In what is being hailed as a victory for free speech, investigative journalist Carole Cadwalladr has successfully defended a libel case against prominent Brexiter Aaron Banks Cadwalladr raised questions in a Ted Talk and a tweet about the relationship between millionaire businessman Banks and the Russian state. SLAPPs or Strategic Lawsuits against Public Participation are lawsuits that are designed not to win in court but rather to silence, intimidate and bankrupt the defendants. Over the past years, this type of vexatious litigation has become a tool to stifle independent journalists all over the world, especially those who write about the rich and powerful. London had a reputation for being a “libel capital” for a while and the Defamation Act of 2013 did very little to change it. This new episode of Trouble with the Truth unpacks the term SLAPPs and takes a look at how defamation suits are being used to gag free media. Our guest Rebecca Vincent from Reporters without Borders talks about the case of the Guardian journalists Carole Cadwalladr who is being sued for libel by British businessman Aaron Banks. Carole Cadwalladr and Professor David Carroll are both well known voices against what they see as Facebook's wrongdoing. They were two founding members of a group called The Real Facebook Oversight Board, launched just three weeks before Facebook's official Oversight Board started work last year. Since then they've used the media to get their message out about everything from Facebook's handling of the US election to the problem of vaccine misinformation on the company's platforms. Outside the Real Facebook Oversight Board, Carole is a well-known journalist who broke the Cambridge Analytica scandal, and David Carroll was seen in the Netflix documentary The Great Hack trying to get his data back from Cambridge Analytica.
