Arelie Garcia is the youngest of the six children in her family.  After high school, Garcia  trains in Automotive Mechanics Technology at the Center for Employment Training and works at My Chevrolet in Salinas as a service advisor.  Co-Worker Miguel Alvarez describes Arelie Garcia as the "Happy One" of the group. Garcia maintains a close relationship with her sisters and texts Veronica almost daily. On September 22, Arelie Garcia sends Veronica a message at 6am,  a simple message of  ‘Good morning, I love you." At 6:30am,  Garcia is seen on surveillance video leaving her apartment heading for work.  She didn't show up at all.  Her sisters begin texting and calling their sister's phone, getting no response.  Garcia's sister, Veronica, logs into Find My iPhone and is surprised to see Arelie Garcia's phone last pinged to a location in Big Sur, about an hour away from Salinas. Her car is found parked on the side of the road. Locked. Most students who receive special education qualify for a "transitions" program that allows them to stay in school until age 21. These programs are meant to provide job training and life skills, preparing our kids to become as independent as possible. But are these programs really providing the type of training that is truly beneficial for our kids? Join the podcast as I have a conversation with Meriah Nichols from "Unpackin Disability With Meriah Nichols." Show notes: Before talking about employment training, we go back to the beginning and discuss the role that ableism plays in the limited options made available for our kids. Also important how as parents, sometimes we also have to address our own ableism (spoiler alert: it is one of the hardest things I've had to do as a parent of two disabled kids). A short discussion on grief, and the fact that most parents experience grief when their child is first diagnosed. Keeping in check the language we use, and what happens to our kids when we push them to be as "non-disabled" as possible. Finding empowerment in disability. What does that look like? How does that translate into future interests and possible job opportunities? How important it is to discover the gifts and possibilities that are a direct result of disability -- the assets. Inclusion: the current model of inclusion doesn't help our kids or their peers as we think about their future possibilities once they reach adulthood. How cana. school play to a student's strengths and build upon those strengths as possible career paths? Many programs and organizations that are meant to help our students tend to be steeped in ableism, and they do not provide ongoing change beyond one time events or experiences. There isn't much available after transition programs because of the limited "training" they provide. If an employee feels they have been the victim of discrimination or harassment at work because of a philosophical belief, they could claim for compensation. But what is a philosophical belief? Is fox hunting, life after death, veganism, Brexit or Scottish Independence protected under the Equality Act or is this just an opinion? And what happens when one person's belief conflicts with another's, like Christianity and homosexuality? There is no hierarchy of beliefs so how should employers deal with this? What impact has social media had on these cases, with it being so easy now for people to express their views on a particular topic? Philosophical beliefs can be a tricky area for HR teams to advise on, but it's a growing issue and important to get right from a reputational and financial perspective. TLT's employment team offers their views and shares some advice on how to deal with these cases, including the need to remain objective, listen and to have clear policies on how the company handles discrimination and bullying. The Me Too campaign has led to an increase in awareness of sexual harassment at work with companies needing to respond appropriately. In this episode, we look at: how companies are responding; how evidence is assessed at trial including emotional impact and banter; the impact of social media on claims and investigations; and vicarious liability for employers and the importance of training. We look at forward-thinking initiatives from the US like the legal obligation to provide training and the use of 'love contracts' or 'relationship contracts', and whether these are likely to be used in the UK. NDAs or 'gagging clauses' as they're often known are often misunderstood due to the way they're reported in the media – we look at what an NDA is and whether they're likely to be further regulated in the future.
