Kinsella on Liberty Podcast: Episode 454. I interviewed/had a discussion with my first IP law boss today, William C. (Bill) Norvell, Jr., about our time together when I was a new lawyer, his love of opera and so on, and his views on politics, war, Trump, and his views on the patent and IP system based on his years of experience as a patent prosecutor and patent ligitator. Bill, previously a parter with my former firm Jackson Walker, is now retired from Akerman. He was unable to connect via video on our Zoom call so his part is audio only. https://youtu.be/dfpn3KWnh2Q I've mentioned before there are very few anti-patent IP attorneys (see Pro-IP “Anarchists” and anti-IP Patent Attorneys). It turns out Bill, the guy who taught me patent law, is mostly of that sentiment. In response to my question about whether abolishing the patent system would mean the end of innovation and inventions, go to about 1:26:00, for this interchange: Kinsella: If the patent system disappeared tomorrow, do you think this this would mean that innovation would stop? Norvell: No, absolutely not. I think it's in the mind in the civilized man and woman mind to move forward and advance society, and we've done this since the caveman and the development of fire and the wheel and so forth. Absolutely not. I think the people that I have known and worked with in my career had brilliant minds;  they were creative people people, and they didn't they didn't really didn't give a damn about the patents. You know another point on this, and in direct answer to your question, is that patents are are applications a lot of times are approved to be pursued in corporations to be “warm fuzzies” for engineers and designers and so forth—"oh this man has three patents etc etc etc”—and there's there's not any care about about protectionism and going into the market and so forth. Mankind, in our entire society, the development of the Industrial Revolution, the evolution of that, is in the in the genes, so to speak, of humanity. I don't think it would affect it a bit. I am reminded of the words of an email to me from a patent attorney (Miracle–An Honest Patent Attorney!): Stephan, Your letter responding to Joe Hosteny's comments on Patent Trolls nicely states what I came to realize several years ago, namely, it is unclear that the U.S. Patent System, as currently implemented, necessarily benefits society as a whole. Certainly, it has benefited [Hostey] and his [partners] and several of their prominent clients, and has put Marshall, Texas on the map; but you really have to wonder if the “tax” placed on industry by the System (and its use of juries or lay judges to make the call on often highly complex technical issues that the parties' technical experts cannot agree on) is really worth it. Of course, anyone can point to a few start-up companies that, arguably, owe their successes to their patent portfolios; but over the last 35 years, I have observed what would appear to be an ever increasing number of meritless patents, issued by an understaffed and talent-challenged PTO examining group, being used to extract tribute from whole industries. I have had this discussion with a number of clients, including Asian clients, who have been forced to accept our Patent System and the “taxes” it imposes on them as the cost of doing business in the USA. I wish I had the “answer”. I don't. But going to real opposition proceedings, special patent courts with trained patent judges, “loser pays attorney fees” trials, retired engineers/scientists or other experienced engineers/scientists being used to examine applications in their fields of expertise by telecommuting from their homes or local offices throughout the Country, litigating patent attorneys providing regular lectures to the PTO examiners on problems encountered in patent infringement cases due to ineffective or careless examination of patent applications, and the appointment of actually qualified patent judges to...

If you stifle that creativity, and say, “You must do it my way,” you're likely to lose a lot of people pretty quickly. One of the best ways to avoid the conflict between the business side of things - which demands creativity according to a specific timetable - and the creative side, is to suggest that your creatives give you their own timetable, rather than asking them to hew to one that the business people made. This increases accountability and personal responsibility, and also does wonders for the company culture. The most important element in choosing a partner is to make sure that you have the same vision. If every detail is perfect but you each see the end goal differently, then the partnership will fall apart, with potentially disastrous results. When you work together with a partner, you absolutely must hammer out the details in advance, and put them in writing - even if your partner is your best friend in the world - so that you both understand what's expected of each of you. If you don't, the business may fall apart - or on the contrary, it may work great, but you're doing all the work even though you're splitting the profits.

We are really excited to be collaborating with the BFI once again, particularly for an episode on Belgian auteur filmmaker Chantal Akerman as they begin an in-depth retrospective of her work. In the autumn of 2022, Akerman's masterpiece Jeanne Dielman, 23, Quai du Commerce, 1080 Bruxelles, was voted the greatest film of all time in Sight and Sound Magazine's once-a-decade poll. We covered that moment with a double episode - which would be a fantastic primer for this show if you haven't listened to it yet. The episode features a conversation in which Dario speaks to Céline Brouwez, the co-ordinator of the Fondation Chantal Akerman at CINEMATEK, and season curator Isabel Stevens. The discourse surrounding the Sight and Sound poll result and its aftermath as a cultural moment frames the chat. Céline discusses the incredible impact of the poll result on her organisation, and Isabel relives the night of the big announcement and the immediate shockwaves that ran through not only cinephile circles but the broader media. We talk about how the moment caused a something revaluation of what constitutes "great" cinema, not to mention great art, and provoked something of a minor crisis in cultural gatekeeping, particularly with regard to lists. One of the things that this BFI retrospective - entitled Adventures in Perception - is keen to address is Akerman's body of work beyond Jeanne Dielman. We go into this in detail, talking through the elements of archiving, restoration and presentation. We think through the breadth of her oeuvre, which has few generic boundaries. And, of course, we explore Akerman herself: her formative experience, the influence of her mother, and her rigorous form borne of a commitment to artistic commitment and morality. Neil and I then reflect further on the notion of a feminist/female cinematic perspective and the philosophical conundrum: can there be an objective definition of art? A U.S. official said that the attack took place overnight at Tower 22, a small outpost near the Syria border. The drone struck living quarters for the troops, contributing to the high casualties, a U.S. official said. The strike, which was carried out by a one-way attack drone, signals an escalation in the fighting in the region. Akerman was formerly a federal prosecutor and the Assistant United States Attorney in the Southern District of New York, where he specialized in going after white-collar crime. Prior to the SDNY, he made his name as the Assistant Special Watergate Prosecutor with the Watergate Special Prosecution Force under Archibald Cox and Leon Jaworski. There Akerman was instrumental in helping crack open the vast conspiracy orchestrated by President Nixon and his co-conspirators that resulted in Nixon's resignation and several prison sentences for his underlings. Akerman joins us today to discuss how Trump is basically screwed in his election interference trial and why televising the trial will be a terrible idea.
