While the underlying logic of the cash bail system in the US may sound convincing on paper, in practice it has become a means of denying justice to, and destroying the lives of, people who have not even been convicted of a crime. “The US Constitution prohibits ‘excessive bail'” The Bail Project notes on their website. “Excessive bail forces people to stay in jail—even though they've not been convicted of anything. Unfortunately, today judges routinely set bail amounts that exceed what most people can afford. The result? Jails are full of people waiting for trial. They are presumed innocent on paper, but in practice, they are being held for weeks, months, and sometimes years as they wait for trial.” David Gaspar, CEO of The Bail Project, joins Mansa Musa on Rattling the Bars to talk about how cash bail creates a two-tier system of justice that punishes people for the “crime” of being poor—and what we can do about it.David Gaspar is the Chief Executive Officer of The Bail Project, a nonprofit organization that provides free bail assistance to those in need and advocates for better, more humane pretrial policies. In the 2022 election, Ohioans voted overwhelmingly in favor of Issue 1. The new amendment to the state constitutions that will allow judges to use cash bail to address circumstances when they have concerns about public safety.rnrnOver the past two decades, the use of cash bail has grown substantially. At the same time, bail amounts have also risen. This has led to an increase in the number of people who are unable to make bail. According to a report issued last year from the U.S. Commission on Civil Rights, more than 60 percent of defendants are detained pre-trial because they can't afford to post bail. Those numbers are higher for women and people of color.rnrnAmerica's cash bail system is based on the idea that money is necessary to ensure that a person returns to court--but The Bail Project is on a mission to prove that idea wrong. Founded in 2018, the nonprofit aims to combat mass incarceration through bail reform. Using a national revolving bail fund, The Bail Project has worked with community partners in cities across the country to bring free bail assistance to more than 28,000 low-income people to date. Since August 2019, The Bail Project has operated a site serving low-income clients in Cuyahoga County and secured release for more than 1,000 people and counting.rnrnJoin Robin Steinberg, Founder of The Bail Project, and David Gaspar, Incoming CEO of The Bail Project, for a discussion about the future of bail reform and how communities can utilize grassroots organizations to create a more just and equitable pretrial system.rnrnSteinberg is also the author of the forthcoming book, The Courage of Compassion: A Journey from Judgment to Connection, which explores what it will really take for us to reimagine and transform criminal justice in America.
Months ago I interviewed the Bail Project, which helps economically disadvantaged people avoid long jail stays while awaiting trial. Ken Good, Texas bail attorney and a board member of the Professional Bondsmen of Texas, heard the interview and wanted to respond. He discusses the bail process, the issue of bail disparities, and how the bail industry deals with risk assessment. Good argues against the bail project's disparate treatment claim and that they are bonding out the most dangerous people who must stay in jail. https://youtu.be/25H3xI9-9As Ken W. Good graduated from Hardin Simmons University in 1982 with a Bachelor of Arts Degree. He received a Master of Education Degree in 1986 from Tarleton State University, a part of the Texas A&M System. In 1989, he received his law degree from Texas Tech School of Law, where he was a member of the Texas Tech Law Review. Mr. Good has argued cases before the Supreme Court of Texas, the Texas Court of Criminal Appeals, and numerous appeals courts, including the United States Court of Appeals for the Fifth Circuit. Mr. Good is married and has two daughters. How do criminal courts work? This episode is part one of a series where I dive into how the system actually works (sorry, tv and news stories are generally not that accurate or representative). Oral Arguments for the Court of Appeals for the Seventh Circuit
The Bail Project, Inc. v. Commissioner, Indiana Departme
When someone is arrested, three options await them before their trial: a judge can keep them in jail, release them, or assign them cash bail. While it is often thought that cash bail is needed to drive some back to the courtroom, this is often not true. Cash bail massively impacts the finances of the people who can least afford it, and it hampers their ability to move past a bad incident. My guest is David Gaspar, the National Director of Operations at The Bail Project. The Bail Project is a 501 nonprofit organization aiming to pay bail for people who cannot do so themselves. Robin also is the founder and CEO of the bailout project, the first-of-its-kind nonprofit revolving bail fund. Robin is a friend of the podcast, having been one of the early guests on the Pod three years ago. For this second episode with Robin, we will focus on how the Bailout project has evolved over the past three years, after a change in presidency, a pandemic, and a moment of national reckoning for systemic racism. This podcast episode will represent the perspective of a woman who has dedicated her career to fighting for criminal justice and against systemic racism.
In this episode Bryn talks to the UK Barrister and Founder of the Malawi Bail Project, Charlotte Mackenzie. Charlotte grew up in south London with an interest in law that prompted her to take an evening class. She went on to pass the bar and take chambers in 42 Bedford Row where she currently practices as a family law Barrister. When she was 21, Charlotte took a short-term legal internship in Malawi which changed her life forever and led to the creation of a charity aimed at educating thousands of Malawian people to their rights and releasing hundreds from illegal detention and imprisonment. In today's episode I had the pleasure of speaking with Sari Baez, the VP of Sales and Marketing for the streetwear brand Diplomacy Worldwide. Sari and I discuss the social movements Diplomacy has connected itself with along with some of what to expect from Diplomacy in the the future. As a way to further engage yourself beyond the listening experience, make sure to shop Diplomacy Worldwide and support the brand by following them on Instagram. You should also follow Sari on Instagram to stay connected to all that she is doing. My final call to action would be to become familiar with The Bail Project. As you'll hear in today's episode, Diplomacy did a capsule collection where they donated proceeds from that collection to The Bail Project and so further knowledge and involvement with them is definitely encouraged. This week on the pod, we talk to Deb Conklin, former Clallam County Prosecutor and current pastor of two churches in Spokane, Liberty Park Methodist in Perry and St. Paul's United Methodist in West Central. In her almost 25 years as a pastor, Deb has also served rural congregations in Deer Park, Davenport and Rosalia. That's the sort of resume that Deb had been on our list of people to talk to for RANGE because of her justice work in Spokane, and she got bumped to the front of the queue when she declared her intention late last week to run for Spokane County Prosecutor as a non-partisan candidate. We discussed competing models of justice between retributive and restorative theories of justice, and beyond that, you'll also hear some pretty big differences between how Deb was trained as a prosecutor – only charging people with crimes you're certain you can get convictions on – and the way we're used to we're used to hearing prosecutorial decisions being made in Spokane. If you think back to our https://www.rangemedia.co/land-of-the-free/ (Bail Project episodes) and the episode with https://www.rangemedia.co/and-justice-for-some-feat-cam-zorrozua/ (Cam Zorrozua and Virla Spencer), of the Way to Justice, you'll remember those advocates talking about prosecutors throwing every charge possible at an accused person as a way of heightening bail and heightening pressure to take a plea. Take a listen and let us know what you think of our first candidate interview.

Last summer, Mike revistied to the classic comedy album "Strategic Grill Locations" by his friend, the late great Mitch Hedberg. The listening experience was so transcendsnt that it inspired Mike to call Mitch's wife Lynn Shawcroft and ask if she would be open to coming on the podcast and discussing Mitch's joke writing process. The two old friends discuss daydreaming, free associating, and how sometimes jokes that feel like one-liners are actually stories unto themselves. Plus, they share stories about Mike and Lynn opening for Mitch, and the time that three of them went bowling and Mitch couldn't believe how bad Mike was at bowling. Instead of providing only money, The Bail Project acts to insure that people return to court by assisting them in personal matters such as housing, transportation and mental illness. This revelation (at least to us) was provided in this conversation with David Gaspar, director of operations, nation wide, for The Bail Project. Also discussed is the incidences in which a person on bail commits another heinous crime.

Kim shares with us her experience with the Bail Project. The use of bail bonds is a widely accepted but dangerous practice in the United States. Watch the video to see my story. I haven't been able to sleep at night knowing people are treated like this every day, especially our black and brown brothers and sisters. To limit this practice, we are raising money for The Bail Project . Every dollar will help bring this unnecessary and traumatic experience for pre-trial detainees, still innocent until proven guilty, closer to an end - both immediately and, later, permanently.More information about The Bail Project: The Bail Project is a national nonprofit organization that provides free bail assistance to thousands of low-income Americans every year, reuniting families and restoring the presumption of innocence. We believe that paying bail for someone in need is an act of resistance against a system that criminalizes race and poverty. It is an act of solidarity with local communities and movements for lowering rates of incarceration.Thank you in advance for your contribution to this cause that means so much to me.https://www.gofundme.com/f/Justice-Is-Not-a-Bail-Bond?member=12180677&utm_campaign=p_cp+share-sheet&utm_medium=copy_link_all&utm_source=customer
Advocates for medical marijuana continue to speak out after the Mississippi Supreme Court invalidated Initiative 65. We examine the health and economic fall out of the decision. Then, the United States' highest court agrees to hear Mississippi's 15-week abortion ban - setting the stage for the potential overturning of Roe v Wade.Plus, the Bail Project comes to Mississippi.Segment 1:Advocates for Mississippi's medical marijuana ballot initiative are expressing frustration following the Mississippi Supreme Court's opinion that effectively overturned the newly adopted constitutional amendment. Rankin County resident Angie Calhoun was a leading voice for Initiative 65 last fall. She said legalizing medical marijuana would have allowed her son to return home. Now, as she tells our Kobee Vance, she feels the life has been sucked out of her. Daniel Thompson says he's spent tens of thousands of dollars on land for farming and distribution - investments he believes the court has now undermined.Segment 2:Mississippi's 15 Week Abortion ban is drawing national attention, following the United States Supreme Court's decision to hear the case this fall. Pro-life champions are celebrating the move as they view it as an opportunity to challenge Roe v Wade. But advocates for reproductive rights find the situation more grim. Diane Derzis is the owner and CEO of Jackson Women's Health Organization - the only clinic in state that performs abortions. She tells our Desare Frazier, with current make-up of the court, Mississippi's 15-week ban is tailor-made to challenge the Roe opinion.Segment 3:Bail - the temporary release of an accused person awaiting trial on the condition of payment - is receiving elevated scrutiny as criminal justice reforms nationwide look to dismantle the discriminatory practice. And while some states have begun getting rid of their cash bail system, the gulf states have not. That's where The Bail Project hopes to help. It's a national organization -- already running in Louisiana -- that helps bail people out of jail. Robin Sterling is the CEO and Founder of the Bail Project. She tells the Gulf States Newsroom's Becca Schimmel the group is trying to reduce the number of people who are behind bars waiting for their day in court. On any given night, more than 450,000 people in the United States are locked up in jail simply because they don't have enough money to pay bail. The sums in question are often around $500: easy for some to pay, impossible for others. This has real human consequences -- people lose jobs, homes and lives, and it drives racial disparities in the legal system. Robin Steinberg has a bold idea to change this. In this powerful talk, she outlines the plan for The Bail Project -- an unprecedented national revolving bail fund to fight mass incarceration. (This ambitious plan is one of the first ideas of The Audacious Project, TED's new initiative to inspire global change.) Hosted on Acast. See acast.com/privacy for more information.
