Break 1: Kia MOG (07.14.22 KIA MOG)   STORY 1:     Gwinnett County closes on purchases of Gwinnett Place Macy's stores Gwinnett County finalized the $16.5 million purchase of the Macy's department and furniture store properties at the former Gwinnett Place Mall, adding to the county's existing ownership of much of the mall's property. This acquisition supports plans to redevelop the site into a mixed-use "global villages" concept featuring residential, retail, green space, and a cultural center. Macy's will continue operating through the 2024 holiday season under a leaseback agreement. The county is now focused on finding development partners, with plans to issue a request for proposals in early 2025, aiming to create a revitalized urban hub and boost economic opportunities in the area. STORY 2: GCPS' Shanna Ricketts Named To Board of Directors For Education Analytics Dr. Shanna Ricketts, executive director of research, evaluation, and analytics for Gwinnett County Public Schools, has been appointed to the board of directors for Education Analytics, a nonprofit focused on education research and technology solutions. Ricketts supports data-driven decision-making in Gwinnett Schools and has extensive experience in education policy and research, including roles with Atlanta Public Schools, the Delaware Department of Education, and Harvard's Center for Education Policy Research. She holds an economics degree from Harvard and a PhD in education studies from Emory University. Ricketts expressed excitement about contributing to Education Analytics' mission of improving student outcomes through data and analytics.   STORY 3: Gwinnett Considering Utility Relocation For State Route 316 Project Gwinnett County commissioners are set to vote on agreements with GDOT to relocate utilities at the Hi Hope Road and State Route 316 intersection in Lawrenceville, a necessary step for converting it into an interchange. The project involves moving water, gravity sewer, and force main infrastructure, costing $11.6 million in total. GDOT will cover most expenses, including $5.11 million for a sewer force main, $1.33 million of $1.36 million for gravity sewer relocation, and $2.9 million of $5 million for other facilities. Gwinnett County will contribute $2.13 million, covering work outside GDOT's project limits. GDOT plans to bid the project in early 2025, with construction expected to begin mid-year. Initially drawn by affordability and proximity, Mallory grew through her involvement on campus, shifting her focus from nursing to GGC's unique patient navigator program within the health science degree. Serving as a resident assistant, and later senior RA, she fostered a sense of belonging in student housing, supporting peers through struggles like mental health challenges and homesickness. Her leadership extended to serving as president of the Greenlight Activities Board, where she worked to create meaningful campus events and strengthen student connections. Mallory credits GGC's community, mentors, family, and faith for helping her overcome personal doubts, teaching her resilience, and shaping her collegiate experience. She plans to gain professional experience and pursue graduate studies after graduation. STORY 5: KimLinh Ngo to become first GGC student to graduate with 3 bachelor's degrees KimLinh Ngo will make history at Georgia Gwinnett College on Dec. 14 as the first student to earn three bachelor's degrees in a single day. Starting as a pre-nursing student, Ngo shifted her focus multiple times, eventually completing degrees in health science (patient navigation), business administration, and management information systems. Her advisor, Janice Alves, played a key role in guiding her through these transitions, encouraging her to explore programming, which became a passion. Ngo balanced her demanding studies with work at two restaurants, using careful planning and time management. Inspired by her parents' hard work as Vietnamese immigrants, she paid her way through college, avoided debt, and helped with family expenses. How can district and state leaders identify signs of school distress long before they are designated as in need of improvement by state accountability systems? In 2020, WestEd partnered with the National Charter School Resource Center (NCSRC) to develop and conduct a portfolio of  research (listed below) that identified signs of early distress in schools, or "indicators of distress," and described an approach to support school improvement efforts. When states and education decision-makers wanted to take the work further into implementation, what emerged is WestEd's Indicators of Distress, an evidence-based early detection system that can help charter and traditional schools meet and surpass accountability standards while fostering positive learning experiences for students. In this episode of the Leading Voices podcast, host Danny Torres talks with Aimee Evan, Senior Research Associate and School Improvement Specialist with the School Choice team at WestEd and co-author of the NCSRC reports, and two state education agency leaders, John Carwell Jr., Education Associate at the Delaware Department of Education, and David Frank, Chief of Staff and Assistant Commissioner, Education Policy, at the New York State Education Department. Securities regulators in the United States have repeatedly asserted that most fungible blockchain-based crypto assets are clearly securities under current law. This assertion is incorrect. An exhaustive review of the relevant appellate case law and the related legal scholarship demonstrates that this position is inconsistent with the Supreme Court's definition of the term “investment contract” as developed by federal appellate courts for nearly a century. This is a panel discussion on the paper by the DLx Law (@DLxLawLLP) team, "The Ineluctable Modality of Securities Law: Why Fungible Crypto Assets are Not Securities.” It is a two-part series, where both Eric Hess (@hess_legal) and I (@JacobRobinsonJD) interview members of the DLx team. They also get into the painful isolation that this policy will lead to for many prisoners, whose main way of connecting with loved ones on the outside is through the mail, because of the cost of phone calls and the hassle of traveling long distances for in-person visits. Finally, they touch on the Delaware DOC's flimsy claim that this policy is designed to reduce contraband--and the much clearer profit motive behind digital mail.  Monica Cosby is a mother, grandmother, activist, organizer, restorative justice and peace circle keeper, poet, person of the theater, and a lover of books, music, cats, dogs, and the earth. Her life and work have been shaped and informed by the communities she has belonged to, including the community of artists, scholars and mothers with whom she was incarcerated for twenty years and whose survival was and is an act of resistance against a system that would dispose of them. She is the lead organizer of Moms United Against Violence and Incarceration and is a wonderful and valuable spirit in the Chicago movement community. Doc clarifies the issues around threats toward school officials, discusses the National School Board Association's (NSBA) under-informed hyperbolic letter to president Biden, Attorney General Merrick Garland's knee jerk memo directing the FBI to figure out strategies to address school threats within the next 30 days, reactions from state-level school board associations, and how your local school district board of education might implement changes including recording audiences attending board of education (BOE) meetings. Doc matches solutions to these issues and also refreshes our minds to how similar matters have been effectively addressed in the past, including FDR's 1930s letter writing campaign. NSBA LETTER TO BIDEN REGARD THREATS TO SCHOOLS. On September 29, 2021, the NSBA, an advocacy group, sent a letter to President Biden with the heading: Federal Assistance to Stop Threats and Acts of Violence Against Public Schoolchildren, Public School Board Members, and Other Public School District Officials and Educators. In the letter, NSBA rolled off this 97-word sentence in which it put some parents in the arena with domestic terrorists: “As these acts of malice, violence, and threats against public school officials have increased, the classification of these heinous actions could be the equivalent to a form of domestic terrorism and hate crimes. As such, NSBA requests a joint expedited review by the U.S. Departments of Justice, Education, and Homeland Security, along with the appropriate training, coordination, investigations, and enforcement mechanisms from the FBI, including any technical assistance necessary from, and state and local coordination with, its National Security Branch and Counterterrorism Division, as well as any other federal agency with relevant jurisdictional authority and oversight.” AG GARLAND MEMO TO FBI. On October 4, 2021, US Attorney General Merrick Garland send a memorandum to the Director of Federal Bureau of Investigation directing the FBI to convene meetings with federal, state, local, Tribal, and territorial leaders in each federal judicial district within 30 days in order to facilitate strategies for addressing threats against school administrators, board members, teachers, and staff, and will open dedicated lines of communication for threat reporting, assessment, and response. STATE SCHOOL BOARD CHAPTERS NOT ON BOARD. The organization Parents Defending Education is curating a running tally of state school boards that have withdrawn from NSBA over the Biden letter (18 state school board associations have bailed from NSBA) as well as state school board associations answers to the following three questions: (1) As the [state association] has not yet commented on the National School Board Association's September 29 letter to President Biden that requested federal intervention in local school board issues – which likened civic participation to “domestic terrorism and hate crimes” and cited the Patriot Act – Parents Defending Education (PDE) would like to know whether your organization was involved in the creation of this letter and whether you agree with its substance and tone. If not, have you contacted the NSBA to let them know? (2) Can you please tell us how, going forward, your organization defines “intimidation,” harassment,” and “threat”? (3) Finally, do you plan to report individuals in your state to the U.S. Department of Justice – or do you believe that concerns can be adequately managed by local and state law enforcement? STATE RESPONSES BURN NSBA. It's apparent that state's are displeased with NSBA and the Garland Memo. Here's the Delaware School Board Association response to PDE's questions: “The DSBA has seen school board meeting protests, some of which have become quite impassioned, however we have received NO reports of violence or threats of violence toward school staff or school board members.  The DSBA does NOT condone violence or threats of violence toward students, staff or board members.  After consultation with the Governor's office, the Public Health Department and the Delaware Department of Education the DSBA developed and issued guidance to school board presidents regarding how to best handle school board meeting protests, which included the ultimate use of LOCAL law enforcement if absolutely necessary.  This guidance was issued prior to the NSBA September 29 2021 letter.  The NSBA letter to President Biden was unnecessary and quite frankly not helpful.” ARE THERE OTHER OPTIONS? Doc believes threats of violence toward school officials is happening, but over-stated by NSBA and Garland. Also, the National Threat Assessment Center has been effective in mitigating school threats for 20 years. Reviewing school board meeting video footage is at the bottom of the FBI's prioritization list. FDR ASKED FOR LETTERS. When FDR was president, the country was hammered by the Great Depression and fears of war. In his fireside chats, he asked listeners to write letters to him describing their plights. More than 8,000 letters a day arrived at the White House - many accusatory and fiery. Doc described why this approach worked, and how it might be one of the strategies considered to make people feel that they are being heard. FOLLOW DR. It’s one thing Democrats and Republicans can agree is long overdue. Meanwhile, health insurance scammers have blitzed the internet with ads for bogus Trumpcare plans. Google – surprise, surprise – is among those profiting. And lastly, Donald Trump’s campaign has wasted a boatload of money, according to a review of expenditures. But at least they got Don Junior’s stupid book onto the bestseller list. THESE ARE THE STORIES YOU NEED TO KNOW: Antitrust: Feds sue Google The Justice Department sued Google yesterday, saying the company has an illegal and abusive monopoly over internet search technology. It is the first antitrust case against Google to result from yearslong investigations into the company’s conduct by the DOJ, Congress, and the states. Eleven state attorneys general, all Republicans, joined the suit. Attorney General Bill Barr reportedly wanted to bring the case before the November election to please Donald Trump, who has vowed to take on Big Tech. According to the New York Times, the government says Google is illegally protecting its dominant position in the market for search with the deals it has struck with companies like Apple. For example, Google pays Apple billions of dollars a year to have its search engine set as the default option on iPhones. To prevail, the Justice Department has to show two things: that Google is dominant in search, and that its deals with Apple and other companies hobble competition. Although those seem like easy things to prove, the case is likely to take years. Democrats have also sought to counter Google’s monopoly market power. Rhode Island Congressman David Cicilline, the chairman of the top competition-focused panel in the House of Representatives, told the Washington Post QUOTE antitrust enforcement against Google is long overdue ENDQUOTE. The Post reports that a handful of states including Colorado, Iowa, Nebraska and New York issued a joint public statement yesterday indicating they are still scrutinizing a wide array of Google’s business practices and may opt to join any federal case later. The more the merrier! Trumpcare scammers fleece consumers There’s no such thing as Trumpcare. But an investigation by ProPublica reveals that thousands of Americans are getting scammed by online marketers selling junk health insurance plans using that name. Facebook and Google have run tens of thousands of ads in the past year containing false claims about health insurance reform and plans. The ads have been viewed some twenty two million times in that time, mostly in battleground states like Texas, Florida, and Ohio. Google even gave the misinformation prime real estate, with the ads as the top-listed results when people search for affordable health insurance. When people respond to the ads, they become sales leads. Then they get deluged with phone calls from brokers. The Affordable Care Act, known as Obamacare, requires most health insurance plans to provide minimal essential coverage, which includes preventive care, mental health care, maternity and more. The unconventional plans sold as Trumpcare are exempted from those requirements, but their weaknesses aren’t made clear to consumers. Far from it. Agents on commission often lie, saying Trumpcare is the new Obamacare. State regulators who spoke to ProPublica say catching scam brokers is like playing whack-a- mole, as those caught using abusive marketing tactics can simply incorporate under a new name and start all over again. Frank Pyle, director of market conduct enforcement for the Delaware Department of Insurance, told ProPublica that harsher penalties might put an end to the scams. Pyle said QUOTE You can fine these companies and they consider it the cost of doing business. But if you lock up their CEO in federal prison, they’ll think twice about harming our consumers. ENDQUOTE. A single-payer system would also solve the problem. Trump campaign bleeding cash A new review of Donald Trump’s election expenditures shows that by overspending in the early stages of the race, the campaign has weakened its position in the final stretch. The campaign has raised well over $1 billion since Trump took the White House in 2017 — and, as the Associated Press put it, set a lot of that money on fire. Among the examples of Trumpian profligacy flagged by the news agency: Trump bought a $10 million Super Bowl ad when he didn’t yet have a challenger. He tapped his political organization to cover exorbitant legal fees related to his impeachment. Aides made flashy displays of their newfound wealth — including a fleet of luxury vehicles purchased by Brad Parscale, his former campaign manager. Mike Murphy, a veteran Republican consultant, said the campaign spent its money on lifestyles-of-the-rich-and-famous activity by the campaign staff, and vanity ads that ran way too early. He added QUOTE You could literally have ten monkeys with flamethrowers go after the money, and they wouldn’t have burned through it as stupidly ENDQUOTE. Other moronic expenditures by Trump and the RNC include: — Nearly $100,000 spent on copies of Donald Trump Junior’s book “Triggered.” — Over $7.4 million spent at Trump-branded properties. — At least $35.2 million spent on Trump merchandise. — At least $14.1 million spent on the Republican National Convention, which was mostly online. — $1.6 million on TV ads in the Washington, DC, media market, an overwhelmingly Democratic area that Trump can’t win. But, of course, it’s where Trump himself watches the tube. Hey, whatever keeps the boss happy... AND NOW FOR SOME QUICKER QUICKIES: Politico reports that Joe Biden’s transition team is vetting a handful of Republicans for potential Cabinet positions. The names being floated include former Ohio Governor John Kasich, Massachusetts Governor Charlie Baker, and Meg Whitman, the former CEO of eBay and now CEO of Quibi. It’s not great news for progressives, but maybe the vetting process will sort out once and for all the question: What on earth is Quibi? A Miami police officer was photographed at a voting site wearing a “Trump 2020” mask yesterday. Steve Simeonidis, the chairman of the Miami-Dade Democratic Party, took the photo of Miami police department officer Daniel Ubeda and posted it online, calling it QUOTE city funded voter intimidation ENDQUOTE. The South Florida Sun-Sentinel reports that Ubeda’s superiors were quick to call the political display unacceptable and a violation of department policy. Of course, they declined to say exactly how he’d be disciplined. Death from drug overdoses are up and may reach an all-time high this year, the AP reports. Addiction experts blame the pandemic, which has left people stressed and isolated, disrupted treatment and recovery programs, and contributed to an increasingly dangerous illicit drug supply. Please remember, friends, we’re all in this together. Nigeria’s largest city, Lagos, is under a twenty four-hour curfew after large crowds attacked two prisons and freed some two thousand inmates. Protests began two weeks ago after a video circulated showing a man being beaten by police. The AP reports that protesters are demanding an end to abuses and respect for human rights in all parts of the police force. Is it really too much to ask? Apparently so. What happens when no one is watching our children?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Patty Dailey Lewis, Executive Director of the Beau Biden Foundation for the Protection of Children, to discuss a little-discussed consequence of the Covid-19 pandemic: the increased threat to children. With children at home, that means more children spending more unmonitored time in unsafe home environments.  As children spend more time on-line, there is also an increased danger from internet predators.   The Beau Biden Foundation’s mission, carrying on the legacy of the late former Delaware Attorney General and son of former Vice President Joe Biden, is to prevent child abuse and crimes against children through effectively educating adults and children, to develop the next generation of child welfare professionals and to strengthen child protection laws around the country. Aaron and Patty discuss increasing concerns about internet safety and online predators, the growing threat to children in unsafe home environments, the importance of parents educating themselves and their kids, and the crucial role of conversation, expectation, and heightened awareness.   What happens when the eyes of the world aren’t watching anymore? Patty explains that 9 in 10 victims are abused by someone they know or trust, emphasizing that we are all home now as result of the pandemic, and that reporters of abuse often are educators and medical professionals. Patty says that reports of abuse have plummeted… but that doesn’t mean the abuse has stopped but more likely is because teachers and health care providers are spending far less time with eyes-on these at-risk kids. Aaron and Patty talk about what we can do to help children and to stop abuse, as well as the Foundation’s available resources for guidance, education, and prevention.   Prior to her position at the Foundation, Patty served as Deputy Attorney General and Director of the Family Division of the Delaware Department of Justice. A passionate advocate for children, Patty has worked in the field of family and child advocacy since 1985. She has served as a commissioner on the Child Protection Accountability Commission, the Governor’s Steering Committee for the Protection of Children, the Victims Advisory Council, and more. A big problem today in schools is how they can be so different in their approach to IEP teams and their approach to inclusion. How are the Administrators, the Principals, and the Directors of Special Education addressing their programs? What are their philosophies on inclusion and special education, and how are they setting the stage for their teachers? How are we going to reform the education system that seems to have so many problems? Amanda and Vickie discuss all these questions and more with today’s guest, Dr. Jackie Wilson, from the Delaware Department of Education. Dr. Wilson discusses her 40-year career in education, her position as the Director of the Delaware Academy for School Leadership, and the Special Education Administrative Leadership (SEAL) Program, an innovative way to train those administrators who are in charge of Special Education programs at the local level. Dr. Wilson was integral to the development of the program and her passion for the children it affects is apparent. She will be invited back at year-end to discuss the results of the program and how neighboring states might benefit from creating and implementing similar training. Show Highlights: Dr. Wilson shares the history and an overview of The Special Education Administrative Leadership (SEAL) Program. In developing SEAL, her department looked for ways to work with current policy to leverage it and to not see policy as a barrier to doing good work. If it was a barrier, then it needed to be changed. There were two strong partners in the development of the SEAL Program:  The Center for Disability Studies, experts in Special Education. The Department of Education, the regulators. This program is accepting applications now to begin classes in the Fall.  The 18-month program will lead to Delaware Certification as a Special Education Director. For this year, there will be no charge. For next year, the charge will be about half of what it would be to go get a Master’s or Doctorate for this program. It’s important to design a set of competencies about what you want people to know and to be able to demonstrate at the end of training. We need to build a group of Directors who understand they must educate their Principals, who are those leading the Special Education support with their teachers. Dr. Wilson addresses the benefits of early intervention. A parent should be an advocate, a collaborator and feel like they’re a part of the IEP team. The “Professional Learning Network” is where 10 school teams in Delaware come together and network, and discuss what works and what doesn’t. The Directors in the SEAL program will be learning the law but they will also be learning instruction and how kids, particularly children with learning disabilities, learn. Ian “Jahiti” Smith is a community activist, musician, teacher, and youth advocate who is committed to helping build stronger communities and fostering real change in Wilmington. Since his arrival in Wilmington, Ian has been involved in criminal justice reform and works with the most at-risk youth. Ian also serves as a founding member of Innocence Delaware, which works to exonerate the wrongfully accused. His work within social justice has brought about real change at the individual, community, City, and State level. Currently, Ian is the Director of Delaware’s Youth Advocate Programs (YAP), an organization that provides re-entry support to juveniles returning to the community from Delaware’s secure placement facilities. Under his leadership, since 2016, the program has grown to a staff of 16 advocates serving over 150 youth versus 2 advocates serving 2 youth at the time he took over the program. Through his efforts, a grant was awarded to YAP through the Criminal Justice Council allowing his work to expand to at-risk youth in elementary schools. He recently began a partnership with the Delaware Department of Health and Social Services, Johns Hopkins and the Urban Institute, working with low-income youth participating in the Youth Employment Study. Ian serves passionately as the elected Vice-President of the Browntown Civic Association. In addition to his professional work, Ian has donated his time and musical talents to numerous community organizations geared towards strengthening the City of Wilmington. His passion for serving began in college. After receiving his degree in Social Science with a minor in Political Science, from Coppin State University, Ian began volunteering for various communities and national organizations, such as the Baltimore Area Council, Boy Scouts of America, where he learned the fundamentals of community organizing, grassroots planning, fundraising, and civic leadership. As a recognized activist in Baltimore, Ian was acknowledged by then-Mayor Stephanie Rawlings-Blake and current City Council President Brandon Scott for his work with the 300 Men Movement, an elite male, volunteer unit which conducted violence deterrence walkthroughs in targeted high-crime neighborhoods. Throughout his career, Ian has been a key influencer, building relationships with individuals and community organizations in order to generate meaningful resources for families and neighborhoods. He will bring that same drive, integrity and commitment to his role as your City Councilman. It is because of his decades of experience, hands-on work with the most vulnerable individuals and families, and dedication to various community organizations that Ian is confident in his ability to affect meaningful change as the next Councilman for the Sixth District. Ian and his wife live in Browntown with their two miniature poodles, Ming and Charlie, and are loving godparents to their 5 godchildren, nieces and nephews.

Through the program she obtained a Master of Secondary Education degree and graduated summa cum laude.Brittany Lewis is currently a Ph.D. candidate in the History Department at George Washington University. She specializes in African-American (colonial to present), urban, and twentieth-century United States history with an emphasis on social movements, political ideology, and the nation- state. Since her time in graduate school, she has worked as the chairperson of the George Washington University branch of the DC History Graduate Student Association, social media chair of The Activist History Review (TAHR), member of the Edward A. Bouchet Graduate Honor Society, member of the Black Graduate Student Association, and Graduate Student Labor Union. Brittany is the recipient of George Washington University’s Herber Prize for Best Teaching. She is also an adjunct professor of Ethnic Studies at Wilmington University.Brittany was crowned Miss Delaware for the Miss America Organization in 2014 and Miss Black American 2017. She was awarded more than $35,000 in scholarships during her reign. During her pageant career she advocated for Domestic Violence Awareness after losing her sister to domestic violence in 2009. She has worked alongside former Governor Jack Markell, Delaware Department of Justice, the National Coalition Against Domestic Violence, and National Network to End Domestic Violence.In addition to her academic and pageant endeavors, Brittany is a a member of Alpha Kappa Alpha Sorority, Inc. and a left-leaning political commentator on the Armstrong Williams show. Are you a parent of a college student or an educator dealing with campus conflict? Maybe YOU are a student who's gotten into some trouble on your campus? If so, this shows for you. We spoke with Dr. Nancy Giacomini and Jennifer Meyer Schrage, J.D., editors of their new book "Reframing Campus Conflict: Student Conduct Practice through a Social Justice Lens." Giacomini and Schrage addressed how the culture and diversity of the student population have changed over the years, and how unfortunately, the system for dealing with student conduct and conflict incidents has becoming increasingly legalistic. How do we re-frame campus conflict so that it is inclusive, fair and is an alternative to the costly legal system? Nancy Geist Giacomini, Ed.D. is a private educator, mediator, facilitator, and author based in Chester County, PA. Nancy completed her Educational Leadership Degree at the University of Delaware while a Conflict Resolution Program (CRP) Associate in the Institute for Public Administration. She taught in the Master’s Program, mediated special education disputes for the Delaware Department of Education, and facilitated state-wide dialogue.   Jennifer Meyer Schrage, J.D. provides leadership to the Office of Student Conflict Resolution (OSCR) within the Division of Student Affairs at the University of Michigan. During her tenure at UM, Jennifer led the OSCR Team in departmental realignment and championed a nationally recognized full-spectrum menu of conflict resolution pathways, including mediation, restorative justice, and related innovative methods. This Spectrum Model was introduced at the 2008 Gehring Academy (Schrage & Thompson, 2008), featured at the 2009 annual conference and has evolved into a collaborative publication due out this summer.
