just adds to the Ridiculousness right so what so the the the issue it is not that I think scores should remain unduly high the issue is that this thing we've put in place either intentionally or unintentionally has only attacked one part of scoring and it is tamped down the ceiling and done very little about anything else and so it's not Equitable across the board I'm all for credibility and scorting I'm all for uh you know increased um accuracy understanding that we are a subjective Sport and you will never remove the subjectivity I just don't think that this thing has been rolled out in a manner and it's supposed to be a pilot program and yet we're getting newsletters and we're getting we're getting told you know what the deductions are that are being missed most says who judging in venue is a different deal than sitting somewhere who knows where in a living room on a video screen and then that's that level of subjectivity is supposed to add more credibility and so I think what we have created is that with a with a targeted part of the scoring Spectrum we have judges looking over their shoulder and there's better ways to do this I I am not about like everything should get a 10 that's not it at all but there there has to be it's got to be whatever we do to increase uh credibility or or or Tamp down or whatever like no one has I've never had anyone present to me that on a consistent basis the wrong team wins or the wrong gymnast wins or whatever now you could say the score might have been too high but was it ranked correctly on that night that's the that's the real question right was it the best routine on that night and you know to the point where people SC scream and clamor enough that that you know at some point Trinity Thomas issued a public apology for getting a 10 for crying out loud here's the thing when you go to a sporting event Scott when you go to a baseball game what's one of the things you hope you see a home run what when you go to a when you go to a football game you you want to see an explosive play a long touchdown pass or things like that you hope to see those things that's sport controversy is also sport and there's nothing wrong with there's never going to be a time when we're when we're all happy with all the scores we see because all of us have biased all of us coaches fans everyone the point is is it ranked correctly is it consistent across the board and by any real objective measure we haven't created a more consistent situation this year we've created a more erratic situation here and and and I'm don't blame the judges one bit because they're doing the best they can to do the job that that that we've asked them to do there are easier ways to correct wrongs in venue and it should be in my opinion given the meat referee authority to convene a conference right now our meat referees have no authority to do much of anything um and and so in tennis the chair umpire can overrule the line judge in in uh the the home plate umpire in baseball can can walk out and call a conference if they thought something was missed at second base these are things that are common in other sports our meat refs are to sit on their hands they judge every routine and many most in almost every venue we we were required to have them but yet they really can't do anything except be a liason to deliver papers from a coach to to the panel to me if I'm if I'm an official I'm going to feel a whole lot better about somebody who's in venue with me as part of the official panel in the meet to be able if something egregious happens to be able to have the authority to walk over and say hey guys let's talk this over and and let's make sure we get this right um that's a simpler solution than than having to use technology from different angles not in venue it's a whole different ball game when you're not judging in venue and so I you know I don't want anything I say or anything live tweeted by the way I had nothing to do with that she just knows how I feel about it and and uh but she's right and and we're we're in a time where where Collegiate athletics's Olympic sports programs many are in Peril for funding and revenue share is is is coming in and scholarships are going to be moved from sport to sport all this everybody got an increase in scholarship no they didn't they got an increased limit and not every school is going to be able to do that and so at a time when when that uncertainty exists for at least 50 or 60% of our programs in our sport we drop this little poison pill into our scoring so that the fans sit there and wonder what the heck's going on so it's ill-timed it's incomplete it's illc conceived and and and it it just is and we keep having to make adjustments and now we're not going to put suggested uh deductions in the in the newsletter anymore I hear and we're not going to put those things out there we're just data collecting that's what we were supposed to be doing in the first place but and then but but there's all this information leaking about what's being looked for and what's not being taken and so it it's just been in my opinion an abject disaster and uh it was fairly predictable that it would be and I hope uh there's growing sentiment that we need to go about this a different way let's examine what we do in scoring let's try to create more accuracy yes but in a time like this we cannot be some kind of purist we can be marketable or we can be purist we're probably not going to be both and and and if we're going to be purist then let's look at the run the gamut let's look at the routine that goes 975 that should go 96 as well you know let's let's let's look at all of it not just the the the higher end scores because these kids work hard and then you see things like this you know where where kids they know they just did the best Vault their life it goes 9925 the next kid's like man what do you got to do to get a 995 I'm not even talking about a 10 Helen Hu should have got a 10 Helen that beam set is the best beam set in the country and she did it flawlessly I dare anybody to tell me where the real deduction was now I was standing I wasn't sitting where the judges were and I'm not questioning their credibility I'm questioning our judgment as a coaches group for for doing this thing that has just created some pendulum swing back and forth where the judges keep trying to find themselves and it's it's just unfortunate so thanks for putting me on my soap box I mean it's not affecting the rankings if you look year to year over the last several years I mean the rankings and the teams that are in the top 15 or what ever you know it's it's The Usual Suspects but if you look at where the uh at the at the higher end scores on each team and where they're capped there's where the change is and so the fans don't get to see their home run they see them and they clear the fence we just don't call them home runs anymore I said that on the air um but it's that was kind of what I meant anyway...” - Jay Clark

213 NEW YORK: Close to Home with Scott Gurian

Hey from The Big Apple I started my adventure in the Big Apple sitting in a park in Brooklyn on a Saturday morning watching small kids and grown-ups playing football – yes, as a European, this is what I call the game where someone kicks a round ball with their feet.  I'm waiting to meet up with my friend Scott Gurian. Even though we'd never met prior, we do consider each other friends.  Scott is a fellow veteran travel podcaster and one of the best in the business. He's the guy from the Far from Home podcast you must have heard me talk about many times here on the Radio Vagabond travel podcast. Scott planned to spend his Saturday with me in Brooklyn, Queens, and New York showing me around some interesting places in his hood while we chatted and got to know each other. Scott lives in nearby Jersey, just across the Hudson River, so we're Close to Home for Scott today. As we walked over to Scott's car — a nice big new Toyota — I immediately joked that it was very different from the small, old car that played a big part in the first season of his podcast. FAR FROM HOME Scott participated in the Mongol Rally and drove a tiny, beaten out Nissan Micra stick shift across Europe and Asia about five years ago for an epic 18,000 mile (29,000 km). He did this crazy adventure from the UK to Mongolia with his brother and two friends – and after that, he decided to drive back in the same car. The first season of Far from Home is outstanding and got me hooked on the podcast long before we knew each other. I highly recommend listening to it if you haven't already. Also, watch a few clips of his journey to experience the trials and tribulations first-hand. Naturally, he has so many memorable stories and anecdotes from that trip, so I wanted to find out which stand out most in his memory. "Oh, so many. Driving across Iran with my brother and two friends (as Americans and Brits) was amazing; the friendliness of the people was memorable. Also, travelling through 'untouched' countries in central Asia like Kazakhstan, Uzbekistan, Tajikistan, etc., was excellent. Seeing Cappadocia in Turkey with its hot air balloons was also amazing. And, of course, Mongolia is incredible with its vast open spaces and extraordinary scenery. It took us about seven weeks to travel from the UK to Mongolia, so as you can imagine, I have many incredible memories from that trip." Scott wanted to see more of the world, so instead of flying back to Europe (like any sane human would), he decided to drive back to explore more countries and regions, like Siberia in Russia. THROAT SINGING IN SIBERIA In one of the episodes of Season 2, Scott visits the remote south Siberian Republic of Tuva to learn about the traditional instruments and the ancient art of throat singing. He even attempts to throat sing himself! Read more about this visit and see photos and videos here. "Russia is such an enormous country with so many different regions home to vastly different cultures. Tuva was a 12 hour journey out the way to visit and it is so unique. It is close to Mongolia so the Tuvans look very similar to Mongolians." HALLUCINATING ON AYAHUASCA IN PERU In another episode, he meets a medicine man who invited him to attend a hallucinogenic healing ceremony where he drank ayahuasca. All while holding his microphone. Have a listen to the episode by clicking here. CLOSE TO HOME Due to the pandemic, Scott hasn't been able to travel overseas. But he is content as he tells me that living in Jersey, there is a lot of adventure that awaits in and around New York. He started cooking and even home-brewing to keep his itchy travel feet scratched. Scott was due to meet me at AfricaBurn – the South African Burning Man just outside Cape Town when lockdown hit. Scott stayed in Jersey, and I was stuck in Cape Town for a while (so be sure to listen to my Radio Vagabond South African travel adventures). We were supposed to travel a bit of South Africa together, but alas, it was not meant to be. SCOTT GURIAN'S NEW YORK TRAVEL GUIDE One of the cool things about making friends worldwide is that they can show you places you usually wouldn't visit. Because I had visited New York several times before, Scott wanted to take me to places few tourists would know about. Here is a list of Scott's unusual but must-visit places in New York Scott took me to: DUMBO A part of Brooklyn is called DUMBO aka "Down Under the Manhattan Bridge Overpass" is a trendy neighbourhood to walk through Brooklyn Heights and Downtown Brooklyn NEW YORK CITY TRANSIT MUSEUM In an old subway station, you can visit the New York City Transit Museum. Move further down and see some 100-year-old subway cars. WILLIAMSBURG Williamsburg is a hipster neighbourhood that is cool to stroll through. QUEENS MUSEUM OF ART Next to where they hosted the World Fair, you find Queens Museum of Art, where the Panorama is now housed – a scaled model of every borough in the greater New York area in the 1960's. THE CITY RELIQUARY The City Reliquary is a not-for-profit community museum and civic organization located in Williamsburg, Brooklyn. It's really cool and weird – and connects visitors to both the past and present of New York. We walked around Brooklyn for a bit and found the iconic Instagram spot with the bridge in the background. You might remember it from the gangster movie 'Once Upon a Time in America' poster. Then visited a place with a lot of food trucks called Smorgesburg. As far as I know, this word comes from the Danish smørrebrød, and then Americans started saying it like the Swedish Chef from Muppet Show. Unfortunately, we didn't find any Danish smørrebrød at Smorgesburg. Another thing we couldn't find after that was… Scott's car. After a slight ordeal trying to locate his car, we eventually found it after getting help from the police. Even locals can get lost in New York. Go figure :) TAJIKISTAN POLICE Our polite encounter with the NYPD reminded me of Scott's experience with the local police in Tajikistan on his trip. I asked him to talk about his experience. "There is a lot of corruption in central Asian countries like Tajikistan. Our British friends in another Nissan Micra got pulled over by some traffic cops who actually aimed their radar gun at another car, and then tried to say it was them who was speeding. My brother's and I stopped too and heard that they demanded $100 which was a month salary here and crazy. Specially since they weren't speeding. It was clearly a scam, and we didn't want to give in to the bribe/corruption stigma. After a long time, we eventually settled on handing over a bottle of vodka, and we were back on the road." Scott secretly recorded the entire encounter that you can listen to in its entirety in Episode 16 of Far from Home, Season 1. Scott tells about more traffic cop encounters he had in central Asia. Most of the time, the cops were polite and never gave them any unnecessary issues. We exchanged stories about the amazing people we get to meet on the road. Scott paid particular mention to the wonderful Iranian popularity he experienced. Thanks to Scott for taking me around the New York area on a beautiful Saturday. Transcript: Day 98 The End? Sunday and the Alarma is over, Lockdown is unlocked, 99 days, it started on Saturday March 14th, but actually I consider that weekend to be the two phoney days of Lockdown.   Saturday 14th March was a pretty normal day, the supermarket rammed with people taking everything off the shelves, including the toilet paper, something that the Spanish do not a use a lot of, most prefer to wash in the bidet than smear on the pan, as it were.   Sunday was equally as busy as people rushed around to be in the right place before the strict measures and fines started on Monday 16th March.  Our friends Jen and Dave making a run for it to their seaside flat, Jen told me “Well it will only be for fourteen days, so we grabbed a few things from the village flat and drove early to the coast.”   As it turned out it has been 99 days and Jen only had her flip flops to wear which after week three fell to pieces and had to patched up with sticking plaster.   For us that first day felt, well felt like this:   CLIP:   So, 99 days, the first thing that happened was our air-conditioning failed due to a power surge that also, we discovered destroyed our faithful ten-year-old iMac computer, then the business laptop decided to join the other two in a suicide pact. That left us with one working laptop and the challenge of buying a new laptop and fixing the air conditioning in full Lockdown.   Ricardo came to the rescue for the air conditioning, finding a new unit tucked away in a warehouse, the laptop had to come all the way from China.  The iMac now resides in our workshop waiting for a trip to Harry the Russian who fixes computers in town.   Chris was out of a job, Spain shut all Gyms on Saturday 14th including the one where he was working, but thanks to our Administration ladies they were able to fill in the complicated online paperwork so that Chris could receive some money from the Government.      Then there was the silence, no traffic, no planes, nothing but birdsong and the waves crashing against the shorelines.  Weird but after a few weeks, quite relaxing.    Our British friends fleeing the country so that they could look after their parents back in the UK.  They left so fast that they had to leave their precious dog behind.  He hasn’t seen them for months now, poor love, but he is enjoying life with a family who run a local kennels.  It took them two days driving pretty much non-stop through Spain and France to grab a ferry back to England.  Petra says she never ever wants to go through that again.   Being really worried about our family, for a few weeks Britain just ignored the Pandemic and my elderly parents went out to a packed pub lunch on Sunday March 15th – but bless them, after that they stayed at home, I think they picked up the seriousness of the situation.    It all seems a long time ago now as we sit outside in the warm sun, the road below noisy and busy, the sounds of the motorcyclists haring round the coast road, great gaggles of cyclists shouting encouragement to each other and on Saturday evening the sea was filled with silly boys on jet skis racing each other, yachts out from Marina de Este, little fishing boats and the odd canoe, far off on the horizon a stream of container ships were heading out to the Atlantic.   Parasols decorated the beach in the distance, all perfectly socially distanced thanks to the lifeguards and the new officers of beach protection.   Chris turned to me and said, “it is if this never happened, like some kind of dream.”   The fact is, it is still happening, it has not gone away and it has not ended, probably not ended for years to come, even if a vaccine was found, it would take years to administer and there would be parts of the world, I am thinking poor parts, that will not be vaccinated.    There currently is no proper control of the virus, it looks like a particular steroid might help, but it seems to have many side effects, My LBC colleague Ken Guy took it for cancer he says on Facebook:   I see that the steroid Dexamethazone could be useful in the treatment of Covid 19. It was part of my cancer treatment back in 2009 and should still be, but I gave it the flick pass sometime back. I took six pills each Monday. It kept me awake till Wednesday and produced mood swings. Neither Gracie nor I appreciated its effect, so I’ve not taken it since.   I should point out he is an Australian. So here in Spain we might be at the end of Lockdown, but we are only at the beginning of the understanding of what this virus is and does, where it actually came from, bat? Wet market? Laboratory Accident?   Will it mutate? Will it return in the Autumn and cause another Lockdown? Will the effects of the virus be nothing compared to the economic havoc it has reeked across the world?   The virus is like life, full of more questions than answers, and in life you should always dare to take risks.  As humankind we took a risk climbing down from the safety of the trees, learning to stand upright, our lives are all about risk.   Thank you for listening to Spanish Practices these last few months, our biggest hope is, weirdly, that we do not have to come back for another season, that dear Spain never has to go through Lockdown ever again, stay safe and well, Goodbye.

Most companies fully understand the need to comply with the FCPA requirements around third parties as they represent the greatest risks for an FCPA violation. However, most companies are not created out of new cloth but are ongoing enterprises with a fully up and running business in place. This means they may need to bring resources to bear to comply with the FCPA while continuing operating an ongoing business. This can be particularly true in the area of performing due diligence on third parties. Many companies understand the need for a robust due diligence program to investigation third parties, but have struggled with how to create an inventory to define the basis of third party risk and thereby perform the requisite due diligence required under the FCPA. Getting your arms around due diligence can sometimes seem bewildering for the compliance practitioner. The information that you should have developed in Steps 1 & 2 of the third party management process should provide you with the initial information to consider the level of due diligence that you should perform on third parties. This leads Step 3 in the five steps of the third-party management-Due Diligence.  Jay Martin, CCO at BakerHughes often emphasizes that a company needs to evaluate and address its risks regarding third parties. This means that an appropriate level of due diligence may vary depending on the risks arising from the relationship. So, for example, the appropriate level of due diligence required by a company when contracting for the performance of Information Technology services may be low, to reflect low risks of bribery on its behalf. Conversely, a business entering the international energy market and selecting an intermediary to assist in establishing a business in such markets will typically require a much higher level of due diligence to mitigate the risks of bribery on its behalf.  Our British compliance cousins of course are subject to the UK Bribery Act. In its Principle IV of an Adequate Procedures compliance program, the UK Ministry of Justice (MOJ) stated, “The commercial organisation applies due diligence procedures, taking a proportionate and risk based approach, in respect of persons who perform or will perform services for or on behalf of the organisation, in order to mitigate identified bribery risks.” The purpose of Principle IV is to encourage businesses to put in place due diligence procedures that adequately inform the application of proportionate measures designed to prevent persons associated with a company from bribing on their behalf. The MOJ recognized that due diligence procedures act both as a procedure for anti-bribery risk assessment and as a risk mitigation technique. The MOJ said that due diligence is so important that “the role of due diligence in bribery risk mitigation justifies its inclusion here as a Principle in its own right.”  Carol Switzer, writing in Compliance Week related that you should initially set up categories for your third parties of high, moderate and low risk. Based upon which risk category the third party falls into, you can design specific due diligence. She defined low risk screening as “trusted data source search and risk screening such as the aforementioned World Compliance”; moderate risk screening as “enhanced evaluation to include in-country public records…and research into corporate relationships”; high risk screening is basically a “deep dive assessment” where there is an audit/review of third party controls and financial records, in-country interviews and investigations “leveraging local data sources.”  A three-step approach was also discussed favorably in Opinion Release 10-02. In this Opinion Release, the DOJ discussed the due diligence that the requesting entity performed. “First, it [the requestor] conducted an initial screening of six potential grant recipients by obtaining publicly available information and information from third-party sources…Second, the Eurasian Subsidiary undertook further due diligence on the remaining three potential grant recipients. This due diligence was designed to learn about each organization’s ownership, management structure and operations; it involved requesting and reviewing key operating and assessment documents for each organization, as well as conducting interviews with representatives of each MFI to ask questions about each organization’s relationships with the government and to elicit information about potential corruption risk. As a third round of due diligence, the Eurasian Subsidiary undertook targeted due diligence on the remaining potential grant recipient, the Local MFI. This diligence was designed to identify any ties to specific government officials, determine whether the organization had faced any criminal prosecutions or investigations, and assess the organization’s reputation for integrity.”  Three Key Takeaways You must have enough information to fully identify the owners, ultimate beneficial owners and related parties to determine if there is foreign official involvement. All commentary on best practices compliance programs require an appropriate level of due diligence. Day 1- The Third-Party Risk Management Process This month, I will consider the risk management of third parties in an operationalized compliance program. As every compliance practitioner is well aware, third parties still present the highest risk under the Foreign Corrupt Practices Act (FCPA). The Department of Justice Evaluation of Corporate Compliance Programs devotes an entire prong to third party management. It begins with the following:  Risk-Based and Integrated Processes – How has the company’s third-party management process corresponded to the nature and level of the enterprise risk identified by the company? How has this process been integrated into the relevant procurement and vendor management processes?  This first set of queries clearly specifies the DOJ expects an integrated approach that is operationalized throughout the company. This means your compliance must have a process for the full life cycle of third party risk management. There are five steps in the life cycle of third party management.  Business Justification and Business Sponsor; Questionnaire to Third Party; Due Diligence on Third Party; Compliance Terms and Conditions, including payment terms; and Management and Oversight of Third Parties After Contract Signing.  Over this month, I will be exploring each of these steps in detail so by the end of this month, you will be able to fully operationalize your third party risk management program.   Step 1 - Business Justification The first step breaks down into two parts:  Business Sponsor Business Justification The purpose of the Business Justification is to document the satisfactoriness of the business case to retain a third party. The Business Justification should be included in the compliance review file assembled on every third party at the time of initial certification and again if the third party relationship is renewed.   Step 2 - Questionnaire The term ‘questionnaire’ is mentioned several times in the 2012 FCPA Guidance. It is generally recognized as one of the tools that a company should complete in its investigation to better understand with whom it is doing business. I believe that this requirement is not only a key step but also a mandatory step for any third party that desires to do work with your company. I tell clients that if a third party does not want to fill out the questionnaire or will not fill it out completely that you should not walk but run away from doing business with such a party.  One thing that you should keep in mind is that you will likely have pushback from your business team in making many of the inquiries listed above. However, my experience is that most proposed agents that have done business with US or UK companies have already gone through this process. Indeed, they understand that by providing this information on a timely basis, they can set themselves apart as more attractive to US businesses.  Step 3 - Due Diligence Most compliance practitioners understand the need for a robust due diligence program to investigation third parties, but have struggled with how to create an inventory to define the basis of risk of each foreign business partner and thereby perform the requisite due diligence required under the FCPA. Getting your arms around due diligence can sometimes seem bewildering for the compliance practitioner.  Our British compliance cousins of course are subject to the UK Bribery Act. In its Six Principles of an Adequate Procedures compliance program, the UK MOJ stated, “The commercial organisation applies due diligence procedures, taking a proportionate and risk based approach, in respect of persons who perform or will perform services for or on behalf of the organisation, in order to mitigate identified bribery risks.” The purpose of this principle is to encourage businesses to put in place due diligence procedures that adequately inform the application of proportionate measures designed to prevent persons associated with a company from bribing on their behalf. The MOJ recognized that due diligence procedures act both as a procedure for anti-bribery risk assessment and as a risk mitigation technique. After you have completed Steps 1-3 and then evaluated and documented your evaluation, you are ready to move onto to Step 4 - the contract. In the area of compliance terms and conditions, the FCPA Guidance intones “Additional considerations include payment terms and how those payment terms compare to typical terms in that industry and country, as well as the timing of the third party’s introduction to the business.” This means that you need to understand what the rate of commission is and whether it is reasonable for the services delivered. If the rate is too high, this could be indicia of corruption as high commission rates can create a pool of money to be used to pay bribes. If your company uses a distributor model in its sales side, then it needs to review the discount rates it provides to its distributors to ascertain that the discount rate it warranted.  Step 4 - The Contract You must evaluate the information and show that you have used it in your process. If it is incomplete, it must be completed. If there are Red Flags, which have appeared, these Red Flags must be cleared or you must demonstrate how you will manage the risks identified. In others words you must Document, Document and Document that you have read, synthesized and evaluated the information garnered in Steps 1-3. As the DOJ and SEC continually remind us, a compliance program must be a living, evolving system and not simply a ‘Check-the-Box’ exercise. Step 5 - Management of the Relationship I often say that after you complete Steps 1-4 in the life cycle management of a third party, the real work begins and that work is found in Step 5– the Management of the Relationship. While the work done in Steps 1-4 are absolutely critical, if you do not manage the relationship it can all go downhill very quickly and you might find yourself with a potential FCPA or UK Bribery Act violation. There are several different ways that you should manage your post-contract relationship. Here we will explore some of the tools which you can use to help make sure that all the work you have done in Steps 1-4 will not be for naught and that you will have a compliant anti-corruption relationship with your third party going forward.  Final Thoughts  I continually give my Mantra of FCPA compliance, which is Document, Document, and Document. Each of the steps you take in the management of your third parties must be documented. Not only must they be documented but they must be stored and managed in a manner that you can retrieve them with relative ease. The management of third parties is absolutely critical in any best practices compliance program. As you sit at your desk pondering whether this assignment given to you by the CCO is a career-ending dead-end; you should take heart because there is clear and substantive guidance out there which you can draw upon.  Three Key Takeaways Use the full 5-step process for 3rd party management. And that keeps me flat out.First off today I'm gonna give you a few words in Aussie English, then I'll give you all a bit of homework. Reckon you can handle that?OK, here we go. Something about words ending in the R sound? We're kinda lazy and leave it off.It's funny, cos when I was in Russia, one day I found my translators chatting together and laughing... they were mimmicking the way we say "SHOWER" and having a good old giggle about it.Our British friends have a similar issue, maybe not as strong. Now compare those words to how an American might say them.Alright, time to put on my American voice... it'll be close enough for this example - all I really need to do his pinch my nose, haha!
