Topic: Breaking Barriers While Helping Others   Guest: Michelle Greenberg-Kobrin   Bio:   Michelle Greenberg-Kobrin is a Clinical Professor of Law at Cardozo Law School and the Founding Director of the Program on Leadership at the Heyman Center for Corporate Governance.  Professor Greenberg-Kobrin is a Lecturer-in-Law at Columbia Law School, where she served as Dean of Students for eleven years. She also holds an appointment at Columbia University's Teachers College in the Klingenstein Center for Independent School Leadership.  She teaches in the areas of transactional law, leadership, conflict resolution and negotiation, intellectual property law and educational governance.  She served as the Title IX Coordinator at Columbia Law School where she authored sexual harassment policies and oversaw the sexual respect initiative, training hundreds of students each year. Professor Greenberg-Kobrin also facilitates the Arev Fund, a grantmaking organization whose mission is to use and promote impactful female Jewish philanthropy to spur change, with a particular focus on the advancement of women.  Areas of interest include spiritual leadership, communal life, social justice, and education. Prior to her appointment at Columbia, she was an attorney in the corporate, securities, and financial Institutions group at Arnold & Porter. She received both her BA and her JD from Columbia University, and was a Bruriah Scholar at Midreshet Lindenbaum and a Torat Miriam fellow.  Professor Greenberg-Kobrin trains leaders around the world and lectures and consultants with various universities, organizations, Jewish day schools and private schools on a wide-range of issues, including leadership training, negotiation and conflict resolution, agunot, policy drafting and implementation, sexual assault and harassment prevention, crisis management, work/life balance, faculty development and training and women and Judaism. She serves on a number of not-for-profit boards and lives in Riverdale, New York with her husband. Title IX prohibits sex-based discrimination in any educational institution and can be quite a tricky topic in faith-based schools. Today's episode shares a recent webinar on this topic. In this webinar Brittany Gates, Title IX and Equity Specialist at ICS, shares her experience as a Title IX Coordinator at a faith-based school, exactly what Title IX is, how to claim a religious exemption under Title IX, and why defined religious values are imperative in these instances. We also discuss code of conduct behaviors in these types of schools, how a safe and healthy culture can be built, why Title IX discipline and school discipline are separate matters, and so much more. Amber Grove is the Title IX Coordinator at the Pennsylvania State University and has served in that role since November 2022. She got her start in higher education in residence life at Duquesne University. As resident director, Amber became involved in Title IX investigations, which transitioned her focus in the field to Title IX. She went on to serve as the Director of Student Engagement and Responsibility at Bethany College, where she was also Title IX coordinator. She relocated to UNCW and served as an adjunct faculty member and the Director of Title IX and Clery Compliance.In 2022, the Biden-Harris administration released a public notice for proposed changes to Title IX. Title IX has seen several public notice periods and rule changes over previous presidential administrations. The most recent proposed rule change to Title IX under the Biden-Harris administration received the most comments ever during the U.S. Department of Education's public comment period, 240,000 comments. This week on SA Voices From the Field we interviewed Courtney Bullard, Founder of Institutional Compliance Solutions about the many Title IX changes that are coming about and their impact on your own college campus.  Courtney Bullard has over ten years of experience representing institutions and organizations in matters involving sexual misconduct, including 8 years as a University system attorney. As in-house counsel, she served as a trusted advisor to the Chancellor, Vice Chancellors, Athletic Director, Director of Office and Equity and Diversity, Title IX Coordinator, Provost and other top level administrators on all legal matters affecting the institution. Her breadth of knowledge and familiarity with the unique aspects of a college campus provide a distinctive approach to partnering with institutions and school districts to assist with their legal needs. She excels in advising clients on all aspects of institutional compliance, including Title IX of the Education Amendments of 1972 and the Violence Against Women Act Reauthorization amendments to the Jeanne Clery Act, and specializes in providing legal advice to institutions during sexual misconduct, stalking and relationship violence investigations. Courtney regularly provides Title IX and Clery training to organizations, attorneys, institutions and school districts, serves as an external investigator into allegations of sexual misconduct, and provides expert witness testimony on matters dealing with institutional response to allegations of sexual misconduct, bullying and hazing in litigation. Courtney is the host of The Law & Higher Ed Podcast and is nationally recognized for her contributions to news media, including the Chronicle of Higher Education, Inside Higher Ed, and VICE news on HBO. Courtney is the creator of Title IX University, an on-line digital platform that provides Title IX training. Courtney received her undergraduate degree from Indiana University in 1998. She graduated from the University of Memphis School of Law in 2001, where she served on the law review as a Comments Editor. Prior to serving as Associate General Counsel for the University of Tennessee, she worked for Baker, Donelson, Bearman & Caldwell and Husch & Eppenberger. Courtney also teaches Business Law as an Adjunct Professor for the University of Tennessee, Chattanooga, and Southern New Hampshire University. Welcome to Authors of Union. Today, we are going to talk with Dr. Pete Caccavari, who has written his first chapbook of poetry, Minor Loss of Fidelity, shipping soon from Finishing Line Press. The book depicts people reacting to their environment – whether natural or human-made – and their struggles to make sense of those encounters. Caccavari's poems chronicle a variety of losses, but also a variety of hard-won gains. These encounters with the environment are mirrored in encounters of content with poetic forms. Personal history, natural history, and poetic history undergird the present, and these gird the present for the future. (Source: Finishing Line Press) Caccavari wears two hats. By day, he is the Associate Vice President for Institutional Effectiveness and Title IX Coordinator for Union Institute & University. His job requires compliance and attention to detail. “I enjoy that job very much – it's where I can satisfy my desire for order."  By night, his creative side emerges. “Poetry, on the other hand, lets me color outside the lines and break the rules.” Caccavari earned his bachelor of arts in English from Xavier University and his M.A. Ph.D. in English from Rutgers University.  He lives in Cincinnati and credits the beauty of the landscape and city as inspiration. The host for the interview-style podcast is Dr. Linwood Rumney, professor in Union's General Education Program, poet, and author. He is the winner of the 17th Annual Gival Press Poetry Award for Abandoned Earth. Rumney's poems and nonfiction essays have appeared in many publications including the North American Review and Crab Orchard Review. His translations of Aloysius Bertrand, an early practitioner of the modern prose poem in French, have appeared in Arts & Letters and Hayden's Ferry Review. Rumney recently completed his Ph.D. as a Charles Phelps Taft Dissertation Fellow at the University of Cincinnati.

Rural hospitals reach capacity as the state's coronavirus cases continue to rise.Then, Mississippi's largest historically black university names its next president.Plus, we examine the factors of poverty during the pandemic.Segment 1:Rural hospitals in Mississippi are operating at maximum capacity as coronavirus hospitalizations rise across the state. The Department of Health reports COVID-19 related hospital admissions have returned to levels seen during this summer's peak of the pandemic, and confirmed hospitalizations have more than doubled since the beginning of October. The surge is placing a significant strain on not just the largest medical centers, but also small, rural hospitals. Dr. Jay Pinkerton is Chief of Staff at George Regional Health System in Lucedale. As he tells our Kobee Vance, rural hospitals are facing many of the same challenges as the rest of the nation.Segment 2:Jackson State University has a new president after a months long search process, and it's a face already familiar to the university. Thomas Hudson will continue to serve as president at Jackson State University, after serving as acting president since February. The Board of Trustees of the Institutions of Higher Learning made the announcement yesterday. Now-president Hudson has also served as Chief Operating Officer, Chief Diversity Officer, and Title IX Coordinator for the university. During the announcement, Hudson said his roots in the JSU and capitol city community run deep.Segment 3: Data analysis by the Mississippi Center for Investigative Reporting shows that coronavirus deaths are twice as high per capita in Mississippi's poorest counties. In the most recent installation of The Poverty and the Pandemic series, investigative reporter Jerry Mitchell explores how generational factors have affected the states poorest areas during the pandemic. Dwight Hamilton, J.D. is the Director of the Office of Equity and Access for the Adtalem Global Education Group. Prior to coming to Adtalem, Mr. Hamilton worked at Northwestern University as its Associate Vice President for Equity and Smith College as its Vice President for Inclusion, Diversity, and Equity and was its first Chief Diversity Officer. After practicing law for fifteen years, Mr. Hamilton transitioned into higher education by working at Grand Valley State University as its Associate Vice President for Affirmative Action and Title IX Coordinator. Our guest today is Megan Farrell, Title IX Coordinator for Palo Alto Unified School District, and advisor and consultant to educational and institutional clients with a focus on Title IX compliance. Title IX Compliance for K-12 is complex and looks different than compliance for higher education in many ways.  In our conversation we cover a lot of ground, looking at the unique aspects of K-12 compliance as well as considering the particular situation in which we find ourselves now, with remote learning and homeschooling. In this episode, Courtney continues her conversation with Stephanie Lott, Title IX Coordinator at Arkansas State University. The full discussion with Stephanie covers campus accessibility, pronoun use, and her journey in Title IX with regard to LGTBQI+ and kink culture. In this second part of our discussion, Stephanie gets into some of the challenges investigators, witnesses, complainants, and respondents tend to face in Title IX investigations of cases involving kink or LGTBQI+ communities. For example, identity questions in hookup culture make for complex experiences, which makes the 'truth' of a case incredibly nuanced. Knowing how to ask the right questions so that trust can be built is an essential part of the investigative process. We also speak about the importance of using and soliciting proper pronouns, and Stephanie shares some pointers about how to go about doing so. Stephanie talks about a few of the strategies that are going down on her campus to make it a more inclusive space in this episode too. Deconstructing our biases around niched behaviors and sexualities has been important for a long time now, and this urgency is no less great in the context of Title IX law and investigations. This is the first of a two-part episode where I talk to Stephanie Lott, Title IX Coordinator at Arkansas State University. Our conversation focusses on understanding kink and LGBTQI+ culture, and how investigators can be better prepared for Title IX cases involving people from these groups. There are many grey areas that can arise in cases covering situations that have turned from consensual to non-consensual in the LGBTQI+ and kink circles. Stephanie stresses the importance of investigators who can build a good rapport and also the importance of Title IX professionals educating themselves about these communities. We also cover the steps Stephanie and her team have taken toward Arkansas State becoming a campus that is more diverse and accessible to all, and she brings up some amazing seminars and theatre-based education initiatives working toward that end.  Natalie M. Randolph, Founder, The Student-Athlete Project Natalie Randolph is a seasoned educator, serving in the District of Columbia for 16 years as an environmental education coordinator, 11 years as a science teacher, and currently as the Title IX Coordinator for the DC State Athletic Association (DCSAA). During her career, she had the amazing privilege to serve as one of the first female head varsity football coaches in the country for Coolidge High School beginning in 2010. During her four-year tenure, she worked hard to facilitate the personal and academic growth of student athletes. She was able to ensure that all student athletes that completed her program graduated and were accepted into a college, university, or post-secondary program. Natalie continues to serve student athletes as the DCSAA Title IX Coordinator and has recently started her own organization, The Student-Athletete Project, which seeks to provide academic, social, and career support for underserved high school student athletes. Natalie is a native Washingtonian and graduate of the University of Virginia.

John Kazlauskas: While an MA student at Gallatin studying documentary filmmaking and social justice, John worked as a Graduate Housing Assistant at 80 Lafayette. During that time he was also a Production Assistant on the Oscar-winning Bowling for Columbine, while his own documentary SPEAK UP! premiered at the San Francisco Gay and Lesbian Film Festival before being acquired for national distribution through the Media Education Foundation. While a Community Developement Educator (CDE) at Hayden Hall, John started the MFA program in Dramatic Writing at Tisch. Since leaving NYU, John has worked as a Writer’s Assistant, Script Cooridnator and Writer on TV shows including Brothers & Sisters, SMASH, Happily Divorced, Mulaney and currently NBC’s Superstore. In addition, he has written freelance jokes for Weekend Update on Saturday Night Live. Dr. Sara Klein currently serves as the AVP for Student Affairs at Stevens Institute of Technology in Hoboken, NJ. Prior to her role at Stevens, she served as Dean of Campus Life and Engagement and Title IX Coordinator at Wagner College. Dr. Klein also held the positions of Associate Dean of Campus Life and Director of Res Ed at Wagner College. Before coming to Wagner, she worked as a CDE in the Department of Res Ed at NYU, and as a Fixed Income, Currencies & Commodities analyst at Goldman, Sachs & Co. Dr. Klein is an adjunct professor at NYU in the HESA program. She has also taught in Wagner College’s Executive MBA program and has instructed webinars for the American College Personnel Association and ResLife.net, as well as presented throughout the country at professional conferences, seminars, and workshops. Dr. Klein has published articles in the Journal of the First Year Experience and Students in Transition, the Journal of College and University Housing, and authored a chapter in Linking Theories to Practice: Case Studies for Working with College Students (3rd Edition). Dr. Klein earned her Ph.D. at NYU in Higher Education, where she also received a Master’s degree in the same subject. She graduated from Washington University in St. Louis with a Bachelor’s degree in Psychology and Music. She lives with her husband, Ben, and two young children in Maplewood, NJ. Ryan Sylvester is a Judge Advocate (lawyer) in the U.S. Navy. He is a native of Little Falls, Minnesota. He completed a Bachelor of Science in Mass Communications (1998) as well as a Master of Science in Educational Leadership (2002) at Minnesota State University Moorhead; a Master of Science in Global Affairs (2007) at NYU; a Master of Arts in National Security and Strategic Studies at the U.S. Naval War College (2018); and a Juris Doctorate (2011) at Fordham University School of Law. He is currently working toward a Master of Science in Strategic Intelligence at the National Intelligence University. Ryan is currently assigned to a legal office at Fort George G. Meade. His prior assignments include: U.S. Fleet Cyber Command/U.S. TENTH Fleet; Office of the Judge Advocate General Code 18 (Intelligence, Cyber, and Information Operations Law); Command Judge Advocate, USS EMORY S. LAND (AS 39); Policy Advisor, U.S. Department of Defense (DoD) Undersecretary of Defense for Policy (Oceans Policy); Defense Counsel, Defense Service Office North in DC; and Trial Counsel, Legal Assistance Attorney, and Command Services Attorney at Region Legal Services Attorney at Region Legal Service Office Naval District Washington in Washington, DC. During law school Ryan interned with the Sierra Leone Mission to the UN in NY. Prior to law school, Ryan had a career as a university administrator for eight years. From 2003-2007 he was the CDE for Weinstein Hall at NYU. From 1999-2003 he was he was an Area Director.

    Jennifer Becker: Confronting Tech-Enabled Domestic Violence (Ep. 148) Legal Momentum's Jennifer Becker joined Joe Miller for Part 2 of our series on how perpetrators use technology to engage in domestic violence. Bio Jennifer Becker is Deputy Legal Director and National Judicial Education Program (NJEP) Senior Attorney. At Legal Momentum, Jennifer is engaged in a range of litigation, education, and policy on issues of gender-based discrimination and violence, including efforts to strengthen state gender-based violence statutes and reauthorization of the federal Violence Against Women Act. Jennifer has presented nationally and internationally on issues related to gender equality and gender-based violence. Jennifer is engaged in NJEP’s judicial training and technical assistance efforts and has developed and presented information about sexual assault and the intersection of sexual assault and domestic violence at national and state judicial conferences and multidisciplinary conferences. Jennifer is a former sex crimes and child abuse prosecutor, having served for seven years in the Bronx County District Attorney’s Office in Bronx, NY. During that time she handled hundreds of such cases throughout all stages of the criminal justice process. Prior to joining Legal Momentum, Jennifer was the Title IX Coordinator for the New York City public school system, a district of more than 1 million students and 135,000 employees. In that role she was responsible for overseeing gender equity compliance, including responding to and investigating sexual harassment and sexual misconduct in schools. Jennifer has developed and conducted trainings for attorneys and non-legal staff on substantive issues related to gender equity laws, discrimination, criminal law, and litigation techniques and strategies.  Jennifer is an active member of the New York City Bar Association Sex and Law Committee and co-chair of the New York County Lawyers Association Women in Law Committee. Times, June 23, 2018) News Roundup Facebook posts biggest single-day loss in stock market history Facebook’s market value dropped $119 billion Thursday after the company released a poor quarterly report.  The single-day drop was the biggest in stock market history and represented 19% of Facebook’s market cap , taking it down to $510 billion. In its quarterly report, Facebook reported usership that fell short of expectations by 20 million active daily users, and its  revenue fell short of analyst estimates by some $130 million for the second quarter. And at $1.72 Facebook’s earnings per share was also two cents lower than Thompson Reuters had estimated. Facebook and Amazon set lobbying records in 2Q18 Facebook and Amazon set new lobbying records for themselves in the second quarter, spending over $7 million combined on its lobbying efforts. This is according to lobbying disclosure records. Facebook spent $3.6 million to deal with the Cambridge Analytica and Russian hacking debacles. Amazon spent some $3.47 million.  Google spent its fair amount on lobbying as well, coming in at $5.9 million for the second quarter alone. Ali Breland reports in Politico. Is Trump doing enough to stave off Russian attacks on the midterms? President Donald Trump met with members of the National Security Council on Friday to discuss cyber threats to the rapidly approaching midterm election. The White House released a statement that said in part, “The president has made it clear that his Administration will not tolerate foreign interference in our elections from any nation state or other malicious actors.” The statement made no specific mention of Russia.   But the president tweeted that he is concerned that Russia might help Democrats—even though Russian President Vladimir Putin stated during the infamous Helsinki Summit that he wanted Trump to be re-elected in 2020. In addition, the Daily Beast reported that Russian hackers recently attempted to access Senator Claire McCaskill’s emails as she launched her 2018 re-election bid. Senator McCaskill acknowledged the attempt, saying it was “not successful”. House Democrats said that the White House’s effort to prevent election interference is insubstantial. They want a more robust action plan from the White House. And Politico reported that most states are unprepared for cyberattacks. Even though Congress appropriated $380 million back in March to help states replace their voting machines, Politico reports that only 14 states and DC plan to do so before he 2020 presidential election. Over in the UK, British lawmakers are proposing that tech companies be held liable for publishing fake news on their sites. Facebook signs binding agreement with Washington State not to help advertisers target customers on the basis of race Facebook signed a binding agreement with Washington State Attorney General Bob Ferguson last week in which the company promised not to allow advertisers to target users on the basis of race. This would include ads for housing, employment, credit, insurance and “public accommodations”. However, advertisers may not need to target race directly. They could target and exclude on the basis of race using non-racial proxies for race. Facebook could potentially still have the ability to cross-reference facial recognition data and users’ likes and dislikes to build psychometric profiles that show trends that correlate with race, which advertisers could then use without creating a paper trail.   DOJ Investigates Sinclair Finally, the Justice Department is now investigating whether Sinclair, Tribune and others engaged in anticompetitive behavior that affected advertising sales rates. The Wall Street Journal reports that the DOJ is looking into whether Sinclair and Tribune coordinated in such a way as to generate higher rates for tv ad spots. The DOJ had stumbled upon potential evidence of coordination practices as it was reviewing Sinclair’s proposed $3.9 billion acquisition of Tribune, which is now in the hands of administrative law judge after the FCC voted unanimously not to approve the acquisition.
