Mary Kate Marshall fell in love with track and cross-country in high school. Running “gives me so much confidence,” Marshall said. Now an athlete at Idaho State University, Marshall is fighting for Idaho’s Fairness in Women’s Sports Act—and for every woman's and girl’s right to compete on a level playing field. The Fairness in Women’s Sports Act prohibits biological men who "identify" as women from competing in women’s sports. Idaho Gov. Brad Little signed the legislation in March 2020, but the bill was quickly challenged by the American Civil Liberties Union. Alliance Defending Freedom, a Christian legal nonprofit, represents Marshall and fellow Idaho State University track athlete Madison Kenyon in their efforts to reinstate the act and protect women’s sports. Marshall and Alliance Defending Freedom attorney Christiana Holcomb join the "Problematic Women" podcast to explain the significance of the court battle for Idaho and for women’s sports across the nation. The implications of congressional Democrats' proposed Equality Act are “tremendously disappointing,” Sen. Marsha Blackburn, R-Tenn., says. The House of Representatives already has passed the legislation, which faces what many Congress-watchers believe will be a closely fought battle in the Senate.The Equality Act would make “gender identity” and “sexual orientation” protected classes under federal civil rights law. This means, for example, that the law would require institutions and individuals to treat transgender women not as biological men who identify as women, but as biological females, giving them access to women’s sports and women’s-only spaces.Blackburn joins the “Problematic Women” podcast to discuss the implications of the legislation becoming the law of the land. She also talks about other issues and shares a bit of her own journey to conservatism. MARY KATE MARSHALL & CHRISTIANA HOLCOMB  Mary Kate Marshall, Collegiate Track Athlete at Idaho State University Christiana Holcomb, Legal Counsel for Alliance Defending Freedom Female Olympians, Title IX pioneers, and more than 300 collegiate and professional athletes submitted a letter to the National College Athletic Association Board of Governors Wednesday, urging them to reject a recent call to boycott Idaho for passing its Fairness in Women’s Sports Act. In the letter, the current and former female athletes state they have benefited personally and professionally “from a fair and level playing field” and urge the NCAA to protect the integrity of women’s sports, consistent with the promise and purpose of Title IX. Signers include world-class athletes cyclist Jennifer Wagner-Assali, track athlete Cynthia Monteleone, and Title IX pioneer and marathon swimmer Sandra Bucha-Kerscher. The coalition supports biology-based eligibility standards for participation in female sports and opposes efforts to bully or boycott the state of Idaho for passing the first state law that prevents males from competing in women’s sports. In May, the American Civil Liberties Union filed a lawsuit, Hecox v. Little, on behalf of a male athlete seeking to challenge Idaho’s newly enacted law. Bethel Christian Academy (Savage/Laurel) has been kicked out of the state’s school voucher program, because of its anti-LGBT views. The school calls that religious discrimination and is challenging the move in court. Bethel says it doesn’t discriminate in anyway, but according to the Sun, does have in the school’s handbook that marriage can only be between a man and a woman and that God assigns a gender to a child at birth. Other faith based schools still receive tax money for the voucher program, but none apparently have those beliefs actually written in the school handbook. I talked with the lawyer for the school, Christiana Holcomb on the case that could have major legal ramifications across the country.

People of faith and our institutions have come under increasing attack in recent years from secular sources. One such attack strikes close to home for the LCMS. One of our congregations, Trinity Lutheran Church in Columbia, Missouri, runs a child-care center and a playground. Now the State’s Department of Natural Resources has a program that’s open to non-profit organizations that provides grants to help reimburse rubberizing play areas with materials made from recycled tires. Trinity applied and was listed 5th out of 44 applications, but, their application was rejected. The Department of Natural Resources ruled that because the playground is owned by a church, it’s ineligible for any public funding, despite the playground being open to all the neighborhood children. Among the constitutional issues facing the Supreme Court in this decision are Free Exercise of Religion under the 1st Amendment and Equal Protection under the 14th Amendment. Oral Arguments were held this morning before the Supreme Court concerning these very issues. The argument for the church was held by the Alliance Defending, and today’s guest is Christiana Holcomb, legal counsel for ADF. Follow updates to the case at playgroundcase.org.

My first guest on the Tami Jackson Show* tonight be Captain Roger Hill. Captain Roger Hill is a West Point graduate, combat veteran and Bronze Star recipient who had dreamed of being a soldier since he was six years old. In 2007, Hill takes command of Dog Company, an 89-man unit of the famed 101st Airborne. The unit is full of rough-and-tumble men who are brilliant in combat but undisciplined at home. Through tough love, Hill and his First Sergeant, an old-school former drill instructor named Tommy Scott, turn the company into the top performers in the battalion. In 2008, Hill and Scott lead Dog Company into combat in Wardak, the most violent province in eastern Afghanistan. For six months, the unit faces off against the Taliban. They survive ambushes, rocket fire and IEDs almost daily, and the number of wounded cuts into Hill's unit by a third. Meanwhile, Hill himself battles his own battalion commander, a charismatic but archly political man who threatens to relieve Hill at every turn. After two Dog Company soldiers die in combat, Hill, Scott and a counterintelligence team learn the reason for the mounting casualties: A dozen Taliban spies posing as local national workers have infiltrated their base. After he captures the spies, Hill is abandoned by his higher command, setting off a ticking clock: he has just 96 hours to either release the spies and expose Dog Company to further casualties — or defy the Army's rules on prisoner treatment. In a true story that weaves the combat action of Band of Brothers with the military courtroom drama of A Few Good Men, Hill and Scott must ultimately choose: Sacrifice their careers or sacrifice their men. Trinity Lutheran Church of Columbia, Inc. v. Pauley, dubbed “The Playground Case.” ABC called it “the most anticipated case in the April sitting.” Fox further described it as “arguably the biggest church-state case in recent memory.” Trinity Lutheran Church of Columbia, Inc. v. Pauley involves a Lutheran preschool in Columbia, Missouri that was denied state funds to improve its public playground due to a law prohibiting government aid to religious schools. This case needs to be watched particularly closely because it will be the barometer for years worth of rulings striking at the heart of America's culture and political war. In fact, on Monday, April 17, just two days before "The Playground Case," the Supreme Court "DISTRIBUTED for Conference" the extremely controversial Masterpiece Cakeshop v. Colorado Civil Rights Commission for possible hearing later this fall. Behind the case representing Trinity Lutheran (and Masterpiece Cakeshop) is Erik Stanley of Alliance Defending Freedom. This will be such a timely discussion: Eric Stanley, Christiana Holcomb, and the rest of the ADF legal team have been working tirelessly on this case, scheduled on the SCOTUS docket for tomorrow morning, Wednesday, April 19. Des Moines Church of Christ in Iowa is suing the state’s civil rights commission, claiming the state is trying to censor the church’s teachings on sexuality and force the church to allow men who identify as women to use the women’s restrooms.
