The Musgrave group which owns Centra and Supervalu, has more than 100 machines operating in its stores. Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in United States ex rel. Schutte v Supervalu Inc. In this case, the court considered this issue: Is a defendant's contemporaneous subjective understanding about the lawfulness of its conduct relevant to whether it “knowingly” violated the False Claims Act? The case was decided on Jun 1, 2023 The Supreme Court held that the False Claims Act's scienter element refers to a defendant's knowledge and subjective beliefs, not to what an objectively reasonable person may have known or believed. Justice Clarence Thomas authored the opinion for a unanimous Court. Both the text and common-law origins of the False Claims Act support an understanding of the scienter as focusing on the subjective knowledge of the defendant. It describes a three-part definition of the word “knowingly” that largely tracks the common-law concept of scienter for fraud: actual knowledge, deliberate indifference, or recklessness. Each of these concepts pertains to the defendant's lack of an honest belief in the statement's truth when making the claim, not what a defendant might have thought afterward. The finishing touches are being put on parade floats and marching routines across Clare as communities gear up for St. Patrick's Day celebrations. While politicians and dignitaries are setting off to various parts of this world to present Clare this weekend, parade organising committees are indicating that the real fun and festivities will be here at home. Community spirit and embracing traditions appear to be the common threads running through St. Patrick's Day plans in Clare communities this weekend. In West Clare, Doonbeg's float procession will kick-off at 3:30pm on Saturday at the footfall field while walkers and marchers are being advised to gather at the school at the same time. Music and entertainment will be provided by the likes of the Tulla Pipe Band and a 40-piece Swiss marching band who'll be celebrating their 50th year in existence. The theme of the parade is 'back to our roots', and member of the organising committee Rita McInerney says it'll be the perfect way to begin the tourist season. In nearby Kilkee, agricultural machinery and vintage cars will be among the sights seen by onlookers in the parade there which starts at 12pm on Sunday. Over in Killaloe, an inter-county parade will be the unique attraction as the procession there will commence at the Ballina GAA pitch at 2:15pm before heading across the bridge and finishing on the main street in Killaloe. The Killaloe Cost Guard, Gardaí and the fire brigade will be among the participants, and organiser Arlene White says the level of support locals have given in the preparation has been touching. Also taking place on Sunday will be the Miltown Malbay parade which will be led by the victorious Miltown Ladies Intermediate and Minor teams. Unsurprisingly, 'sporting heroes and traditions' is the theme of the festivities there, and entertainment will be provided by Bríd O'Donoghue and friends from 1:30pm before the parade begins at 2:30pm. Organising committee member David Talty says the parade is always a community effort. Ennistymon's parade will start opposite Supervalu at 3pm with entertainment in the square from 2pm and prizes for best walking group, best float and best dressed window to be won. Moving north to Doolin, parade participants will assemble at Doolin Pier on Sunday afternoon before beginning their trek down Fisher Street and all the way through the village. Local publican and committee member Patsy McDermott insists Doolin will be the place to soak up the atmosphere this Bank Holiday weekend.
Cork-based Velo Coffee Roasters is the first coffee roastery in Ireland to obtain the prestigious B Corp Certification, marking a significant milestone in the company's commitment to social and environmental responsibility. B Corp status is bestowed upon businesses dedicated to upholding the highest standards of positive impact on society and the environment. It evaluates a company's holistic social and environmental impact across five key areas: governance, workers, community, environment, and customers. Just over 30 businesses headquartered in Ireland hold this certification. Velo coffee roastery achieves B Corp status Suzanne Casey, General Manager of Velo Coffee Roasters said: "We are thrilled to achieve this gold standard of sustainability, and to be the first coffee roastery in Ireland to have done so. Our decision to pursue B-Corp certification stemmed from our genuine commitment to transparency - we want to adhere to comparable standards that will drive tangible change. The process involved a comprehensive evaluation of every part of our operations - from packaging choices to policies to sustainability targets. While the accreditation system was rigorous, it compelled us to be even better and optimise our operations for the betterment of the planet, which ultimately will foster trust among suppliers and customers alike." As part of its social and environmental responsibility, Velo, which is stocked in Dunnes Stores, Tesco, and premium SuperValu stores along with Aldi stores nationwide and in the UK, sources speciality coffee beans in collaboration with their partner Covoya. This ensures full traceability to the farm and fosters sustainable partnerships with farmers. The company, which employs 15, has just announced it's on track to invest over €7,000 this year into local community projects where it works, with a total of almost €20,000 invested in the past five years. The company's efforts include impactful initiatives such as supporting agricultural and social projects at origin, such as the Finca las Mercedes farm in El Salvador. By paying a premium on their coffee beans, Velo allows for funds to be directed back into the communities to support specific projects - including a new access bridge for a local school to shorten commutes and organising STEM education initiatives. Already recognised as an Origin Green Gold company, the B Corp certification is the next progression in Velo's journey toward social and environmental responsibility. With a commitment to continuous improvement and transparent reporting, Velo has also led the industry in sustainable packaging commitments, introducing completely recyclable packaging to their retail coffee in 2021. Suzanne added: "At Velo, our primary objective is to make a meaningful impact on communities. From our team members and loyal customers to our inspiring suppliers and local communities, we view Velo as a cohesive community. Coffee has the power to bring people together, and we aim to leverage that power through responsible sourcing and production." Velo Coffee Roasters was established in 2018 by cafe owner Rob Horgan. The coffee was initially roasted on-site in the café managed by Suzanne Casey. After the success on the Grow With Aldi programme in 2018, Velo Coffee Roasters moved to a purpose-designed facility in Mayfield Business Park, Cork city in 2019 with Rob and Suzanne both moving into the roasting business full-time. It's no secret that Cork GAA is in a financial hole. Rebuilding Páirc Uí Chaoimh went way over budget with a final cost – for the amateur organisation – topping €100 million. Little wonder it is casting around for sources of revenue. Selling the naming rights to the stadium seemed the most straightforward way to bring in much-needed cash – until it wasn't. As soon as it leaked at the start of the week that the county board was considering doing a deal with supermarket chain SuperValu to change the name of the 45,000 seater stadium to SuperValu Páirc controversy raged. Tánaiste Micheál's Martin's tweet likely stalled the move: he reminded the county board in advance of its Tuesday meeting to ratify the deal, that “Pádraig Uí Chaoimh was a key figure in the formation of the GAA at club and national level. Govt allocated €30m towards the development of the stadium and never sought naming rights”. The names of GAA stadiums throughout the country have been changed to reflect commercial sponsorship deals, but as Irish Times sportswriter Malachy Clerkin explains, this is different and is just one symptom of the many problems in Cork GAA. The False Claims Act protects government programs from fraud by, inter alia, imposing civil liability on anybody who knowingly presents false claims for payment to the government or makes false statements that are material to such claims. 31 U.S.C. § 3729(a). The statute defines "knowingly" to include acting with: (1) actual knowledge; (2) deliberate ignorance; or (3) reckless disregard of the falsity of information. See id. § 3729(b)(l)(A). The question presented is: Whether and when a defendant's contemporaneous subjective understanding or beliefs about the lawfulness of its conduct are relevant to whether it "knowingly" violated the False Claims Act. CONSOLIDATED WITH 22-111 FOR ONE HOUR ORAL ARGUMENT. This case presents the same question as No. 21-1326, United States ex rel. Schutte v. SuperValu Inc. It also arises from the same court of appeals. The Court may wish to consider the two petitions together.
