Năm 2025, Pháp kỷ niệm đúng 50 năm luật Veil được Quốc Hội thông qua, cho phép phụ nữ được phép nạo phá thai. Nhưng cũng phải mất 49 năm từ khi ngừng xem nạo phá thai là hành vi phạm tội, đến năm 2024 Pháp mới công nhận chấm dứt thai kỳ là quyền cơ bản của con người. Đây được xem là một dấu mốc lịch sử về quyền sinh sản tại Pháp. Không phải là chính quyền pháp khuyến khích nạo phá thai mà là cho phép phụ nữ tự do định đoạt thân thể và tương lai của mình, đồng thời giảm bớt nguy cơ các đảng chính trị chiếm đa số trong tương lai có thể muốn thiết lập lệnh cấm hoặc hạn chế, như Mỹ hay Ba Lan …Nhìn lại lịch sử, chấm dứt thai kỳ tại Pháp bị nghiêm cấm từ năm 1810. Dẫu không có số liệu chính thức, nhưng theo ước tính, mỗi năm có khoảng 500.000 phụ nữ, thuộc mọi hoàn cảnh và tầng lớp xã hội, phá thai. Thường thì chỉ những người có điều kiện tài chính mới dễ tìm được bác sĩ đáng tin cậy ở trong nước hay nước ngoài để chấm dứt thai kỳ. Phải đến năm 1975 luật Veil về nạo phá thai (đạo luật đặt theo tên bộ trưởng Y Tế Pháp thời đó là Simone Veil)mớiđược ban hành.1975 : Dấu mốc lịch sửSử gia Bibia Pavard là đồng tác giả cuốn sách « Đạo luật Veil. Một thế kỷ lịch sử » (NXB Découverte, 2024). Trong bài trả lời phỏng vấn của báo Le Monde ngày 17/01/2025, kỷ niệm 50 năm luật Veil, sử gia Bibia Pavard nhấn mạnh là dẫu cho cuộc đấu tranh về quyền phá thai đã thu hút các nhà nữ quyền từ đầu thế kỷ XX, nhưng phải đến tận cuối những năm 1960 - đầu những năm 1970 thì chấm dứt thai kỳ tự do và miễn phí mới được đặt vào tâm điểm phong trào đấu tranh nữ quyền tại Pháp.Đạo luật Veil năm 1975 là thành quả của 5 năm đấu tranh, vận động. Các tổ chức tranh đấu xem đó là một thắng lợi, nhưng cũng nhiều người thất vọng vì chưa đạt được tầm mức theo mong muốn. Theo sử gia Bibia Pavard, với đạo luật Veil năm 1975, chấm dứt thai kỳ vẫn chưa được công nhận là quyền mà chỉ được xem là sự rộng lượng của xã hội đối với những phụ nữ có thai nhưng do hoàn cảnh không thể muốn giữ thai để sinh con. Và đạo luật cũng chỉ là tạm thời với thời hạn 5 năm, chi phí nạo phá thai không được cơ quan Bảo hiểm Xã hội hoàn trả, người nước ngoài không được nạo phá thai tại Pháp …Các nhà nữ quyền hiểu rằng luật Veil khi đó mới chỉ mang đến một quyền khá « mong manh ». Ngoài ra là thái độ chống đối của nhiều bác sĩ. Đến những năm 1980-1990 thậm chí còn xuất hiện đội quân chống nạo phá thai, với hàng loạt hành động nhằm cản trở hoạt động của các cơ sở y tế nạo phá thai. 2025 : Chiến thắng biểu tượngCùng với những biến chuyển trong xã hội, dần dần thì phụ nữ cũng được tạo thuận lợi hơn khi tự nguyện chấm dứt thai kỳ : chi phí được Bảo hiểm Xã hội hoàn trả 100% theo hạn mức, tuổi thai tối đa khi bỏ thai được kéo dài, quy định về khoảng thời gian suy nghĩ trước khi phá thai được dỡ bỏ, phụ nữ được lựa chọn phương phá thai bằng thuốc hay dụng cụ, được hỗ trợ tâm lý sau khi phá thai, hình thức tư vấn từ xa được phát triển …Bên cạnh đó là việc ban hành các đạo luật ngăn chặn hành vi cản trở hay tìm cách cản trở phụ nữ phá thai hay tiếp cận thông tin về phá thai, hay hành vi dọa dẫm, gây khó khăn cho các cơ sở và nhân viên y tế phá thai cho phụ nữ. Việc làm lan truyền thông tin sai lệch cũng bị xử lý. Và gần đây nhất, cách nay tròn 1 năm, vào ngày 08/03/2024, tổng thống Emmanuel Macron chủ trì lễ đóng dấu ấn vào đạo luật ghi quyền tự nguyện chấm dứt thai kỳ vào Hiến Pháp, đưa nước Pháp trở thành quốc gia đầu tiên trên thế giới mà quyền tự nguyện chấm dứt thai kỳ được Hiến Pháp công nhận và bảo vệ. Quyết định của chính quyền Macron được xem là bước đi tiên phong trong bối cảnh Tòa án Tối cao Hoa Kỳ hồi tháng 06/2022 đã hủy bỏ quyền phá thai, trong khi ở nhiều khu vực trên thế giới, thậm chí ngay tại châu Âu, cũng nổi lên một số phong trào tìm cách hạn chế quyền phá thai, thậm chí nghiêm cấm việc phá thai, cho dù việc ép buộc duy trì thai kỳ có thể gây nguy hiểm cho tính mạng người phụ nữ.Ba Lan : « địa ngục của phụ nữ » cần chấm dứt thai kỳTheo tổ chức bảo vệ quyền sinh sản, Center for Reproductive Rights, thì hiện nay trên thế giới vẫn còn tới 40% số phụ nữ trong độ tuổi sinh con sống tại những nước mà nạo phá thai bị hạn chế hoặc bị cấm. Riêng tại châu Âu, Ba Lan là một trong những điển hình về luật cấm hà khắc, tới mức nhiều phụ nữ đấu tranh đòi quyền chấm dứt thai kỳ gọi Ba Lan là « địa ngục của phụ nữ ». Từ năm 2020, chấm chứt thai kỳ gần như là bất hợp pháp ở Ba Lan, trừ 3 trường hợp : có thai do bị cưỡng hiếp, hoặc quan hệ loạn luân, hoặc nếu do duy trì thai kỳ sẽ đe dọa trực tiếp đến tính mạng hoặc sức khỏe của người mẹ.Phán quyết củaTòa Bảo Hiến Ba Lan đã khiến đến 90% số trường hợp nạo phá thai trở thành hành vi bất hợp pháp. Đạo luật khắc nghiệt tới mức nhiều bác sĩ, nhân viên y tế không dám tiến hành thủ thuật phá thai vì lo sợ gặp rắc rối với pháp luật, thậm chí là án tù giam, bởi vì việc hỗ trợ nạo phá thai bị cấm, ai vi phạm có thể bị tù giam 3 năm. Năm 2023, lần đầu tiên có một nhà tranh đấu cho nữ quyền bị phạt lao động công ích vì hỗ trợ một phụ nữ chấm dứt thai kỳ.Mới đây, AFP hôm 13/02/2025 cho biết là theo các số liệu chính thức trong 10 tháng đầu năm 2024 chỉ có 780 ca nạo phá thai tại các bệnh viện ở Ba Lan. Thế nhưng, trên thực tế, theo Abortion Without Borders, mạng lưới các nhà đấu tranh cho quyền chấm dứt thai kỳ, « nạo phá thai tại Ba Lan là chuyện thường ngày » và mỗi năm có tới 150.000 ca phá thai. Việc « phá thai chui » dĩ nhiên sẽ có những nguy cơ đối với sức khỏe của phụ nữ.Anh : Dư luận, pháp luật và thực tế vẫn có cùng một lối Nhìn sang Anh, quốc gia sinh ra phong trào cánh tả thế giới (từ thập niên 1840) và các nhóm tiên phong về nữ quyền rất nhiều năm trước khi ngày Quốc tế Phụ nữ được lập ở Mỹ (1910), cho tới nay, quyền phá thai của phụ nữ vẫn là một vấn đề phức tạp.Từ Luân Đôn, thông tín viên Nguyễn Giang ngày 06/03 giải thích thêm :« Dù đã vào năm thứ 25 của thế kỷ 21, Anh quốc vẫn phải sống với luật cho phép phá thai từ năm 1967, và tới những năm 2009-2010, cả Giáo hội Anh giáo (quốc đạo của Anh) và Giáo hội Công giáo tiếp tục phản đối phá thai, coi đây là điều “trái đạo đức”. Tuy thế, vấn đề ở Anh không phải là các giáo hội có ảnh hưởng gì tới quyền nạo phá thai của phụ nữ, mà là chuyện luật Anh điều chỉnh sự việc quá chi tiết, gây khó khăn cho phụ nữ. Ví dụ, một mặt luật công nhận quyền phá thai của người mẹ khi thai nhi chưa tới 24 tuần tuổi, mặt khác, lại coi là tội hình sự nếu ai đó cố ý tự phá thai sau 24 tuần tuổi mà không được giám định y khoa của ít nhất 2 bác sĩ. Phá thai chỉ được phép nếu sinh mạng của người phụ nữ gặp nguy hiểm, nếu có bất thường nghiêm trọng ở thai nhi hoặc nếu người phụ nữ có nguy cơ chịu đựng tổn thương thể chất và tinh thần nghiêm trọng. Về thủ tục, việc phá hủy thai nhi quá 10 tuần tuổi phải được thực hiện ở bệnh viện hoặc trạm xá công (National Health Service), với mục đích cao cả là để đảm bảo sức khỏe cho người phụ nữ. Các quy định trên thực tế đã tạo ra tình trạng khó xử cho phụ nữ, nhất là các thiếu nữ, những phụ nữ trẻ, độc thân, chưa có kinh nghiệm cuộc sống, khiến họ không tìm đến 2 bác sĩ như luật định mà tới các trạm xá từ thiện.Cảnh sát Anh cho tới gần đây vẫn điều tra các trạm xá cung cấp dịch vụ phá thai và mở tới 60 cuộc điều tra hình sự ở Anh và xứ Wales kể từ năm 2018 đến đầu năm 2024. Họ yêu cầu trạm xá cung cấp thông tin cả về những phụ nữ gọi điện, gửi email tới tìm hiểu về thủ tục phá thai, dù chưa ai tới nơi thực hiện điều này. Một số nhà vận động cho rằng làm như vậy, cảnh sát đã khiến nhiều phụ nữ lo sợ và chỉ khiến dịch vụ bán viên thuốc phá thai sớm trên mạng internet tăng lên, không ai kiểm soát được.Tất cả những việc này xảy ra khi mà đại đa số người dân ở Anh (87%) coi việc cung cấp dịch vụ phá thai cho phụ nữ là điều cần thiết (điều tra dự luận năm 2023 của YouGov).Cùng lúc, có hiện tượng các trạm xá cung cấp dịch vụ phá thai miễn phí ở Anh trở thành mục tiêu biểu tình của những tổ chức chống phá thai hay còn gọi là “vì sự sống” (pro-life). Để giải quyết chuyện này, tân chính phủ Lao Động hồi tháng 10 năm ngoái đã ban lệnh cấm họ tiếp cận các trạm xá có dịch vụ phá thai trong vòng 150 mét. Với chính phủ của đảng Lao động, chính đảng đã nêu phá thai như một quyền của phụ nữ trong cương lĩnh tranh cử, thì đây là biện pháp bảo vệ mạnh mẽ hơn cho phụ nữ tiếp cận dịch vụ phá thai mà chính phủ nói là một phần của việc “chăm sóc sức khỏe thiết yếu”. Nữ bộ trưởng Jess Phillips nói hồi cuối năm 2024 rằng: “Quyền tiếp cận các dịch vụ phá thai là một quyền cơ bản của phụ nữ ở đất nước này, và không ai phải cảm thấy bất an khi tiếp cận dịch vụ này.”Nhưng với các nhóm Ki tô giáo phản đối quyền phá thai thì đây là việc dùng cảnh sát can thiệp vào nhân quyền và họ cầu nguyện để phụ nữ không bước chân vào các trạm xá nói trên ». Đã đến lúc chống bất bình đẳng Trở lại Pháp, cho dù được cho là có những quy định đi tiên phong, nhưng trên thực tế, từ luật lệ đến thực tế vẫn có độ chênh rất lớn, không thể ngày một ngày hai xóa bỏ. Phụ nữ tại Pháp vẫn gặp trở ngại khi tự nguyện chấm dứt thai kỳ. Giới quan sát và đấu tranh cho nữ quyền nói đến tình trạng bất bình đẳng mà phụ nữ gặp phải khi muốn phá thai. Chính vì thế, theo chính phủ Pháp, ban hành các đạo luật là chưa đủ. Điều cần làm bây giờ là chống bất bình đẳng về khả năng tiếp cận dịch vụ phá thai, do điều kiện chênh lệch giữa các vùng miền, tầng lớp xã hội và khả năng tiếp cận thông tin chuẩn xác.

We hear some of the emotional speeches from MPs across the House of Commons during yesterday's violence against women and girls debate including a response from Safeguarding minister Jess Phillips. The Trawl is back! Jemma and Marina are thrilled to be back behind their mics but could not have predicted the kind of fallout and controversy they'd be back with. A certain tech bro, out of control billionaire, has been firing off tweets suggesting, amongst other things, that the US should exert economic pressure on the UK to get far-right agitator Tommy Robinson out of prison and that King Charles should dissolve Parliament, while crossing so many lines there aren't any lines left to cross. At the heart of his rantings is a very serious and tragic issue, the vile grooming gangs who sexually abused and tortured young girls in places such as Rochdale and Rotherham and whose victims have been let down and failed by politicians of all flavours, the police, and councils. Jemma and Marina discuss why drawing attention to a topic which does deserve more focus isn't the same as wanting to interfere in a country's democratic processes. As for calling out Jess Phillips in the reprehensible manner that Musk has, they spend a bit of time discussing why that is so wrong and looking at reaction. As for the drop mic moment when Musk declared that Farage should not be leading Reform a mere few hours after Farage had been sucking up to him on the Laura Kuenssberg show, the Trawl ladies have just the right clip to express how it made them feel. And of course, a Trawl would not be a Trawl without pudding and under-rated tweets. Jemma and Marina were thrilled when Labour MP, Jess Phillips, agreed to take time out of her mad diary for a proper chinwag. Then Palestine Youth Movement organizer Remo Ibrahim reveals what REALLY happened at the synagogue protest and Jewish anti-zionist Rich Siegel talks about why he condemned the sale of occupied land. Craig Murray is an historian, ex British ambassador to Uzbekistan, whistleblower, friend and campaigner for Assange's freedom and Workers Party candidate for Parliament under George Galloway's Workers Party in Blackburn. Jody McIntyre is a candidate for Parliament under George Galloway's Workers Party of Britain. He is the sole independent candidate running in the Birmingham-Yardley constituency, located in the city of Birmingham, England, against the Labour Party's Jess Phillips, who is a member of Labour Friends of Israel and is likely to become a minister in the new government, if she wins re-election Birmingham-Yardley. Jody has cerebral palsy and is a lifelong activist, focused on Palestine, disability-rights, and education. He converted to Islam as a young adult and has lived in Palestine multiple times, including being there on the day of the October 7th attacks. In 2010, he was the subject of national-news coverage when he was dragged out of his wheelchair by police multiple times while participating in mass protests against budget cuts and tuition hikes. Remo Ibrahim is an organizer with the Palestinian Youth Movement, LAOCIE chapter (@palestinianyouthmovement, @pymlaocie). He is committed to the struggle for Palestinian liberation, and to confronting Zionism and white supremacy wherever it appears. Rich Siegel is a musician and activist. Raised in what he calls “the cult of atheistic Zionism posing as Judaism”, in his youth Rich was very involved as a supporter of Israel, notably as a teenage Zionist youth group president. He then lived in Israel in his 20's working as a pianist in a luxury hotel. Rich's change of heart began as a spiritual awakening, by which he came to see that Jewish tribal identity and the state of Israel were worshipped as idols. Then he became acquainted with Zionism's crimes against humanity, which contradicted the Zionist narrative he grew up with. Organizing demonstrations against Zionist activity in the northern New Jersey suburbs where he lives, Rich's activism hit a high note when a talk he gave in front of the Teaneck town council went viral. Recently Rich was fired from a teaching job at a local music school due to a pro-Palestine Facebook post. He is director of Deir Yassin Remembered, a pro-Palestine charity and activist organization.
