Les gardiens d'immeubles peuvent, sous certaines conditions, délivrer des procès-verbaux (PV) aux locataires pour sanctionner des incivilités ou des infractions aux règlements intérieurs. Cette pratique, bien que peu courante, est mise en œuvre par certains bailleurs sociaux pour maintenir la tranquillité et le respect des règles au sein de leurs résidences. Assermentation et formation Pour être habilité à dresser des PV, un gardien d'immeuble doit être assermenté. Cette assermentation est précédée d'une formation spécifique, généralement d'une durée de deux jours, visant à instruire le gardien sur les procédures légales, les droits des locataires et les modalités de rédaction d'un procès-verbal. Ce n'est qu'après cette formation et l'assermentation que le gardien peut légalement constater et verbaliser certaines infractions. Infractions concernées Les infractions susceptibles d'être sanctionnées par un gardien assermenté concernent principalement les incivilités affectant la vie collective. Parmi elles, on trouve : - Dépôts sauvages de déchets : abandon de détritus dans les parties communes ou aux abords de l'immeuble. - Non-respect des règles de stationnement : véhicules garés dans des zones interdites ou gênant l'accès. - Nuisances sonores : bruits excessifs perturbant la tranquillité des résidents. - Dégradations des parties communes : actes de vandalisme ou d'incivilité entraînant des dommages matériels. Les amendes associées à ces infractions varient en fonction de leur gravité, allant de 38 à 3 750 euros. Par exemple, un dépôt sauvage de déchets peut être sanctionné par une amende de 68 euros. Procédure de verbalisation Lorsqu'un gardien constate une infraction, il doit rédiger un procès-verbal détaillé, mentionnant les faits observés, la date, l'heure et le lieu de l'infraction, ainsi que l'identité de la personne concernée si elle est connue. Ce PV est ensuite transmis aux autorités compétentes, telles que la police municipale ou le service juridique du bailleur, qui décideront des suites à donner. Limites et contestations Il est important de noter que les locataires disposent d'un droit de contestation des amendes reçues. Si le procès-verbal repose sur des déductions sans preuves tangibles, la contestation peut aboutir à l'annulation de l'amende. La Cour de cassation a, par exemple, déjà statué en faveur de locataires lorsque les preuves étaient insuffisantes. Exemples concrets À Paris, l'office public de l'habitat, Paris Habitat, a assermenté plus de 400 gardiens depuis 2018. Daily Dose of Hope June 4, 2024 Day 3 of Week 10 Scripture: Numbers 15-18; Psalm 113; Colossians 3 Welcome back to the Daily Dose of Hope, the devotional and podcast that complements New Hope Church's daily Bible reading plan. Let's get right into Numbers. These are some hard chapters. In chapter 15, we have the guy who is stoned for picking up wood on the Sabbath. It's no accident this story comes immediately after the discussion about intentional sin. This guy is definitely being used as an example. This is what happens when… Don't take the Lord's commands lightly. I'm not sure how I feel about this but it does make me overwhelmingly grateful for Jesus. After such a passage, it isn't surprising that we then get the Scripture on tassels. Men were to wear the tassels on their clothing to be a reminder of God's laws. Obviously, they needed reminders. Who are we kidding? We need reminders too! These tassels were like old-school WWJD bracelets but a lot more serious. Infractions had pretty serious consequences. I want to spend some time on Numbers 16. Here we have some Levites who are challenging Moses and Aaron. They are not direct descendants of Aaron but they feel like they should be able to do the work of the priests, that they are just as holy. Their arrogance is a bit alarming. They want the power and prestige, or what they perceive to be power and prestige. Keep in mind, their behavior is a direct and overt disobedience against God. They may appear to be challenging Moses but they are really challenging God. As I read it, I'm actually getting a little scared about what God is going to do to them. You know it isn't going to be good. And it isn't. They die and it isn't pretty. This is the thing. God chooses the humble. Throughout Scripture, God chooses the humble and obedient to be leaders over his people. When leaders allow power to go to their head, that is typically the beginning of their downfall. Let's talk briefly about Psalm 113. It's a little different from the other psalms we have been reading. It's a psalm of praise and the author lists quite a few reasons why God is to be praised. But then he says this in verses 7-9, He raises the poor from the dust and lifts the needy from the ash heap; he seats them with princes, with the princes of his people. He settles the childless woman in her home as a happy mother of children. The author concludes by emphasizing that while God is transcendent and over everything, he is also active in our lives and in this world. He may sit high but he looks low. Obviously, there are still poor people and motherless children. There is still heartache but that does not mean God isn't intricately involved in our lives. He may not swoop in and fix everything in the way we want but that isn't the kind of God we serve. We know that God's ultimate putting things right move was to send Jesus. Jesus was all about putting things right, reconciling humanity to God, and providing a way for new life and resurrection. Let's move on to Colossians 3. In this chapter, Paul begins a discussion on sanctification, encouraging the believers at Colossae to grow in their walk with Christ and reflect Jesus in all they do. He implores them to live differently than those around them; they have a higher calling. The false teachers were concerned with life on earth but Paul is telling the Colossians that there is so much more for which to live. Paul begins by speaking of the vices that must be set aside as Christ-followers. Then, he begins to speak of virtues. I love this! He speaks of these character traits like clothing; "clothe" yourselves with compassion, kindness, humility, gentleness, and patience. Because they are new people in Jesus Christ, they put on new clothes that represent that new life. One can accept Christ and receive salvation, but it is a process learning how to live like a believer. It takes practice putting on these new clothes and yet it is so very important. They must also learn to forgive one another and love each other. We take these concepts for granted in today's church because we talk about love and forgiveness so often. But this would have been new stuff for these early believers. For many, it would have been a drastic shift from their previous life. While we talk a great deal about love and forgiveness in the modern-day church, I think we also still are figuring out how to live out these concepts. If you ask people who left the church why they did so, it often amounts to being mistreated by a church member or being turned off by hypocritical behavior. It would probably do all of us some good to do an assessment. How much do we reflect compassion in our interactions with others? How often do we reflect kindness, humility, gentleness, and patience? How loving have we been toward others over the past week? How forgiving have we been? Take a moment and think about each virtue. Rate yourself on a scale of 1 to 10. What areas need work and how might you practice living these out? Take some time and reflect on today's readings. There is a lot to digest. Blessings, Pastor Vicki

SunDevilSource's Chris Karpman and Blake Niemann explain and evaluate the NCAA's findings in ASU's mitigated level-1 recruiting infractions case. The ASU program will be on probation for the next four years and face punishments that align with a penalty matrix that is the lowest of three tiers for Level I infractions. Individual show-cause penalties against four former staffers, including Herm Edwards, were objectively much more severe. We'll have the details on the implications of these infractions and how they will impact Sun Devil athletics moving forward.
