Associate Energy Minister Shane Jones says we live in uncertain times and, because of that, we need to crank up the Marsden Point oil refinery again. I agree that we live in uncertain times, but I certainly don't agree that we should pour time and money into something which has had its day. Shane Jones isn't the only person talking about it though. The Prime Minister has said too that the Government is considering reopening Marsden Point as part of its plan to strengthen the country's fuel and energy security. Because, since it was closed in April 2022, we've been importing all our refined fuel. We've also been importing all the bitumen we need for roads as well since the refinery closed. Before then, 70% of the bitumen used in New Zealand for roads was produced at Marsden Point, with 30% imported. Now 100% is imported. But let's not forget some of the nonsense that gets trotted-out about the old refinery. Which, once you cut through and dismiss, shows just how crazy it would be to try and get it up and running again. First up: it wasn't the previous Labour government that shut it down – the Associate Energy Minister was trotting out that line again this morning. It was actually shut down by the private company which owned it back in 2022. The company was known as Refining NZ, these days it's known as Channel Infrastructure. I think the Government needs to drop this idea of looking into reopening it. Because if the people who know a thing-or-two about running a refinery think it's a stupid idea, then who am I going to listen to? The people who know what they're on about? Of course I am. We all should, including the Government. Because all this is, is another one of those desperado elements of the coalition agreement between National and NZ First. Shane Jones is from the north and he's just doing what any MP would do for their region. And, before he continues with all this bluster about geopolitical clouds casting doubt on our future fuel supply, he should listen to what Refinery NZ said a year after shutting down the refinery. They said it would cost billions to reinstate and take at least a couple of years to do it. So why would you? Especially, when you consider who might run the thing. Because if the private outfit that used to run it wanted out, I don't see anyone else putting their hand up to take over. What's more, generating electricity is the future. Refining oil isn't. Even one of the union people who fought against the closure thinks we'd be flogging a dead horse trying to reopen it. Justin Wallace is First Union's oil and gas co-ordinator and he's on record as saying that it would be unrealistic to expect the refinery to be cranked into action again. He has said that although the footprint of the refinery is still there, the company that shut it down dismantled its key components as soon as they were able, and 80-90% of the staff who had worked at the refinery have left. He says: “They've gone overseas, taken redundancy, or retired. Unless the Government is willing to tax more people to find more money to rebuild it, I think it's a pipe dream.” Can someone please pass that on to Shane Jones? Are You Refining Your Backlog Enough (or Too Often)? - Mike CohnHi V. Lee,Ever felt like your backlog refinement meetings are either way too long or painfully unproductive? You're not alone.Backlog refinement can be a game-changer—or a time sink. The difference? How well you understand the purpose.So, let's get clear. Refinement is when a team and its product owner look at the top items on the product backlog to make sure each is sufficiently well understood and small enough to be brought into the next sprint.That means breaking down large items, adding detail, estimating effort, and generally getting your stories “ready” for the team to work on.Great refinement helps your team:Avoid surprises during sprint planningReduce rework due to misunderstood storiesDeliver value faster, with fewer blockerOnce per sprint works well for teams that like fewer meetings. Keep in mind that the meeting will be longer, though.Once per week can help avoid long, draining sessions—especially if your once-per-sprint meetings are creeping past two hours.What Is Product Backlog Refinement? How Often Should You Do It?Most teams will either do a refinement meeting once per sprint or once per week. What I don't recommend is going beyond that.I've worked with teams in the past that were running 2–3 refinement meetings per week, each an hour or more. Unless your backlog is in serious disarray or your product is unusually complex, that's overkill.And remember—refinement doesn't only happen in meetings. In this case, the court considered this issue: Should challenges by small oil refineries seeking exemptions from the requirements of the Clean Air Act's Renewable Fuel Standard program be heard exclusively in the U-S Court of Appeals for the D-C Circuit because the agency's denial actions are “nationally applicable” or “based on a determination of nationwide scope or effect”?The case was decided on June 18, 2025.The Supreme Court held that EPA's denials of small refinery exemption petitions from renewable fuel requirements must be challenged in the D-C Circuit because they are locally applicable actions based on determinations of nationwide scope or effect. Justice Clarence Thomas authored the 7-2 majority opinion of the Court.The Clean Air Act establishes a tripartite venue system for reviewing EPA actions. “Nationally applicable” EPA actions must be challenged exclusively in the D-C Circuit, while “locally or regionally applicable” actions ordinarily belong in regional courts of appeals. However, locally or regionally applicable actions that are “based on a determination of nationwide scope or effect” must be reviewed in the D-C Circuit if EPA finds and publishes that such basis exists. To identify the relevant “action” for venue purposes, courts must look to the specific statutory authority EPA is exercising rather than how EPA packages its decisions. Each EPA denial of an individual refinery's exemption petition constitutes its own “action” because the Clean Air Act allows each small refinery to petition EPA separately and requires EPA to act on each petition. An action is “nationally applicable” if it applies on its face throughout the entire country; alternatively, it is “locally or regionally applicable” if it applies only to particular places. EPA's denial of a single refinery's exemption petition applies only to that specific refinery in a particular location, making such denials paradigmatically locally or regionally applicable actions.The “nationwide scope or effect” exception applies because EPA's statutory interpretation and economic theory formed the core basis for its denials. A “determination” refers to EPA's justifications for taking action, and determinations have nationwide “scope” if they apply throughout the country as a legal matter or nationwide “effect” if they apply as a practical matter. An EPA action is “based on” such a determination only if that determination lies at the core of the agency action and forms the primary explanation for EPA's decision—requiring more than but-for causation. EPA's interpretation of “disproportionate economic hardship” and its RIN passthrough theory constitute clear determinations of nationwide scope because they apply generically to all refineries regardless of location. These determinations formed the core basis for EPA's denials because EPA used them to reach a presumptive resolution to deny all petitions, then considered refinery-specific factors only to confirm it had no reason to depart from this presumptive disposition. Where EPA relies on determinations of nationwide scope or effect to reach a presumptive resolution, those determinations qualify as the primary driver of its decision, making EPA's confirmatory review of refinery-specific facts merely peripheral by comparison.Justice Neil Gorsuch authored a dissenting opinion, joined by Chief Justice John Roberts, arguing that the Clean Air Act's substantive provisions do not call for EPA to make determinations of nationwide scope or effect when acting on individual small refinery hardship petitions, and that the majority's new test will make simple venue questions unnecessarily difficult and expensive to resolve.The opinion is presented here in its entirety, but with citations omitted. When we fall into sin, God is at work in our lives to remove that from us. Today, as we study Jeremiah 9, we'll learn about God's work in the children of Israel, even as they rebelled against Him. Join us! DISCUSSION AND STUDY QUESTIONS: 1. Have you ever been frustrated or disappointed with God's people? What did you do about it? Did you bring that matter to God and leave it with Him? Why or why not. 2. It is clear from verse 1, that Jeremiah is not pleased with the people of God. How does he characterize his despair? 3. There may even be times when we want to leave our problems behind. How does Jeremiah want to leave in verse 2? What reasons does he give at the end of the verse for his desire to leave? 4. Verses 3 to 6 return to the familiar theme of recounting the sins of the people. What are some of the sins listed in these verses? How do they reflect the kind of society that the people had devolved to? Was this the kind of society that was originally envisioned when God first called Abraham to establish a nation devoted to the Lord? 5. What is the refining work that God spoke of in verse 7? How will this purify His people? 6. What additional sins are presented in verse 8? What is the Lord's response to these sins in verse 9? Why is it important for us to know that the Lord will not leave sin unpunished? If we don't see such punishment in this world, why can we trust that all sin will be dealt by God in eternity? 7. What kind of judgment will befall the land in verses 10 & 11? 8. In verse 12, why does the Lord look for wise people to recognize what God is doing? If there is no one to recognize the reasons for their turmoil, what might the people think is the cause of their maladies? 9. What further judgment and punishment will the people receive in verses 13 to 16? Does the degree of judgment startle you? How does Deuteronomy 28-29 help us understand why the people would face this kind of judgment? As New Covenant believers, will we face this kind of judgment for our sin? Why not? 10. What kind of mourning is spoken of in verses 17 to 19? If the parents had taught their children to obey the Lord, would they have to teach them, in verse 20, to mourn? Why not? 11. Verses 23 & 24 are well-known verses that summarize the kind of life that God calls His people to pursue. Why don't you write these verses out in your own words. 12. Why does God call “wise people” to not boast in their own wisdom, in verse 23? Why do people often think that their wisdom is particularly wise? What does it mean to not boast in our own wisdom any longer? Where should our wisdom come from? How might you not look to your own wisdom, but instead look to God's wisdom? 13. What does it mean to know and understand God, in verse 24? Are you a person who knows God? On June 18, 2025, the Supreme Court released its decisions for two circuit splits arising under the Clean Air Act (CAA) provision regarding judicial venue: EPA v. Calumet Shreveport Refining, L.L.C. (23-1229), and Oklahoma v. EPA (23-1067). Decided 7-2 and 8-0, respectively, the outcome of these cases hinged on the Court’s interpretation of the CAA’s unique venue provision, 42 U.S.C. § 7607(b)(1). The CAA states that challenges to “nationally applicable” actions may be filed only in the D.C. Circuit. 42 U.S.C. § 7607(b)(1). Conversely, challenges to CAA actions that are “locally or regionally applicable” may generally be filed only in the appropriate circuit court for the region. Id. But there is an exception: actions that are “based on a determination of nationwide scope or effect” must be filed in the D.C. Circuit “if in taking such action the Administrator finds and publishes that such action is based on such a determination.” Id.In Calumet, the Court ruled 7-2 that the “EPA’s denials of small refinery exemption petitions are locally or regionally applicable actions that fall within the “nationwide scope or effect” exception, requiring venue in the D.C. Working 5 part-time jobs, while married and in school full-time was the straw that broke the camel's back. That is, the back of today's Success is Subjective guest, Cam Sherman.
