by the Biden administration: Biden v. Nebraska and Department of Education v. Brown. The plan aims to cancel up to $20,000 of student debt for low-to middle-income families, and was rolled out last August during the tail end of the COVID-19 pandemic. It relied on the Higher Education Relief Opportunities for Students Act of 2003 (or the HEROES Act), a law passed after 9/11 that gives the secretary of education the power to make changes to student loan programs during a national emergency. At the heart of the challenges to the plan are major questions surrounding the scope of presidential power; the doctrine of “standing”—or who can bring a lawsuit in court; and whether certain issues are of such “vast economic and political significance” that they should be left to the legislative branch and not decisions of federal agencies. William Araiza of Brooklyn Law School and Anastasia Boden of the Cato Institute join to unpack the arguments on both sides of the cases.
