En Guatemala empezó el juicio por el asesinato del francés Benoît Maria, quien trabajaba en una ONG en el país. En agosto de 2020, murió tiroteado en una emboscada, y aún no se saben los motivos del crimen. Benoît Maria había trabajado durante 20 años en apoyo a las comunidades indígenas mayas en el desarrollo agrícola, cuando fue asesinado fue el 10 de agosto de 2020, a la edad de 52 años, mientras conducía su camioneta en un camino hacia el pueblo indígena de San Antonio Ilotenango, en el departamento de Quiché.“Una sentencia condenatoria”Tres años después se abre el juicio por esta causa en el que sólo una persona, Diego Tay Vicente, ocupa el banquillo de los acusados, enfrentándose a la familia de Benoît Maria que defiende el abogado Edgar Pérez Archila.“Hay un sentimiento todavía de incertidumbre. Obviamente no están acostumbrados al desarrollo de estos juicios. El tema de la aceptación de cargos generó dudas. Sin embargo, el debate apenas está iniciando en estos momentos. Vamos a discutir con la familia para explicarles, pero sí hay esta situación de evaluación de cómo está la traducción, porque no hablan español”, explica el abogado.Según él, estarían “satisfechos con que el Tribunal logre entender la hipótesis acusatoria en el sentido de que hay una responsabilidad del señor Diego Tay Vicente en la ejecución de los hechos en contra de la vida de Benito Maria. Una sentencia condenatoria, con eso estaríamos satisfechos. Es decir, que el tribunal dé como acreditado que efectivamente los hechos fueron cometidos por la familia Tay Vicente y en este caso por el señor Diego Tay Vicente”.“Cuál es el móvil?”Benoît Maria es recordado a día de hoy por sus compañeros como un activista de vocación que desde joven tuvo el deseo de involucrarse en una ONG rural internacional. Desde su asesinato, su entorno aún se sigue preguntando cuáles fueron los motivos del crimen.“Todos tenemos exactamente la misma interrogante. ¿Cuál es realmente el móvil, el motivo? Porque el que se maneja ahora a través de la hipótesis del Ministerio Público es que al señor Benito María lo mataron por no haber pagado un peaje. Sin embargo, todavía se tiene la duda si realmente fue por eso. Pero ésa es la acusación y la investigación que se ha realizado es que los rumores que habían en la comunidad era que efectivamente no pagó un peaje y que era un roba niños y por eso tomaron la decisión de quitarle la vida”, subraya Edgar Pérez Archila.La justicia francesa también es competente para investigar en este caso. Paralelamente a las investigaciones en Guatemala, se llevó a cabo una investigación preliminar en Francia al mismo tiempo que en febrero de 2021 se nombró a un juez de instrucción en el Tribunal de Casación de París.
