Lori Vallow Daybell, convicted in Idaho of murdering her two children and now facing charges in Arizona, caused a significant delay in her legal proceedings when she refused to be transported to court for a Rule 11 competency hearing. The hearing was scheduled to assess her mental fitness for trial in connection to the death of her ex-husband, Charles Vallow, and an attempted murder charge involving her ex's nephew, Brandon Boudreaux. Vallow Daybell, a former Chandler resident, was found guilty in 2023 for the deaths of her 7-year-old son, Joshua "J.J." Vallow, and her 16-year-old daughter, Tylee Ryan. Their bodies were discovered in her Idaho backyard in 2020. She is serving a life sentence without parole and was later extradited to Arizona after Governor Katie Hobbs approved the transfer. Today, we welcome back Chris Kotterman, the Director of Government Relations for the Arizona School Boards Association, to discuss the past Arizona legislative session, significant bills that did and didn't make it into state policy, and what might be coming in the 2024 session. Kotterman notes that fewer bills than usual affecting education will take effect this year due to several vetoes by Governor Katie Hobbs but does share with hosts Donnie and Juliana about HB2460, which relates to the suspension of students in grades K-4. He then talks through several bills that did not pass in the 2023 session but that may arise in future sessions. He specifically clarifies Arizona Revised Statute 15-117, which talks about parental permission for particular surveys for students, and clarifies how districts are approaching those regulations. Kotterman also mentions a finance bill that may arise in the next session and makes some predictions about other bills and discussions that will return to the Arizona Capitol next session, which kicks off in January 2024. With the passage of House Bill 2288, recently signed into law by Governor Katie Hobbs, some laws have been added to the Arizona Revised Statue (ARS) regarding large vehicle right-of-way within roundabouts. Today's show opens with GA Attorney General Chris Carr's 61 person indictment of Antifa domestic terrorists who tried to wage war on the police with impunity. It's nice to finally see some action being taken against this mob of organized crime that has been allowed to operate unscathed by our weaponized Department of Justice and our FBI. It time for more Constitution-loving elected representatives to fight for our country and the rule of law. Instead, another FOIA request shows there is no documentation whatsoever proving AG Merrick Garland had give US Attorney David Weiss the powers to take the Hunter Biden investigation wherever he needed to. There is not one mention at all of what Garland testified to, under oath, and has been repeating for over a year. Hunter Biden's criminal wrongdoing was first noticed by people inside the investment bank Morgan Stanley. His business activities were so unusual, the created a Power Point presentation and filed the suspicious activity reports with the Security and Exchange Commission (“SEC”) and recommended Hunter for further federal investigation. Michigan Secretary of State Jocelyn Benson, while trying to dodge all of the fraudulent 2020 voter activity we've been documenting, has decided to follow Colorado's lead. She is moving to unilaterally, arbitrarily disqualify Donald Trump from being placed on the Michigan ballot. She is also erroneously claiming she can do this under the 14th Amendment. Here's the massive problem we are seeing in our current judiciary. We used to have this notion of the presumption of innocence. We have now turned it around and it seems we have now embraced the presumption of guilt. This is the exact opposite of every free nation on the face of the Earth. This must be fought back with everything we have if we want to keep our country intact. Kari Lake thanked a better-late-than-never response from former AG Bill Barr about the latest ruling in Arizona regarding the flagrant disregard for following the election laws related to mail-in ballot signature verification. The law is clear and the wording was precise, yet for SoS at the time (and now Governor) Katie Hobbs invented her own counting criteria. For whatever it's worth, Sen. Joe Manchin (D-WV) is furious with Biden's latest move to ban drilling oil across millions of acres, calling it an assault on our economy. Sen. John Barrasso (R-WY) called the decision a reward for our adversaries a hurt for American families. Shivanthi Sathanandan, the vice chair of the Democrat Party in Minnesota, who virulently advocated for the dismantling of the MN Police Department, while neighborhood were burned to the ground from BLM-Antifa, was assaulted outsider her home by a pack of carjackers. Now, seeing first-hand the results of her magic-thinking, wants her attackers to be prosecuted and their city to be “taken back.” Well, I hate to say it, but this is the result of putting Leftist ideologues in charge. Finally, I spoke about what it means to have solid core of ethics and values to help keep you focused and consistent. The Arizona governor is calling for new limits on construction in the Phoenix suburbs due to a dwindling supply of groundwater. Governor Katie Hobbs announced a pause on new subdivisions that don't have a proven source of water. The policy comes after an analysis that says the supply of groundwater will fall short of demand over the next 100 years. Hi, I'm Kathy Fettke and this is Real Estate News for Investors. Growth Putting Pressure on Water Supply Phoenix is the 5th largest city in the U.S. with more than 1.6-million people, but the entire metro area has closer to 5-million people. Those suburbs and outlying areas are also growing rapidly, and putting more and more pressure on groundwater supplies that do not replenish rapidly, especially during times of drought. The city's groundwater analysis involved tests on more than 40,000 wells, along with the testing of aquifers and streamflows. Those tests show that water levels will fall about 185 feet across the entire basin over the next century. Outlying areas that are closer to the mountains will see a bigger decline in those levels. As reported by the Washington Post, the outflow of water is expected to exceed the inflow by a factor of 1.4 or 140%. The unmet demand would be about 4% or close to 5-million acre-feet of water over 100 years. One acre foot is about 326,000 gallons. A typical home might use half- to one-acre foot per year. At one acre-foot per home, about 50,000 homes would run dry in the Phoenix area over that 100 year period. At a half-acre foot, it would be more like 100,000 homes. Those are very rough figures. New Policy Requires Water Assurances To address the issue, Governor Hobbs announced that any new development projects will have to have proven water supplies. And many Phoenix area cities already have them, such as Scottsdale, Mesa, Gilbert, and Goodyear. But more rural communities that rely on groundwater don't have those assurances. Former Phoenix mayor Terry Goddard says: “You can't build unless you know exactly where the water is coming from.” Developments that have already been approved can still move forward, but those cities are also scrambling to be sure they have adequate water for the decades ahead. Places like the town of Queen Creek, east of Phoenix, is working on a way to import water and meet demands for mushrooming growth. According to the Post, the town is spending $27 million to buy Colorado River water from a farm elsewhere in Arizona. It also made a deal for groundwater in another part of the state. The town's water resource director, Paul Gardner, says the town has about 10,000 lots ready to build, and water has been secured for those homes. But the city is working on ways to import water for other parts of the project, and while water importation will help solve the problem, Gardener also says the water price tag is rising. One of several landowners involved with development projects expects the cost of water to add as much as $15,000 to $25,000 to each home. Dan Reeb told the Post: “Arizona has gotten very good at stamping out four-bed, two-and-a-half bath, three-car garage homes, and a great job to go with it.” But he says: “It's not going to be as inexpensive and simple as it has been for the last 50 years of phenomenal growth.” Massive Development Project on Hold One massive development plan in Buckeye called Teravalis is now on hold. Plans call for some 100,000 homes on 37,000 acres for what would be the largest planned community in Arizona. But most of the property currently lacks the necessary water supply approvals. Buckeye officials are working on a solution, and they insist that their water future is secure. A big part of their plan is an $80-million deal to purchase groundwater from another rural part of the state. Each town, city and/or region is dealing with its own water supply problem, so there's a difference in how well they are each solving this problem. While some cities have already invested a lot of money in their water supplies, newer communities that rely on groundwater are having to rethink their options. In addition to informing residents about the water situation, Governor Hobbs is also offering assurances that the city won't be running out of water anytime soon. She says: “We are not running out of water and we will not be running out of water. We have to close this gap and find efficiencies in our water use.” Sharon Megdal of the Water Resources Research Center at the University of Arizona says it's a matter of responsible growth. She says: “What these models are suggesting is that the patterns of growth may change.” She says: “It's part of our reality check, an appropriate one, that we make sure the people buying these homes can be confident that the water is there.” Groundwater as Key to the Future An Arizona State University professor doesn't feel that the issue is being addressed as a major priority. He told the Post: “I'm incredibly concerned. I don't think that people, and this is everyone, the general public, but right up to our water managers and elected officials, really understand now that groundwater is the key to our future.” (2) It's a reality check for states and cities across the west, including those who draw water from the drought-stricken Colorado River. The Colorado River supplies drinking water to 40-million people along with hydroelectric power to millions. As the two states using the most water from the Colorado River, California and Arizona are part of a preliminary deal to conserve and reallocate water from the river. Voting Rights Lab reports that over 80 election-related bills were filed this session, after a past year of conspiracy theories and chaos in counties around Arizona. Last Monday, Gov. Katie Hobbs, who won a bruising campaign over election denier Kari Lake last year, vetoed SB 1074, which would have required ballot tabulating machines to be made entirely of U.S. components. Testimony on the bill indicated that no such replacement machine exists, meaning elections would be hand counted – a slower, less accurate and more expensive method.Hobbs also vetoed HB 2415, which would have purged registered voters from the semi-permanent vote-by-mail list after just one election cycle if they didn't vote. Currently, non-voting voters are removed from the list after two-cycles. Signature matching is notoriously inaccurate, particularly for elderly and disabled voters. HB 2322, a bill which would have codified signature verification already in practice under Arizona's election guidelines, was also vetoed by Hobbs.
