In this presentation, Pamela Samuelson, professor of Law and Information at UC Berkeley, discusses whether computer-generated texts and images fall under the copyright law. She says that early on, the consensus was that AI was just a tool, like a camera, so humans could claim copyright in machine-generated outputs to which they made contributions. Now the consensus is that AI-generated texts and images are not copyrightable for the lack of a human author. The urgent questions today focus on whether ingesting in-copyright works as training data is copyright infringement and whether the outputs of AI programs are infringing derivative works of the ingested images. Four recent lawsuits, one involving GitHub's Copilot and three involving Stable Diffusion, will address these issues. Samuelson has been a member of the UC Berkeley School of Law faculty since 1996. She has written and spoken extensively about the challenges that new information technologies pose for traditional legal regimes, especially for intellectual property law. She is a member of the American Academy of Arts & Sciences, a fellow of the Association for Computing Machinery (ACM), a contributing editor of Communications of the ACM, a past fellow of the John D. & Catherine T. This series on artificial intelligence explores recent breakthroughs of AI, its broader societal implications and its future potential. In this presentation, Pamela Samuelson, professor of Law and Information at UC Berkeley, discusses whether computer-generated texts and images fall under the copyright law. She says that early on, the consensus was that AI was just a tool, like a camera, so humans could claim copyright in machine-generated outputs to which they made contributions. Now the consensus is that AI-generated texts and images are not copyrightable for the lack of a human author. The urgent questions today focus on whether ingesting in-copyright works as training data is copyright infringement and whether the outputs of AI programs are infringing derivative works of the ingested images. Montana is one of the states in our country signing anti-queer and anti-transgender laws – among the rash of laws signed just this year, since January, in Montana, are laws that allow healthcare providers to refuse patients based on conscience, that define biological sex as only male or female, that prevent gender-affirming medical care for transgender kids, and that prohibit drag shows and drag story hours if there are minors present. These new laws will hurt Montana's transgender residents – and that's essentially their intention. Our guest today is raising a more specific concern, and says that Montana's anti-transgender laws will hurt Indigenous peoples' religious expression. Rosalyn LaPier, is an indigenous writer, environmental historian, ethnobotanist, and a professor of history at the University of Illinois at Urbana-Champaign. Ultimately, America abandoned the failed enterprise of the prohibition, and everyone - except, it seems, the New Zealand legislature - learnt the bitter lesson that it is impossible to force people to abandon addictions. Tayo further questions the ethics and morals of what he sees as a serious human rights violation. The pro-liberty advocate is general counsel, Southeastern Legal Foundation, a non-profit public interest constitutional law firm that advocates for individual liberty, free speech, economic freedom and the rule of law. In a penetrating opinion piece recently on five 'ways' Americans could see their First Amendment rights radically challenged during the Biden Administration, she wrote: "One word, five letters: 'unity.' It is the left's new mantra. How do we know? Because the mainstream media can't stop praising and echoing President Joe Biden's inaugural calls for unity. But a word is simply a word." "The actions of the left over the years have told a different story, a sneaky one," added Hermann. "One in which they use unity to create a divide. We are 50 states united as one nation under God. In that sense, we can all agree that unity is no doubt a civic virtue we should strive for. But today's use of the word "unity" is simply a wolf in sheep's clothing, and it comes at a cost to conservatives. That cost is your voice, your speech, your constitutional right." The Southeastern Legal Foundation is paying close attention to disturbing trends for conservative-minded students on college campuses in America. It's a trend, however, that cuts a wide swathe across the American population. "If you are a college student, or anyone else for that matter, and you disagree with any policy coming out of the left – for example, on climate change -- then you are personally responsible for dividing our country.," said Hermann. "if you agree [with the left], then you are very uniting our country." Added Hermann: "That is not what our country is founded upon." In our wide-ranging interview, Hermann spells out how students on college campus, and the American public generally, may find themselves "cancelled" unless they tow the new woke line of thinking. "We've had multiple calls from students we've worked with, who've been physically assaulted, simply because they are standing up for the constitution," said Hermann. NASIR: Oh, I messed you up, right? This is our podcast where we cover business in the news and answer some of your business legal questions that you, the listener, can send in to ask@legallysoundsmartbusiness.com. Very fun episode today. I’m really looking forward to something that I’m very much into which is CrossFit. Actually, I’m not at all. Never done it in my life but I feel like I should say that. MATT: Yeah, I’ve never done it, never plan on doing it. I have friends that are all about it and I’ve seen people do it. It just seems like it’s asking to be injured. It’s not natural. They’re just, like, jerking around tons of weight awkwardly and – I don’t know – it just seems very questionable but I’m sure it can get you into good shape, if done correctly. NASIR: Yeah, I think the problem is a lot of people do it incorrectly because they’re either not being trained properly or the trainer doesn’t know what they’re doing. Actually, what I am into is all the CrossFit videos of people getting injured doing crazy stuff. That’s pretty funny. MATT: I like to watch injuries. NASIR: Yeah, but they do some really, really dumb stuff and it’s obvious bad form. And then, of course, it’s really what not to do in CrossFit. MATT: Well, it’s one of two things, right? It’s either people that are pushed too far – like, they just go on to keep doing more and more weight or more and more reps so they’re going to push themselves and compromise their body; or, two, they’re just so tired at that point that you’re not 100 percent and you just let something slip and that’s how you get hurt. NASIR: Yeah. MATT: But I’m not like you and like to watch people get injured. NASIR: Uh… Well, I mean, that’s about as close as I can get to CrossFit. MATT: Yeah. NASIR: But there is a joke with CrossFit that I think there’s one rule about CrossFit that you don’t stop talking about CrossFit which is totally true because people that are in it are way in it. I don’t know what it is. MATT: It’s a cult, basically. So, what we’re going to talk about, this is a CrossFit gym in West Palm Beach, Florida. The reason I like talking about these is they’re just good conversation pieces and we’re dealing with trademark infringement, just to let people know. I like to have the debate of whether this is an infringement or not for these things. So, basically, those of you who are familiar with Nike – which I hope everyone is – they have the Jordan brand which, I’m sure, everyone has seen – even you, Nasir. NASIR: Michael Jordan! MATT: Even you who doesn’t watch too much basketball, I’m sure you know who Michael Jordan is and have seen the logo at some point. NASIR: I stopped following basketball when he retired the first time. MATT: 1998. Well, that’s a while ago. So, we’ll link it on the show notes but it’s him, you know, just jumping through the air. It’s the iconic shot of him – like, the ball up in the air, one leg up, one leg back. NASIR: Dunking. MATT: On his way to dunk. So, this CrossFit gym, their logo is basically the exact, it’s not exactly the same but it’s the Michael Jordan Jumpman logo but upside down. NASIR: It’s pretty close. MATT: I just don’t really understand it, I guess. Is it trying to make some sort of message? I don’t understand it to begin with, but that’s why Nike is going after them, saying, “We own the rights to the Jumpman logo. This is infringement. You’ve just taken our logo and flipped it upside-down.” NASIR: How come I can’t find their actual logo? I keep finding the Nike logo. MATT: Yeah, I was just trying to find that, too.
