Force Placed Insurance Charges Allow Special Defense to Foreclosure Post 4802 In an action to foreclose a mortgage the trial court granted in part the plaintiff's motion to strike the defendant's special defenses and counterclaim; subsequently, the court, Cirello, J., granted the plaintiff's motion for summary judgment as to liability only; thereafter, the court, Spader, J., rendered judgment of foreclosure by sale, and the defendant appealed. In M&T Bank v. Robert R. Lewis, No. SC 20817, Supreme Court of Connecticut (April 30, 2024) the appeal of a foreclosure judgment presented one question important to insurance professionals: Whether allegations of impropriety in a mortgagee's force placement of property insurance arise from the making, validity or enforcement of the mortgage for purposes of a special defense to a foreclosure action. Robert R. Lewis claimed that the trial court improperly granted the plaintiff's motion to strike two of the defendant's special defenses arising from the plaintiff's conduct in its force placement of flood insurance on the property at issue, alleging that the plaintiff had unclean hands and breached the implied covenant of good faith and fair dealing on the ground that those defenses do not arise from the making, validity or enforcement of the mortgage. After the defendant failed to make his monthly payment on August 1, 2017, the plaintiff notified him in writing of his default. The plaintiff subsequently elected to accelerate the note and foreclose on the mortgage. The parties participated in the state's court-supervised foreclosure mediation program but were unable to reach an agreement to modify the loan. The trial court granted the plaintiff's motion for summary judgment as to liability only. Defendant's claim that the trial court improperly granted in part the plaintiff's motion to strike the defendant's special defenses of unclean hands and breach of the implied covenant of good faith and fair dealing predicated on the plaintiff's improprieties in the force placement of the flood insurance, do not ''arise from the making, validity or enforcement'' of the mortgage. In the present case, the trial court struck the special defenses of unclean hands and breach of the implied covenant of good faith and fair dealing on the ground that the defendant's allegations did not relate to ''the specific mortgage at issue in this case.'' (Emphasis added.) The question remains whether those allegations are sufficiently related to the making, validity or enforcement of the mortgage. The Supreme Court concluded that they are. The defendant alleges, the plaintiff charged the defendant an amount greater than the ''cost'' of the insurance, in violation of section 5 of the mortgage agreement, concealed a ''kickback'' agreement that it had with ASIC. All of this alleged conduct is directly related to the plaintiff's reliance on and enforcement of section 5 of the mortgage agreement. The Supreme Court noted that the alleged effect of the plaintiff's conduct in enforcing section 5 of the mortgage agreement-that it wrongfully increased the defendant's overall debt-provides a sufficient nexus to the foreclosure action. Defendant's allegations in support of the special defenses are sufficiently connected to the enforcement of the mortgage. Since an action to foreclose a mortgage is an equitable proceeding it is a fundamental principle of equity jurisprudence that for a plaintiff to show that he is entitled to the benefit of equity he must establish that he comes into court with clean hands. The clean hands doctrine is applied not for the protection of the parties but for the protection of the court. It is applied not by way of punishment but on the basis of considerations that make for the advancement of right and justice. A mortgagor who has defaulted on a mortgage is not precluded from asserting the special defense of unclean hands. Therefore, the Supreme Court took the Defendants allegations as true it concluded that the defendant alleged willful conduct that is not equitable, fair or honest. The defendant sufficiently pleaded that the plaintiff's alleged misrepresentations interfered with his right to receive the benefits of the agreement. This Defendant did by alleging that the plaintiff's kickback scheme wrongfully resulted in the defendant's payment of more than he was obligated to pay and more than the plaintiff was entitled to charge him, pursuant to the mortgage agreement. By alleging that Plaintiff's conduct with force placed insurance increased his overall debt the trial court improperly struck the special defenses. Insurance is important to every mortgagee needing it to protect the security for the loan. Mortgages require insureds to obtain insurance and allow, if they fail, to obtain force placed insurance that only protects the mortgagee at the expense of the insured. However, the mortgagee should never charge the insured more than it pays since that would be fraudulent and, as in this case, a defense to the foreclosure. (c) 2024 Barry Zalma & ClaimSchool, Inc. I'm interning for Leg Up Legal and I'll be today's guest host for The Law Lives Project. This week's guest had a rough start to law school due to a bad relationship, but managed to find her way. She got exposure to law by working for a jury consulting company and she decided to continue working for that company and go to law school part-time. After law school, she started working for an insurance defense law firm, and she utilized the early years of her career to explore lots of different practice areas and practicing different law firms. Hi, my name is Bill Johnson, I'm a partner here at Moore Ingram Johnson & Steele. Along with my duties as general counsel for the firm as well as I've been a partner, I handle large liability claims in various areas including a lot of liability claims, motor vehicle claims including trucks, and even such things as premises liability. In addition to that, I also work with 831 (b) captive arena with Matthew Howard. Due to my experience with insurance, I write policies for our clients, investigate claims, determine if they're appropriate to be paid and handle that portion of the 831 (b) as well. I think one of the things that make Moore Ingram Johnson & Steele different from other firms is that I, like every other attorney here, really care about the clients. Clients want about three things from you. They want you to do what you tell them you'll do, they want you to care about their problems and they don't want surprises. If you have something bad happen in a case, call them and tell them. If you have something good happen in a case, certainly call them and tell them. I'm passionate about my family, my faith and my clients. I think those three relationships all require trust and dedication and I always try to provide that in all three. I've been married to a wonderful lady who's been my wife for almost forty years. I have three grown children now, all married very recently and I have two wonderful grandkids and all the stories you've heard about grandkids are true. I think one thing that sets our firm aside is we're set up very much like a large firm, we're just smaller. We try to produce excellent work product just like the big firms at a more reasonable rate. I think one of the things that make my practice different is that I fly all over the country for various clients. I have been blessed in that several clients has picked us as either regional or even national council in certain products which allow me to try cases with being friend of the court all over the nation. I'm also licensed both in Kentucky, Tennessee and Georgia so I don't need the friends of the court status in those cases. We've been very blessed to have that opportunity. You know when I graduated from law school, I was going into corporate law. And I got a job in South Georgia and when I started, they said that they actually had more work in the workers’ comp department than they did in corporate. So I decided to take a shot at doing workers’ comp defense and actually I have been doing workers’ comp defense now for the last 20 years representing employers throughout the State of Georgia on the workers’ comp issues as well as other employee employment issues. My name is Rodney McColloch and I am a partner here in the Workers’ Comp Department at Moore Ingram Johnson and Steele. I primarily handle workers’ compensation defense, other insurance defense issues, and some employment issues for employers throughout the state. I definitely feel like someone was watching over me when I started the practice of workers’ compensation defense rather than corporate. I have to say that my personality fits it better. I like things to move along fast, I like to be creative and sitting behind the desk all day pushing papers is definitely not my personality. So, I am thankful that I had that opportunity and now 20 years later, I am still handling workers’ compensation cases every day throughout the state of Georgia and actually into other states in the southeast. The hardest part of practicing law is keeping your priorities and having a balance. I would say my number one priority is my family. My wife and my three daughters. I love to spend time with them, which is probably why I'm a terrible golfer. If I ever had a five-hour window, of free time, I would love to spend it with my family rather than be on the golf course. Maybe that will change when I retire. My second passion other than working is wine. And anyone that has been to my office can tell I have a lot of wines. I love tasting unique wines. I actually got engaged in Napa and the one thing that I tell my clients is that, unlike wine, claims don't get better with age. So I like to move claims along very quickly. A lot of clients asks, "What sets us apart from our competition?" And I would say that aside from hiring really good attorneys, smart people and aggressively pursuing claims and being creative, is our communication. We have always strived to keep our clients informed and we believe that a client that is informed the whole way along will not have any surprises and will anticipate the outcome and be happy with it. I know that all the young attorneys that we hire at our firm, we always tell them that a client can handle bad news, but they can't handle our surprises. So, we try to make sure that everybody is included in the decision-making process and at the end of the day, hopefully everybody gets the result that they're looking for.
