Join Ben and Rahul for their in-depth discussion of Ben's recent three-week jury trial in which Ben represented a little girl who developed cerebral palsy following the development of necrotizing enterocolitis in the NICU.  Ben discusses how decision-making guided by big data led to him and his client to turning down an $11 million offer after closing arguments to take a verdict.  He discusses what he learned following extensive discussions with jurors following the trial. Ben describes how this verdict influences his thinking about data, risk and approach to trial moving forward.About Ben Gideonhttps://gideonasen.com/our-team/benjamin-gideon/Ben grew up in Portland, Maine, attended public schools and graduated from Deering High School in 1989. Ben's father, Martin Rogoff, was a prominent member of the Maine Law School faculty, so Ben grew up immersed in discussions of the law. Ben began to develop his legal skills early in life through nightly arguments with his father at the dinner table. In high school, Ben played varsity soccer and was the captain of the hockey team. Following high school, Ben attended Cornell University in Ithaca, NY. Ben attempted to walk on to the Cornell hockey team, but was eventually cut from the team, ending his hockey career. Depressed and disappointed at this failure, Ben became a poor student, failed several classes, and was told he was being suspended from college on academic probation. After rehabilitating himself through some community college courses, Ben was able to gain re-admission to Cornell and to complete his degree. Ben applied to law school and was admitted to Boston University School of Law. There, Ben was a standout student. His grades were so exceptional after his first year that he was accepted as a transfer student to Yale Law School where he earned his law degree.Ben began his career in private practice at a large, multi-national law firm, Latham & Watkins, in New York City. Ben achieved success in a broad range of different types of plaintiff's cases—police civil rights, product liability, medical malpractice, nursing home, maritime and industrial accidents.Early in his career, Ben achieved a landmark civil rights verdict against a police officer for violating his client's civil rights with a Taser shooting. Here is how ACTL describes the qualifications required for membership:Membership in the College cannot exceed one percent of the total lawyer population of any state or province.Founding Gideon Asen LLCAfter 17 years at Berman & Simmons, in November 2020, Ben decided to leave one firm he loved and had helped to build, to form a new law firm, Gideon Asen LLC.“I was very proud of everything we accomplished at Berman & Simmons,” Ben said, “but I was excited by the challenge of building a new firm that could be even better.”Ben's first step was to recruit Taylor Asen to join him.“Taylor and I have a common mission,” Ben said. “Although we're separated by 12 years, Taylor also attended Yale Law School and completed prestigious Federal clerkships. He's insanely smart.”“But perhaps more important, Taylor and I share a common vision of a plaintiff's law firm where clients have access to exceptional lawyers and service. We are both supremely competitive and don't tolerate mediocrity. We believe we owe it to our clients to give them the very best, and that is what Gideon Asen will provide.”Podcast, Writing and TeachingBen enjoys thinking about the practice of trial law and strategies for success and is a frequent writer and speaker on trial topics.Ben co-hosts a podcast called Elawvate! which focuses on the human factors and guiding principles that drive successful lawyers and law firms.Personal Life and InterestsBen lives in Freeport, Maine, with his wife, Sara Gideon, and three children, Julian, Aleksandr, and Anna Josephine. Transferred from Grady Hospital in Atlanta after receiving treatment for car crash-related injuries, Elizabeth was admitted to Landmark Hospital with a stable stage 2 sacral ulcer, which quickly escalated to stage 4. The pressure ulcer took a full year to heal, but Elizabeth's activities continue to be limited due to the poor wound care she received. Despite the defense's attempts to blame Landmark's new medical records system, Elizabeth's daughter and even Elizabeth herself for her injuries, a Gwinnett County, Georgia jury returned a verdict of $1,300,000 in damages.    Guest Bio: Richard Mitchell Richard C. Mitchell is a partner with Mitchell & Shapiro LLP. He concentrates on personal injury matters, including medical malpractice, trucking and auto wrecks, and aviation crashes. In December of 2003 and 2014, he was voted by his peers in Georgia Trend magazine as one of Georgia's “Legal Elite” in the personal injury area. From 2003-2019 the readers of Atlanta Magazine voted him a “Georgia Super Lawyer” in personal injury litigation. He is regarded as one of the most experienced personal injury and medical malpractice lawyers in the Atlanta, Georgia area and has received the highest possible professional rating, Martindale-Hubble's AV Preeminent rating, consecutively for 20 years. After clerking for 2 United States District Court judges in Atlanta, Richard C. Mitchell was an associate and partner with the major law firm Powell, Goldstein, Frazer & Murphy for over 14 years before leaving to start his own firm in 1997. During that time, he successfully represented numerous manufacturers and insurers in product liability cases, including manufacturers of automobiles, aircraft and aircraft components, forklifts, woodworking machinery, chemicals, conveyor belts, and electric limit switches. He left the large firm in order to concentrate on representing injured individuals. Mr. Mitchell's years of experience defending clients in personal injury cases and working with insurance companies have given him a unique insight into the civil litigation process and an ability to work with defendants to obtain favorable results for his clients. He is a successful veteran of more than 100 trials, arbitrations, and mediations; he, therefore, has the experience and skills to achieve his clients' goals before a judge and jury in the event a settlement cannot be reached. In this episode, Steve Fretzin and Christina Martini discuss:How Tina pivoted from engineering to legal. Selling big law by increasing the stickiness factor through cross-selling.Minding your assets in networking and cross-marketing. Building your book of business authentically.  Key Takeaways:The practice of law is not that different from having and nurturing the relationships in your life. Everything is all about relationships which are dynamic and require proactivity. Good business development, whether in a solo firm or in big law, requires a multi-pronged approach. Leverage existing clients, leverage your network, and talk to your peers. The right work for you is out there, but you've got to ask for it. Be prepared and have dynamic conversations with your potential clients. It will help build and nourish the relationship, but it will also create opportunities. As a woman, embrace who you are, embrace your femininity and who you want to be in the world when you go to market. Be authentic in your relationship building and in building your book.  "The rubber really meets the road when you cross-sell your clients into areas that are completely unrelated to yours. That's how you institutionalize clients. This week, Simone is joined by two CLC experts, Erin Chlopak and Brendan Fischer, as well as attorney Peter Earle and “BadAss Grandmas” Ellen Chaffee and Dina Butcher. These guests help explain two key instances in which big money spending impacted local communities. Importantly, they also explain how every day citizens can make their voices heard.Campaign finance can sometimes seem like something far removed from our everyday lives, maybe something that only matters in Washington. But there's a lot going on at the state and local levels, too, and there's a lot that everyday citizens can do to influence things and ensure their community's voices are heard. Guests:Dr. Ellen Chaffee is a consultant to university governing boards after a long career in higher education research and administration. This included two university presidencies, presiding over two national professional associations, and serving on boards of directors. After decades of political independence, she agreed to be a running mate to a gubernatorial candidate, which taught her "too much" about how the current political system works and how unsuited she is for that arena. Her alter ego, BadAss Grandma for Democracy, works to improve America's flawed democracy, which is a root cause of most social problems.Dina Butcher's grandson's friend dubbed her BadAss after seeing her picture on a brochure promoting an initiated measure to amend the ND Constitution regarding having an ethics commission and requiring transparency in political influence on elections. This 2018 campaign led to many of her fellow Republicans questioning her loyalty. As a first generation American, born to German-Jewish refugees who fled Germany in 1939, she feels she needs to speak up against the militant right infiltration of the Republican party. Since she tended a Goldwater campaign headquarters “trailer” in King George County, Virginia with a pause while her husband served in the FBI, she has been a Republican activist, run for elective office in 1996 and served in three Republican administrations. This graduate of Skidmore College with teaching credentials earned at Minot State College, says her daughters say “she has lost her filters and gained her voice” in this her ninth decade.Erin Chlopak leads CLC's work to promote and defend strong campaign finance laws and ensure that existing laws are enforced. Through litigation, advocacy and public education, Erin works with CLC's campaign finance team to make our political system more transparent and accountable, and to protect the right of every American to participate in the democratic process.Read her full bio here.Peter Earle was born in Mexico City on June 22,1950, and emigrated to the United States in 1955.  He graduated from the Chicago-Kent College of Law with High Honors in 1988. As an attorney, Mr. Earle has been selected for an AV Preeminent rating by Martindale-Hubbell each year for the last 30 years. Mr. Earle has also successfully litigated numerous individual lead poisoning cases resulting in the expansion of the risk contribution doctrine in cases where the plaintiff is unable to identify the manufacturer of the product that actually caused the injury. Thomas v. Mallett, 701 N.W.2d 523 (WI 2005); Gibson v. American Cyanamid, 760 F.3d 600 (7th Cir. 7/14/14). He is widely regarded as an aggressive bilingual lawyer dedicated to enforcing the rights of working people and holding accountable those who abuse authority.Brendan Fischer currently serves as Deputy Executive Director at Documented, having served as Director, Federal Reform at CLC from 2016-2022. He has expertise in campaign finance, government ethics, lobbying and political transparency issues, and is a frequent commentator for national news publications. He also has spoken at conferences and events nationwide on money-in-politics issues. Before CLC, Brendan was General Counsel with the Center for Media and Democracy, where he led the watchdog group's legal research and advocacy efforts. Links for Part One:“Bad Ass Grandmas Say Alaskans Should Vote for More Transparency in Elections” (Campaign Legal Center)“How Our Government Put Money and Oil Before the People of North Dakota” (Campaign Legal Center)“Ballot Initiative in North Dakota Aims to Increase Transparency” (Campaign Legal Center)“Badass Grandmas” on Facebook“North Dakotans for Public Integrity” on FacebookAbout the North Dakota Ethics Commission    Links for Part Two:“Secret Money Puts Our Health and Safety at Risk” (Campaign Legal Center)“Senate Must Act to Bring Dark Money to Light” by Peter Earle (Daily Kos)"Poisoned by their homes: how the US is failing children exposed to lead” (The Guardian)Lead-Safe Wisconsin About CLC:Democracy Decoded is a production of Campaign Legal Center, a nonpartisan nonprofit organization which advances democracy through law at the federal, state and local levels, fighting for every American's right to responsive government and a fair opportunity to participate in and affect the democratic process. On Thanksgiving Day in 2000, 17-year-old Shannon Houchin was driving to work when she crested the top of a hill and saw the headlights of a garbage truck in her lane. She quickly swerved to avoid the large Monarch Environmental truck and swerved again to avoid a pedestrian, which sent her car spinning and sliding sideways into the garbage truck. As a result of the crash, Shannon spent over 50 days in a coma and sustained brain and physical injuries that require round-the-clock care, including involuntary muscle contractions, bilateral third nerve palsy, dementia and hyperphagia -- a memory-related eating disorder. Trial lawyer Tyler Thompson shares how he utilized testimony from residents who had near collisions with Monarch Environmental garbage trucks and how the company ignored warnings about parking on the opposite side of the street for two years — some incidents being as recent as one week before Shannon's accident. In spite of the defense's arguments, a Warren County, Kentucky jury found that Shannon was not at fault and awarded her $27,335,667.87 in damages.    Click Here to Read/Download the Complete Trial Documents     Guest Bio: Tyler Thompson Tyler Smyth Thompson is a graduate of Berea College and the University of Louisville Brandeis School of Law, and currently the senior partner at the law firm Dolt, Thompson, Shepherd & Conway, PSC in Louisville, Kentucky.  He and his wife, Frances Travis Thompson MD, have three daughters, Calley, Madison and Ellery.   Mr. Thompson has represented clients in medical negligence and products liability cases throughout the United States.  He has achieved a number of eight-figure settlements on behalf of injured clients and has obtained a number of multi-million dollar verdicts at trial, including three verdicts exceeding $10 million dollars and two verdicts exceeding $20 million dollars.   In 2008, Mr. Thompson became an invited member of the Inner Circle of Advocates, a trial lawyer organization limited to 100 lawyers in the United States, which the National Law Journal has called "a fraternity of superstar personal injury litigators" and the Washington Post recognized as "a select group of 100 of the nation's most celebrated trial lawyers."  Super Lawyers Magazine has selected Mr. Thompson as one of the top 10 attorneys in Kentucky on multiple occasions and in the 2021 Edition, he was ranked number one among all Kentucky lawyers.   Mr. Thompson is an invited member of the American College of Trial Lawyers, the International Academy of Trial Lawyers and a past recipient of the Peter Perlman Outstanding Trial Lawyer Award, given annually to an attorney in Kentucky who has demonstrated excellence in the courtroom.  He has an AV Preeminent rating from Martindale-Hubbell and is listed in Best Lawyers in America. How To Get The Right People When Preparing For Divorce with Eric Broder

The Divorced Woman's Guide Podcast

If you are contemplating going for divorce or currently going through the process, who are the right players that you need to assemble and have on your side? In this episode, Top Lawyer in Family Law, Matrimonial, Arbitration, and Mediation, Eric Broder joins us to share valuable inputs on where to start and identify who and when to get certain professionals involved in the process — whether that be before, during, and after your divorce.  Key points in this episode:  ✔️ Eric posits that early on, it is necessary to get a therapist or a divorced coach, "we are not as qualified as a therapist who can get to know you in an entirely different manner and be with you when the case is over." Lawyers most often can focus on the legal side and are not fully qualified to assist you in dealing with the emotional and psychological aspects. ✔️ Be careful who you listen to. Friends and people close to you should be supportive and encouraging during the process. However, should your friends tell you about their case, or the people they know may confuse you. Remember, every case is different, and you must focus more on yours and talk to the professionals. ✔️ Remember that while a divorce is personal, it is also a business transaction. Eric shares that clients who had their cases move the fastest are the ones that decide rationally and treat it like a business transaction. "In 80 -90% of our cases, people figure out what to do with their kids and don't have many issues." ✔️You may need a real estate appraiser to come in. Many states don't recognize what a real estate broker values a house; if you cannot agree on the value of a house with your spouse, you may need a certified real estate appraiser. ✔️ Seek the guidance of parenting coordinators. They can be your fallback and prevent everyone from going to court and resolving new issues. It's much more expensive to go to court and pay your lawyers than it is to see an excellent therapist or social worker.  ✔️ Other experts you may have to bring in are a business evaluator, a forensic accountant, a financial planner, and trust and estate lawyer in the three stages of the divorce process. They will help you make sound decisions and save you from spending higher costs in the future. Connect with Eric Broder: Eric Broder is a co-founding member and partner at Broder Orland Murray & DeMattie LLC.  He is an AV Preeminent rated attorney by Martindale Hubbell®, the highest possible rating in both legal ability and ethical standards, earned through a strenuous peer and judicial review procedure.  He has also been designated a "Top Lawyer" in Family Law, Matrimonial, Arbitration, and Mediation in Westport, Greenwich, New Canaan/Darien, and Fairfield Magazines.  Eric has been selected as a Connecticut Super Lawyers® in Family Law each year from 2013 to 2020. Adam is a partner in the Labor and Employment Practice Group in Sheppard Mullin’s San Diego (Del Mar) and Los Angeles offices. He is an AV Preeminent® (highest honor) rated attorney from Martindale-Hubbell.  Adam has also been recognized by BTI Consulting Group as a BTI Client Service All-Star. Adam represents a broad spectrum of employers in all areas of employment law before federal and state courts, the American Arbitration Association and JAMS. Adam represents national and international clients in retail, transportation, high-tech, manufacturing, healthcare, biotech, financial services, hospitality, food services and non-profit organizations. In April 2020, along with Sheppard Mullin partners Richard Simmons and Brian Murphy, Adam co-authored the Employer’s Guide to COVID-19 and Emerging Workplace Issues book (Castle Publications, LLC; ISBN: 978-1-940747-61-3).   Adam’s second book was released in May of 2021, Managing Employees Without Fear: How to Follow the Law, Build a Positive Work Culture, and Avoid Getting Sued (Society for Human Resource Management; ISBN: 1586446649). What We Discussed in This Episode: Why it was important for Adam to write this book at this time. Why should company managers be well-versed in employment law? Why is it important for managers to first identify what type of leader they are? How can managers make the most of the first three months after hiring a new employee? What is implicit bias and how is it a conundrum for employers? How should a manager handle a difficult conversation in the workplace? What will be the greatest challenge facing employers coming out of the pandemic? How can a manager prepare themself to say goodbye to an employee properly and legally? This week, your hosts Steve Lowry and Yvonne Godfrey interview Craig Milsten of KBG Injury Law (https://resultsyoudeserve.com/).    Remember to rate and review GTP in iTunes: Click Here To Rate and Review   Episode Details: Million Dollar Advocates Forum member Craig Milsten of KBG Injury Law shares how he successfully represented an elderly man with limited vision who was blinded due to a fall on an unmarked step at a shopping center in York County, Pennsylvania. On July 3, 2012, William Waite, a U.S. Army veteran and retired president of an architectural products company with vision in only his left eye, tripped and fell face-first over a single step in the sidewalk at a shopping center owned by Argento Family Partnership. After the fall, William was immediately blinded in his one good eye and has been unable to see ever since, despite undergoing four surgeries, including a corneal transplant. Despite the fact that the primary defendant John Argento is an award-winning civil defense litigator, trial lawyer Craig Milsten secured justice on his client's behalf, citing experts and pointing out to the jury how much money John Argento was willing to spend on legal fees, but not the nominal fee it would have cost to paint the step a different color or to display a warning sign for customers. In March 2017, a York County, Pennsylvania jury found Argento Family Partnership negligent after less than an hour of deliberations and awarded $4,035,329.11 in damages to William in one of the largest personal injury verdicts in York County history. www.CanadianImmigrationPodcast.com With the legalization of marijuana in Canada on October 17, 2018, there continues to exist tremendous confusion on how this will impact Canadian marijuana users travelling to the US and American's coming to Canada for a little "marijuana tourism". The issue is complex for individuals, but down right maddening for multinational companies sending employees back and forth across the Canada/US border on a daily basis. In this episode, I was joined by Canadian and US Immigration Attorney Henry Chang who shared some great advice on the real dangers that exist for users of marijuana seeking to travel cross border between Canada and the US and some great tips for employees of Canadian marijuana companies travelling to the US. [smart_track_player url="http://traffic.libsyn.com/canadianimmigrationpodcast/CIP_S3E9.mp3" social="true" social_twitter="true" social_facebook="true" social_gplus="true" social_linkedin="true" ] Henry Chang, a partner with the law firm of Blaney McMurtry in Toronto, Ontario, has always been a great resource for anything related to cross border immigration. As an immigration lawyer/attorney licensed to practice immigration law on both sides of the border, he was the perfect choice to join me on this Episode to explore the hidden dangers and pitfalls that the legalization of pot in Canada has created for Canadians and Americans crossing the Canada/US border. Henry is a member of the Law Society of Ontario and the State Bar of California. He is consistently ranked as one of Canada's top lawyers by The Canadian Legal Lexpert Directory, Who's Who Legal, and Best Lawyers. He also holds an AV (Preeminent) rating, the highest possible rating, from Martindale-Hubbell. Henry is the chair of the firm's Immigration Law Group. As a recognized authority in the field of United States and Canadian business immigration law, his style of legal representation is often referred to as the “gold standard” for cross-border mobility law. With limited exceptions, Henry personally supervises the preparation of such cases, in order to ensure the highest probability of a successful outcome. Henry lectures extensively in Canada, the United States, and overseas. His work has been published in numerous nationally- and internationally- recognized publications, including LexisNexis' Immigration Law & Procedure, which has been cited in over 300 Federal Court decisions in cases from across the U.S. circuit courts of appeals, federal district courts, and the U.S. Supreme Court. Two of Henry's more recent articles have propelled him forward as one of the go-to lawyers on this topic and landed him many interviews with media seeking to demystify some of the lesser known dangers that are lurking in the shadows for marijuana users crossing the border. How the Legalization of Marijuana Will Affect Your Ability to Travel to the United States Canadian Companies Should Educate Their Employees Prior to Marijuana Legalization In this episode Henry and I covered the following topics: Canadians travelling to the US after legalization Employees of Canadian companies travelling to the US Americans coming to Canada for "marijuana tourism" Bringing marijuana across the border (into Canada or the US) [Tweet "What you must know about Pot and cross border travel"] Additional Resources: How to Contact Henry Chang: https://www.blaney.com/contact-us Website: https://www.blaney.com/ Listen to Mark Holthe's Canadian Immigration Podcast [smart_track_player url="http://traffic.libsyn.com/canadianimmigrationpodcast/CIP_S3E9.mp3" social="true" social_twitter="true" social_facebook="true" social_gplus="true" social_linkedin="true" ] Topics for our Next Podcast [reminder]If you have a suggestion for topics we could cover in the Podcast, please drop me a line.
