Justin Clark, a man who never learned to take no for an answer, died Thursday at the age of 58. Born in 1962 with cerebral palsy,  unable to walk or talk, he leaves a legacy few Canadians will ever match. Clark became a pioneer in the fight for the rights of disabled people--determined that they should be treated as full-fledged human beings. Justin Clark, who died Thursday at the age of 58, is pictured with his friend and former teacher Robbie Giles as they attend Canada Day celebrations in Ottawa. Their friendship was fast and lasted (see below) a lifetime. (Submitted by Robbie Giles) After spending his youth at the now-closed Rideau Regional Centre in Smiths Falls, Ontario, he decided that he wanted to control his life. He sued his parents for the right to leave the institution they had placed him in as a child. "The 6 day trial began in November 1982 in Perth, Ontario," writes Anoop Kalsi in her review of the proceeding, published in Dec. 2018. "Justin testified by pointing to a board filled with symbols, a bliss board, which read his answers aloud. This was the first time a bliss board was used in a Canadian court," writes Kalsi, a paralegal at Baker Law in Toronto, whose senior partner David Baker had represented Clark. "When Justin finished his testimony, his parents stood up from their seats and applauded," writes Kalsi, adding: "You can read Justin’s testimony in the unpublished manuscript written by Audrey Cole and Melanie Panitch in PDF here and in text here." Clark is pictured with John Matheson, the judge who presided over his case. "He was not a 'mentally retarded man,' who could not learn, the court found. He was a 'gentle, trusting, believing spirit' and 'very much a thinking human being,' the judge ruled, giving him control of his own affairs." (See link below.)  (Submitted by Carole MacLauchlan) The ramifiations of the stand Clark took and the decision Judge John Matheson made nearly 40 years have had a profound effect on--and for--Canadians. Following the ruling, guardianship laws were re-examined, and in some provinces, rewritten.  Disabled people are no longer "put away." And more and more, a disabled person--not his guardian--gets to make the important decisions that affect his or her life--though that fight continues. And anyone who ever met him or had their life changed because of him is not about to forget Justin Clark and his victory in that courtroom back in 1982. Here's something from the website of British Columbia's Community Ventures Society. "The example Clark set is one that we should all be thankful for," says the post. "He took a bold step to change the course of his life and the lives of many others. He has clearly experienced the benefits of this and we're sure many others have as well." For most of his adult life, Clark lived at Foyers Partage in suburban Ottawa but took the time to play bocce at a rehab centre once or twice a week. (David Gutnick/CBC) In November 2018, Clark was the subject of a radio feature by Montreal-based CBC journalist David Gutnick.  "Today, at 56, Clark is thriving. He has travelled widely — to Germany, Switzerland, France and to visit a brother in the United States. He sees his siblings and friends regularly, and corresponds with them by email," Gutnick reported. "He loves his job at ComputerWise, where he designs greeting cards and calendars. Once or twice a week, he plays bocce at the gymnasium of an Ottawa rehab centre." Clark leaves an extraordinary legacy. Robbie Giles, Justin Clark's former teacher, visits him at his home at Foyer Partage in Ottawa. “I just fell in love with the wonderful soul that he was,” Giles told told the Ottawa Citizen's Kelly Egan. Leverage is an important tool, especially in real estate investing. It’s perhaps the most distinguishing characteristic from other asset classes (paper assets – stocks, bonds, mutual funds, etc. and alternative assets – oil and gas, art, agriculture). That is, leverage is a common practice in today’s real estate world. Without it, we wouldn’t have near the quality nor quantity of homes, apartments, high rise office buildings, warehouses, or retail stores as we do today. By definition, leverage is using borrowed capital for an investment, expecting the profits made to be greater than the interest payable. Many real estate investors use leverage to buy properties, by borrowing money from banks, credit unions, and private lenders. There are some people who prefer not to use leverage though. These people consider leverage a risk, and prefer to buy properties with all cash, or pay off loans quicker than required by making extra mortgage payments. A person who doesn’t use leverage is most likely doing so to avoid or reduce risk. They associate debt with risk. But is this person really reducing their risk. Let’s take a deeper look. Let’s say there are two investors who both buy 2 houses next door to each other. Both are $100,000. Investor A pays all cash for the property. Investor B pays a 20% down payment and borrows the rest. Both of their houses appreciate 4% in the first year, now both valued at $104,000. Investor A, who paid all cash, has a 4% return on his money. Investor B, who only paid a $20,000 down payment, realizes a return of $4,000/$20,000 = 20% on her money. This scenario shows how leverage magnifies returns. Note that equity had nothing to do with the returns. Both properties appreciated 4%, independent of equity. But what about risk? What if these homes decrease in value by 20%, and are now worth $80,000. That’s a $20,000 loss for both investors. As Keith Weinhold says, equity has a rate or return of 0. It can only go down in value. It will not go up. So how much equity would you want, if it can only go down, and not up? I personally wouldn’t want any of it. By reducing your equity position in a property, you have less of your money exposed to market conditions. If you are sued, there is less money to go after. In the event you have an insurance claim and the insurance company doesn’t want to pay your claim, guess who is on your side? Your partner, the bank. Remember, when you have a low equity position, you have less skin in the game. Conversely, the bank has a lot of skin in the game. Therefore the bank has an interest in your insurance claim too. Leverage isn’t all bad, like some want to make it. Used wisely, leverage can allow you to grow your portfolio much quicker, reduce your risk, and magnify your returns. Leverage though, can magnify losses just as it does returns, so it’s important to invest wisely. If you haven’t yet used leverage to buy a rental property, I recommend you go back and take a listen to Ep. 127 with John Matheson. He provides a ton of great resources on preparing your project and yourself for a loan with the bank. This is a critical piece to your real estate investing journey, and you should treat it like such.

I did not include John Tomlinson,who played Banquo, in these scenes.  (68 min) One of the beautiful elements of this podcast site is to behold the incredible number of countries that participate. When I listened back to my dialogue, dopey Charlie spoke of July 4th as if it were a "global" holiday. I apologize, since each country has its own special day. I think the excessive New York heat got to me.(if that is a good excuse)
