Body image is a common theme on How to Fail. It's something everyone at some point has either struggled with personally, or knows someone who has. We hear from Paloma Faith on the topic - she speaks about being thrown out of ballet school aged 10, because she showed signs of becoming curvy, and that wasn't the correct body for a ballet dancer. Then we go to a part of my conversation with the incredible British sitting volleyball player, Martine Wright. Martine lost both of her legs in the 7/7 London bombings in 2005 and speaks so eloquently about how she actually wouldn't change anything. She is now a mother, a wife, a charity ambassador, certified pilot and the recipient of an MBE. I hope this episode offers comfort to anyone who's ever struggled with body image and acts as a reminder that there's beauty in every version of ourselves. A comprehensive exploration of tort law, focusing on negligence, intent, and strict liability. The discussion delves into the nuances of torts, including the importance of understanding intent in torts versus criminal law, the role of negligence in tort law, and the concept of strict liability. Key cases and examples are used to illustrate these principles, providing valuable insights for law students and professionals. In the intricate world of law, torts stand as a fundamental pillar, shaping the way we understand accountability and justice. This deep dive into tort law unravels the complexities of negligence, intent, and strict liability, offering insights crucial for law students and professionals alike. The Essence of Torts: Torts are not just about memorizing rules; they are about understanding the underlying principles of accountability. As highlighted in the discussion, negligence forms a significant portion of tort law, with 50% of torts questions focusing on this area. Mastering negligence involves understanding duty, breach, causation, and damages, with a keen eye on the nuances of duty and causation.Intent and Its Complexities: Intent in torts differs significantly from criminal law. The discussion emphasizes the importance of distinguishing between specific and general intent, especially in cases like battery and assault. The Villa v. Darul case serves as a perfect illustration of how intent is applied in torts, focusing on the intent for contact rather than the resulting injury.Strict Liability and Its Reach: Strict liability shifts the focus from the defendant's mindset to the nature of the activity or product. Whether it's abnormally dangerous activities or product liability, the principle remains the same: accountability without fault. The discussion also touches on the intriguing overlap of tort concepts, such as applying battery principles to environmental pollution cases. At its core, tort law is about achieving corrective justice, ensuring that those responsible for harm bear the cost. As we navigate the complexities of torts, we must consider how these principles apply to both physical and emotional vulnerabilities, challenging us to think about the future evolution of tort law.Negligence Focus: Negligence constitutes 50% of torts questions, emphasizing the importance of understanding duty, breach, causation, and damages.Intent in Torts vs. Criminal Law: Intent in torts focuses on the contact rather than the resulting injury, differing significantly from criminal law.Transferred Intent: This principle applies to core torts like battery and assault, allowing intent to transfer between victims or torts.Eggshell Plaintiff Rule: Ensures full compensation for physical harm, accounting for the plaintiff's unique vulnerabilities.Comparative Fault Systems: These systems vary by jurisdiction, affecting how damages are calculated based on the plaintiff's fault.Product Liability: Involves understanding manufacturing defects, design defects, and failure to warn, crucial for tort law.TakeawaysTorts are about accountability and corrective justice.Negligence is 50% of torts questions, focusing on duty, breach, causation, and damages.Intent in torts differs from criminal law, focusing on contact rather than injury.Strict liability focuses on the nature of the activity, not the defendant's mindset.Villa v. See omnystudio.com/listener for privacy information.

Amanda discusses her family's distinguished background, her mother's recent MBE award, and the cultural differences she has navigated as an expat. From the royal experience of receiving an MBE to the nuances of food and tea culture, Amanda provides insights into the British-American cultural divide. She reflects on her journey from Massachusetts to Texas, the evolution of dinner parties to potlucks, and the complexities of tea terminology. This conversation offers a rich exploration of identity, culture, and the expat experience. Links Spilling the Tea NEW COLUMN! Spilling the Tea: The Great US/UK Fruitcake Divide Legacy: One family, a cup of tea, and the company that took on the world J. Lyons and Co History Lewis's of Liverpool department store history Order of the British Empire Takeaways Amanda's mother received an MBE for her charitable work. Amanda comes from a distinguished British commercial family. The royal investiture ceremony was a proud moment for Amanda. Cultural differences between British and American life are significant. The transition from Massachusetts to Texas presented new challenges. Food culture in America differs greatly from British traditions. Potluck culture is prevalent in America compared to formal dinner parties. Tea culture in the UK is complex and often misunderstood by Americans. Amanda's experience on Jeopardy was both surreal and rewarding. The importance of community and neighborliness in American culture. Sound Bites On American vs. British confidence culture: "One of the things that really impressed me was how self-confident Americans were and are because I had come from the UK where they have a phrase... called tall poppy syndrome. So tall poppy syndrome means don't stick your head up too high because you don't want to bring attention to yourself." On the family tea empire: "The name Lyons was borrowed from a cousin because the family was already successful in another business and they didn't want to use their names to go into this new venture... So they borrowed the name of one of their cousins, which was Joe Lyons." On British boarding school reality: "I went away at the age of 10. My brother was sent away to prep school... at eight to a boarding school, which he said he would not do to his children. And so his children didn't go to boarding school until they were 13." On American fruitcake disappointment: "It's because this is the only fruitcake that you know. You don't know the stuff that's full of alcohol and really delicious and takes three months to sort of mature before you even bake the thing." On her Nigella Lawson connection: "Nigella's probably a second or third cousin... my father and her mother were very close growing up... I did get invited to her 21st birthday party, which I sadly couldn't go to because I just have my wisdom teeth out." On meeting Princess Anne: "She asked my mother about something that she had done in the 1970s and my mother went 'I didn't even remember I'd done that. How did you know about that?' And she said 'well you've covered a lot of ground.'" On the dinner party culture shift: "I came over here and I started inviting my husband's colleagues over to dinner and they would... always phone and ask, what can I bring? And I'd say, don't bring anything... I didn't understand it." On American neighborliness shock: "The fact that neighbours came over and knocked on my door. I mean, we just didn't do that in England... I lived for a year in a part of Bristol. We never met our neighbors. It just would never occurred to us to go and say hello to them." On tea terminology confusion: "If somebody sends me an invitation and says, come for high tea at four o'clock... I know that's not what that means. It doesn't mean I'm going to be having beans on toast. It means they're going to be serving afternoon tea." On Jeopardy success rates: "I looked up the acceptance rate and it's 0.2% that actually get accepted to be on the show. So I'm very proud that I made it. Sadly, I didn't win, but it was an incredible experience." (This episode was first published in November 2022.) Today's guest is one of my personal heroes, Caryn Franklin. Caryn started her career in the 80s as a fashion editor before moving into TV where she presented, amongst other things, BBC's The Clothes Show. Always outspoken, Caryn has spent four decades being a thorn in the fashion industry's side. Championing diversity of all forms LONG before it became the cool thing to do. She cofounded All Walks Beyond The Catwalk to promote body equality in fashion, chaired Fashion Targets Breast Cancer and was awarded an MBE for her services to fashion. Now she's written Skewed, with Professor Keon West, to examine how media bias distorts our views of others. To bring it back down to my usual level, She is also the owner of my fantasy hair! Of course he is most famously known for being the former vice-chairman of the greatest football club in the world, The Arsenal. Being the man who hired Arséne Wenger, winning 18 trophies and guiding us to a season completely undefeated. If that's not enough, he also received an MBE in recognition of his achievements in 2019.David and I discuss his love for theatre, football and how both can help people in so many ways. Sha'Carri, Kids, Consequences,& Celebrity Drama: A 7Sharp Discussion on Modern Society Join Blu and Roger for a lively discussion on the changing world and the challenges of modern parenting. They talk about how kids today have too much screen time with dedicated cartoon and film channels, unlike when they were young and had limited TV options. The hosts express concern about "lazy parenting" and the rise in children's allergies, noting that kids don't spend as much time outdoors climbing trees or rolling down hills as they used to. The conversation shifts to a discussion of accountability and discipline, inspired by a video of an unruly girl screaming at her mom. This leads to a broader conversation about two other high-profile incidents: The hosts analyze a viral video of an American athlete named Sha'Carri pushing and hitting a man at an airport. They discuss the man's restraint and Sha'Carri's subsequent apology, which they feel was not genuine and was done to protect her endorsements. The episode also touches on allegations against UK comedian Mo Gilligan, with a woman claiming he is a "deadbeat dad" to their 18-month-old son. The hosts explore the idea of taking such matters to court for legal financial arrangements rather than airing them on social media. The show concludes with shoutouts to the One Extra family for their nominations and Nicki Topper for receiving an MBE, before promoting the show's merchandise. #7Sharp #AffinityXtra #Parenting #KidsandTech #LazyParenting #Discipline #Accountability #ShaCarriRichardson #DomesticAbuse #MoGilligan #DeadbeatDads #ShannonSharpe #ParentingAdvice #Podcast #UKComedy #AthleteLife #Relationships #Family https://youtu.be/5_5baDx764U 0:00 - Introduction and Welcome 2:00 - The Challenges of Modern Parenting 7:00 - The Dangers of Technology for Kids 10:00 - A Shift in Youth Culture and Discipline 15:00 - American Athlete Sha'Carri Richardson and Domestic Abuse 20:00 - The Public Apology and Male Vulnerability 25:00 - UK Comedian Mo Gilligan and Deadbeat Dad Allegations 30:00 - Debating Public Callouts vs. Legal Action 35:00 - Shoutouts and Final Thoughts 40:00 - Show Closing and Merch Promotion

This Day in Legal History: John Locke BornOn August 29, 1632, John Locke was born in Wrington, England. A foundational figure in political philosophy, Locke's ideas on government, natural rights, and property would come to shape the ideological core of liberal democracies. His “Two Treatises of Government” advanced the notion that legitimate governments are founded on the consent of the governed and exist to protect life, liberty, and property. Locke's theory of property, rooted in the idea that individuals gain ownership by mixing their labor with natural resources, would have lasting effects not only in political theory but also in legal frameworks—particularly intellectual property law.Locke argued that since individuals own their labor, they also own the results of that labor. This labor-based theory of property acquisition later served as a philosophical underpinning for intellectual property rights, especially in Anglo-American legal systems. The notion that creators have a natural right to control and benefit from their intellectual creations echoes Locke's broader views on property. His influence is visible in early American legal thought, including the U.S. Constitution's provision empowering Congress to secure authors' and inventors' exclusive rights.Locke's work also fueled the American Revolution and the drafting of the Declaration of Independence, with Thomas Jefferson borrowing heavily from Locke's formulations on natural rights. Likewise, his theories permeated the French Revolution and the Declaration of the Rights of Man and of the Citizen. Beyond constitutional law, his legacy persists in modern debates about the balance between public access and private rights in intellectual property regimes. Locke's vision of a just legal order grounded in individual rights, voluntary association, and property remains central to contemporary legal theory.A federal judge will hold a hearing on whether to temporarily block President Donald Trump from firing Federal Reserve Governor Lisa Cook, who is challenging her removal in court. Cook argues that Trump lacks legal grounds for firing her, alleging that the justification—claims of past mortgage fraud—is a pretext tied to her refusal to lower interest rates. The Federal Reserve Act permits governors to be removed only “for cause,” though that term is undefined and has never been tested in court. Cook denies the fraud allegations and says even if true, the conduct occurred before she took office and should not qualify as cause for removal.Trump's administration argues that the allegations are sufficient to justify her dismissal and may also claim that legal limits on removing Fed governors infringe on the president's executive authority. The outcome of this case could significantly impact the perceived independence of the Fed and may ultimately be decided by the U.S. Supreme Court. A Biden-appointed judge, Jia Cobb, will first determine if Cook is likely to succeed on the merits and if her removal would cause irreparable harm. The decision could lead to a preliminary injunction, subject to appeal.Trump has already clashed with the Fed, particularly with Chair Jerome Powell, over interest rate policies and management decisions. Removing Cook would allow Trump to install a fourth member on the seven-seat board, potentially shifting its direction.Trump's firing of Fed Governor Cook could be blocked by US judge | ReutersThe national average score on the July 2025 Multistate Bar Exam (MBE) was the highest in over a decade, reaching 142.4—the best performance since 2013, excluding pandemic-altered years. The MBE, which accounts for half of a bar taker's score in most states, is a key component of the U.S. bar exam. The National Conference of Bar Examiners expects the slight uptick in scores to translate into modestly higher pass rates across jurisdictions. This marks the third consecutive year of improvement for July test-takers, in contrast to the February bar exam, which continues to show declining performance. February 2025 saw a record low MBE average of 130.8, partly due to California's decision to use its own bar exam for that session—a move that backfired due to widespread logistical issues. The California Supreme Court has since ordered the state to resume using the MBE starting in July.As states begin releasing July results, optimism is growing among recent law graduates. However, the disparity between February and July results highlights persistent challenges for repeat test-takers and bar exam policy shifts across jurisdictions.US national bar exam scores hit 12-year high | ReutersMajor U.S. law firms saw strong revenue and profit growth in the first half of 2025, fueled by a sharp rise in billing rates—up 9.2% on average. This surge helped offset rapidly increasing expenses, particularly those tied to attorney compensation and the adoption of artificial intelligence tools. Overhead costs excluding lawyer pay rose by 8.6%, while total expenses, including compensation, were up 9.5%. Despite heavy investment in generative AI, firms haven't realized cost savings yet, as they're still maintaining full legal staffing alongside the new technology.Top partners at elite firms, such as Milbank and Quinn Emanuel, are now charging more than $3,000 per hour, with Milbank's Neal Katyal commanding $3,250. Experts note that while AI may one day disrupt the traditional billable hour model, that shift hasn't materialized yet—echoing past predictions during earlier tech changes that never fully played out. Still, some consultants believe AI may eventually push firms toward flat-fee or project-based pricing, especially as AI becomes capable of completing tasks in minutes that previously took hours.Meanwhile, law firm expenses are also climbing due to higher real estate costs and professional liability insurance. The legal talent pipeline remains strong, with law school applicants up 18% year-over-year and recent graduates enjoying a record-high 93.4% employment rate.Law firm rates, revenues soar but costs pile up in AI era | ReutersA federal judge has dismissed University of Pennsylvania law professor Amy Wax's lawsuit claiming racial discrimination in response to university sanctions against her. Wax, who is white, alleged that UPenn treated her unfairly based on race when it suspended her for a year with half pay over a pattern of controversial public comments about minority groups. Judge Timothy Savage ruled that her claims were “implausible,” noting that she failed to show how her race influenced the disciplinary process or the charges brought against her.Wax argued the university disproportionately disciplines white faculty for speech-related conduct while overlooking similar actions by faculty of color. However, the court found her comparisons to other UPenn speakers flawed, as those individuals had not repeatedly made derogatory remarks about minorities. The ruling follows an earlier denial of Wax's request for a preliminary injunction, where the court found she hadn't proven that the suspension would cause her lasting professional harm.Wax has long been a polarizing figure at Penn Law. Her 2017 op-ed favoring Anglo-Protestant cultural norms and later remarks about Black and Asian students drew widespread criticism. In 2018, she was barred from teaching required first-year courses, and in 2022, a faculty complaint sought a major sanction after she suggested the U.S. would be better off with fewer Asian immigrants.Judge tosses law professor Amy Wax's bias lawsuit over UPenn sanctions | ReutersThis week's closing theme is by Wolfgang Amadeus Mozart, a composer of some note. This week's closing theme is Mozart's Piano Sonata No. 11 in A major, K. 331 – I. Andante grazioso, a work that showcases the clarity, grace, and inventiveness that define Mozart's style. Composed around 1783, likely in Vienna or Salzburg, this sonata is one of Mozart's most beloved keyboard pieces, notable for its departure from traditional sonata form. Instead of the expected fast-paced opening movement, Mozart begins with a theme and variations—a gentle, lilting Andante grazioso that unfolds with elegance and wit. Each variation adds a new layer of texture and character, giving performers the opportunity to explore contrasting articulations, ornamentation, and moods. The charm of the movement lies in its simplicity and restraint, traits Mozart uses not as limitations but as a foundation for subtle playfulness and sophistication. The theme itself is dance-like, with a lightly flowing triple meter that invites the listener in rather than demanding attention. While the final movement of this sonata—the famous "Rondo alla Turca"—often steals the spotlight, the opening movement contains just as much ingenuity and expressive depth. It's a window into Mozart's ability to transform formal conventions into personal, lyrical statements. This sonata was likely intended for his students or amateur musicians, yet it retains the masterful balance of accessibility and complexity that only Mozart could achieve. As we close this week, the Andante grazioso reminds us that refinement doesn't require grandeur, and that musical beauty often lies in the quiet unfolding of a well-turned phrase.Without further ado, Mozart's Piano Sonata No. 11 in A major, K. 331 – I. Andante grazioso, enjoy! This is a public episode. If you'd like to discuss this with other subscribers or get access to bonus episodes, visit www.minimumcomp.com/subscribe

In this special episode of Life of a CISO, I sit down with the brilliant Jane Frankland, MBE—an internationally recognized thought leader in cybersecurity with over 28 years of experience. Jane shares her unexpected journey into the field, starting not from a tech background but from art and design. Her curiosity and drive led her to co-found one of the earliest penetration testing consultancies, long before the term "cybersecurity" became mainstream. Together, we dive into how the industry has evolved, why penetration testing has become commoditized, and why it's no longer enough to offer just technical solutions—true value now comes from insight, strategy, and resilience. Jane also offers powerful reflections on the burnout many CISOs face today and why so many are leaving traditional roles to launch their own consultancies or step into virtual CISO models. We discuss what it really means to build a business in today's climate, the importance of defining your unique value, and why small businesses are an underrated opportunity in the cyber space. From vendor strategy to shifting away from limiting beliefs, Jane brings a fresh, honest, and empowering perspective that challenges the status quo. Whether you're building your career or launching your own venture, this episode is full of clarity and inspiration for the next step in your cyber journey.

Professor Carl Jones is a conservation biologist who is best known for saving the Mauritius kestrel from extinction. He is the scientific director of Mauritian Wildlife Foundation, chief scientist at Durrell Wildlife Conservation Trust and an honorary professor in ecology and conservation biology at the University of East Anglia. He was born in Carmarthen in Wales and was fascinated with animals from an early age, rearing rescued common kestrels, owls and hawks in his back garden. He studied biology at North-East London Polytechnic and, after learning about the plight of the Mauritius kestrel, he was determined to go out to the country to try to save the bird.He arrived in Mauritius in 1979 when there were only two known breeding pairs left in the wild. By the time he left in 1999 he'd established a captive breeding programme and today hundreds of Mauritius kestrels fly over the islands where he spent decades pioneering his, sometimes controversial, methods. Today the Mauritius kestrel is the national bird. He is also responsible for saving from extinction three species of reptiles, a fruit bat and several plants. He was appointed an MBE for his work in 2004 and in 2016 he won the prestigious Indianapolis Prize – the world's leading award for animal conservation.Carl lives in Carmarthen with his wife and two children and assorted animals including two Andean condors called Carlos and Baby.
