TUPELO, Miss. (WTVA) — Tupelo mayoral candidate Rob Chambers is charged with a misdemeanor after being accused of kicking a teenager in the groin outside his home just one day after filing to run for office. Lee County Sheriff Jim Johnson said three teens came to Chambers' house in Belden Saturday night, rang the doorbell, then ran away. He said when they did it again, Chambers jumped out of the bushes, grabbed one of the teens and kicked him. "The parents of the juvenile that was kicked filed a report with the Lee County Sheriff's Department," said Johnson, "and an affidavit was signed by the parents in Lee County Justice Court. And subsequently, a warrant was issued for simple assault." Chambers, the only candidate challenging incumbent Todd Jordan, turned himself in to law enforcement Tuesday and posted a $600 bond. In a Sunday Facebook video, the candidate indicated he thought there may have been more to what happened instead of just a prank. "It could be some kind of coincidence," said Chambers. "I don't know. But it certainly appears to me that it's targeted to try to intimidate me to not be involved in this mayoral election." Johnson said what happened was not politically motivated. "This is a situation that — if you've got teenage kids or even when I was a child, kids pulling pranks on other kids — we can say that there was a child at the home the same age that knew these individuals," said the sheriff. The case involving the candidate would normally be handled by Tupelo police, but the department turned it over to the Lee County Sheriff's Department to avoid a conflict of interest. WTVA 9 News reached out to Chambers Tuesday to see if he wanted to comment further after what he posted Sunday. He did not answer multiple phone calls.
In Florida, a woman contacted the Lee County Sheriff's Office to report that her elderly father killed her mother. Over in Denver, Colorado, a fight broke out at a home on Sunday over a bottle of hot sauce that left one man dead. This past week, a Texas man was taken into custody for murder after a tipster came forward and told law enforcement he admitted to the murder of a missing man. In Michigan, a man is charged with the murder of a 13-year-old girl he's accused of impregnating. However, deputies became suspicious when they pinged Brian's cell phone and discovered it was inside the house. As the investigation progressed, authorities uncovered a disturbing series of events. Jake Hemmert was arrested on an outstanding warrant and later confessed to killing his father in what he claimed was a suicide request. He admitted to cleaning up the crime scene and disposing of evidence, including the mattress on which the murder occurred. During a search of the home on September 7, 2023, detectives discovered the large chest freezer hidden under a pile of supplies. Marceno began his law enforcement career in Suffolk County, New York before moving to Southwest Florida where he joined the Collier County Sheriff's Office. While with CCSO, he worked as a Patrol Deputy and was a member of numerous specialty units within the agency. He transitioned to a larger public liaison role in community policing, eventually serving as Executive Officer. He is the recipient of numerous awards and commendations. In 2012 he was awarded the Collier County's Distinguished Public Service Award, given to the county's top public servant. Sheriff Marceno joined the Lee County Sheriff's Office in 2013, most recently serving as Undersheriff for more than two years. During that time, Sheriff Marceno assumed supervisory responsibilities for day-to-day operations as a member of Command Staff. Prior to his role as Undersheriff, he was a Captain, serving as the Executive Officer to Sheriff Mike Scott. In March 2017, Sheriff Carmine Marceno graduated from the prestigious FBI National Academy Session 267. The intense 10-week program is by invitation-only for law enforcement managers nominated by their agency because of demonstrated leadership. The grueling session includes course study, specialized training and physical challenges. Lie to Your Insurer and You Will Lose Plaintiffs Richard Converse and Stephanie Converse own the property. Defendant State Farm Fire and Casualty Company (“State Farm”) insured the property at the relevant time. After a fire on December 8, 2019, Plaintiffs sought coverage under the insurance policy. Plaintiffs brought this action when Defendant denied coverage for much of the claim. In Richard Converse, and Stephanie Converse v. State Farm Fire And Casualty Company, No. 5:21-CV-457 (TJM/ATB), United States District Court, N.D. New York (July 12, 2023) the USDC was asked to rule on cross-motions for summary judgment. BACKGROUND State Farm insured the Converses against the risk of loss to a rental property under a homeowners policy. The parties agree that Plaintiff Stephanie Converse sent a letter to Joseph Pelton on or about November 8, 2019 that stated: “Joe, ... Having issues with my house again. Need help this time! I will pay $5,000 cash when I get the insurance. The back door will be unlocked and open to the basement. That's where the access to utilities are. Make look like electrical. I will come up after it happens so I will meet up with you. ... It's a mint green house with garage. Love you, See you soon. Stephanie.” While Plaintiffs admit that Stephanie Converse mailed the letter, they “deny any implication or allegation that Stephanie Converse committed insurance fraud, paid anyone to commit arson on the property, or was in any way involved in the fire that caused the loss on the property.” Stephanie Converse filed a claim on December 8, 2019 for the loss caused by the fire. State Farm mailed Stephanie Converse a blank Sworn Statement in Proof of Loss and a return envelope. Stephanie Converse appeared for an examination under oath (“EUO”) in connection with her insurance claim on March 13, 2020. Stephanie Converse affirmed during the examination that “everything as far as you can recall [was] truthful about what you told Mr. Loarca[.]” Defendant denied Stephanie Converse's claim on October 7, 2020 and Plaintiffs sued. ANALYSIS The materiality requirement is satisfied if the false statement concerns a subject relevant and germane to the insurer's investigation as it was then proceeding. The undisputed evidence before the Court indicated, Stephanie Converse told an investigator that she had made no such request. Defendant does not argue that Plaintiff dissembled about the cause of the fire at the home, committed arson herself, or paid Joseph Pelton to set the home on fire. The Court found that as a matter of law Plaintiff made these misrepresentations willfully. Stephanie Converse made material misrepresentations to insurance investigators as a matter of law and breached the insurance contract and Defendant is entitled to summary judgment in this respect. Failure to Cooperate Testifying falsely can also breach the condition of cooperation. Stephanie Converse admitted to Lee County Sheriff's Office investigators that she had written the letter she had denied to State Farm. Converse thus made misrepresentations about facts material to State Farm's investigation.misrepresentations were not willful. Proof of Loss Defendant's motion for summary judgment, was granted and Plaintiffs' motion for summary judgment was denied. ZALMA OPINION An insured who seeks to hire a person to set fire to her house for a fee paid from insurance proceeds is offering to pay for a felonious act. If the person refuses to set the fire, has an alibi when an arson fire actually occurred, performed by a person unknown, and the insured lies about her offer to burn her house, the lie is sufficient to deny the claim in accordance with the terms and conditions of the policy. On December 16th, 2022, Karen Rolland requested assistance from deputies with the Lee County Sheriff's office. The call was in regards to picking up her grandkids, Taylor and Blu. But when she arrived at her ex daughter in law's home in Moro, Arkansas, little Blu, who was turning 6 that day, was nowhere to be found. Ian is tied for the fifth-strongest hurricane by wind speed in U.S. history. Its strength puts it alongside other recent hurricanes in the Gulf Coast like Ida and Laura. Early projections of Ian's destruction estimate that the storm has created tens of billions of dollars in damage across Florida. Although several communities were hit by the hurricane, Fort Myers and Sanibel Island in Lee County were among the hardest hit. And at a press conference on Tuesday, the Lee County Sheriff confirmed 55 deaths in the county, which is more than half of the total deaths in the state. Nearly 180,000 customers are still without power. And school is still closed in the county for the rest of the week. Now that storm waters have receded, these communities are looking ahead at recovery. As we've learned in the past, not all communities are equally equipped to deal with the devastation after a hurricane. In a November 2020 report, FEMA's own advisors admitted that the agency wasn't meeting requirements to provide aid without discriminating based on race and other factors. One of President Biden's first goals was to change that. Early in office, he signed an executive order that mandated federal agencies to create racial equity – both in new and existing policies. But in the community of Dunbar, a historically Black neighborhood in Fort Myers, about a quarter of its residents live below the federal poverty line, and many are concerned they won't get the recovery assistance they need. In nearby Harlem Heights, a predominantly Latino and Black neighborhood, more than a third of residents live below the federal poverty line. When an alternative medicine doctor was found bludgeoned to death in her Bonita Springs, Florida home in the summer of 2015, friends and neighbors worried a burglar was on the loose, looking for his next random victim. Detectives with the Lee County Sheriff's Office told the public that Dr. Teresa Sievers had been bashed in the back of the head after returning home early from a trip with her husband and two daughters. An online sleuth group wondered if Dr. Sievers's death was connected to that of several other alternative medicine doctors throughout the country who had also died under mysterious circumstances in recent months. The Georgia Bureau of Investigation has arrested a Warwick police officer who exchanged marijuana for cash while on duty and in uniform.On Jan. 28, Leon Mitchell, 32, was arrested on the following charges:Two counts of sale/distribution of marijuanaOne count possession with intent to distribute marijuanaFour counts of possession of a firearm during the commission of a felonyThree counts of violation of oath of officeTwo counts of use of a communication device during the commission of a felonyThe GBI SWRDEO received information that Mitchell was selling marijuana while on duty and in uniform.During the investigation, agents began obtaining marijuana from Mitchell in Worth County and in Lee County.The investigation led to the arrest of Mitchell at the Warwick Police Department and a search of the vehicle Mitchell was driving.Additional marijuana, scales and plastic bags were located in the vehicle. Three days later, Carol's parents return home from vacation and discover her car parked outside their residence, as well as a note from Carol's boyfriend, Eugene LaFaye Jr., who claims she has gone missing without explanation. Due to their troubled relationship, there is evidence to suggest that Eugene was responsible for Carol's disappearance, but even though he eventually goes to prison for another murder, he never admits any involvement. Episode 72 Kyle ByrtusKyle Byrtus, was a gifted athlete with a promising future. But like too many people, he lost his way and got mixed up in drug and battled addiction. His addiction derailed his plans, and caused a hurdle in his relationships with his family. His Mom, Lynne, feared that one day she would get a call that her son was dead, and that he had overdosed. Sadly, in August 2013, Lynne got the call she worried about- her 25 year-old son Kyle was dead. But he hadn't overdosed, he was the victim of a homicide. Kyle was shot and discarded in a south Western Florida field. There was little in the way of evidence or clues in his case due to heavy rain, and decomposition.
