Transferred from Grady Hospital in Atlanta after receiving treatment for car crash-related injuries, Elizabeth was admitted to Landmark Hospital with a stable stage 2 sacral ulcer, which quickly escalated to stage 4. The pressure ulcer took a full year to heal, but Elizabeth's activities continue to be limited due to the poor wound care she received. Despite the defense's attempts to blame Landmark's new medical records system, Elizabeth's daughter and even Elizabeth herself for her injuries, a Gwinnett County, Georgia jury returned a verdict of $1,300,000 in damages.    Guest Bio: Richard Mitchell Richard C. Ward Black Law is now one of the largest woman-owned law firms in North Carolina. Attorney Janet Ward Black is the principal owner of Ward Black Law located in Greensboro, North Carolina. It is one of the largest woman-owned law firms in North Carolina. The firm's clients have received settlements of more than $100 million over the last 10 years. The firm represents people injured at work, in accidents, and by dangerous products and environmental hazards across North Carolina. A graduate of Davidson College cum laude in economics and Duke Law School, Black served as the third woman president of the North Carolina Association of Trial Lawyers and the fourth woman president of the North Carolina Bar Association. She was the second lawyer in history to serve as president of both organizations. Welcome to episode 197 of the Grow Your Law Firm podcast, hosted by Ken Hardison. In this episode, Ken sits down with Michael Moebes, founding attorney at Moebes Law, to discuss how Michael has mastered referral partnerships. Michael Moebes, Esq. is the eponymous founding attorney at Moebes Law, LLC: a law practice dedicated to representing injured individuals. Specifically, Moebes Law specializes in workers' compensation, veterans disability, and personal injury claims. Has an accident ruined your life? You should probably give Michael Moebes a call. Michael began his professional career as a client representative with IBM before resigning to attend law school at Georgia State University in Atlanta. He spent three years representing employers and insurers at the insurance defense law firm of Drew, Eckl & Farnham in midtown Atlanta before joining the legal team at Liberty Mutual Insurance Company for two years. These five years taught him how insurers evaluate injury claims in terms of validity and financial exposure in addition to teaching him about the nuances of practicing injury law throughout the great state of Georgia. In 2009, Michael started Moebes Law, LLC and has passionately represented the injured ever since. In fact, he has recovered millions of dollars and won countless medical procedures in the course of his representation of injured workers and veterans since starting his firm. He is active in the National Organization for Veterans Advocates, the Workers Injury Law and Advocacy Group, and numerous local and national bar organizations. He's a registered neutral by the Georgia Supreme Court as well. Michael has been named a “Rising Star” (before he was over 40) and then a “Super Lawyer” by the Georgia “Super Lawyers” organization multiple times, an honor given to 2.5% of attorneys in their practice field as voted upon by their peers. He has also been named among the “Legal Elite” by GeorgiaTrend magazine. He has lectured at the Georgia Trial Lawyers annual convention, the “Fundamentals of Law Practice” course at Georgia State University College of Law, and the “National Return to Work Week” radio show. In 2013, he was interviewed for the companion guide of “Solo By Choice,” a guide to starting one's own law firm. When not practicing law, Lieutenant Colonel Moebes served as a Medical Service Corps officer with the U.S. Air Force Reserves for 23 years before retiring in 2020. He deployed three times in support of Operation Iraqi Freedom: twice to Balad Air Base, Iraq and once to Andrews AFB, Maryland. In the course of his decorated military service, he facilitated the aeromedical evacuation of thousands of wounded warriors, and he participated in the Jessica Lynch rescue mission in 2003. He was featured in cover story articles in the Daily Report newspaper after both Iraqi deployments. The three-part “Iraq Diary” article published in October 2003 won national recognition. When not serving his country or his clients, Michael enjoys traveling, writing, and time with his three young children, wife, and dog of questionable lineage. He and his family are active members at Buckhead Church and support several local charities, including Wellspring Living, the Sandy Springs Conservancy, and the Anti-Defamation League; he was selected to the Glass Leadership Institute for the ADL. Read Full Bio Here Dax López For nearly 11 years, Dax served as a judge on the State Court of DeKalb County where he presided over complex criminal and civil matters.  As only the second Hispanic judge on a court of record in the history of Georgia, Dax was known to be an efficient, fair, and just jurist who earned the respect of lawyers and litigants alike. A native of Ponce Puerto Rico, Dax attended Vanderbilt University and Vanderbilt Law School where he was an editor on the Vanderbilt Journal of Transnational Law and the president of the Vanderbilt Bar Association.  After law school, Dax served as the law clerk for federal judge Hector M. Laffitte in the Federal District Court for the District of Puerto Rico. Prior to his appointment to the bench, Dax was a trial lawyer at three prestigious law firms in Atlanta specializing in complex civil matters, business litigation, product liability, and employment law. Throughout his legal career, Dax has received numerous recognitions.  Dax has been named as one of the Top Fifty Industry Leaders by the Atlanta Business Chronicle, as among Georgia's Legal Elite by Georgia Trend magazine, and as a Rising Star in 2009 and 2010 by the SuperLawyer Magazine.  In 2010, Mundo Hispanico named Dax to be the Funcionario Destacado del Aňo.  In 2011, Dax was named by Georgia Trend Magazine to be among the best and brightest 40 Under 40 and by The Fulton Daily Report to be among those in the legal profession who were “On the Rise.”  He is also the recipient of the Justice Benham Community Service Award. Rich, a retired Brevard County District Fire Chief, strategically swerved and ultimately rolled his truck to avoid crashing into a Domino's delivery car that pulled out in front of him. Rich was rendered a quadriplegic and died 15 months later due to complications. An Orange County, Florida jury returned a verdict of $8,977,788.55 in damages against Domino's Pizza LLC. His knowledge and understanding of the legal needs of his clients come not only from the practice of law but from his early career as sheriff's deputy in Alachua County. Before becoming a law partner at Avera & Smith in 1989 (then Avera & Avera), Mark served as a sheriff's deputy for Alachua County. He became the department's youngest deputy ever to be promoted to the rank of Sergeant. His primary assignments were uniform patrol division, SWAT, and the supervision of the department's Street Crimes Unit. Mark completed his bachelor's degree at the University of Florida while working midnight shifts for the Sheriff's Department and went on to graduate from UF with a law degree. Today on the podcast, Robin and Lester interview Ray Persons, Senior Litigation Partner at King and Spalding and President of the International Society of Barristers.   Ray Persons: W. Ray Persons is a senior litigation partner at King & Spalding, an international law firm that represents a broad array of clients, including half of the Fortune Global 100, with 900 lawyers in 23 offices in the United States, Europe, the Middle East and Asia.  Ray has a national practice focused on product liability, mass tort, class action and complex litigation.  Ray has represented more than 50 of the Fortune 500 as counsel or national coordinating counsel for clients in the pharmaceutical, automotive, chemical and energy industries; he has served as lead counsel in 92 jury trials, 90 percent of which went to verdict.  He has served as lead counsel in over 25 Engle progeny tobacco jury trials.  He serves as national counsel in In re UST Litigation for one of the world's largest petroleum companies in claims brought by dozens of states alleging fraudulent overpayment of claims for reimbursement of costs associated with cleanup of underground storage tanks.  He served as national coordinating counsel and lead trial counsel for Union Carbide Corporation in the successful defense against claims of an alleged industry-wide conspiracy to subject workers to cancer-causing chemicals.  He represented one of the world's largest pharmaceutical companies in a 442-plaintiff case involving claims of exposure to arsenic and chromium stemming from the 60- year operation of a manufacturing facility in New Jersey.  Ray successfully defended against claims brought by 1,200 homeowners and residents who lived in the vicinity of a fertilizer plant; the chemicals of concern were arsenic, lead, mercury and sulfur dioxide.  Ray is regarded as one of the best trial lawyers in the country, as evidenced by his election as a Fellow of the American College of Trial Lawyers, the International Society of Barristers and the Litigation Counsel of America.  He holds the rank of Advocate in the American Board of Trial Advocates.  He is listed in The Best Lawyers in America in four categories:  Commercial Litigation, Bet-the-Company Litigation, Mass Torts, and Product Liability; Chambers USA:  America's Leading Lawyers for Business; Lawdragon 500; The Legal 500; Georgia Trend magazine's “Legal Elite,” and Atlanta Magazine's Georgia Super Lawyers (Top 10 for eight consecutive years).  He is a member of the Defense Research Institute, Federation of Defense and Corporate Counsel, International Association of Defense Counsel, and American Health Lawyers Association.  Ray received his undergraduate degree in 1975 from Armstrong State College and his law degree in 1978 from The Ohio State University.  He was awarded the Armstrong State University Distinguished Alumnus Award in 2000, the Moritz College of Law 2005 Distinguished Alumnus Award, The Ohio State University 2006 Distinguished Service Award, and The Ohio State University 2012 John B. But it has to be written into the contract, and it must describe what can fall into that category. It often plays in with other pieces of the contract, such as non-refundable deposit, etc. It is not all-inclusive. The event industry as a whole has exploded. On both the vendor and couple side, a lot of money is being invested. Wedding professionals are starting to come back to their clients with amendments to their contracts. When a lot of changes are going to be needed, a cancellation is a much better option to move forward. The best option if things are staying pretty much the same is an amendment. Things to look for in an amendment or new contract - What is the reschedule date? What is included in this reschedule? Make sure you are getting something similar. Be specific as possible. You can ask for things to be rewritten or revised! Make sure it references the date of the first contract and the new dates. What payments are being applied where? Everyone who signed first contract needs to sign the new one Make sure postponements are addressed. If you have to reschedule your rescheduling, it's important to be covered. Depending on the way it's written, you should be able to postpone again. If you are confused or struggling through this at all, it would be smart to connect with a lawyer. You don't need a partner level lawyer to read through these contracts. You can go with a lower level associate, who understands contracts, to get you into a place where you can feel comfortable and confident.
