While governing boards need to be open to input and recommendations from their college, foundation, or system's stakeholders, they must also discern between what's appropriate and what could compromise their independence and their institution's mission and integrity. That's especially important these days, as political polarization is increasingly creating challenges for board members in fulfilling their fiduciary duties of loyalty, obedience, and care. AGB released a Board of Directors' Statement on Influences Impacting Governing Board Independence and Leadership in late 2023 to guide boards in the governance of their colleges, foundations, and systems; inform them of their roles and responsibilities; and clarify their relationships with those involved in the governance process. In part one of this two-part podcast, AGB Interim President and CEO Ellen Chaffee speaks with two people who serve as AGB senior consultants and senior fellows: Jill Derby, who previously was chair of the Nevada Board of Regents and is the current chair of the American University of Iraq in Kurdistan, and David Maxwell, president emeritus of Drake University and board member and former board chair at Grinnell College. Ellen, Jill, and David will explore the challenges faced by governing boards in upholding their fiduciary duty amid increasing external pressures, as well as highlight the importance of maintaining board independence and protecting institutions from any undue influences.

In today's episode, we'll be discussing the legal and medical aspects of the PPD permanent partial disability exam, which is part of the process in most workers' compensation claims. And we'll do that with two experts, Jason Mills, partner at GGRM Law Firm, and Dr. James Anthony, GGRM's Chief Medical Officer.Dr. Anthony is an experienced clinician and teacher, and he is one of the most respected Permanent Partial Disability (PPD) rating doctors in the state who has assessed and rated thousands of workers' compensation claims for the past 20 years. He's been practicing and teaching medicine for more than 36 years. He's also a trained lawyer, obtaining his JD from Florida State, and is a member of the Florida Bar. Over his career, Jason D. Mills, Esq. partner at GGRM Law Firm, has acted as lead counsel on several thousand contested workers' compensation claims. He has developed a reputation as a tireless advocate for his injured clients. Mr. Mills has successfully litigated workers' compensation cases through the Nevada Industrial Insurance system at all levels of the administrative law process, from the initial Hearing Office through the Nevada Supreme Court. Mr. Mills is also active in the state trial lawyers association, the Nevada Justice Association (NJA). In that capacity, Mr. Mills has both lobbied and testified for the NJA on important issues related to Nevada's injured workers at the Nevada Legislature since 2015. In 2016 Mr. Mills was elected to the Board of Governors for the NJA. In 2017 Mr. Mills was awarded the NJA's “Badger Award” for his distinguished service to the association and the people of the State of Nevada. In 2018 Mr. Mills was elected to the Board of Trustees for the Citizens for Justice, the NJA political action committee. In 2018 the State Bar of Nevada selected Mr. Mills as one of the five co-founding board members to serve on the State Bar of Nevada Board of Workers' Compensation Legal Specialization in order to create and administer a state bar certification and testing process for attorney specialization in the field of Nevada workers' compensation law. Despite being legal in our state for medical and recreational use since 2016, the Nevada Board of Pharmacy has marijuana classified as a Schedule I substance, the strictest classification for drugs with "no currently accepted medical use," up there with methamphetamine and heroin. So last month, the American Civil Liberties Union of Nevada (ACLUNV) filed a lawsuit against the state to have marijuana removed from the list of Schedule I drugs. ACLUNV Executive Director Athar Haseebullah explains how Nevadans are still being impacted by the possession of marijuana because of this “loophole” that disproportionately affects communities of color and what they hope to achieve starting with their first major hearing on Monday.

The Nevada Board of Regents recently signed off on a plan that will fold Tahoe's Sierra Nevada University into the University of Nevada, Reno. First announced in early July, the merger could be complete as early as fall 2022, but the schools have to get approval from a number of other educational regulatory agencies. He is an internationally-recognized speaker on these (and related) topics at conferences and professional meetings. Kim Berens joins me in Session 44 of The Behavioral Observations Podcast in what I originally thought was going to be a discussion about the company she co-founded, Fit Learning. While we spoke about Fit Learning a-plenty, Kim also provided tons of historical anecdotes on the development of our field, the development of Precision Teaching (where she recounted many personal conversations with Ogden Lindsley), and her take on where our field's challenges lie. If you haven't heard about Fit Learning, you'll want to check out their website. Their unique instructional model typically results in 1 year of academic growth for every 40 hours of instruction. If you're like me, you had to read that sentence two or three times to let it sink truly sink in. Kim shares the story of how Fit Learning was developed from its humble beginnings at the University of Nevada, Reno to licensing Fit Learning affiliates all around the globe. Here is a portion of her bio-sketch: Kimberly Nix Berens, Ph.D., BCBA-D, LBA is a Founding Director of Fit Learning, a Board Certified Behavior Analyst at the doctoral level, and a Licensed Behavior Analyst in the state of New York. Her work centers on using behavior analysis to transform the learning abilities of a wide-range of children, including those who are struggling, average, gifted, learning disabled, or on the autism spectrum. She received her doctoral degree in psychology with a specialization in behavior analysis at the University of Nevada – Reno (UNR) in 2005 under the supervision of Dr. Ogden Lindsley, Dr. Patrick Ghezzi and Dr. Thomas Boyce. Along with the other co-founders, Dr. Berens assisted in the creation of Fit Learning (originally Center for Advanced Learning) as a graduate student at UNR and, since that time, she has overseen the expansion of the organization to include locations in Reno, Nevada; Medford, Oregon; Locust Valley, New York; Manhattan; Phoenix, Arizona; and Perth, Australia. She relocated to the New York area in 2010 to focus on opening learning laboratories throughout the east coast. Through these learning labs, Dr. Berens and her team have developed a powerful system of instruction that combines precision teaching, direct instruction, curriculum-based measurement, and relational frame theory. This system consistently produces over one year’s growth in 40 hours of instruction. Following an appointment by Governor Jim Gibbons, she served on the State of Nevada Board of Psychological Examiners from 2009 – 2010 where she assisted in the development of state licensing regulations for behavior analysts. Dr. Berens was the first behavior analyst in the country to hold such a post. She has provided clinical and research supervision to undergraduate, master’s, and doctoral students and she continues to serve as an affiliate faculty member in the Behavior Analysis Program at the University of Nevada – Reno. Prodigy was hospitalized a few days ago in Vegas after a Mobb Deep performance for complications caused by a sickle cell anemia crisis. As most of his fans know, Prodigy battled the disease since birth. The exact causes of death have yet to be determined. Prodigy, born Albert Johnson, was diagnosed with sickle cell anemia when he was three-months old - RIP! O.J. Simpson may be one step closer to becoming a free man. Simpson will have a July 20 hearing before the Nevada Board of Parole to decide whether he will be released from prison. The parole board will weigh several factors in deciding whether to release Simpson. According to Nevada defense attorney Dan Hill, Simpson fits the profile of an inmate who would receive parole at the first opportunity. GOOD LUCK O.J., your going to need it!
