In December 2023, when South Africa accused Israel of genocide before the International Court of Justice, I thought it was wrong to do so. Israel had been attacked. Its defense was legitimate. The blood was on Hamas's hands.But over the last year, I have watched a slew of organizations and scholars arrive at the view that whatever Israel's war on Gaza began as, its mass assault on Palestinian civilians fits the definition of genocidal violence. This is a view now held by Amnesty International, B'Tselem, Human Rights Watch, and the president of the International Association of Genocide Scholars, among many othersOne reason I have stayed away from the word genocide is that there is an imprecision at its heart. When people use the word genocide, I think they imagine something like the Holocaust: the attempted extermination of an entire people. But the legal definition of genocide encompasses much more than that.So what is a genocide? And is this one?Philippe Sands is a lawyer who's worked on a number of genocide cases. He is the author of, among other books, “East West Street,” about how the idea of genocide was developed and written into international law. Last week, as Israel continued to prosecute its eliminationist war against Palestinians in Gaza, an eclectic group of right-wing bigwigs gathered in Washington, DC for the fourth iteration of the National Conservatism conference — convened by Yarom Hazony, an Israeli-born writer, activist, and former speechwriter for  Benjamin Netanyahu. As our guest, historian Suzanne Schneider, explains, Hazony aspires to export Israel's model of illiberal democracy and dispossession to the nations of the world. And if the embrace of NatCon by American conservatives is any indication, he is succeeding. Nations, for Hazony, derive their legitimacy not from the consent of the governed (which, for Israel, would include disenfranchised Palestinians in the West Bank) but from God, who designated the land of Israel as the home of the Jews. All nations are born of divine covenant, not consent; political community is based on unchosen and inherited obligations extending outward in concentric circles of coercion, from the nuclear family, to the clan, to the tribe, and so on. This slipshod political theology authorizes a world of sovereign, militarized ethno-states, intensely protective of patriarchal prerogatives, and with no obligation to international law, human rights, judicial interference, or constitutional guarantees for religious or racial minorities. If Israel is the God-given home of the Jews, why shouldn't America be the God-given home of white Christians? It's not difficult to perceive the appeal of this vision for NatCon's attendees, including Trumpist senators like Josh Hawley and Mike Lee, Catholic integralists like Gladdin Pappin and Chad Pecknold, racist nativists like Stephen Miller, or Viktor Orbán propagandists like John O'Sullivan. First, most obviously, they achieve their goal of control and carnage in Palestine, making the territory unlivable for the indigenous people in an effort to take the land. Second, Israel's military industrial complex is vastly enriched from the sale of weapons and tech. And third, Israel's weaponry allows them to to commit mass terror in Gaza: “After 1967, there were many nations that publicly opposed what Israel was doing, but the insurance policy is that Israel has been selling weapons and surveillance tech to so many countries for so long that those nations were less likely to criticize Israel where it matters, like the UN.” And the vast extent of this insurance policy is likely greater than we realize. “No one even knows, by the way, how many countries Israel has sold weapons to. I calculate anywhere between 125 and 145 nations, which is the majority of nations on the planet, have bought some form of Israeli weapons, surveillance tech, or repressive technology.” But since October 7, Antony explains, Israel's grip over the world is slipping. House Speaker Mike Johnson, self-proclaimed champion for human rights and freedom, and enemy of dictators everywhere, inched closer to getting Ukraine aid after eight months of successfully delaying it, empowering Russia's genocide. Kremlin state TV repeatedly praised Johnson for assisting their brutal invasion, which, as discussed in this week's bonus show, emboldened Iran to unleash a shocking swarm of drones and missiles against Israel. The Ukraine aid package still faces delays, thanks to MAGA, and will have to go back to the Senate before it reaches President Biden's desk. The Trump-proposed changes, of structuring some of the aid as a loan, can be forgiven by the President, including partial loan forgiveness by Biden on his way out, should he lose the election. If Trump wins, he could force Ukraine to repay what's left of the loan and refuse to send ATACMS, the long-range missiles that have made Ukraine effective at blowing up Russian planes and other military targets that slaugher civilians. The compromise in this aid package, far less than what Ukraine actually needs to win the war, adds to the urgency to ensure Trump loses the electoral college.
