Women in the U.S. experience a growing gender wage gap, earning 83 cents for every dollar men earn in 2023, according to the U.S. Census Bureau. This marks the first annual increase in the gap in 20 years, attributed to the lasting impacts of the pandemic on the labor market. Many women returned to low-wage sectors, while men's wages increased more significantly. The gap for Hispanic women narrowed, but gaps for Black and Asian women widened, with white women's wages remaining stable. Latino women's workforce participation rose by 5%, yet they continue to earn less than white men. Despite some women moving into higher-paying roles, overall wage growth remains slow. Experts identify structural issues in the labor market as barriers to pay equity. This episode addresses a problem which has existed for women, since we entered the workforce. A problem that, despite a host of stated commitment and endless implementation of interventions, persists. The gender pay gap. Let's debunk the myths that continue to perpetuate a narrative that is both incorrect and does not serve women and contributes to gender inequity. I share data that shows how even after adjusting for years of work experience, industry, and region, men start their careers at higher levels and pay than women and, after starting behind, women often do not catch up. Men move further up the career ladder, they move faster, and are more highly compensated. There is an abundance of advice offered to women to help “fix” gender inequity, but we need to shift our focus to gender bias in organizational systems that drive that pay gap. This episode addresses the systems, structures, and polices needed to fix the problem. Let's stop blaming women or trying to fix women. We are not broken! We do not need to be fixed! What we need fixed is the gender pay gap. This episode is about the real problems that need to be fixed, including 1. Affordable and equitable childcare, 2. Gender discrimination and unconscious bias, 3. Socialization, and the shuffling of women into lower paying work, and 4. Same pay for same work (the Paycheck Fairness Act). To fix the gender pay gap, we need pragmatic solutions that address bias and a long history of inequity and discrimination. President Joe Biden addresses the nation on March 1, 2022, during his State of the Union Address. Here are some of the key highlights from his powerful speech. President Biden began by acknowledging the war that is going on currently in Ukraine. He praised the Ukrainians for standing strong and fighting for democracy. President Biden made it clear that we as a nation stand with the Ukrainian people. He also sent a clear message to Russia, by stating that we will hold them accountable for their actions. The Russians are currently facing a freeze on their economy and the United States has placed a freeze on Putin's assets along with his top officials' assets as well.The President briefly spoke about the 6.5 million jobs that were created last year that grew the economy by 5.7 percent during that time. We will stay on track with improving infrastructure for decades into the future. The President stated that 65,000 miles of highways will be repaired and around 1,500 bridges will be updated. He mentioned that all poisonous lead pipes will be replaced so that everyone can have clean drinking water. In addition, everyone should have access to affordable high-speed internet and housing.The President spoke about the misstep with the Pandemic Funds that were intended for small business owners. There were supposed to be watchdogs overseeing how the funds were allocated out and there was a lack thereof. The Justice Department will soon name a Chief Prosecutor for Pandemic Fraud and how they plan to remedy it.The President continued by addressing the issues with nursing facilities. He stated that the quality has gone down, and the prices are up. Nursing homes will also be held accountable on how they handle day to day business and how they care for loved ones.As the President continued, he briefly mentioned the Paycheck Fairness Act that would raise the minimum wage to $15/hr. He also spoke highly about the nominated Ketanji Brown Jackson that will serve on the US Supreme Court.President Joe Biden took the time to recap what his administration has done so far while in office and he also outlined what his plans are for the future. The history of the American Association of University Women mirrors the progress of women in the United States. As the number of women graduating from college grew, so did our membership. AAUW's advocacy efforts have propelled countless new laws, including the Equal Pay Act, first proposed in 1945 and finally passed in 1963; the Title IX amendment in 1972; the Family and Medical Leave Act in 1993; the Lilly Ledbetter Fair Pay Act in 2009; and the Paycheck Fairness Act, which was passed by the U.S. Representatives in 2019 but is awaiting action in the Senate. #EqualPay #WomensRights #AAUW

While the COVID-19 outbreak shows a dire need for worker support, it exposes a need that's been there all along. Global crises aren't the only types of crises that shake up our lives. Personal and family crises can put us in critical situations that require more support. The bill would empower the attorney general and workers to hold accountable employers who commit wage theft or look the other way while it's happening by issuing stop work orders in wage theft cases and bring civil wage theft violations to court. It also provides workers greater protection from retaliation and allows workers and whistleblowers to also bring forward public enforcement actions in court. Details vary by state. BE HEARD Act (HR 2148) Bringing An End To Harassment by Enhancing Accountability and Rejecting Discrimination in the Workplace Act Current law doesn’t do enough to stop discrimination, particularly for the most vulnerable workers. To address the issue, the ACLU drafted Principles and Priorities for Legislative Action to Eliminate Workplace Harassment for Congress. The BE HEARD Act strengthens and broadens discrimination laws, removes barriers for targets, and helps employers create incentives and accountability for safe workplaces: It extends protections to all. Title VII of the Civil Rights Act doesn’t address workers in small businesses. This law would cover all employees regardless of business size plus independent contractors, volunteers, interns, fellows, and trainees — and add LGBTQ workers as a protected class. It gives targets a fair chance in court. Case law requires that harassment be “severe or pervasive” to win in court, often unattainable and that groping may not even fall under. The bill outlines what conduct is and is not unlawful to give guidance to the courts who’ve historically excused abusive conduct, blocking justice, and preventing others from speaking up. It promotes transparency. Acts of discrimination are most often kept private, furthered with agreements that mandate arbitration rather lawsuits upon starting jobs. The bill would ban mandatory arbitration and non-disclosure agreements upon accepting a job. It restores protections for workers harassed by supervisors. The bill would make holding employers liable for supervisor harassment easier. It assists employers in creating harassment-free workplaces. The bill authorizes research and data collection and gives employers template policies, trainings, and surveys plus best practices. Paycheck Fairness Act (HR 7) An effort to address the gender pay gap, the Paycheck Fairness Act holds employers accountable for retaliating against workers who share wage information and places the burden on employers to justify pay gaps. Workers can then sue for wage discrimination. PRO Act (HR 2474) The PRO Act will empower workers to negotiate better wages, benefits, and working conditions while preventing employers from interfering in union elections and other workers’ rights violations through penalties. It will also override “right-to-work” laws that prevent unions from collecting dues from the workers they represent. (Unions are force that drives gender equality, higher wages, better benefits, and safer workplaces, but union membership is only 10 percent of the country’s workforce.) "The environment in which the debate is happening, it's not like it was 10 years ago. We're in the midst of a 'Me Too' movement, we're in the midst of a very, very public discussion about equal pay." This is what Rep. Rosa DeLauro told S&P Global Market Intelligence about why she recently reintroduced the Paycheck Fairness Act and why she thinks it has momentum as it heads to the Senate. It has has already been a big year for pay equity advocates: In January, Citigroup Inc. became the first bank to disclose its median gender pay gap, while actress Michelle Williams made headlines when she spoke on Capitol Hill about her personal experience being paid far less than her male costar. DeLauro hopes to build on that momentum. The Democrat congresswoman from Connecticut is one of several experts we interviewed about the gender pay gap for the latest episode of ESG Insider, an S&P Global podcast. While the U.S. Congress weighs DeLauro's bill, the U.K. has already implemented a law requiring that organizations report on their gender pay gaps. In April, U.K. companies disclosed this information for just the second time, and our podcast dives into the new data points, looking at which companies and industries made progress closing the gap. In the U.S., the issue is also garnering investor attention. In this episode, we hear from an activist shareholder who submitted a proposal calling for more gender pay gap disclosures at some of the nation's largest banks. Bank of America Corp. and Wells Fargo & Co. shareholders voted down the proposal at meetings in April, and JPMorgan Chase & Co. shareholders are poised to vote on the proposal later in May. "We're definitely at a transition point for transparency and disclosure, and any employer that is too hesitant risks being left behind by the broader conversation," said Glassdoor Senior Economist and Data Scientist Daniel Zhao. We talked to Zhao about a new report by Glassdoor, which found the gender pay gap is narrowing but persists around the globe. The U.S. adjusted pay gap fell below 5% in 2018 from 6.5% in 2011, thanks in part to a tighter labor market, more women participating in the workforce and greater awareness of the issue, the jobs website found. The issue is gaining momentum and publicity, but experts we interviewed say closing the gap will take years. "That might not sound like a lot, but it adds up to tens of thousands of dollars over a woman's career," Zhao said. "The gender pay gap is narrowing, but at a slow pace. At the current rate, it will be decades if not generations before the pay gap closes fully." (Photo: AP)

In his Chicago's Best Ideas talk on Tuesday, January 27, Professor Epstein spoke about three proposed laws in the area of labor relations: the Employee Free Choice Act, the Lilly Ledbetter Fair Pay Act, and the Paycheck Fairness Act. Epstein spent most of his time on the Employee Free Choice Act (EFCA), so my attention will focus on that law. (Epstein has a column about the Lilly Ledbetter Act on Forbes.com.) The EFCA is an amendment to the National Labor Relations Act (NLRA).
