The biggest bribery investigation in US military history revolves around a Malaysian defense contractor who just made an escape as brazen as the case itself: Leonard Francis aka Fat Leo snipped off his ankle monitor and disappeared from house arrest.We're talking about the case of Leonard Glenn Francis, a defense contractor who owned a company named Glenn Defense Marine Asia, or GDMA for short. He bribed his way literally to the top of the US Navy chain of command, and the fallout included an admiral who was short-listed for chairman of the joint chiefs of staff, but now is the first serving admiral to be convicted and serve jail time in US history. His father's abuse of his mother, both physical and emotional, led to Leo having the same duality of obsession with and dislike of women. Like his father, this would ultimately be Leo's undoing, as the angry wives of US Navy officers like Michael Misiewicz were the ones who provided the initial reports to the NCIS which began the Fat Leonard investigation into the US Navy Pacific fleet chain of command. 2 Leo grew from scrappy husbanding agent to preferred military contractor between the time of the USS Cole bombing and 9/11, by providing whatever "services" the US Navy officers he dealt with wanted. Women, booze, parties, hotel suites, 5 star meals... Leo could get it if you wanted it, as long as you had some influence in the US Navy that could turn Leo a profit down the line. Leo even procured a former British ship, which he renamed "The Braveheart", to serve as a floating brothel-slash-casino which followed the 7th fleet around the south Pacific with diplomatic clearance. Even when NCIS caught wind of Leo's exploits, he was difficult to prosecute both because of the reach of his influence within the chain of command, and because Leo also had the NCIS director at Quantico, Virginia on his payroll. As it turned out, special agent in charge John Beliveau had befriended Leo when he was a security aide to an admiral in Japan years before. In fact Leo was so problematic to prosecute that he wasn't... earlier this month he removed his ankle monitor and disappeared from his San Diego home. As it turns out the security company contracted to look after him wasn't doing their job very well either, they hadn't been to his home in days and didn't notice the tampering with the ankle monitor for 6 hours. 3 Leo was due to be sentenced tomorrow, but he's now on the run. In this episode we examine a unique type of reporting called investigative journalism, requiring unbridled courage, integrity and sacrifice from certain journalists to bring stories of major significance to public attention. In their role as watchdogs, investigative journalists play a crucial role in placing greater scrutiny on the abuses of power and influence. One of the most famous examples in recent memory includes “The Watergate Scandal” in 1972, which led to the resignation of President Richard Nixon in 1974. However in this episode, we focus on the crusading work of one such journalist, Gary Webb and his subsequent demise at the hands of the established elites of his own industry. He was an award winning investigative journalist best known for his 1996 series of articles in the San Jose Mercury News, entitled “Dark Alliance-The Story behind the Crack Explosion.” Webb's expose revealed that the CIA helped to initiate America's crack cocaine epidemic in the early to mid 1980s. This elaborate scheme involved drug traffickers linked to the Contras (a CIA-backed guerrilla army in Nicaragua) who were plotting an attempted coup of the socialist Sandinista government. The proceeds of this illicit operation were used to fund the contras, while the imported cocaine worth millions of dollars were destined for the most impoverished cities in America. His series sparked public outrage, not only about the American government's role in drug trafficking, but also because low income black neighbourhoods, in the south-central area of Los Angeles were the prime targets. It made a mockery of the US government's highly celebrated “war on drugs” policy at home and abroad. We examine the mainstream media's initial disregard for the story, followed by the outright attack from the “Big Three” major dailies. Webb's story was discredited with allegations of shoddy reporting and poor editorial practices at the Mercury News. But even more damaging were accusations that “Dark Alliance” was nothing more than a conspiracy theory and the work of an irrational fantasist. Webb's series was also attacked for lighting the fuse on a widespread sentiment known as “Black Paranoia.” This referred to a federal conspiracy to undermine inner city Black-American neighbourhoods during the 1980s. Also of interest, is how the CIA manipulated its “productive relations” with the press, using its media assets to undermine “Dark Alliance.” We then outline the subsequent demise of Gary Webb, as a result of the shameful attack on his story and subsequent public humiliation. In the final section we explain how Webb's character assassination was enacted by “weaponizing” the journalistic profession via the concept of legitimacy and autonomy. This raises troubling questions about its legitimacy as a professional platform of discourse and the authority of its “moral badge” of ethics and protocols, which stem from the depth of its obsequiousness and unremitting pursuit of power and status.

Guitarist and composer DJ Sparr joins us to chat about the central role that the relationships built in school play in securing future work. He shares about his experience performing Kenneth Fuch's Electric Guitar Concerto with JoAnn Falletta and the London Symphony Orchestra and the difference between performing his vs. others' works. We also talk about the typical day-to-day schedule of a performer-composer, and working this into family life. Electric guitarist and composer D. J. Sparr, who Gramophone recently hailed as “exemplary,” is one of America's preeminent composer-performers. He has caught the attention of critics with his eclectic style, described as “pop-Romantic…iridescent and wondrous” (The Mercury News) and “suits the boundary erasing spirit of today's new-music world” (The New York Times). The Los Angeles Times praises him as “an excellent soloist,” and the Santa Cruz Sentinel says that he “wowed an enthusiastic audience…Sparr's guitar sang in a near-human voice.” He was the electric guitar concerto soloist on the 2018 GRAMMY-Award winning, all-Kenneth Fuchs recording with JoAnn Falletta and the London Symphony Orchestra. In 2011, Sparr was named one of NPR listener's favorite 100 composers under the age 40. He has composed for and performed with renowned ensembles such as the Houston Grand Opera, Cabrillo Festival, New World Symphony, Washington National Opera, and Eighth Blackbird. His music has received awards from BMI, New Music USA, and the League of Composers/ISCM. Sparr is a faculty member at the famed Walden School's Creative Musicians Retreat in Dublin, New Hampshire. His works and guitar performances appear on Naxos, Innova Recordings, & Centaur Records. D. On Thursday Jon Wilner of Mercury News reported that USC and UCLA are planning on joining the Big Ten as soon as 2024. This news sent massive shockwaves throughout the college football landscape as well as college athletics overall. Now Oregon fans find themselves asking, what does this mean for the Ducks? Do they try to join the Big Ten? Does the Big Ten even want them? Should they try to join a different conference? What about going independent? Max Torres and Graham Metzker take an early look at where this move leaves Oregon and the options that are on the table right now. The Ducks look like a very attractive school for any conference given their obvious connection with Nike and their strong football history, albeit much of it is a lot more recent than many of the sport's blue bloods. Dan Lanning's first year as a head coach also feels like it's taken on a much more significance, as Oregon's path to the playoff would likely become harder if the Ducks were to join the Big Ten. Hells Angels founder Sonny Barger has died at the age of 83 after battling cancer. The biker, of California, passed away peacefully surrounded by his wife Zorana and relatives on June 29. A statement on his Facebook page read: “If you are reading this message, you'll know that I'm gone. I've asked that this note be posted immediately after my passing. “I've lived a long and good life filled with adventure. And I've had the privilege to be part of an amazing club.” He told fans to “stay loyal, remain free, and always value honor”. Intro.(1:35) - Start of interview.(2:22) - David's "origin story". He grew up as an "army brat" including living in Germany for about 10 years. He went to high school in West Point, NY. He stayed to go to college in Buffalo, where he also got his MBA. He left the Army and came to CA, where he ran IT for a company. He eventually went to law school first to Santa Clara, and then to UC Davis.(4:17) - His experience joining Fenwick in 1997, "in the front-end of the dot-com boom getting started." "I learnt a lot in the bubble years, and it was a tremendous advantage to my career to have done that early on."(5:32) - On the origin of Fenwick's Corporate Governance Surveys (published externally starting in 2007). "It was started to provide more than anecdotal advice to clients." The Mercury News published the SV150 List (a list of the largest Silicon Valley companies measured by revenue), and the idea was to compare and contrast that list with the S&P 100 (comprising 100 major blue chip companies across multiple industry groups.)(11:41) - On boardroom diversity: The percentage of women directors is now almost identical for the SV150 (30.3%, up from 25.7% in 2020) and S&P 100 (30.2%, up from 28.7% in 2020). On the impact of institutional investors in this change, SB-826 and AB-979 in CA, and the Nasdaq's diversity rule. "Silicon Valley had been behind in gender diversity. Institutional investor attention was the largest driver of increasing gender diversity on boardrooms."(16:15) - On dual-class share structures. The adoption of dual-class shares has emerged as a recent clear trend among Silicon Valley technology companies (from 2.9% in 2011 to 21.3% in 2021, as opposed to S&P 100 that where it decreased from 9% in 2011 to 8% in 2021). Per Prof. Jay Ritter data, 46.2% of all 2021 tech IPOs had dual class share structures.(23:05) - On the prevalence (and complexities) of dual-class share structures in private companies.(26:43) - On directors getting more than one vote ("disproportionate voting rights amongst directors"). Note DGCL 141(d).(29:17) - The Peloton case and how dual-class shares may impact shareholder activism.(31:46) - On sunset provisions for dual-class shares. "The Council of Institutional Investors' 7-year sunset provision is not convincing, 10-12 years is more convincing due to a variety of factors, including investments in R&D and traditional growth horizons."(35:11) - On staggered (or classified) boards: Over the period from 2004 through 2021 proxy seasons, staggered boards have dropped from around 45% to just 3% in S&P100, while they have increased to 52.1% in SV150 companies. "This is a perfect example of why 'best practices' are not equivalent ("there is no one-size-fits-all") in large cap and smaller cap companies." "This reflects the reality that one of the principal reasons for classification, as a takeover defense, is less compelling for some larger companies due to the sheer size of the companies and relative dispersion of their stockholdings."(39:54) - On majority voting. "The rate of implementation of some form of majority voting among S&P 100 companies has risen from 10% to 96% between the 2004 and 2021 proxy seasons. Among the technology and life sciences companies in the SV 150, the rate has risen from 0% as recently as the 2005 proxy season to 56.3% in the 2021 proxy season." "I don't see a lot of data that says that [majority voting] has much of an impact one way or another." "Zombie directors is a nice soundbite, but it's somewhat of an unfair pejorative."(45:09) - On the "stay private vs. go public" debate. "The relative success of companies that have gone public with dual-class share structures has informed the market of what is more or less acceptable." "There are a variety of choices that can be used to go public." "There is a lot of psychic, morale and social value in going public: it's still part of the dream in Silicon Valley to go public." "Liquid currency is a good thing too, particularly for growth via acquisitions." "I do expect this year 2022 to be a lower year for IPOs... the volatility is very high. was an American investigative journalist. He began his career working for newspapers in Kentucky and Ohio, winning numerous awards, and building a strong reputation for investigative writing. Hired by the San Jose Mercury News, Webb contributed to the paper's Pulitzer Prize-winning coverage of the Loma Prieta earthquake. Webb is best known for his "Dark Alliance" series, which appeared in The Mercury News in 1996. The series examined the origins of the crack cocaine trade in Los Angeles and claimed that members of the anti-communist Contra rebels in Nicaragua had played a major role in creating the trade, using cocaine profits to finance their fight against the government in Nicaragua. It also stated that the Contras may have acted with the knowledge and protection of the Central Intelligence Agency (CIA). The series provoked outrage, particularly in the Los Angeles African-American community, and led to four major investigations of its charges.

In this episode we examine a unique type of reporting called investigative journalism, requiring unbridled courage, integrity and sacrifice from certain journalists to bring stories of major significance to public attention. In their role as watchdogs, investigative journalists play a crucial role in placing greater scrutiny on the abuses of power and influence. One of the most famous examples in recent memory includes “The Watergate Scandal” in 1972, which led to the resignation of President Richard Nixon in 1974. However in this episode, we focus on the crusading work of one such journalist, Gary Webb and his subsequent demise at the hands of the established elites of his own industry. He was an award winning investigative journalist best known for his 1996 series of articles in the San Jose Mercury News, entitled “Dark Alliance-The Story behind the Crack Explosion.” Webb's expose revealed that the CIA helped to initiate America's crack cocaine epidemic in the early to mid 1980s. This elaborate scheme involved drug traffickers linked to the Contras (a CIA-backed guerrilla army in Nicaragua) who were plotting an attempted coup of the socialist Sandinista government. The proceeds of this illicit operation were used to fund the contras, while the imported cocaine worth millions of dollars were destined for the most impoverished cities in America. His series sparked public outrage, not only about the American government's role in drug trafficking, but also because low income black neighbourhoods, in the south-central area of Los Angeles were the prime targets. It made a mockery of the US government's highly celebrated “war on drugs” policy at home and abroad. We examine the mainstream media's initial disregard for the story, followed by the outright attack from the “Big Three” major dailies. Webb's story was discredited with allegations of shoddy reporting and poor editorial practices at the Mercury News. But even more damaging were accusations that “Dark Alliance” was nothing more than a conspiracy theory and the work of an irrational fantasist. Webb's series was also attacked for lighting the fuse on a widespread sentiment known as “Black Paranoia.” This referred to a federal conspiracy to undermine inner city Black-American neighbourhoods during the 1980s. Also of interest, is how the CIA manipulated its “productive relations” with the press, using its media assets to undermine “Dark Alliance.” We then outline the subsequent demise of Gary Webb, as a result of the shameful attack on his story and subsequent public humiliation. In the final section we explain how Webb's character assassination was enacted by “weaponizing” the journalistic profession via the concept of legitimacy and autonomy. This raises troubling questions about its legitimacy as a professional platform of discourse and the authority of its “moral badge” of ethics and protocols, which stem from the depth of its obsequiousness and unremitting pursuit of power and status.

Welcome to Truthspresso Express! This is where I record an episode on my commute to or from work. I recorded this episode on Monday, September 20th. I "celebrate" the official first release day of "booster shots" by recalling two articles I read the night before. The first article was about how recent studies are showing that the effectiveness of certain COVID vaccines are waning. Moderna seems to be a little better than Pfizer. The most recent study shows Pfizer as low as 42% effective against the current Delta variant. The article highly recommended "booster shots" but ultimately concluded that future effectiveness still depends on how any individual immune system wants to handle injections or infections. The second article sugar coated the FDA's overwhelming down vote on political pressure to approve Pfizer "booster shots" by mentioning that the FDA "approved" such shots for certain older patients or some who have serious risks. Do we really expect to handle a coronavirus pandemic with indefinite, periodic jabs of mRNA? What could be some potential side effects from too many of these shots? Sources Consulted: Lisa M.
