Chapter Fifty: The Women Win Equal Pay (with Jeffrey Kessler)

After the 2015 Women's World Cup, the US Women's National Team used their heightened profile and propensity for activism to file a complaint  with Equal Employment Opportunity Commission (EEOC) against US Soccer seeking equal pay to their male counterparts on the US Men's National Team. Five players -- Alex Morgan, Hope Solo, Carli Lloyd, Megan Rapinoe, and Becky Sauerbrunn -- asserted that the US Soccer Federation's payment structure unfairly favored male players, resulting in women earning significantly less than their male counterparts for similar work. Jeffrey Kessler, maybe the world's most prominent sports attorney, became the legal anchor  to the USWNT efforts then and would remain so moving forward. That complaint went unresolved but was the first step in a series of actions that ultimately brought the USWNT a victory. After a reconfiguration of the players union, and a few iterations of collective bargaining agreement negotiations, the women took charge of the fight for equal pay. And leading up to the 2019 Women's World Cup, they decided to escalate the conflict, working with Kessler to file a lawsuit against US Soccer -- this time in the name of 28 players on the national team roster at the time. Filed on International Women's Day, the suit sought backpay and damages, in addition to equal pay moving forward. It would take three years to resolve, but eventually the women emerged victorious, settling with US Soccer for a landmark $24M. Kessler joined Founding Futbol to share his experience supporting the USWNT in their pursuit of equality. He talks about how he ended up in sports law,  when he first connected with the team and so much more. Founding Futbol is a year-long exploration of the critical moments that have led to soccer's emerging popularity in America.Visit our website for more information: FoundingFutbol.com. Welcome in for another edition of the Morning Espresso from the SDH Network, brought to you by Oglethorpe University, Atlanta's premier undergraduate learning experience and soccer powerhouse.  Wild Atlanta United win in their opener on Saturday night with two goals from Latte Lath and a banger from Edwin Mosquera. Good start, but definitely things to improve going forward. Had chances to break the game wide open in the first 45, but didn't and Montreal grew into the match and provided some real challenges. San Diego became the story of the opening weekend with a 2-0 win in LA over the Galaxy. The win could have been even bigger, huge statement for San Diego. Bruce Arena started his era in San Jose with a 4-0 win over RSL, Cristian Espinoza with 3 assists from a wing back position there. Philadelphia surprised everyone with a big win in Orlando. Columbus and Chicago combined for 5 goals in the first half of a very interesting match that saw the Crew get the win with Steven Moreira again providing the spark to unbalance the opponent. Youngest USWNT lineup since 2001 saw them defeat Australia 2-1 in the SheBelieves Cup. Japan defeated Colombia 4-0 so Wednesday's USA-Japan match will determine the tournament champion and the USWNT have to win due to Japan having superior goal differential.  Sportico had a fascinating story over the weekend about the US Soccer Federation's interest in overhauling some of men's college soccer. Early stages in all of it, but I can't wait to see where everything goes. The battle for Champions League spots in England will be the defining story the rest of the way as the title is pretty much Liverpool's after their big win over Manchester City. 7 points separate 4th place City and 11th place Brentford, and a 5th Champions League spot could go to England due to the country coefficients.  Rangers fired Philippe Clement as the San Francisco 49ers try to buy up enough shares to become majority owners, setting the table for a clear new vision for the club. The Turkish league has gone outside the country to assign the referee for today's huge clash between Galatasaray and Fenerbahce.Neymar scored an Olimpico to silence taunting fans on the road, he's been looking great for Santos in his early days there.  Foster Gillett's failure to pay has stranded another player, now Valentín Gómez's transfer to Udinese in Italy has collapsed and he'll be going back to Vélez Sarsfield. The proposed relationship with Estudiantes is also on the verge of collapsing with Juan Sebastian Veron potentially leaving Argentina entirely to get more involved with The Miami FC of the USL Championship, where his son will be playing.  More Espresso on Tuesday on the SDH Network, presented by Oglethorpe University.

Welcome in for another edition of the Morning Espresso from the SDH Network, brought to you by Oglethorpe University, Atlanta's premier undergraduate learning experience and soccer powerhouse.  The USL announced plans yesterday to add a D1 professional league on top of their existing USL Championship and USL League One structure. They're planning to get started in 2027 or 2028 and will have a number of criteria they'll use in determining which teams are going to be selected to join it and in earning the D1 status from the US Soccer Federation. Hopefully, the USL doesn't hurt what is a great, thriving league at the moment to chase this. The growth over the years of USL Championship, USL League One, USL League Two, the W-League, and the launch of the women's Super League, along with the growth on the academy side is one of the great success stories of US Soccer history. This new level of competition has to enhance the rest of the USL ecosystem, not take away from it. This will be one of the big stories to watch as we see where soccer in this country grows in the decade following the World Cup. The Premier League's new Squad Cost Ratio rules won't take effect yet, they'll stick with the Profit & Sustainability Rules for next season.  No club in Premier League history has come back from more than 5 points back with 14 games to go, Arsenal are currently 7 points behind Liverpool. Leverkusen hosts Bayern in a top-of-the-table clash in the Bundesliga. A win puts them within 5 points of the leaders from Munich, a loss likely ends the title race.  Zlatan has become irritated by Sergio Conceiçao and he's already being scrutinized at Milan. He just arrived, but welcome to Serie A. Newell's hosts Rosario Central on Sunday at 3pm in Argentina, a great rivalry to watch if you can. Orlando has acquired a new Designated Player to replace Facundo Torres, they've signed Croatian winger Marco Pašalić from HNK Rijeka. He has 5 caps for Croatia. Benjamin Rollheiser is a name to keep an eye on in MLS. The NWSL created a $5M "Restitution Fund" to compensate current or former players who have suffered from abuse while playing in the league. An Argentine top flight match was suspended due to an AR being struck with something from the crowd. The US Soccer Federation has updated its Referee Abuse Prevention Policy and it's a good step forward.  Get to know Damion Downs. The 20-year old striker for FC Köln in the German 2nd division has 9 goals and 5 assists in 21 games and should be on the radar for Mauricio Pochettino and the USMNT.  Results from yesterday: Club Leon take the top spot in Liga MX, Monterrey win at Forge FC in ConcaChampions, while Real Esteli of Nicaragua upset Tigres in the first leg but now have to defend a 1-0 lead in Monterrey in the second leg.  Newcastle advanced to the Carabao Cup Final and seek their first trophy in 56 years. The boys are back and on a very sad and heartfelt note, we have to kick off this week's show eulogizing an absolute legend both in the football world, and specifically within the Ravens family. Super Bowl champion Jacoby Jones tragically passed away this weekend at the age of 40. Josh and Dante kick off the show talking about what he meant for our generation of Ravens fans, and why he is an hall of fame personality who will be missed so much. Josh recaps his weekend at Wobble and tells us about his experience raving with Audrey and her crew. The Summer of Soccer is officially over with Argentina and Spain winning Copa America and the Euros, respectively. The boys break down both finales from Sunday, and take a look at the stylistic differences in the European game compared to the "American" game. Josh has a message for spectators of the security debacle in Miami preceding the Copa America final. Staying in the realm of soccer, the boys were elated to finally discuss Gregg Berhalter being relieved of his duties as USMNT head coach. Josh stipulates why this should be a starting line, not a finish line for the US Soccer Federation. Dante and Josh discuss potential replacements for Berhalter, including the commonly mentioned Jurgen Klopp, and Dante's personal pick, Herve Renard. Moving over to baseball, the Orioles dropped 5 of their last 6 games prior to the All Star break which they needed desperately. Limping into the break, the O's we're gifted the final game against the Yankees thanks to some bad defense. Corbin Burnes started the All Star game for the AL, with Gunnar Henderson and Adley Rutschman also joining him in the starting lineup. Henderson also took part in the Home Run Derby on Monday, but unfortunately did not make it out of the first round. The wait is finally over: EA Sports College Football 25 is out and Dante is emotional about it. The boys wrap up talking some more Wobble, and giving out their music recommendations for the week. The boys are back and all over the place with this episode. This week's show is a mixed bag of everything from Gunnar Henderson's MVP pace, to hot dog eating contests. The boys kick off the show addressing the absolutely DEVASTATING news that Joey “Jaws” Chestnut will not be competing in the annual Nathan's hot dog contest on the fourth of July due to a conflicting sponsorship deal with Impossible Meats. Dante and Josh are both outraged over this, as should every other American sport enjoyer, and explain why this is frankly unconstitutional. Sticking in the realm of American-centric sports, the boys are talking soccer. This week, the topic of their footy discussion revolves around the USMNT and, more specifically, the head coach. Josh kicks off this part of the show by getting on his soap box and asking the question, “why is Gregg Burhalter the head coach of this team?” and frankly he has many points. The mismanagement of arguably the best crop of talent this country has ever seen is only scratching the surface when it comes to GGG's inexcusable lack of results in his tenure as coach. The boys take this conversation into the deep end diving into the US Soccer Federation and why they believe the decisions made, along with the prioritization of the MLS over the USMNT, is soulless and should be considered organizational malpractice. All this to say that the USMNT are winning IN SPITE of GGG, not because of him (a lot like a beloved Baltimore team helmed by a unanimous MVP). Moving away from soccer, college basketball made some headlines this week as UConn head coach Dan Hurley was rumored to be “zeroed in” on by the Los Angeles Lakers, only for Hurley to confirm a day later that he will be returning to UConn. Josh and Dante explain why this is ultimately good for all parties involved, especially college basketball as a whole. Transitioning over to the Baltimore teams, the Orioles have been WHITE HOT over the last two weeks, seeing production from their usual suspects as well as a catalytic effort from… the bullpen! O's relievers have posted incredible numbers in the 13 game stretch of late and we finally have to give them love. Gunnar Henderson continues his MVP campaign only adding to his insane pace on the year. The injury bug has bit the O's yet again as Danny Coulombe heads to the IL, but Jorge Mateo is activated and Dean Kremer is rumored to be making a rehab start in the near future. The Baltimore Ravens have begun their mandatory minicamp and have all their key players in attendance (shocker). Ronnie Stanley has much to prove, however we believe he can return to form. Lastly on sports, it's a major championship week which only can mean one thing… Scottie Scheffler no matter what. The boys shell out some song recommendations this week, as well as some unhinged conversations, and we send you into a fantastic weekend. Cheers to all of you. We love YOU!

Shown by its mismanagement of the US Open Cup, the US Soccer Federation has lost all authority as the governing body for the sport in this country. USSF has allowed MLS to become the most powerful soccer entity in this country. At the same time, the US soccer system is a mess as leagues compete against leagues. The chaos of the way that the US Open Cup debacle has been run shows how weak the leadership is under the US Soccer Federation. Also discussed in this episode is the new TV deals from USL and NWSL, and how those two leagues will be giving MLS a run for its money since the launch of MLS Season Pass. Ho ho ho, soccer fans! Hope you all had a Merry Christmas and are looking forward to the New Year! The soccer news certainly hasn't slowed down during the holidays. US Soccer responded to the MLS' sending of MLS Next Pro teams to the US Open Cup with a simple rejection, and MLS had to issue a rebuttal to save face. The back-and-forth is encouraging for fans and soccer purists, and hopefully will serve to better the working relationship between the two soccer powers in the United States. Tune in as our host gives his thoughts and introduces you to the people who make up the US Soccer Federation committees charged with overseeing the historic tournament. Nick also discusses three Chicago Fire players to build on and goes over all the latest transfers in the league. Sports internships are among the best ways to gain experience, connections, and skills as you build your career. In addition to providing an excellent training ground for you to apply your abilities, they also offer organic opportunities to build a network that can help you get a job. Getting varied experiences through multiple sports internships is one thing; taking advantage of the opportunities they present is another.Today's guest on the WorkInSports Podcast is Alana Meraz, MLB International Partnership Activation Coordinator. Meraz graduated from Arizona State University in 2019 with a Business Sports and Media degree. Meraz's proactive embrace of sports internships and building her network played a big role in getting her a job in MLB within three years of earning her degree. How to Get a Job in Professional SportsWith only four prominent leagues (MLB, NFL, NBA, and NHL) comprising around 30 teams each, jobs in professional sports are highly competitive and, therefore, notoriously difficult to obtain. From 2017-20, Meraz took five internships to establish herself and form a community of professional advocates. Those experiences included:• Phoenix Rising (Community Relations/Sponsorship Activation Intern)• Arizona State Athletics (Game Day Intern)• Arizona Public Services (Events Intern)• Sports as a Job (Social Media Marketing Intern)• ISL (Sponsorship and Tours Coordinator)Additionally, Meraz spent a year as a part-time game operations assistant with the Arizona Diamondbacks. While the COVID-19 pandemic in 2020 provided an obstacle to getting her career started in earnest due to canceled events, she founded Latinx in Sports to build a community of professionals looking to break into the industry, which she still runs today. Her efforts landed her a Fan Experience Coordinator position with the US Soccer Federation in 2021, and she has been with MLB since 2022. On today's episode, Meraz and VP of Content and Engaged Learning Brian Clapp discuss:• How Meraz's sports internships set her up to get where she is now• What her day-to-day role as International Partnership Activation Coordinator consists of• Why Meraz founded Latinx in Sport• How important networking was for Meraz's career growth• What sports career advice she has for aspiring professionals looking to enter the industryEnjoy the full episode to learn how to get a job in professional sports. He said one of the main obstacles was bad leadership. Until it changed. Today, Cindy Parlow Cohn is president of the federation. After taking up the leadership role, she worked across from Kessler in grueling negotiations to make gender parity a reality for the women's and men's national teams. Top ten women's football teams US, Canada, Germany and Brazil have all been eliminated from the 2023 Women's World Cup before the quarter-finals, and underdogs Jamaica and Morocco won big early on. In a landmark deal in February 2022, the US women's team finally received pay parity after a year's long battle with the US Soccer Federation. In contrast, a Jamaica team member's mother had to start a GoFundMe campaign in order for the Jamaican team to be able to prepare for this year's World Cup. In today's conversation, I am joined by Evan Nesterak, the co-founder and editor-in-chief of Behavioral Scientist, a nonprofit digital and print magazine that examines the world through the science of human behavior. Previously, he led the Mindset Assessment Project, an initiative designed to bring rigorous psychological research into the world of sport and worked with Angela Duckworth at the University of Pennsylvania on character development research. This is such a fun conversation, where Evan tells some "never before publicly discussed" stories from his background and that of Behavioral Scientist, which is always fun. We get to hear all about his work and the focus at the magazine, it is full of laughs and brainy goodness. You don't want to miss it!  Show Notes: [00:42] In today's conversation, I am joined by Evan Nesterak, the co-founder and editor-in-chief of Behavioral Scientist, a nonprofit digital and print magazine that examines the world through the science of human behavior. [02:36] Evan shares about himself, his background, and the work that he does. [03:35] He also did some research with the US Soccer Federation where they did a study looking at the mindsets of the elite youth players in the development academy.  [06:09] Evan shares how he met past Brainy Business guest Leidy Klotz.   [08:50] Often when you are newer to something you are automatically put into the mentee role. It is powerful to have that script flipped and be the mentor even if you are newer into something if you have enough experience that you can add value.  [11:13] He learned a lot working with Angela Duckworth and he has taken a lot of lessons since leaving the lab.  [12:25] Evan shares the history of how Behavioral Scientist started.   [14:00] After graduating from college, he decided to do what he now calls “real world college.”  [16:24] He realized there was no place for him to read about really interesting psychology work that was happening.  [17:21] In 2012 Evan and his brother started The Psych Report. They had expert psychologists write about their research in digestible, interesting, and engaging ways.  [17:59] In 2016 it evolved: they teamed up with some other projects and co-founded Behavioral Scientist in 2017.   [20:33] The way we think about human behavior can influence the world we design.  [22:48] They compiled a team from various backgrounds and got to work. Their goal has been to stay curious, prioritize people who ask interesting and ambitious questions about human behavior, and try to answer them in rigorous and thoughtful ways.  [25:12] Don't worry about trying to read everything. Try and find your trusted sources.  [27:12] Being open to other formats can be a really great way to read with an eye for human behavior.  [28:55] You immediately have respect for people when you write or do something outside of your comfort zone.  [29:45] Melina shares about past guests  Doug Kenrick and David Lundberg-Kenrick and their work.  [33:04] The first thing when writing a book in academia is to take action and try and do it.  [33:58] Then you need to understand what your background and strength is in writing and who you want to write for. [35:20] You have to get someone invested and a great way to do that is stories, examples, and cost and opportunities.  [38:04] The more focused you can be in your writing the better.  [39:09] Evan's first suggestion is to sign up for the Behavioral Scientist weekly newsletter and see if it is for you. Hopefully you will encounter things that you wouldn't necessarily seek out but you would learn something that would have  an impact on your life.  [41:17] Monthly they put out the Research Lead where they focus on new research topics.   [44:16] Brain Meets World is a thematic print issue that traces the journey of what happens to our ideas as we bring them out to the world.  [46:40] When you chase the answers all the time it never feels satisfying.  [48:52] Melina's closing thoughts Thanks for listening.
