For all subscribers this week, Ken and Josh discuss Luigi Mangione's indictments in both Pennsylvania and New York, and he's also the subject of a federal criminal complaint. Both New York and the Feds look eager to prosecute him, and there's going to be wrangling over who gets to go first, with an important difference in the stakes — he's facing a capital federal charge, while New York does not have the death penalty. New York's top count — murder as an act of terrorism — poses some challenges for the state to prove. For paying subscribers: The dueling lawsuits brought by the actors Blake Lively and Justin Baldoni, each accusing the other of wrongdoing during and after the making of their hit film “It Ends With Us;” a discussion of the appellate ruling that upheld one of the judgments E. Jean Carroll won against Donald Trump; a look at why Matt Gaetz, even after resigning from Congress, couldn't block the release of the ethics committee report that alleges he had sex with a 17-year-old in violation of Florida law; and an update on the civil lawsuit against Jay-Z, who will continue to defend himself against a rape allegation from an anonymous plaintiff — and about how his hyperaggressive lawyer, Alex Spiro, is pissing off Judge Analisa Torres.Upgrade your subscription at serioustrouble.show to hear the whole thing!

From AP: Sex and drug tourism has long been a problem in Medellin, but the dangers came to a head late last year. Between November and December, eight American men were killed, many after meeting local women who are often used as pawns by criminal groups that target foreigners. Now the tourism boom has presented officials with a new set of dark challenges, including an uptick in sex trafficking and the killing of tourists and Colombian women after rendezvous on dating apps.“This area has spun out of control,” Medellin Mayor Federico Gutiérrez said recently while touring a park known for the sex trade.Meanwhile per mercatornet: Both New York and California, as well as the rest of Nevada, are inching toward the decriminalization of prostitution. Now, decriminalization is not the same thing as legalization of prostitution. Under legalization models, prostitution supposedly comes above ground, and prostitutes are taxed like any other worker, and purportedly fall under workplace safety requirements. In practice, of course, prostitutes in countries where it is legal report no increase in safety, and trafficking actually increases. Governments are simply not capable of, nor interested in, providing the type of oversight that would be necessary.Become a supporter of this podcast: https://www.spreaker.com/podcast/depraved-and-debaucherous--5267208/support.

Both New York and New Jersey require the workers' compensation carrier to contribute its equitable share of litigation costs on the petitioner/claimant's third-party recovery. One of the best ways to cut down exposure and resolve a workers' compensation claim months (sometimes years!) earlier than it otherwise would have is a “global settlement.” In this episode, “Getting Creative With Global Settlements: Lien Waivers, Litigation Costs, and Clever Consent Agreements (https://loisllc.com/webinar/getting-creative-with-global-settlements-lien-waivers-litigation-costs-and-clever-consent-agreements/),” Christopher Major (https://loisllc.com/attorney/christopher-major/), partner at Lois Law Firm, discusses when a case is in a position for a “global settlement,” how the numbers work in both States, best practices, and how the carrier can avail itself of a clever consent agreement to settle on its terms. Senate Approves Maloney as Ambassador

Critics raise concerns about ties to crypto industry The U.S. Senate on Tuesday (March 12) confirmed the nomination of former Rep. Sean Patrick Maloney as the U.S. representative to the Organisation for Economic Co-operation and Development, based in Paris. The vote was 63-31. Maloney, whose U.S. House district included the Highlands, will receive the rank of ambassador. President Joe Biden nominated the Philipstown resident for the position last summer. Maloney, a Democrat, served five terms in the House before being defeated in the November 2022 election by Mike Lawler. Both New York senators, Chuck Schumer and Kirsten Gillibrand, voted for his appointment. The OECD, founded in 1961, "works to build better policies for better lives" by creating "evidence-based international standards and finding solutions to a range of social, economic and environmental challenges" such as job creation, improving education and fighting tax evasion. The group came out of the Organisation for European Economic Co-operation, which was created to administer U.S. and Canadian aid for the reconstruction of Europe after World War II. "Authoritarian regimes are trying to tell a story that their single-party systems, command economies and repressive security apparatuses deliver the best outcomes for their people," Maloney said in a statement on Nov. 16 to the Senate Foreign Relations Committee. "The OECD provides the objective research to expose that fiction and demonstrate the strength and benefits of a free society." He added: "Modern small-town America needs a strong global economy, open/reliable markets, good infrastructure, affordable food and energy prices and an educated workforce. If confirmed by the committee, the needs of American families will always be my primary concern at the OECD." A group called the Revolving Door Project in January raised concerns about the nomination, saying Maloney has a conflict of interest because he serves on a 10-person advisory committee for the cryptocurrency trading platform Coinbase and the OECD plays a role in developing global crypto regulation. Coinbase hired Maloney on the same day in May 2023 that Biden submitted the nomination. "Unlike most cases of conflicts of interest, where a nominee had performed work in the past that could play a role in how they approach their government position, this is a case of a private firm hiring an individual after their imminent nomination was known," said Jeff Hauser, the executive director of the project, in a statement. "This not only allowed Maloney's Coinbase work to escape notice on his financial disclosure - which he had already submitted - but it allowed a cryptocurrency firm with a demonstrated interest in OECD policymaking to hire the presumptive future U.S ambassador." In a December letter to the CEO of Coinbase, Sen. Elizabeth Warren of Massachusetts criticized the firm for hiring Maloney, former Defense Secretary Mark Esper, former Sen. Pat Toomey of Pennsylvania and former Rep. Tim Ryan of Ohio for its advisory board. "This abuse of the revolving door is appalling, revealing that the crypto industry is spending millions to give itself a veneer of legitimacy while fighting tooth and nail to stonewall common-sense rules designed to restrict the use of crypto for terror financing - rules that could cut into crypto company profits," she wrote. "It also reveals significant gaps in the nation's ethics laws." According to Politico, Maloney wrote Warren in February to pledge that, if confirmed, he would "immediately resign from all private-sector advisory work and recuse himself from OECD decision-making processes on crypto and digital assets policy." Maloney also said he would not accept employment, board service or compensation from any crypto company or organization for four years after he left the OECD. Warren voted for his appointment.

All the trades were crazy, but it looks like the Baltimore Ravens might've done the best job by landing Kyle Hamilton without trading up and landing a first round pick from the Arizona Cardinals for Marquise Brown and using it to get Tyler Linderbaum. Also, the Green Bay Packers had two first round picks and spent both of them on the defense with Quay Walker and Devonte Wyatt. 7: The 1930 500-mile Peter Dawson Relay

Ultrarunning History

By Davy Crockett Both a podcast and a full article (Listen to the podcast episode which includes the bonus story about my first 100-mile race attempt) As the Great Depression began raging across the world, race events for professional ultrarunners pretty much dried up in the United States. All professional sports suffered in America during that time. For a few years, promoters in Canada filled the void, and were able to attract some of the most talented American ultrarunners to head northward, to run in their races. One such race was the 1930 Peter Dawson Relay held in the province of Quebec. This was one of those forgotten races that deserves a place in the history of ultrarunning. Both New York and Boston bid for the race but it was awarded to Quebec. It included many of the greatest American ultrarunners of that time. Most of them have been totally forgotten and all have now passed away, but some of them lived into the 1980s and 1990s. The race participants were an interesting breed. They had a passion for endurance running and enjoyed the attention it gave them. Most of the American entrants in the relay had run together for many weeks in 1928 or 1929, racing across America in C.C. Pyle’s "Bunion Derbies," They knew each other well. Several of the Canadians had competed against each other at a 200-mile “Green Stripe” snowshoe race held the previous winter, an event that caught the imagination and attention of Quebec and elsewhere. The Race Formation Armand Vincent The 1930 Peter Dawson Relay was organized by sports promoter, Armand Vincent (1900-1948). He was a well-known boxing promoter in Quebec. The race involved teams of two runners each, using a similar relay format that was popular at the time for six-day bicycle races. A description of the race included, “Unlike the man-killing Pyle 1928-29 marathon races across America which saw individual runners plodding along wearily the width of the continent, the Peter Dawson event will be raced in relays. The relay arrangement ensures more sustained and greater speed, a far more testing race.” The distance for the race was planned for about 500 miles, in daily stages, for eight days. The top runners would average running the entire distance at nearly six-minute-mile pace. Rules for each stage would determine how often the runners were allowed to switch off with their teammate. The race was set for July 1930 by the sponsors, Samuel and Allan Bronfman of the Distillers Corporation of Montreal. Yes, it was sponsored by a liquor company during the period of prohibition in America. These two businessmen had successfully put on the Great Stripe International Swimming Marathon in 1929 and the 1930 Green Stripe 200-mile six-stage snowshoe race from Quebec City to Montreal. The sponsors named this running event, “Peter Dawson,” after a popular brand of Whisky. They had made a fortune exporting alcohol to the United States during the prohibition years, which wasn’t against the law to do in Canada. The start was set to start in Montreal. The course would follow roads, mostly dirt at that time, making a giant circle within the Quebec Province. For the last stage, a marathon (26.2 miles) was planned to be held in the large baseball stadium at Montreal. It is important to put this and other ultradistances races of the time it their proper historical perspective. These runners were true trail ultrarunners who ran dirt roads. They would not be running six-minute-miles on nice smooth paved roads, they were running on rutted dirt roads that went over hills and became muddy. Several of these runners had already run up and over mountains, running across America -- twice. Many had recently run against horses for hundreds of miles and beat them. Think about the inaccurate claim that was told in recent decades, that trail ultrarunning was invented in the mid-1970s, running against horses. The sport was not invented then.
