Two federal legislators have courageously offered their Republican colleagues an actual choice of leadership in the House and Senate. Representative Andy Biggs and Senator Rick Scott rose to challenge those deemed unassailably entitled to be the GOP's bosses in their respective chambers. They deserve our thanks – and support. Representative Kevin McCarthy's lack of integrity and personal misconduct prompted him once before to withdraw in ignominy from a bid for House Speaker. His refusal to articulate a compelling policy agenda and fund some Republican nominees contributed to his party's tiny majority this time around. Similar disqualifying traits apply to Senator Mitch McConnell and helped preclude the GOP's victory in his chamber. Worse yet, he's deeply compromised by the Chinese Communist Party. A handful of Republicans can deny McCarthy the Speakership in January. A majority of them in the Senate should reject McConnell.   This is Frank Gaffney.

Sam hosts Mark Joseph Stern, senior writer at Slate, to discuss the recent opening arguments that have come in front of the Supreme Court. First, Sam runs through updates on the Democratic victory in Arizona bringing Kari Lake down, the GOP creeping even closer to a House majority, Biden's attempt to renew the student debt repayments, and Iran detaining minors for protest, before watching the right cope with their disappointing showing last week. Mark Joseph Stern then joins as he dives right into the joint affirmative action case being taken against Harvard and UNC, walking through why – despite it supposedly hinging on the 14th Amendment – the majority of the arguments and discussion has been conservative racial aggrievement about policy, with the legal theory coming from the more liberal judges while still appreciating policy impact. Next, Mark parses through Haaland v. Brackeen, the upcoming Supreme Court case that ostensibly deals with states' rights to lay claim to native children living on reservations, and the larger impact of weakening the rights of reservations and their laws in the eyes of the US courts, opening it up to exploitation by both the state and corporation, also drawing a parallel to Georgia's treatment of indigenous peoples in the lead up to the Indian Removal Act. In the homestretch of the campaign, Sen. Rick Scott of Florida claimed he doesn't know any Republicans who want to cut Medicare, Medicaid or Social Security. Matthew Yglesias and Laura McGann can name a few.In fact, as much as the election has been a debate about inflation, abortion and democracy, none of those issues will be at the top of either party's agenda at the start of the next Congress. Instead, House Republicans are planning to force President Joe Biden to make cuts to Medicare, Social Security and Medicaid. It would be risky to cut these popular programs on their own, but Democrats won't agree to join them without a compromise, like raising taxes. And now to make it definitive the destruction of the Nord Stream pipeline, which I would bet was a US action, perhaps the US and Poland. This is a speculation — Bloomberg Host: That's quite a statement. Why do you feel that that was a US action? What evidence do you have of that? Jeff Sachs: Well, first of all, there's direct radar evidence that US helicopters, military helicopters that are normally based in Gdansk, we're circling over this area. We also had the threats from the United States earlier in this year that one way or another, we are going to end Nord Stream. We also have a remarkable statement by Secretary Blinken, last Friday in a press conference, he says this is also a tremendous opportunity. It's a strange way to talk if you're worried about piracy on international infrastructure of vital significance.
