26 years ago, before the election of George W. Bush in 2000, I wrote, produced and starred in a show about the history of the campaign song, called "Muckrakers," with the fabulous Linda Kerns. Given that this bicentennial election season is heating up, I thought it'd be fun to revisit some songs from elections past…Let's look at one from 1856...Some background: in 1854 was “Bleeding Kansas” - a bitter dispute between pro and anti-slavery forces over that territory, which led to the break up of the two major parties and the formation of a new one — THE REPUBLICANS — who vowed to oppose any further extension of slavery. But, THE DEMOCRATIC WINNER OF THE 1856 ELECTION WAS….?Many people consider him the WORST president we've ever had (until now) - because he might have prevented the Civil War, and he blew it. I'll give you a hint: he was a bachelor - girl he was engaged to as a youth committed suicide. One eye was nearsighted, the other far - so he held his head a a funny angle….Got it? He was the quote: “most available, and most unobjectionable JAMES BUCHANAN, former Secretary of State to Polk, who once called him “an able man,” but added that, “he sometimes acts like an old maid.”Nevertheless, Bucky won big! Carried every Southern state, except Maryland and six free states - proving that the majority still put the preservation of the Union above all else. And, that is exactly what Stephen Foster's WHITE HOUSE CHAIR urged the voters to do.

This Day in Legal History: Mexican-American WarOn May 13, 1846, Congress approved President James K. Polk's request for a declaration of war against Mexico, formally beginning the Mexican-American War. Polk had told Congress that Mexico had “invaded our territory and shed American blood on American soil,” after a clash between Mexican forces and American troops near the Rio Grande. The problem was that the land where the clash occurred was disputed: the United States claimed the Rio Grande as the border of Texas, while Mexico maintained that the border was farther north at the Nueces River. Congress accepted Polk's framing and passed the war declaration, but the vote did not settle the legal question of whether the president had maneuvered the country into war. Many Whigs saw the conflict not as a defensive war, but as a war of expansion designed to seize Mexican territory.One of the sharpest critics was a young Whig congressman from Illinois, then serving his only term in the House of Representatives. In December 1847, a one Abraham Lincoln introduced what became known as the Spot Resolutions, demanding that Polk identify the precise “spot” where American blood had supposedly been shed. Lincoln wanted to know whether that spot was truly American soil, or whether U.S. troops had been sent into disputed territory first. In one of the resolutions, he asked whether “the particular spot of soil on which the blood of our citizens was so shed” was actually American soil at the time. The challenge was simple but devastating: if Polk could not prove the location was within the United States, then his legal justification for war began to fall apart.Lincoln's attack did not stop the war, and it made him unpopular with many voters who thought he was undermining American soldiers in the field. Critics even mocked him as “Spotty Lincoln.” But the episode revealed an early version of the Lincoln who would later become president: a lawyer-politician who focused on the exact words used to justify government power. The May 13 declaration therefore stands not only as the beginning of a war, but as an early constitutional fight over presidential war-making, disputed borders, and whether Congress had been asked to approve a war on a false premise.Texas has sued Netflix in state court, accusing the company of misleading subscribers about how it collects and uses viewing data. The lawsuit claims Netflix built its reputation by presenting itself as a paid, ad-free alternative to companies that rely heavily on user tracking and advertising. According to Texas, Netflix nevertheless collected large amounts of information about what users watched, how they browsed, and how they interacted with the platform.The state alleges that Netflix profited from that data by using it for advertising and sharing or selling it to outside companies without proper consent. The petition also criticizes features such as autoplay, describing them as design choices that push users toward binge-watching by removing natural stopping points. Texas further claims that Netflix marketed itself as family-friendly while still tracking children's viewing and browsing behavior, even if it has not yet targeted children with ads. Attorney General Ken Paxton said the company misrepresented itself as safer and more privacy-protective than it really was.The lawsuit brings claims under the Texas Deceptive Trade Practices Act and seeks civil penalties, an injunction, and an order requiring Netflix to delete data allegedly collected through deceptive practices.Texas Sues Netflix Over ‘Staggering' Data Logging - Law360Federal prosecutors have brought the first criminal charges against companies involved in operating the M/V Dali, the container ship that struck Baltimore's Francis Scott Key Bridge in March 2024. The indictment names Singapore-based Synergy Marine, India-based Synergy Maritime, and Radhakrishnan Karthik Nair, who served as technical superintendent for the ship. Prosecutors accuse them of recklessly operating the vessel, falsifying inspection records, failing to report a hazardous condition to the Coast Guard, obstructing agency proceedings, and lying to National Transportation Safety Board investigators. The crash killed six construction workers, destroyed the bridge, disrupted access to the Port of Baltimore, and allegedly caused billions of dollars in economic losses. According to prosecutors, the Dali had electrical and mechanical problems that made it vulnerable to blackouts, and Synergy employees improperly used a flushing pump as a regular fuel supply pump for generators.The government claims that if the proper pumps had been used, the ship could have regained power in time to avoid the bridge. The indictment also includes environmental allegations tied to pollutants released into the Patapsco River, including oil, shipping containers, and bridge debris. Synergy denies wrongdoing and says the Justice Department is wrongly treating a tragic accident as a crime. The company argues that the crash was caused by a loose wire, consistent with the NTSB's findings, and says the DOJ's theory conflicts with maritime experts' conclusions. Separate civil litigation over liability is still moving forward, including claims by Maryland, Baltimore, cargo interests, insurers, and others. Planning for the Key Bridge replacement is underway, with the new bridge expected to cost between $4.3 billion and $5.2 billion and be completed by late 2030.Ship Managers Indicted Over Baltimore Bridge Disaster - Law360In my column for Bloomberg this week, I wrote about how Congress made the adoption tax credit partially refundable beginning in 2025, a change that could help families manage the high costs of adoption. The policy is meant to make the credit more useful when families actually need the money, since adoption can involve major expenses such as agency fees, legal bills, travel, and other costs that arrive long before any tax benefit is received. But refundable credits also raise fraud concerns for the IRS because they can result in direct payments from the government.The column warns that the IRS may respond by delaying refunds, issuing broad documentation requests, and placing legitimate families through lengthy reviews. That concern is based on what happened in 2010 and 2011, when the adoption credit was fully refundable and the IRS subjected many claims to extra scrutiny. During the 2012 filing season, 90% of returns claiming the credit received additional review and 69% were selected for audit. Adoption claims are often complex, not suspicious, because they can involve international agencies, state courts, amended documents, failed placements, special-needs rules, and unusual expense records. The IRS should issue clear guidance before filing season so families know what documents they need to submit with Form 8839.It should also create a standardized checklist or attachment and a dedicated review track staffed by employees trained on adoption-credit rules. Without better guidance and staffing, the refundable portion of the credit may become less useful because families could face audits, professional fees, delayed refunds, or fear of claiming the benefit at all. In Part 2, we pick up right where we left off in Part 1, with Gina's first official address in San Francisco. In talking about finding a place to live in The City, Gina mentions that all her friends either live in rent-control apartments they've been in forever, or they're able to live in a place that someone in their family bought and has kept in the family. When she tells me where that first apartment in SF was, I let her know that my first place here, back in 2000, was less than a block away. As we're name-dropping hotspots on the block, I have a brain fart and can't remember the name of Cordon Bleu, the rad greasy-spoon Vietnamese joint still there on California near Polk. From that first apartment, Gina would take Muni to her job over in Potrero Hill. Back then, in the days before smartphones, she'd read on her long, chill Muni rides. She'd come home, make dinner with her roommate, and maybe head out to Polk Street or for karaoke in the hood. That AmeriCorp VISTA gig lead to a job doing literacy work. At that part-time job, Gina also started doing events. She also ran a non-profit dance company, and was trying her best to make both things work out for her. We step back to talk about Funkanometry SF, Gina's dance company. It started in LA, moved north, and the founders handed Gina the keys, so to speak. That happened in Gina's senior year at Berkeley. Because the dancers she was directing were older and more experienced, and because she had literally no experience running a non-profit or a business, she went to Barnes and Noble to buy a copy of a book from the "For Dummies" series. In Gina's time running it, Funkanometry took off. They received invitations to perform internationally, to places like the Philippines, the UK, and Colombia. On the back end, Gina figured out a way to pay herself $600 a month. She felt like she'd made it. Despite all those successes, though, the company didn't make money. The low-paying, part-time job and non-profit dance company was fun, but it wasn't meant to last. She got hit up on LinkedIn by a recruiter for Google and got an interview. Gina had reservations and talked with her mom about them. Lillian told her to daughter to go and listen to what they have to say, and so that's what Gina did. After the interview, she still didn't know if it was a good fit, but she accepted the offer regardless. She was now a software engineering recruiting coordinator at Google. To get to work, Gina took the infamous Google bus. As someone from The Bay who already had immense pride in her city, she felt ashamed. The money was good, but standing in line to wait for the hated busses felt bad. When cars or pedestrians passed by while she waited, she wanted to let them know that she wasn't "one of those people," that she's from here and runs a non-profit dance company. It didn't matter. Her internalized shame remained, but she says the job was fun enough to make up for it. That Google contract job turned into full-time work, and Gina stayed at the company for seven years. During this time, Gina met and started dating a San Franciscan who grew up in the Inner Richmond. They got engaged and Gina moved to that hood. She still worked at Google and now waited for their corporate bus in a chiller area with fewer protests. Then Gina's family suffered a tragic loss. One of her first cousins died by suicide. She says the experience "broke [her] family open," meaning it obviously hurt them all, but it also brought them closer. It made waiting for the Google bus that much more impossible for Gina, too. She'd moved into a new role at the company and was doing events for them. She decided it was time to branch out on her own and do what she loves. She was able to go part-time while launching her own events company. She'd tried to quit, but Google asked her to stay on. It ended up serving her well, as it provided some needed income while she undertook all the stuff it takes to start a company from scratch. The first event she produced under her new moniker, Make It Mariko, was Undiscovered SF, which began in 2017 as the first Filipino night market in SOMA. The first Undiscovered SF was such a success that it inspired Gina to transition Make It Mariko to her full-time work. The stories goes like this: A friend let her know about the nonprofit SOMA Pilipinas. She met with those folks and pitched a launch event. They applied for and received a $5K grant to do the event. A friend was able to wrangle $150K on top of that. That one launch event turned into six events, spaced out one per month. In 2020, Undiscovered SF went virtual. Gina had her tech background, and they had plenty of time to transition. This allowed them to connect Filipinos across the diaspora, sitting on panels and interacting with one another. And of course, there were DJs from all over. Prior to the pandemic, in addition to many other kinds of events, Make It Mariko had quite a lot of corporate event-planning business. Since COVID, though, a lot of that went away. Gina decided she wasn't gonna sit around and wait for big events to hire her company. She wanted to build on the success of self-produced events like Undiscovered. The seeds of what became POC Food and Wine were planted. Gina loves wine. During the pandemic, she got a scholarship to join a wine program where she was able to dive into that world. One of the topics was pairing, and so she was able to take that knowledge and apply it to the POC Food and Wine Festival, pairing POC chefs with specific wines and other beverages. Attendees were encouraged, but not required, to navigate the space and its makers along the lines laid out for them by Gina and her staff. I'll just say: It was one of the best, most unique experiences I've had in my 26 years here in the Bay Area. We end the episode with me letting Gina know how much I also enjoyed this year's Love Thy City event, which took place in February. It was to celebrate Make It Mariko's 10th anniversary and to establish a relationship with The Foundary space in South of Market. The love (right there in the name) that night was palpable—love of San Francisco, of community, of one another. All of these events—Undiscovered, POC Food and Wine Festival, Love Thy City—for me show how dedicated Gina and her people are to uplifting real people doing extraordinary things. This is the second episode in a five-part series called The Corridor, following five separate encounter accounts submitted by five unconnected people across five different decades, all describing experiences along the same north-south ridgeline running from the Cohutta Wilderness in northern Georgia up through the mountains of eastern Tennessee.In Part Two, a woman named Karen shares an account from the summer of nineteen ninety-four. Karen was a seasonal employee with the United States Forest Service, assigned to maintain a decommissioned fire road along a ridgeline in the eastern part of Polk County, Tennessee. The road had been built decades earlier for timber access and fire suppression but had fallen into disuse, and Karen's job was to keep it from washing out entirely — clearing drains, cutting brush, removing blowdowns. She worked alone, driving a Forest Service pickup to the ridge each morning and spending six to eight hours on the road before heading home. The nearest paved road was about seven miles out by dirt track, and radio reception on the ridge was unreliable at best.Over the course of three weeks, Karen documented a series of findings that she logged in a field notebook with times, coordinates, and measurements. During her first week she discovered multiple hardwood trees snapped between six and nine feet above the ground, some with tops wedged into adjacent trees and at least one with a spiral fracture indicating the trunk had been twisted rather than broken by wind or ice. In her second week she began encountering a powerful organic smell at the same GPS coordinates on the road every afternoon, arriving consistently around four o'clock and dissipating within ten to fifteen minutes.At a creek crossing near the smell location she found bipedal tracks in soft mud measuring nineteen inches from heel to toe and roughly seven inches across the ball, with visible toe impressions and no claw marks, spaced in a walking pattern with an estimated stride of four and a half feet. In her third week she discovered handprints pressed into a clay bank alongside the road — large, with long fingers and a clear opposing thumb, significantly bigger than her own hand.The episode builds to the night Karen got a flat tire on the road after dark during her final week on the assignment. Alone, seven miles from pavement, with no cell phone and no radio reception, she knelt beside the truck with a lug wrench and a headlamp to change the tire.While she was working, she heard bipedal footsteps approaching on the gravel road from the north — steady, heavy, two-legged. The footsteps stopped approximately forty feet away and then began pacing back and forth across the road for roughly ten minutes. When Karen stood up, the footsteps stopped. Moments later she heard a single long exhale from the timber on the uphill side of the road, originating from above her own head height and close enough to hear clearly. As one of the co-owners of The Lodge Card Club, Doug Polk has played his fair share of crazy hands on their live poker stream, especially against fan favorite Taras! The two battle it out again on stream in a 3-bet pot, where Polk bluff raises Taras' river block bet. In poker cash games it is important to understand when to use a blocker bet, which is typically a small bet made on the river with a medium strength hand that does not want to face a large bet from your opponent. Blocker bets allow you to set your own price, extract thin value from worse hands, and reduce the likelihood of facing a big bet. But strong made hands and bluffs should also be used to keep your range balanced and help you to avoid being exploited. Doug Polk ‘WCGRider' is the owner of The Lodge Card Room along with Brad Owen and Andrew Neeme. Doug has won over $9,500,000 in live poker tournaments and 3 World Series Of Poker (WSOP) bracelets, including a win in the 2017 $100k Super High Roller for $1,600,000. Since 2014, he has played over 135 times on live streamed poker cash games and has won more than $900,000. Taras, whose real name is Taras Bobrovytsky, is a Canadian amateur poker player living in Texas. Taras is the Founder of Prediction Explorer and RandomWalk NFT, he is also known to be a software engineer and angel investor. He has been a regular at The Lodge for a long time and will play stakes from $5/$10 up to $400/$800. He is known to be very talkative at the table. Since 2022, he has played over 32 times on live streamed poker cash games and has won over $160,000. In early 2022, poker professionals Doug Polk, Brad Owen and Andrew Neeme joined forces to acquire a controlling stake in The Lodge Poker Club & Card Room, which happens to be the largest poker establishment in Austin, Texas. This exclusive poker club, accessible only to its poker members, boasts an impressive array of amenities, including over 80 poker tables of cash games and poker tournaments, operating around the clock. Additionally, The Lodge provides an inviting ambiance with 40 large screen TVs, allowing poker club members to enjoy sports entertainment whilst playing poker or while relaxing in the cozy waiting area. Preflop:From the hijack, Crypto Max raises with 87o to $500, as Doug Polk then 3-bets to $1,700 with T9 of spades. Taras, who was sitting in the under the gun straddle, decides to cold 4-bet with the poker solver approved hand, ace-five of diamonds. Crypto Max folds, as Polk calls in position with his suited connector. Flop – Ah Js Td:Taras flops best with top pair and a backdoor flush draw, so he chooses to fire a continuation bet of $4,100. Polk calls having flopped bottom pair, a backdoor straight draw, and a backdoor flush draw. Turn – 7h:With a weak kicker, Taras slows down and checks his pair of aces. Polk checks behind with his pair of tens and gutshot straight draw. River – Qc:The queen of clubs on the river means there is a one liner to broadway available. Taras puts out a block bet of $3,000 with his top pair, and is met by a raise to $9,000 from Polk, whose hand has now been downgraded to fourth pair.
