In a major win for EU regulators, the European Court of Justice has ruled that Apple must pay €13 billion in back taxes to Ireland, dismissing a final appeal by the company against the European Commission's 2016 order. The state tax gap—the difference between the true tax liabilities owed to a state and the amount voluntarily submitted to revenue agencies—is possibly the most stubborn and perplexing problem facing tax administrators. For decades, revenue commissioners have tried to close the gap through audits and enforcement sweeps, but the process is slow, costly, and uncertain. Janette Lohman, a former director of the Missouri Department of Revenue, believes there is a way to collect more delinquent taxes faster, cheaper, and with less hostility: a strategy she describes as “prospective voluntary disclosure.” The states generally allow delinquent businesses to voluntarily come forward and pay their back taxes plus interest for a specified look-back period, but Lohman has proposed a process that allows delinquent taxpayers to submit their taxes on a going-forward basis without paying any back taxes or penalties. On this episode of Talking Tax, Bloomberg Tax senior reporter Michael J. Bologna caught up with Lohman to discuss her efforts in Missouri to boost compliance using prospective voluntary disclosure. Lohman, a tax partner in the St. Louis office of Thompson Coburn LLP, recently presented her strategy during the annual meeting of the Federation of Tax Administrators. The IRS collected $1 billion in back taxes from high-wealth individuals, highlighting their efforts using funds from the Biden administration's 2022 climate, health care, and tax package. Campaigns targeted individuals with over $1 million in income and $250,000 in recognized tax debt. Treasury Secretary Janet Yellen emphasized tax fairness through these actions. In June, the Treasury proposed a rule to stop partnership basis shifting, potentially generating over $50 billion in revenue over a decade. Other initiatives included addressing improper deductions for personal flights on corporate jets and targeting delinquent millionaires. Despite benefits, Republican efforts in Congress threaten IRS funding, with proposed cuts such as a $1.4 billion reduction in 2023. Nearly two-thirds of audits in 2023 involved those earning less than $200,000, indicating ongoing IRS scrutiny of non-high-wealth partnerships.Learn more on this news visit us at: https://greyjournal.net/news/ Hosted on Acast.
