He has prosecuted computer crime cases and routinely advised on cybersecurity, searching and seizing electronic evidence, and conducting electronic surveillance. He has managed DOJ cyber-policy as Senior Counselor to the Assistant Attorney General for the National Security Division and then as an Associate Deputy Attorney General. He has also served as Special Counsel and Special Investigative Counsel for DOJ's Inspector General. Bailey is a graduate of Yale University and Yale Law School. He has taught law courses at Georgetown Law School and Columbus School of Law in Washington, DC. Francisco last week at the Rivest-Shamir-Adleman (RSA) conference.  We summarize what they said and offer our views of why they said it. Bobby Chesney, returning to the podcast after a long absence, helps us assess Russian warnings that the U.S. should expect  a “military clash” if it conducts cyberattacks against Russian critical infrastructure. Bobby, joined by Michael Ellis sees this as a routine Russian PR response to U.S. Cyber Command and Director, Paul M. Nakasone's talk about doing offensive operations in support of Ukraine. Bobby also notes the FBI analysis of the NetWalker ransomware gang, an analysis made possible by seizure of the gang's back office computer system in Bulgaria. The unfortunate headline summary of the FBI's work was a claim that “just one fourth of all NetWalker ransomware victims reported incidents to law enforcement.” Since many of the victims were outside the United States and would have had little reason to report to the Bureau, this statistic undercounts private-public cooperation. But it may, I suggest, reflect the Bureau's increasing sensitivity about its long-term role in cybersecurity.   Michael notes that complaints about a dearth of private sector incident reporting is one of the themes from the government's RSA appearances. A Department of Homeland Security Cybersecurity and Infrastructure Security Agency (CISA) executive also complained about a lack of ransomware incident reporting, a strange complaint considering that CISA can solve much of the problem by publishing the reporting rule that Congress authorized last year.  In a more promising vein, two intelligence officials underlined the need for intel agencies to share security data more effectively with the private sector. Michael sees that as the one positive note in an otherwise downbeat cybersecurity report from Avril Haines, Director of National Intelligence. And David Kris points to a similar theme offered by National Security Agency official Rob Joyce who believes that sharing of (lightly laundered) classified data is increasing, made easier by the sophistication and cooperation of the cybersecurity industry.  Michael and I are taking with a grain of salt the New York Times' claim that Russia's use of U.S. technology in its weapons has become a vulnerability due to U.S. export controls.  We think it may take months to know whether those controls are really hurting Russia's weapons production.   Bobby explains why the Department of Justice (DOJ) was much happier to offer a “policy” of not prosecuting good-faith security research under the Computer Fraud and Abuse Act instead of trying to draft a statutory exemption. Of course, the DOJ policy doesn't protect researchers from civil lawsuits, so Leonard Bailey of DOJ may yet find himself forced to look for a statutory fix. (If it were me, I'd be tempted to dump the civil remedy altogether.)   Michael, Bobby, and I dig into the ways in which smartphones have transformed both the war and, perhaps, the law of war in Ukraine. I end up with a little more understanding of why Russian troops who've been flagged as artillery targets in a special Ukrainian government phone app might view every bicyclist who rides by as a legitimate target. Finally, David, Bobby and I dig into a Forbes story, clearly meant to be an expose, about the United States government's use of the All Writs Act to monitor years of travel reservations made by an indicted Russian hacker until he finally headed to a country from which he could be extradited.

Dr. Steven Gundry has worked in medicine for over 40 years. Probably best known for his work as a cardiothoracic surgeon and heart surgeon… but today he is focusing on something very different: Teaching people how to avoid surgery by using his unique vision of human nutrition. He began his surgical residency at the University of Michigan. While there, he was chosen to participate in a prestigious research program run by the National Institutes of Health. This is where his love of scientific research was born. He was one of the first 20 surgeons to test the implantable left ventricular assist device, a type of artificial heart. He also helped pioneer the use of robots for minimally-invasive heart surgery. He holds the record for the longest-surviving pig-to-baboon heart transplant – a procedure called xenotransplantation. Dr. Gundry and colleague Leonard Bailey, performed more infant and pediatric heart transplants than anyone else in the world. Dr. Gundry operated in more than 30 countries – including charitable missions to China, India, and Zimbabwe. He published over 300 articles or book chapters on cardiac surgery as well as on nutritional breakthroughs dealing with high cholesterol, heart disease, and hypertension. In 2001, He met a so-called “hopeless” patient suffering from heart disease. By making some unusual changes in his diet — almost by chance — this man made a complete turnaround. Eventually Dr. Gundry was able to give him the quadruple bypass surgery that has kept him alive to this day. In working with him, he made some major discoveries that changed the course of my career. He learned what nutrients were deficient in the American Diet, and which of our “staple” foods were actually toxic to the human body.

DR. MARY WILSON Dr. Mary Wilson began her nursing career in 1987. She was employed by San Antonio Hospital in Upland California in June of that year. She quickly transitioned into the CCU there by the following year. She moved on to the Operating Room at St. Bernardine's Medical Center by the year 1989. There she was promoted to Open-Heart Coordinator for the hospital and worked with Dr. Leonard Bailey performing pediatric open-heart procedures. She left that position in 1992 and moved with her extended family to Colorado where she continued as the Open-Heart Coordination at Memorial hospital in Colorado Springs. Missing the sunny beach air of California, she and her family moved back to California and she accepted a position once again at St. Berardine's, but this time in an administrative role as the Manager of the Outpatient Surgery Center. One of the highlights of her career is having served in Haiti after the catastrophic earthquake in 2010. Seeing the devastation and poverty there gave her life a new meaning. Holding injured children in her arms and helping transport them to a higher level of care at the University of Miami's mobile units was an experience that shaped her life moving forward. Working with vulnerable populations has been a professional goal of hers that she was able to fulfill in 2016 when she began giving anesthesia at the Indio Surgery Center to pediatric patients. In this podcast, Dr. Wilson discussed her award-winning Outstanding Doctor of Nursing (DNP) Project, titled Pediatric Dental Anesthesia Guideline Development and Evaluation in an Ambulatory Surgery Center. My guest on today's podcast and former guest on my show "", Dr. Steven Gundry proposes in his new book "", that the “diseases of aging” we most fear are not simply a function of age; but rather, they are a byproduct of the way we have lived over the decades. In The Longevity Paradox, he maps out a new approach to aging well—one that is based on supporting the health of the “oldest” parts of us: the microorganisms that live within our bodies. He believes that - from diseases like cancer and Alzheimer’s to common ailments like arthritis to our weight and the appearance of our skin, these bugs are in the driver’s seat, controlling our quality of life as we age. Dr. Gundry is a cum laude graduate of Yale University with special honors in Human Biological and Social Evolution. After graduating Alpha Omega Alpha from the Medical College of Georgia School of Medicine, Dr. Gundry completed residencies in General Surgery and Thoracic Surgery at the University of Michigan and served as a Clinical Associate at the National Institutes of Health. There, he invented devices that reverse the cell death seen in acute heart attacks; variations of these devices subsequently became the Gundry™ Retrograde Cardioplegia Cannula. It has become the world’s most widely used device of its kind to protect the heart from damage during open-heart surgery. After completing a fellowship in congenital heart surgery at The Hospital for Sick Children, Great Ormond Street, in London, Dr. Gundry was recruited as Professor and Chairman of Cardiothoracic Surgery at Loma Linda University Medical Center. There, he and his partner, Leonard Bailey, pioneered infant and pediatric heart transplantation. Together, they have performed more such transplants than any other surgeons in the world. During his tenure at Loma Linda, Dr. Gundry pioneered the field of xenotransplantation, the study of how the genes of one species react to the transplanted heart of a foreign species. He was one of the original twenty investigators of the first FDA-approved implantable left ventricular assist device (a kind of artificial heart). Dr. Gundry is also the inventor of the Gundry Ministernomy, the widely used minimally invasive approach to aortic- or mitral-valve repair, the Gundry Lateral Tunnel, a “living” tissue that can rebuild parts of the heart in children with severe congenital heart malformations; and the Skoosh™ venous cannula, the most widely used cannula in minimally invasive heart operations. One of the fathers of robotic surgery, as a consultant to Computer Motion (now ), Dr. Gundry received early FDA approval to use robotic-assisted minimally invasive surgery for coronary artery-bypass and mitral-valve operations. He holds patents on devices for connecting blood vessels and coronary artery bypasses without sutures, as well as for repairing the mitral valve without the need for sutures or a heart-lung machine. He has served on the Board of Directors of the American Society of Artificial Internal Organs (ASIAO), and was a founding board member and treasurer of the International Society of Minimally Invasive Cardiothoracic Surgery (ISMICS). He recently completed two successive elected terms as President of the Board of Directors of the American Heart Association, Desert Division. Dr. Gundry has been elected a Fellow of the American College of Surgeons, the American College of Cardiology, the American Surgical Association, the American Academy of Pediatrics, and the College of Chest Physicians. He is a member of numerous other surgical and medical societies. He is also the author of more than three hundred articles, chapters, and abstracts in peer-reviewed journals on surgical, immunology, genetic, nutrition, and lipid investigations. He has operated in more than thirty countries, including charitable missions to China, India, and Zimbabwe. Inspired by the stunning reversal of coronary artery disease in an “inoperable” patient, using a combination of dietary changes and nutriceutical supplements, in 2001, Dr. Gundry changed the path of his career. An obese, chronic “diet” failure himself, he adapted his undergraduate Yale University thesis to design a diet based on evolutionary genetic coding, which enabled him to reverse his own medical problems. In the process, he effortlessly lost 70 pounds. The equally astonishing results from following what he came to call Diet Evolution in several of his staff led Dr. Gundry to accept a position in Palm Springs where he could devote his efforts to disease reversal. Welcome to a new episode of An InfoSec Life on ITSPmagazine! Today’s topic looks at the life of a hacker and the challenges they face from both a liability and legal perspective. We also look at how organizations deal with the research activities they encounter from both cybercriminals and ethical hackers alike. To help me have this conversation, I am delighted to welcome Amit Elazari, Lecturer at UC Berkeley School of Information, and Leonard Bailey, Special Counsel for National Security at the U.S. Department of Justice, Criminal Division where he is Head of Cybersecurity Unit for the DOJ’s Computer Crime & Intellectual Property Section. There are laws to protect companies from cybercriminals. However, those laws— when interpreted as such—also block ethical hackers from researching and looking for exploitable weaknesses. Changes in the acts and laws over the years have made it better, if not easier, for ethical hackers to perform their research and engage in responsible disclosure. The question is: do these changes also make it "better" and/or “easier” for the cybercriminals? “Safe harbor is not a blanket approval of protection from the law." ~ Amit Elazari During our chat, we dig into the many yin yang elements of this topic as we explore some of the details behind responsible disclosure and vulnerability disclosure programs, the related language and frameworks available from the DoJ and Disclose.io, and how those interact with—and often counteract—the Computer Fraud and Abuse Act (CFAA) and the Digital Millennium Copyright Act (DMCA). There’s a lot of work being done to help establish a safe environment for vulnerability research and responsible disclosure to take place.
