It's very important that parents are engaging and monitoring their children! When you leave children to their own devices, they turn to other people and things! It's detrimental that parents are of healthy mindsets because if they are not they will project their own unresolved issues onto their children, which leads to dysfunction in their children's lives. Monitor your children and know what they're entertaining. Spend quality time with your children, nuture them, and show them love! Unfortunately, sometimes, despite the good parenting, some children will still go the wrong way because they are enticed, influenced, persuaded, coerced, etc., by people and things that are no good for them. Parent's aren't with their school age children 24 hours a day, but as long as children are getting the proper care and attention from their parents, those parents should know they done the best and the right thing for them. Regardless, many children will go astray because of the other people and things that are in their environments and social circles, etc.Become a supporter of this podcast: https://www.spreaker.com/podcast/relationships-and-relatable-life-chronicles--4126439/support.

Understanding the Exclusionary Rule: A Deep Dive into Criminal ProcedureThis conversation provides a comprehensive overview of the exclusionary rule in criminal procedures, detailing its historical evolution, the shift from judicial integrity to deterrence, and the mechanics of how the rule operates. It discusses the fruit of the poisonous tree doctrine, exceptions to the rule, the good faith exception, and the distinctions between Miranda violations and coerced confessions. The conversation concludes with insights on harmless error and impeachment, emphasizing the ongoing tension between individual rights and societal safety. The exclusionary rule is a cornerstone of criminal procedure, designed to protect constitutional rights by preventing illegally obtained evidence from being used in court. This rule, rooted in the Fourth, Fifth, and Sixth Amendments, serves as a judicially created remedy rather than a personal constitutional right. Its primary goal is to deter police misconduct by ensuring that evidence obtained through illegal means is inadmissible in court. The Evolution of the Exclusionary RuleThe exclusionary rule has evolved significantly since its inception. Initially applied only to federal cases, it was extended to state courts through landmark cases like Mapp v. Ohio. This expansion was crucial in standardizing constitutional protections across the United States. However, the rule's application has been subject to numerous exceptions and limitations, reflecting the ongoing tension between individual rights and societal security.Key Cases and DoctrinesSeveral key cases have shaped the exclusionary rule, including Weeks v. United States, Wolf v. Colorado, and Mapp v. Ohio. These cases highlight the rule's development and the Supreme Court's shifting philosophy. The rule's application is further complicated by doctrines such as the "fruit of the poisonous tree," which extends exclusion to derivative evidence, and exceptions like the independent source and inevitable discovery doctrines.Balancing Rights and SecurityThe exclusionary rule embodies the delicate balance between protecting individual rights and ensuring collective security. While it aims to deter police misconduct, its application can result in the exclusion of reliable evidence, potentially allowing guilty individuals to go free. This trade-off underscores the rule's complexity and the ongoing debate over its effectiveness as a deterrent.ConclusionThe exclusionary rule remains a vital component of criminal procedure, reflecting the judiciary's commitment to upholding constitutional rights. As legal professionals and students navigate its intricacies, understanding its history, key cases, and exceptions is essential for mastering this complex doctrine.TakeawaysThe exclusionary rule is a judicially created remedy. It aims to deter police misconduct by excluding illegally obtained evidence.Standing is crucial; defendants must prove their own rights were violated. The fruit of the poisonous tree doctrine extends to derivative evidence.Exceptions to the exclusionary rule include independent source and inevitable discovery. The good faith exception allows evidence if officers acted reasonably.Miranda violations have different remedies compared to Fourth Amendment violations.Coerced confessions lead to absolute exclusion of evidence.Harmless error allows convictions to stand despite errors in evidence admission. The tension between individual rights and societal safety is central to the exclusionary rule.criminal procedure, exclusionary rule, Fourth Amendment, Fifth Amendment, Sixth Amendment, judicial integrity, deterrence, fruit of the poisonous tree, good faith exception, Miranda rights

It's all about the mindset that you have! When you're of unhealed hearts and minds you're very quick to act and/or react over things to include speculation and lies! Many people are very easily provoked over hearsay. It goes back to the ridiculous lie over the rapture. Many people fell for it because people want so badly to believe in something, yet if they really believed in Jesus, they should have known better. It goes to show that most people talk one thing but believe and do another! When you have your own unresolved issues that you neglect, and you continue to put them on the back burner to go along, to get along, to belong, you'll always be left behind and falling prey to the many predators who feed off of the vulnerabilities you've shown to them! You'll contine as broken people who are being mentally bamboolzled and controlled by other broken people! Change must start with you, it's an inner process that must take place! You must be willing to unlearn all the bad conditioning and behaviors to become the best version of yourself! You are better than who or what you come from, if you believe it! The narrative highlights the damaging effects of shunning and the difficult journey of deprogramming and finding her own path to healing, eventually leading to a reconciliation with her father and the creation of her own supportive “chosen family.” Vicki's story provides a raw and deeply personal account of growing up within the Jehovah's Witness organization, experiencing severe abuse, and the long, difficult path to recovery and self-discovery. Coerced Confessions in Delphi: Bob Motta Weighs In Richard Allen's so-called “confessions” in the Delphi murders weren't made in a police interrogation room. They were made after months of extreme isolation, cut off from his wife, under conditions that defense attorney Bob Motta describes as “passive coercion.” In this segment, we explore the reality of those prison conditions — 23 hours a day in a cell, relentless verbal harassment, and the kind of mental strain that can push anyone toward a breaking point. We discuss how Allen's mental state deteriorated to the point where he made bizarre, contradictory statements — including admitting to crimes that never happened. Motta explains why these conditions matter in the appeal process, how courts evaluate whether a confession is voluntary, and why isolation tactics are so dangerous in pretrial detention. This is a sobering look at how “protective custody” can blur into psychological punishment, and what that means for justice in a high-profile case like Delphi. #DelphiMurders #RichardAllen #PrisonConditions #CoercedConfession #TrueCrime #MentalHealth #JusticeSystem #AppealProcess #HiddenKillers #BobMotta Want to comment and watch this podcast as a video? But is it possible that Brendan Dassey isn't guilty as we were all led to believe? (Is Brendan Dassey Innocent?) *** After a night of bar-hopping, Ozzy Conde and girlfriend Kimberly Long got into an argument that ended up with Ozzy laying on the floor – dead. Kimberly was sent to prison. At least that's the story the prosectors told. But Kimberly fought for years to try and convince people she was not a murderer. But was she? (Kimberly's Long Struggle to Prove Her Innocence) *** The idea of someone breaking down and confessing to police that they committed a crime – when in actuality they did not do it – seems ludicrous to us. Among the many war crimes and crimes against humanity committed during Russia's full-scale invasion of Ukraine are large-scale efforts to deport Ukrainian children to Russia. Thousands of children have already been taken to Russian camps and facilities, leading the International Criminal Court to issue arrest warrants for two senior Russian officials, including Russian President Vladimir Putin, in March 2023. Despite the arrest warrants, the deportations have continued. A new report from the Yale School of Public Health Humanitarian Research Lab identified 314 individual Ukrainian children that Russian officials transferred from Ukraine to Russia for coerced adoption and fostering, acts that likely constitute grave violations of international law. What are the report's key findings? And how might they contribute to efforts toward accountability, including potential new criminal charges against Russian officials? Joining the show to discuss the report are Oona Hathaway and Nathaniel Raymond. Oona is a Professor at Yale Law School and an Executive Editor at Just Security. Episode Summary:  In this thought provoking episode, host Joseph Arvidson sits down with Dr. Jerrod Brown to explore the complex factors contributing to false confessions and wrongful convictions. Dr. Brown, an expert in neurocriminology, offers insights into how various mental and physical health factors-such as untreated nutritional deficiencies and cognitive impairments-impact behavior, decision making, and the reliability of client interviews.  Together, Joseph and Dr. Brown unpack the vulnerabilities that can make certain individuals more susceptible to false confessions, from neurodevelopmental disorders and high levels of suggestibility to external pressures in the interview room. This episode challenges justice professionals to broaden their perspectives, looking beyond traditional frameworks like risk-needs-responsivity, to embrace a holistic view of client behavior. With practical implications for probation officers, correctional staff, and all who interact with justice-involved individuals, Dr. Brown's insights offer a pathway toward more effective, informed, and compassionate practices in the field. What You'll Learn:  The types and causes of false confessions: Voluntary, Coerced, and Internalized. How cognitive impairments, neurodevelopmental disorders, and high suggestibility influence client statements and behaviors. The impact of nutritional deficiencies and physical health on mental well being and behavior in justice contexts. In a heartbreaking case of manipulation and abuse, Paul Ferguson was sentenced to 30-100 years in prison for his role in the torture and death of his own autistic brother. Coerced by his monstrous mother, Shanda Ark, Paul became an instrument of cruelty. But did the court fully understand the depths of psychological damage that warped Paul into this tragic figure? If he didn't inflict the abuse himself, does he share equal responsibility? Defense attorney and former prosecutor Eric Faddis joins Tony Brueski to dissect this controversial ruling. They'll delve into the disturbing questions surrounding the case: Damaged Pawn: Could Paul's autism and traumatic upbringing mitigate his culpability? Was he merely acting out his own abuse under his mother's sinister control? Sentencing Controversy: Was the judge's heavy-handed sentence justified? Did it balance justice for the victim with acknowledging Paul's complex psychological landscape? Psychological Horror: What do the revelations about Paul's alleged joy in inflicting pain tell us about the permanent scars of his manipulative upbringing? Rehabilitation vs. Protection: Is a decades-long prison term meant to punish Paul or protect society from a potentially dangerous individual damaged beyond repair? Road to Recovery? Does Paul Ferguson have any chance for release and rehabilitation in his lifetime? What might his legal options be? Join us for a chilling examination of the boundaries between victim and perpetrator, where mental illness, familial abuse, and the pursuit of justice collide in a profoundly unsettling story.    Want to listen to ALL of our podcasts AD-FREE?
