On this episode of The Open Door (April 17th), panelists Jim Hanink, Mario Ramos-Reyes, and Valerie Niemeyer discuss medical ethics. Our focus will be the debate about the criteria for brain death. Our special guest is John A. Di Camillo, PhD, BeL. He is an Ethicist and the Personal Consultations Director at The National Catholic Bioethics Center (NCBC). He manages its 24/7 free ethics consultation service as well as the Personal Consultations Fellows and Interns Program. He applies Catholic moral theology to science and medicine through research, writing, speaking, mentoring, and fielding hundreds of ethics questions every year. His areas of focus include cooperation with evil, sexual orientation and gender identity, reproductive technologies, and pregnancy complications. Among the questions we'll ask are the following. Please feel free to suggest your own. What is Catholics United on Brain Death and Organ Donation about? What were the goals of writing it and seeking endorsements for it?Why is there no moral certainty of death when following the American Academy of Neurology guidelines for a determination of brain death? What is ongoing hypothalamic function? Is it compatible with brain death? What would be the effect of improved clinical guidelines that require cessation of hypothalamic function?Should patients expect that the existing American Academy of Neurology guidelines—or something even less rigorous—will be applied in practice? Is there a reasonable expectation that the existing guidelines will be improved in the near future?Does a person considering organ donation have good reason to expect that he or she will be truly dead at the time of vital organ procurement?Given that we must presume life until death is certain, and given the lack of moral certainty of death whenever the current brain death criteria are used, can we still assume that a majority of vital organ donors are deceased at the time of organ harvesting? Is it wise, at this time, to decline organ donor status at the Department of Motor Vehicles (DMV) upon first receiving a driver's license? To revoke organ donor status through the appropriate channel in one's state?Should we advocate for the right of patients and health care professionals to conscientiously object to the use of the current brain death criteria for a determination of death? How can we best highlight the Church's teaching on the need for moral certainty of death as a condition for vital organ procurement? What do you hope will happen next, now that Catholics United has been published?

On this day in legal history, August 21, 1878, the American Bar Association or ABA was formed. The American Bar Association (ABA) was established on August 21, 1878, in Saratoga Springs, New York, marking a pivotal moment in American legal history. At a time when the legal profession was primarily comprised of sole practitioners, 100 lawyers from 21 states founded the ABA with the stated aim of advancing jurisprudence, promoting justice, and ensuring uniformity of legislation. Since its inception, the ABA has grown to represent approximately half of all lawyers in the United States, with additional categories of associate and international memberships.Throughout its history, the ABA has not been without its warranted criticisms and controversies. The Association's past stances on race led to marked scrutiny, with a notable incident in 1912 where William H. Lewis's admission was rescinded due to his race, a policy only changed in 1943. This legacy spurred the creation of the National Bar Association by African-American lawyers in 1925. In recent years, the ABA has made attempts to increase diversity, such as electing its first African American and Hispanic-American presidents and achieving a majority-female roster of officers in 2016. More recently, criticism extends to policy positions, drawing ire particularly from conservative viewpoints for its stances on issues like abortion, gun control, and same-sex marriage. Additional criticism has been directed at the ABA's failure to keep pace with the changing demands of modern society, its resistance to regulatory reform, and its handling of the practice of law in modernity. A federal judge in Washington, D.C., has ruled that AI-generated art does not qualify for copyright protection as it lacks human authorship. The case was brought by computer scientist Stephen Thaler, who sought copyright registration for a piece created by his AI program "Creativity Machine," but the U.S. Copyright Office denied his application. Judge Beryl A. Howell's decision is the first in the U.S. to define legal boundaries for AI-generated art, a rapidly growing field. Citing previous cases where non-human creations were denied copyright protection, Howell stated that courts have consistently refused to recognize copyright in works without human involvement. The ruling opens up questions about how much human input is required for AI-generated works to qualify for copyright and how to determine the originality of such art. Thaler's attorney plans to appeal, but the Copyright Office believes the court's decision was correct. The ruling adds to an ongoing debate about copyrightability in the era of AI, as the Copyright Office recently granted limited copyright registration for an AI-assisted graphic novel, further complicating the issue.AI-Generated Art Lacks Copyright Protection, D.C. Court Says (1)A federal judge has rejected a $6 million class settlement between Tesla Inc. and homeowners who claimed the company engaged in a bait-and-switch with rooftop solar panel prices. In 2016, Tesla introduced a solar panel that resembled a tiled roof, and plaintiffs Matthew Amans and Babek Malek alleged that the company initially lured customers with a low cost before hiking the prices in April 2021. The proposed settlement included specific sums for customers who incurred additional costs or chose to proceed at the increased price. The plaintiffs asked Judge Vince Chhabria to preliminarily approve the deal in June, which would cover around 8,200 class members. However, Judge Chhabria denied the approval motion, stating that the filing didn't adequately explain the case's strengths and weaknesses or sufficiently clarify how the parties calculated the relief amounts. The case was dismissed without prejudice which means we will see a refiling of the motion for preliminary approval of class action settlement. Tesla $6 Million Solar Roof Price-Hike Deal Rejected by JudgeAn investor in AMC Entertainment Holdings Inc. will drop a lawsuit demanding a board election at the movie theater chain, as the company has scheduled its first general shareholder meeting in over a year for November 8. The parties agreed to dismiss the litigation in Delaware's Court of Chancery with prejudice, meaning the case cannot be refiled. The lawsuit was filed in July, in conjunction with a separate shareholder case over AMC's APE units. An approved nine-figure settlement on August 11 allowed AMC to enact a plan to convert its preferred stock to common shares, with APE units ceasing to trade on August 25. The Chancery Court denied a motion to stop the conversion from one objecting investor. Meanwhile, another AMC investor filed a new lawsuit this week alleging that the settlement shortchanges APE holders. In a related development, AMC has sued its insurers in Delaware Superior Court for refusing to fund the settlement.AMC Investor Agrees to Drop Lawsuit Over Chain's Annual MeetingCalifornia's Department of Motor Vehicles (DMV) is investigating "recent concerning incidents" involving General Motors' autonomous vehicle unit Cruise, after a robotaxi was involved in a collision with an emergency vehicle in San Francisco. The DMV has requested Cruise to reduce its active fleet by 50% until the investigation is completed and road safety improvements are made, a request Cruise has agreed to. The accident occurred when a fire truck operating in an emergency mode collided with one of Cruise's cars, resulting in non-life-threatening injuries to the sole passenger. Cruise stated that the car identified the risk and initiated a braking maneuver but was unable to avoid the crash. This incident comes after the California Public Utilities Commission (CPUC) voted to allow Cruise and Waymo's robotaxis to operate at all hours and charge passengers in San Francisco, despite opposition. Insurers Should Avoid Suing Each Other The United StatesCourt of Appeals for the Ninth Circuit certified to the California Supreme Court, the following question for our review: "Under California's Motor Carriers of Property Permit Act (Veh. Code, § 34600 et seq.; the Act), does a commercial automobile insurance policy continue in full force and effect until the insurer cancels the corresponding Certificate of Insurance on file with the Department of Motor Vehicles (DMV or Department), regardless of the insurance policy's stated expiration date?" The Supreme Court in Allied Premier Insurance v. United Financial Casualty Company, S267746, Supreme Court of California (July 24, 2023) the California Supreme Court logically advised the court of its opinion based on the statute and California precedent. The certified question arose only in the context of claims for equitable contribution and subrogation between two insurance companies. It bears repeating that the plaintiffs in the underlying lawsuit were compensated to the full limits of Allied's policy under the terms of their settlement and that, at all relevant times, Porras, the trucker, properly maintained an active operating permit. BACKGROUND A carrier can satisfy that requirement by obtaining a policy of insurance. If a carrier does so, the insurer must submit a certificate of insurance to the Department as evidence that the "protection required under [section 34631.5,] subdivision (a)" is provided. The Act requires that proof of financial responsibility be continued in effect during the active life of the permit issued to the motor carrier. This requirement prohibits cancellation of a certificate of insurance without notice to the DMV by the insurer. United appealed to the Ninth Circuit, which certified the question of law to the Supreme Court. If the Act requires a commercial auto insurance policy to remain in effect indefinitely until the insurer cancels the certificate of insurance on file with the DMV, then Allied must prevail. If not, United must prevail. DISCUSSION Equitable contribution assumes the existence of two or more valid contracts of insurance covering the particular risk of loss and the particular casualty in question. The Act Does Not Extend the Policy Beyond the Term Contained in the Contract As to cancellation of a policy, the HCA provided that protection against liability shall be continued in effect during the active life of the trucker's permit, and that the policy of insurance or surety bond shall not be cancelable on less than 30 days' written notice to the PUC, except in the event of cessation of operations as a highway carrier as approved by the PUC. An uncancelled certificate of insurance that remains on file with the DMV does not cause the corresponding insurance policy to remain in effect in perpetuity. But that is not to say that an uncancelled certificate of insurance imposes no obligation of any kind on the responsible insurer. CONCLUSION Under the Act, a commercial automobile insurance policy does not continue in full force and effect until the insurer cancels a corresponding certificate of insurance on file with the DMV. The duration of the policy's coverage is regulated by its terms and those of any endorsement or amendment to the policy itself. The terms of an insurance contract generally determine the duration of the policy's coverage. Although an endorsement can amend the policy, neither the Act nor the specific endorsement requires extending coverage beyond the underlying policy's expiration date. --- Support this podcast: https://podcasters.spotify.com/pod/show/barry-zalma/support

Larry Snow, 73, pleaded guilty in May to one count of attempted witness tampering for trying to dissuade a confidential informant. “According to court documents, Larry Snow used his access as the former Commissioner of Revenue to a Virginia Department of Motor Vehicles (DMV) database as part of an effort to retaliate against and tamper with the confidential informant, Person A, after Person A aided law enforcement in controlled purchases of methamphetamine and heroin from Bryant Snow,” according to a release from the United State Attorney for Western District of Virginia. Specifically, the elder Snow sought to print out material identifying the informant for his son to use to intimidate and to discredit that person while incarcerated at Central Virginia Regional Jail. Snow resigned in May 2022 as Commissioner of the Revenue in Greene, having been elected in 2019 while under indictment. National employment returns to pre-pandemic levelsThere were 528,000 nonfarm jobs added across the United States of America in July, according to the latest employment figures released this morning by the Bureau of Labor Statistics. The unemployment rate is at 3.5 percent. “Both total nonfarm employment and the unemployment rate have returned to their February 2020 pre-pandemic levels,” reads a release that was sent out this morning. The report also notes that the number of permanent job losers is now lower than February 2020. The long-term unemployed is defined as those jobless for more than 27 weeks, and that figure is also below pre-pandemic levels. Other statistics in the release are worth noting. In July, 7.1 percent of the workforce continued to telecommute due to the pandemic. The labor force participation rate is defined as “the percentage of the civilian noninstitutional population 16 years and older that is working or actively looking for work.” That figure was at 62.1 percent in July, lower than the February 2020 figure of 63.4 percent. The next employment numbers from the Bureau of Labor Statistics will be out September 2. Charlottesville seeking input on police chief searchHow much experience should the next Charlottesville Police Chief have? What leadership qualities would you like to see? What should the police department leader’s top priority be?Those are some of the questions in a survey that the firm POLIHIRE is conducting as part of their contract to conduct a search for the next chief. The survey is open through August 15 and is available in English and Spanish. (fill out the survey)The person hired will replace Acting Chief of Police LaTroy A. Durrette who has been in the position since former City Manager Chip Boyles fired RaShall Brackney after three years on the job. Brackney sued the city and several individuals for race, color, and gender discrimination, as well as interference with contract, unlawful retaliation, violation of the state’s whistleblower statute, and more. According to a series of waivers filed in the case, all defendants have until sixty days after July 1 to respond to the case. Albemarle Supervisors endorse Rio Road Corridor PlanThe Albemarle Board of Supervisors has officially endorsed a plan that offers guidance for how future intersection improvements on Rio Road may look in the future. “This is a planning level document that establishes a vision for improvements along the corridor with sufficient analysis of the conceptual design to understand whether the proposed concepts can address future and existing conditions and can meet [Virginia Department of Transportation] and other relevant engineering standards,” said David Benish, development process manager for Albemarle County. The county hired the civil engineering firm Line + Grade to develop the plans. Supervisors were last briefed on the work last October and the Planning Commission saw the draft in May. The work was split into two sections to reflect two different roadway characters. “Phase one is very much an arterial roadway [with] five lanes with a continuous left-hand turn lane in the middle,”  said Dan Hyer with Line + Grade. “Whereas phase two still resembles in many locations the local collector that it is. It’s very much a local road.” Hyer said the work involved analyzing crash data such as at the intersection of Hillsdale Drive and Rio Road. Eighty-nine percent of crashes at the location are left-hand turns. As such, recommended changes are to eliminate that movement at Hillsdale, Old Brook and Northfield. “The solution that we have recommended basically absolves all left-hand turn movements by replacing the two intersections with a singular dog-bone or bean-shaped roundabout,” Hyer said.  Belvedere Drive and Rio Road would be turned into a “Continuous Green-T” intersection and Albemarle has applied for funding. A roundabout is funded at John Warner Parkway and Rio Road and that will soon get under design. The second phase of the project is broken into three segments, with the northern one including two planned developments. The Board of Supervisors approved the 328 Rio Point apartment complex last December, and an application has been filed for 43 town homes just to the south in a project called Rio Commons. “And we think that if those developments can work with this plan that the corridor can transform in a positive way and that some of the risks that we’ve identified can be mitigated through the build-out of these developments,” Hyer said. Supervisor Ned Gallaway of the Rio District was the lone vote against the Rio Point development last December. He said he was concerned about more people in the area.“As we approve the sidewalks and the access down to the Parkway, we’re only creating more pedestrian activity and that’s going to introduce a vehicular piece which is going to be really dangerous so I think we need to get our heads around that sooner rather than later,” Gallaway said.Gallaway said his endorsement of the plan did not mean that he supported the specific recommendations involved. He said there is a competing plan to reroute Hillsdale Drive that would take away the need for the bean-shaped roundabout. “We know that that intersection is completely problematic and needs a solution but it just may not be the solution that’s in the study so if we vote to approve the study, it doesn’t mean we’re necessarily voting to approve that project,” Gallaway said. As for phase two, Gallaway said he would like to see more traffic calming to slow down the speed of traffic, similar to the bump-outs on Park Street in the City of Charlottesville between the U.S. 250 bypass and downtown. Gallaway said he was grateful staff was able to work to get the corridor study done. The vote to endorse the plan was unanimous and it will now be considered as part of the update of the Albemarle County Comprehensive Plan, otherwise known as AC44.Second shout-out: Save the date for Rivanna Conservation Alliance’s Community Watershed clean-upIn today’s second Patreon-fueled shout-out: Mark your calendar for RCA’s third annual Rivanna River Round-Up community watershed cleanup coming up on Saturday, September 24. In April, Council adopted a $212.9 million general fund budget that was 10.76 percent higher than the one for the year before. That’s built on increased assessments for both real estate and personal property as well as a one-cent increase in the real estate tax rate. That was the first such increase in several decades. There are about 30 weeks until whoever is City Manager in March 2023 presents a recommended budget and 36 weeks until Council is expected to adopt their amended document. Council got a briefing this past Monday and learned about some of the factors coming up and some suggested the schedule be moved up. (view the presentation)Will the budget continue to grow at a double-digit level, or will it be more modest? How much will it cost to implement pay and benefit increases that may come through a collective bargaining ordinance? What about the cost of inflation? While the answers aren’t yet known, the foundation is being laid for whatever will end up happening. At the end of August, city departments will be sent packets to request funds for capital projects and these will be due by the early October. There’s at least one change to that process.“We’re going to include a Planning Commission member on the review team,” said Krissy Hammill, the city’s director of budget and performance analysis.Requests from nonprofits and outside agencies are due sometime in mid-October and recommendations from the Vibrant Community team will be completed in mid-January. Also around that time will be another change to the budget process.“It’s called the city manager budget forum,” Hammill said. “The date for this will be January 10 and it will be held at Carver Recreation Center. This will be an opportunity for the city manager to make a presentation and to engage in public discussion.”Hammill said the growth in the budget for next year is expected to be more modest than the 10.76 percent increase from FY22 to FY23. She’s also keeping an eye on inflation.“We already know that there are cost increases that we’re seeing both just in general things as well as capital projects due to supply chain issues and inflation,” Hammill said. “We’re not sure of what exactly what the revenue impact would be for a potential recession if there to be one.” There will likely be higher compensation costs for city employees due to collective bargaining as well as a need to carry on the ongoing costs of positions funded using one-time money. Between now and the budget adoption, Council may have an updated strategic plan paid for through the city’s use of American Rescue Plan Act funding. “The time is right,” said interim City Manager Michael C. Rogers. “In doing the strategic plan right, we’ll get a consultant to engage you individually and collectively over the next few months and by the time we get to April, we ought to have a new direction or at least some themes.”City Councilor Michael Payne said he wanted to make sure there is funding to address a human resources phenomenon known as compression, funding for climate, and for city investment in nonprofits to build subsidized housing. “How can we get our adopted Affordable Housing Plan and that $10 million a year into a more stable place in terms of how we’ll fund it at $10 million a year which is what the plan calls for,” Payne said. Payne also wants to make sure there is funding to invest in public transportation. Rogers said a compensation study is expected to be completed by the end of the year. “That will tell us where we are compared to other jurisdictions in the region in terms of our salaries,” Rogers said. “It will define a competitiveness gap.”The Fluvanna County Board of Supervisors were briefed on their compensation study on Wednesday. Rogers said the August 15 Council work session will feature a presentation of the collective bargaining ordinance followed by a first reading on September 6 with adoption currently anticipated on September 19. “And we expect that there will be a push to begin to recognize collective bargaining units after that,” Rogers said. Another direction to budget staff is to reexamine a policy where 40 percent of new revenues created by additional real estate taxes goes to Charlottesville City Schools. Some on the current Council have called for that agreement to be revisited, and Rogers said budget staff would look into it and begin preliminary discussions with the school system.“And at some point the Council probably should have that meeting with schools to discuss an issue like this,” Rogers said.As for increased spending on public transit, Rogers said current planning by the Thomas Jefferson Planning District is relevant. A governance study for how to implement a proposed Regional Transit Vision is about to get underway.“The long term play is probably the discussion about a regional transit agency, and what are the dynamics that need to be in place for us to move that forward,” Rogers said. “It’s been talked about a long time.” The current calendar calls for the second public hearing on the budget to be held on April 3, 2023 and for adoption at a special meeting on April 11. City Councilor Sena Magill said she wanted to adjust the schedule so that the final public hearing does not happen during the week City Schools are on spring break. “And it’s just one more way that it makes it harder for some people to serve on Council,” Magill said. Charlottesville Mayor Lloyd Snook said he would like to see the budget process moved up further so that Council could have more influence. The budget is introduced to the public the first week of every March. “There are places, particularly in Northern Virginia, where Council is involved in budget discussions by mid-December,” Snook said. “They’re not waiting until February or March and the practical effect of what we do is that our opportunity for actually commenting on things is compressed into about four weeks.” Snook said he would like to see the budget introduced in early February. Rogers said he would look into seeing if that could be accomplished, but it would leave for no break at all for budget staff. Hammill suggested holding budget development work sessions when needed. One such work session that comes to mind is the one last September when Council signaled its willingness to transfer a financial commitment for the West Main Streetscape toward school reconfiguration. That gave staff direction as they built the FY23 budget.Payne pointed out that Albemarle County has adopted their budget in May for the past two years. Rogers and Hammill said they would return with more options. For all of my stories on the budget process in Charlottesville, visit Information Charlottesville.Housekeeping notes for edition #416When will the next installment of Charlottesville Community Engagement? Supporting sponsorships were made by Home Depot, George's INC, Valley Health, and Navy Federal. Additional support was given by Virginia Housing, Dupont Community Credit Union, United Bank, City National Bank and Molina Healthcare. The event would not be possible without the support of these companies. Project Connect events are held in more than 300 communities across the nation. They are recognized as an effective, organized effort to coordinate services to best assist people who are dealing with poverty and homelessness. At last year's event, 500+ individuals received help from 60 area providers. Highlights included offering 79 dental screenings, 87 free haircuts from volunteer stylists, distributing 150 clothing bags, and distributing 125 food boxes. 85% of attendees in 2021 said they would likely not have been able to obtain the services without Project Connect. What makes the event unique is the personalization and service clients will receive when they attend. Volunteer “Guides” will be matched one-on-one with participants to assist them in accessing the services they needed the most. Walk-ins are welcome, but registration is required in advance of the event to guarantee access to some services. Appointments must be scheduled to receive services from the Department of Motor Vehicles (DMV) for the Winchester and Woodstock Event. Appointments are also strongly recommended for veterinary care for pets in the Winchester event. More information about registration and on the programs and vendors is available on United Way NSV website: https://www.unitedwaynsv.org/projectconnect Volunteers are still being recruited for Project Connect. Volunteer barbers and hair stylists are highly needed for both events. Additional shifts for set-up, clean-up and for event staff are still available. As soon as I pray, you answer me; you encourage me by giving me strength. ~ Psalm 138:3 (NLT) Have you ever seen the movie Zootopia? If not, you're missing out on a pretty funny, and cute, Disney story. One of the most remembered scenes, and probably the funniest, is when the main characters are forced to go to the Department of Motor Vehicles (DMV) to gain some information on a bunch of unsolved kidnappings. When they get there, they discover that all of the employees are sloths. For those who live in a cave, a sloth is a medium sized furry, cuddly creature with very long limbs who loves to hang out in trees and eat leaves. Perhaps the feature they are most known for is that they move very, very slowly. Every action is in slow motion. Want to swing over to that branch which is a foot away? That'll take five minutes. (OK, I exaggerate a bit. But not much.) The reason the movie scene is funny is that the main characters are in a bit of a rush, but the sloth employees are moving in super-slo-mo. It is frustrating to say the least. There is much wailing and gnashing of teeth as they wait for the answers they are seeking. Eventually they get the information and they are off and running. Sometimes it seems like God has sloth-like tendencies. I mean, I throw up a prayer for guidance, healing, or a million other things, and the answer takes forever to come back; if at all. It's like He's moving in extreme slo-mo. In contrast, we have this verse out of the Psalms which has a different take on it, “As soon as I pray, you answer me; you encourage me by giving me strength.” This doesn't seem to make sense with my own, personal experience with prayer. The answers don't come quickly. I believe what the Psalmist meant was that as soon as our prayers go up, God begins to take action. Of course, we're super impatient. We want things done immediately. But God wants them done perfectly. Perfection takes time. So, though we often don't get an immediate answer, it is probably because God is lining everything up to provide the perfect answer. Prayer begins and ends with trust in God. We must trust that He will answer (even if it's “no” and we don't like it) in His own time as He provides us with the perfect answer for our unique set of circumstances. He's not being a sloth. He's being God, looking at all the angles, options, and possibilities before giving us the perfect answer.

In this episode of Season 10, Attorney Jay Ruane breaks down the DMV point system in Connecticut and also explains the different between infractions, violations, and crimes. The Department of Motor Vehicles (DMV) in Connecticut has rules regarding different motor vehicle violations and what they mean for your driver's license. The more driving violations you get, the more points will be assessed against your license. If you reach 10 points against your license, it will be suspended. It doesn't matter if you had one infraction in Hartford, a violation in New Haven, and a charge in New London. The DMV keeps track of all driving issues throughout the state, and the points will add up and stay on your license for 24 months. If you are worried about keeping your license, check out this episode to learn more about points and violations. You can also check out our website for more resources.

Attorney Teresa DiNardi explains how you wind up with two different cases when arrested for a Connecticut DUI and what that means for you and your license. Being charged with a Connecticut DUI will trigger two processes against you - the court process and the Department of Motor Vehicles (DMV) process. The court process will determine if you were driving under the influence and will result in criminal penalties such as fines, a license suspension, jail time, a criminal conviction, and more. The DMV process will determine if the DMV should suspend your license as a result of the acts that you are accused of. These cases are independent of one another, but it is a good idea to find a Connecticut DUI lawyer who can fight for you in both. To learn more, visit our website and follow Teresa on Facebook.

Some may wonder how one man finds time to run an outpatient counseling clinic five days a week and still manage to write, direct, and produce his own series of films and books, but Dr. Terrence Graham does it. As the co-founder and owner of Graham, Moore & Clark LLC, Addiction, Behavioral and Biblical Counseling, Dr. Graham provides individual and group therapy for adolescents and adults from 12 years old to the elderly. Some of his services include providing clinical supervision at Level III residential homes, opioid treatment, and substance abuse assessments and treatment for the NC Department of Transportation and the Department of Motor Vehicles (DMV). He started his private practice counseling service in his hometown of Kenansville, NC in 2008. He debuted his practice with two other counselors who are based outside of North Carolina, but as the company grew, he decided to move forward on his own. Dr. Graham holds a bachelor's degree in Psychology and a master's degree in Agency Counseling from NC A&T State University, and a doctorate in Biblical Counseling from Andersonville Theology Seminary. He says that psychology was a natural passion for him.   He was also a Wake County school-based mental health therapist for 13 years where he provided addiction and behavioral counseling for adolescents. He notes that therapy can also help address conflict resolutions, anger management, anxiety disorders, depression, PTSD, and more. Dr. Graham is also a licensed clinical addiction specialist, national certified addiction counselor, masters addiction counselor, distance credentialed counselor, substance abuse professional, certified bariatric treatment specialist, and clinical certified sex offender treatment specialist.   Dr. Graham is currently working on expanding his biblical counseling services by connecting with churches to be a liaison to promote mental health awareness and be a resource for pastors. Biblical counseling is the process in which the Bible is used to treat addictions, behaviors and mental health.   A longtime lover of drawing and creating, Dr. Graham initially dreamt up his film production company, 5Ft Productions as a third grader in Rose-Hill Magnolia Elementary School, in Duplin County, NC. Dr. Graham now uses his established film company to produce movies that can be used as teaching tools in his counseling practice. Each film produced is organized around a behavioral concept that he treats as a counselor.   5ft Productions is Dr. Graham's multi-media production company that produces independent films, publishes books, video, music, and curriculum writing. The company's body of work currently consists of five movies, three published books, an album and an anti-bullying curriculum manual.   To learn more about Graham, Moore & Clark LLC, please visit their office at:   4086 Barrett Drive, STE A Raleigh, NC 27609   You may alos call them at 919-710-7332    You can also send an email to:  gmccounseling@yahoo.com   To learn more about Dr. Terrence Graham, please visit his website at www.5ftproductionsllc.com   To view the edition of Huami Magazine that Dr. Terrence Graham is featured in please click on the following link: https://issuu.com/terrywatson7/docs/huami_magazine_ralieigh_nov_20192   To learn more about Huami Magazine, please visit our website at www.mykelmedia.com   Please follow Huami Magazine on Facebook and Instagram   To advertise on this podcast, or to learn more about advertising in the pages of Huami Magazine, please call 336-340-7844 or send a detailed email to huamimagazine@gmail.com

Voter Suppression: Let Us Count the Ways

Voter suppression is a strategy used to influence the outcome of an election by discouraging or preventing specific groups of people from voting.  It is distinguished from political campaigning in that campaigning attempts to change likely voting behavior by changing the opinions of potential voters through persuasion and organization. Voter suppression →  attempts to reduce the number of voters who might vote against a candidate or proposition. The Tactics of Voter Suppression range from minor changes to make voting less convenient, to physically intimidating and even physically attacking prospective voters, which is illegal. Limiting the amount of places to voteLimiting the time one can voteNot having voting be compulsory but where you must register and keep information accurately updated works against engaging younger votersShutting down Department of Motor Vehicles (DMV) offices in minority neighborhoods,Making it more difficult for residents to obtain voter IDsShutting down polling places in minority neighborhoods; Systematically depriving precincts in minority neighborhoods of the resources they need to operate efficiently, such as poll workers and voting machines; and purging voters from the rolls shortly before an election US HISTORY OF VOTER SUPPRESSION: First you had to own property→ white males ONLY Jim Crow years: poll tax, literacy test, and grandfather clause- to prove your grandfather had been born in the US- repressing slaves In Texas 2016: a voter ID law requiring a driver's license, passport, military identification, or gun permit, was repeatedly found to be intentionally discriminatory-- PRECISION OF SUPPRESSION: Student IDs could not be used as IDs In Wisconsin under Scott Walker: imposing strict voter ID requirements, the law cut back on early voting, required people to live in a ward for at least 28 days before voting, and prohibited emailing absentee ballots to voters In Iowa: Lawmakers passed a strict voter ID law with the potential to disenfranchise 260,000 voters. Out of 1.6 million votes cast in Iowa in 2016, there were only 10 allegations of voter fraud;  May 2017: President Donald Trump established the Presidential Advisory Commission on Election Integrity, purportedly for the purpose of preventing voter fraud. Critics have suggested its true purpose is voter suppression.  Kansas secretary of state: Kris Kobach, a staunch advocate of strict voter ID laws and a proponent of the Crosscheck system. Crosscheck is a national database designed to check for voters who are registered in more than one state by comparing names and dates of birth. Researchers at Stanford University, the University of Pennsylvania, Harvard University, and Microsoft found that for every legitimate instance of double registration it finds, Crosscheck's algorithm returns approximately 200 false positives..... Kobach has been repeatedly sued by the American Civil Liberties Union (ACLU) for trying to restrict voting rights in Kansas FELONS ARE CITIZENS TOO: Across this country today, an estimated 5.8 million Americans – 5.8 million of our fellow citizens – are prohibited from voting because of current or previous felony convictions. That’s more than the individual populations of 31 U.S. states The upcoming 2020 election has huge consequences and everyone needs to get out their ad do their civic duty, but what if you can't find your polling place, or found out that it has moved across town and you don't' drive. Maybe your state requires a photo I.D. or you can't afford to miss work? Unfortunately, these are the realities voters face. Be INFORMED, help others understand, and fight for your right to vote. Happy Friday! On December 27, 2019 FrontPage published my latest article: New York State Blocks ICE and Border Patrol Access to DMV Database: Cuomo’s gift to ISIS, the drug cartels, and human traffickers. The issuance of driver’s license to illegal aliens violates commonsense and is in direct contradiction to the findings and recommendations of the 9/11 Commission. Blocking access to the databases of the Department of Motor Vehicles (DMV) endangers the very lives of CBP (Customs and Border Protection personnel including the Border Patrol as well as ICE (Immigration and Customs Enforcement) agents.  This also impedes the investigation of human traffickers, drug smugglers and other aliens engaged in criminal activities including terrorists.  A single bomb-laden truck parked in the garage of the World Trade Center in February 1993 killed six people, injured more than one thousand people and caused more than a half billion dollars in damage and almost toppled one of the Trade Center buildings. While immigration has arguably become the most divisive and contentious issue in America, Immigration could and should be one issue that nearly all Americans could agree on, if they were told the truth!  That is the purpose of my program. This is Mike Ramos from Your Car Dealer Bond.   I hate to talk politics for several reasons: 1) I'm not sure if anyone cares about my view on something I'm admittedly not that well-versed in. 2) I have always been taught to avoid the political conversation in my 20+ years in Corporate America. 3) I'm terrified to lose half of my customers and listeners we have built so hard to compile. 4) I actually despise politics for the most part.    So why would I actually put any political content out that has nothing to do with California Used Car Dealers? Great question and I'm glad it crossed your brain because it shows that you are paying attention. I only did it because I really do think that I'm not the only one that has never voted or does not vote anymore.   I also think that other people just like me are just trying to scratch out a living and raise their families. And just like me, these same people weren't raised around politics and this landscape is a bit foreign to us. I also strongly believe that others just like me are sick and flipping tired of no one being able to give a straight answer about anything that flies in the face of their side's politics. ---------------------------------------------------------------------------- Please consider connecting with YCDB on Social Media:   Check out Your Car Dealer Bond on Twitter: https://twitter.com/yrcardealerbond   Follow Your Car Dealer Bond on Facebook: https://www.facebook.com/pages/Your-Car-Dealer-Bond/395072210503844   Here's how to find Your Car Dealer Bond on YouTube: https://ycdb.us/YouTube   Connect with Your Car Dealer Bond on Instagram: https://ycdb.us/Instagram   Connect with Mike Ramos on LinkedIn: www.linkedin.com/in/mike-ramos-ycdb   Check out Your Car Dealer Bond on Pinterest: https://www.pinterest.com/yourcardealerbondllc/   ---------------------------------------------------------------------------  President Donald Trump and Hilary Clinton could learn a thing or 2 about how the regular people of America think about politics by listening to episode 11 of the Your Car Dealer Podcast. And although we are probably best known to our audience for being the only podcast dedicated to the success of the used car dealer industry, we are also dedicated to the small business owners that make the United States go around.   Right around the 9:30 mark, I share a hilarious story about the last time I headed off to the voting polls to cast my vote. Email me at mike@yourcardealerbond.com if you have ever heard a more outrageous story about someone going to go pull the lever on either the Democrat or Republican side of the aisle.   At about the 13:59 minute mark I start talking about my assessment of the information that I've routinely seen from Don Lemon at CNN or Sean Hannity. I even mention Ana Navarro, Sonny Hostin, Joy Behar, and Whoopi from The View.   My perspective is that they are all tainted, just depends on by who. It's tough to understand the info when they are ones telling the story because they are too predisposed to a certain angle.   At the 23:55 mark, I discuss my insurance background and the process of an insurance filing getting submitted to the Department of Insurance (DOI). Here's I'm comparing this completely transparent process to the corrupt and murky world of being a political talking head. I apologize for the 6-minute sidebar about the insurance world.   Kudos to the California Department of Insurance for creating this transparency and the California Insurance Guarantee Association (CIGA). I can't stand the California Department of Motor Vehicles (DMV) or many other state-run offices, but the DOI is actually quite impressive.   Somewhere in the neck of the woods of the 29.55-minute mark I start to discuss my thoughts on Serena Williams recent outburst. #HFE. As a previous wrestler, wrestling coach, football player, and football coach, I understand rules and emotion. I also have seen champions at the kid level, high school level, college level, and Olympic level and none of them act the way Serena Williams acted.   I have always respected William's skills and what she had to go through to become a champion and the best that ever lived in her sport, especially given that she grew up in a tough area. That said, this outburst was not champion-like and not something you want your kids trying to emulate. It also doesn't define Serena Williams and a few over-reactions in any career should be expected from the highest level athletes, and not tarnish their reputation in the process.   Special thanks to Google for making it possible to do research in order to put this type of content out into the world. I also thank them for creating such a great search engine that makes it possible for people around the country to find the Your Car Dealer Podcast. Though we’re officially Bangkokians, our status with Thai Immigration is still one of “tourist”, which means we have to exit the country every 30 days. Or rather, our status was tentative. We just firmed that up, though it took a little Frogger-playing to make it happen. We share two stories on today’s program, one about our trip to Kuala Lumpur, Malaysia and one about trekking Chile: 1. Malaysian Visa Malaise Music credit: Upbeat Forever by Kevin MacLeod We get a fair number of questions about our visa status as we travel. And while we’re certainly not experts, we’re getting pretty good at navigating foreign consulates and embassies. You’d think that a single country’s consulate would work the same all over the world, right? You’d be wrong. Our first visit to the Thai Embassy was in Birmingham in the UK, and it was a model of efficiency. Our recent visit to the Thai Embassy in Kuala Lumpur was more like a trip to the Department of Motor Vehicles (DMV). If you can’t find your red tape, this office probably requisitioned it. Chillin’ in Chile Music credit: Kings of Tara by Kevin MacLeod There’s no one right way to travel the world. And in the six months since we met Traveling Jackie, she tried just about all of them. She’s still on the road, but we caught up with her to recently to get the skinny on her envy-creating experiences in Chile last year. (Oh, and she’s a travel podcaster, too!) And That's The Show! We’re headed for some much-needed beach time next week, along with our fellow traveler bloggers and new travel podcasters, Amber & Eric from With Husband in Tow. Those two have a drinking problem.
