Interest from US donors to be philanthropic to causes overseas is picking up steam. This is often happening without the knowledge that there are ways to do this in a manner that incorporates due diligence and tax benefits. In this episode of the PFP Section podcast, Jonathan Gassman, CPA/PFS, Rick Peck (NH Charitable Foundation), and Brooks Reid (CAF America) walk CPA advisors through what they need to be considering with their relevant clients. They answer the following questions: What are the 3 main considerations in cross border giving? How do you receive a tax deduction when donating outside the US? What due diligence needs to be done to make sure the charity is on the up and up? Are there resources to make this process more seamless for CPA advisors and their clients? Join Ted Hart, President & CEO of CAF America, as he chats with our Senior Vice President of External Affairs, Jessie Krafft, about establishing Donor Advised Funds (DAFs) for legacy planning. Often, the legacy planning process involves laying out how donors will bequeath assets to charities after their death. This podcast will share how donors can establish a Legacy Donor Advised Fund (DAF) to secure their charitable legacy—a legacy that is not limited to only USA charitable organizations, but can support a favorite charity virtually anywhere in the world. Legacy planning represents the continuation of donors’ values through the transfer of wealth and assets toward charitable causes. Depending on the size of the estate, these plans can be very simple or very complex, and a Legacy DAF can provide multi-generational support for a donor’s philanthropic legacy. In this podcast, we will share the step-by-step approach for donors and their financial/legal advisers to use in the creation of a Legacy DAF. We will share details that should be considered in this process and important questions donors should ask before establishing a Legacy DAF.

In this episode we talk to Ingrid Srinath, Director of the Centre for Social Impact & Philanthropy at Ashoka University about philanthropy and civil society in India and the impact of new restrictions have come in as part of the Foreign Contributions Regulation Act 2020 (FCRA 2020). (Disclaimer: the views expressed are Ingrid’s own and do not necessarily reflect those of her employer, or of CAF). We discussed: The FCRA 2020 What is the FCRA 2020? Why are CSOs in India concerned about the impact it will have? How much existing funding will be affected by the new rules? What is the rationale from government? Does this stand up to scrutiny? Has the Covid-19 pandemic played any role in precipitating this move on the part of the Indian government? What is the rationale for prohibiting onward granting? Why is this a particular cause for concern? Will this particularly harm smaller organisations and less poplar causes? As part of the new FCRA the Indian government has stipulated that no more than 20% of a foreign contribution can be spent on “administrative expenses”. How are these defined? What is the rationale for this? Will this new limitation on administrative expenses make it harder to invest in infrastructure, digital capabilities, governance etc.? The new law also requires CSOs in receipt of FCRA funds to do so in a dedicated bank account at a New Delhi branch of the State Bank of India- what is the rationale for this? The wider context for Civil Society & Philanthropy in India What is the overall makeup of the Indian civil society sector, in terms of formalised vs informal orgs, large vs small, different cause areas etc.? What is the attitude of the Indian government towards civil society in general? What is the attitude towards CSO advocacy and campaigning? How has the Covid pandemic affected Indian civil society? What is the infrastructure for civil society in India like? Are there gaps, and if so where? What is the history and current context for philanthropy in India? E.g. how much HNWI giving is there? How much mass market giving? What role does corporate philanthropy play? What role do foundations play? What kind of domestic causes receive philanthropic funding in India? What is the attitude of the Indian government towards philanthropy? What is the attitude of the Indian public towards philanthropy? What kind of philanthropic responses to the covid-19 crisis have we seen in India? Do recent critiques of philanthropy in the US and elsewhere resonate in the Indian context? (E.g. re that philanthropy exacerbates inequality, that it is anti-democratic, that some source of wealth are “tainted” etc.). This podcast reviews the 5 important changes that have been made to India's FCRA law as a result of the September 28, 2020 Amendment. CAF America will review the new prohibition on Indian nonprofits re-granting funds received from foreign donors to other FCRA registered nonprofits. The Amendment reduces the cap on the use of foreign funds for administrative expenditure to a maximum 20%, requires Indian nonprofits wishing to receive foreign funds to open an FCRA Bank Account with State Bank of India, it grants the power to FCRA to freeze the funds in the FCRA bank account in case of non-compliance with the FCRA requirements, and enables the Ministry of Home Affairs to suspend FCRA registration of an organization for more than 6 months. Also, the provisions of the Amendment state that renewal of the FCRA license will happen every six months provided the applicant is not fictitious, not convicted for triggering communal tension, and not guilty of diversion of funds. These provisions will greatly impact cross-border giving to India. CAF America is committed to keeping abreast of the changing regulatory environment and to maintaining full legal compliance within Indian laws. What do donors need to know to navigate the new provisions? Join Ted Hart, CEO of CAF America and Jessie Krafft, Senior VP of External Affairs to learn how the new requirements and restrictions affect US donors interested in supporting the work of nonprofits in India.

CAF America President & CEO Ted Hart and his guest expert David Shevlin, Partner at Simpson Thacher, discuss the new charitable giving rules that became law as part of The Coronavirus Aid, Relief and Economic Security (CARES) Act. The $2 trillion coronavirus stimulus bill includes provisions meant to encourage Americans to donate to charity. The move is meant to encourage additional contributions to the nonprofit sector, which is the third-largest industry in the country. Four specific provisions of the CARES Act will be discussed on this podcast, each provides incentives for individuals, families and corporations to give, but to receive the associated tax benefits, the new rules must be followed. Listeners will learn the steps necessary to qualify for the new "universal deduction", learn how those who itemize their deductions, can take the new 100% deduction off their adjusted gross income, learn how donor-advised funds are implicated in the new rules and how charitable contributions for corporations, that make cash contributions in 2020, can deduct 25% taxable income (up from 10%).

Today’s episode is a great one. Not only will we be talking about innovation in the field, but we’ll also address how today’s guest, Ted Hart, gives compliance officers a framework by which to think through issues that they face. Ted is the President and CEO of CAF America and brings 30 years of experience in advising global philanthropy. Ted and CAF CAF has a unique goal: to provide service to the philanthropic community, specifically to those in the United States who want to give abroad but have tax issues to face they don’t quite understand. They’ve been in business for 27 years. Cross Border Giving CAF America worked with several professionals in the market to write “Cross Border Giving.” The goal was to educate on a topic that can be confusing, so each professional wrote a chapter based on their expertise. The book and workbook together provide a great foundation, to which those who wish to donate to charities outside the US can refer. The 3 R’s and 7 Principles of International Giving Regulatory compliance, reducing the risks, and protecting reputation: these three things should be on the mind of every donor as they seek to give outside the US. As for the 7 principles, you’ll find a direct line back to the 3 R’s:Integrity of the processUnderstanding all aspectsRespect for the culturesResponsiveness to changing issuesFairnessCooperation and collaborationEffectivenessTed breaks down what each of these principles means in the bigger picture of giving, and how they inform good practices. They help keep the donor central to the process with their vision and mission. CAF works in such a way that donors can see exactly how their gifts are impacting people around the world, even for those people who can’t necessarily donate large amounts for extended periods of time.Working with Charities Not all charities are created equally, so CAF includes in its mission a rigorous vetting of charities and making sure they are doing with donors’ money what is expected of them. It’s a system of checks and balances that makes sure the people that donors want to help are getting the most out of the donations they send. The Legal Side of Cross-Border Donating Money laundering is a major concern when the same laws we have in the United States don’t apply in other countries, and it’s something CAF takes very seriously. No donor wants to learn that they have been funding terrorist activities. Ted talks about the strong procedures CAF has in place to prevent such things from happening. On the flip side of that coin, many governments around the world have tightened down and created regulations for money coming into their countries. They want to know where it’s going and how it’s being used. Ted talks about a new Chinese regulation and why CAF is one of the leading organizations compliant with Chinese law. As technology continues to advance at an unprecedented pace, success is predicated upon the ability to pioneer and adapt in a rapidly changing environment. The line between organizations that thrive and those who lag behind becomes clearer as forward thinking teams capitalize upon the opportunities afforded by technology innovators. One of the most promising developments of today is the work being done with distributed ledger technology, specifically blockchain. Though many have indirectly heard of distributed ledger technology through their knowledge of BitCoin, the potential of this technology far exceeds those platforms. This innovation creates unique challenges and opportunities for many industries, not the least of which are international grantmaking organizations. The new issue that third-party grantmaking organizations must solve is how blockchain can be operationalized to enhance the future of international giving while remaining in full regulatory compliance with laws across the globe. Solving this problem is no simple task, but if understood and implemented, the benefits will be far reaching. Join Ted Hart, President and CEO of CAF America, on Wednesday, October 10th, from 2:30-3:00pm EDT. for a discussion with Jeffrey Neuburger about the potential and challenges of this technology. Jeffrey Neuburger is a partner, co-head of the Technology, Media & Telecommunications Group, a member of the Privacy & Cybersecurity Group and editor of the firm’s New Media and Technology Law blog. Jeff’s practice focuses on technology, media and advertising-related business transactions and counseling, including the utilization of emerging technology and distribution methods in business.

Join Ted Hart, President and CEO of CAF America, as he discusses crowdfunding complications and how to ensure your campaign is charitable in nature with guest, Jessie Krafft, VP of Donor Advised and Grants Services at CAF America.
On January 1, 2017, the “Law of the People’s Republic of China on Administration of Activities of Overseas Nongovernmental Organizations in the Mainland of China” (colloquially known as “China’s Overseas NGO Management Law”) went into effect. The law requires that foreign NGOs coordinate their efforts with the Ministry of Public Security (MPS) and provides the framework within which they can continue their activities in the country: (1) opening an office in China, or (2) applying for a temporary activity license. Earlier this year there was a general initial wave of confusion due to the lack of clarity and guidance on the implementation of the law, as the year progressed the Chinese government provided additional guidance. It is because of the complexity of this matter, and persistent concerns regarding regulatory compliance that we are producing this education program. CAF America helps grantmakers and philanthropists translate into practice the proper way to reach regulatory compliance when granting to charitable organizations and projects in China. Join us on the CAF America Radio Network as our President and CEO, Ted Hart, discusses this law and regulatory compliance for granting charitable funds into China with Jessie Krafft, Vice President of Donor Advised and Grant Services at CAF America.
