The elimination of pit toilets in public schools has been an ongoing battle in South Africa. Schools across rural South Africa are still subjected to these degrading pit latrines. Plain pit toilets were banned from South African schools by the Minimum Uniform Norms and Standards for Public School Infrastructure in 2013 and had to be removed and replaced by 2016. However, more than a decade later, all the initial deadlines (2016 and 2020), plus new deadlines have been missed by the Department of Basic Education (DBE). The DBE now plans to eradicate these pit toilets by 2025. Meanwhile, SECTION27 is closely monitoring whether the Limpopo Department of Education will meet its own 31 March 2025 deadline to eradicate and replace all pit toilets at so-called "Priority 1" schools in the province. The department missed their initial 31 March 2023 deadline to do so and has repeatedly extended this deadline. Life Esidimeni families are staging a picket urging the the National Prosecuting Authority (NPA) to pursue criminal charges against the former Gauteng Health MEC Qedani Mahlangu and the former Director of Mental Health in Gauteng, Dr. Makgabo Manamela for their roles in the Life Esidimeni tragedy. In 2016, 144 people with mental health problems died after they were moved from Life Esidimeni. In July, this year, Judge Mmonoa Teffo found that former Gauteng Health MEC Qedani Mahlangu and mental health director Makgabo Manemela could be held criminally liable for the deaths of some of the 144 mental healthcare users. Online publication Spotlight editor Marcus Low expressed disappointment with government for its failure to ratify the World Intellectual Property Organization-administered Marrakesh Treaty to accelerate access to published works for persons who are blind, visually impaired or otherwise print-disabled. The Marrakesh Treaty was adopted in 2013 by the World Intellectual Property Organization to address the widespread problem known as "book famine", the situation where few books are published in formats that are accessible to those who are blind or visually impaired. "The shocking thing is that the Treaty was concluded 13 years ago and today, 10 years later, it is not fixed in South Africa. Every year when government says all the nice things on disability month - November - to me it rings hollow," Low said. Speaking during the SECTION27, Blind SA and Daily Maverick webinar on 'Court-Ordered Copyright Act Changes for the Blind and Visually Impaired', Low said that over 80 countries including the US, the UK, India and Brazil had ratified the Treaty, as well as fellow African countries such as Nigeria. Blind SA (represented by SECTION27) challenged the constitutionality of South Africa's Copyright Act for the way it discriminated against persons who were blind or visually impaired. In particular, the Act required that anyone wanting to convert a book into an accessible format, like Braille or large print, needed to obtain the permission of the copyright holder. Recognising the heavy burden this placed on persons who are blind or visually impaired, the Court declared the Copyright Act unconstitutional in 2022. Now, persons who are blind or visually impaired no longer need to obtain permission from the copyright holder, while Parliament finalises changes to the rest of the Act. The court has also given Parliament 24 months to cure the unconstitutional defects in the Copyright Act. Low highlighted that there were two traditional problems with how the law worked regarding blind people. "One is where as a blind person or someone helping a blind person, you are not allowed to make an accessible format copy. So the Marrakesh Treaty says that if you are a member country you have to allow that. The treaty says that you should be allowed to share books across borders," he said. University of the Witwatersrand School of Law's Mandela Institute senior researcher, Dr Sanya Samtani, explained that people with disabilities had been excluded domestically in South Africa and internationally from full and equal participation in society. She said the Marrakesh Treaty put in law mandatory exceptions for people with visual and print disabilities. Meanwhile, Low said that the benefits of the judgment on the court-ordered Copyright Act changes for the blind and visually impaired were not well understood as yet, highlighting that it took time to make accessible copies and could sometimes be quite expensive. "If you can see you can go to the book store, buy the book you want to read, if you can afford it, otherwise you can go to a library and whatever books are in the library, you can read. There is no obstacle there. So if you cannot see to read those books then it becomes more complicated, so we can turn those books into other formats, such as Braille," he explained.

The campaign is in response to a 2021 Progress in International Reading Literacy Study which revealed that 81% of Grade 4 learners cannot read for meaning in any language, including their home language. Public interest law centre SECTION27 has applied to be admitted as friend of the court to make submissions which highlight the pattern of neglect for learner safety in a case about unsafe school infrastructure in Gauteng. This follows the death of a learner after being electrocuted at school because circuit breakers, earth leakage and other electrical equipment had repeatedly been stolen, making the school unsafe. The case will be heard virtually in the Gauteng Division of the High Court on October 21. SECTION27 explained that over four years after the death of a matric learner in 2017, the Gauteng Department of Education (GDE) had not confirmed that it had addressed the unsafe infrastructure at the school. It added that learners at the school, therefore, remained at risk of serious injury or death. “Risks to learners' safety and rights need to be prevented at all costs, and where dangerous infrastructure is flagged (as was the case at this school), provincial education departments must remedy the situation timeously so that catastrophes like this never occur,” SECTION27 said. It further explained that unsafe school infrastructure violates learners' interconnected rights to basic education, an environment that is not harmful to their health or well-being and their right to have their best interests considered as paramount in all matters. The centre called for the relevant departments to be proactive and comply with their duties to prevent injuries and deaths owing to unsafe infrastructure at all schools. SECTION27 said if its submissions were admitted it would address the systemic nature of unsafe school infrastructure. It will also argue that government has a history of non-compliance with statutory, constitutional and common law obligations to ensure safety at schools. The centre will again look at the role of public officials, including government officials and educators, in keeping learners safe in the place of a parent, and the need for accountability for failures in this regard. SECTION27 stated that it did not represent the deceased learner's family.

Pit toilets court battle continues in Limpopo today

The battle by education advocacy group, Section 27, to get rid of pit toilets in Limpopo schools is set to continue in the Polokwane High Court today (Friday). In 2018, Judge Gerrit Muller ordered that the Limpopo Department of Education and Department of Basic Education to develop a plan to eradicate pit toilets at Limpopo schools. Section 27 together with Equal Education, who have joined as a friend of the court, believe the plan provided by government is unconstitutional and unreasonable. The Gauteng health department has commenced with the preparation for the relocation of mentally ill patients from the controversial NGO's to appropriately equipped facilities. Health minister Aron Motsoaledi and Gauteng's newly appointed health MEC Gwen Ramokgopa announced in a media briefing in Pretoria. They say police are also conducting forensic investigations on 19 unclaimed bodies, believed to be that of the mentally ill persons who were moved to the NGO's from the Life Esidemeni facility. Sakina Kamwendo speaks to attorney at SECTION27, Sasha Stevenson.
