Per Trump si tratta del suo primo comizio a Washington dall'assalto al Congresso il 6 gennaio 2021. Il suo mandato si apre già tra mille polemiche. I primi provvedimenti. Sarà avviato il grande piano per contrastare l'immigrazione che prevede arresti, vere e proprie deportazioni. Sul piano operativo doveva scattare in queste ore a Chicago, città simbolo del potere democratico, ma la fuga di notizie del Wall Street Journal ha solo spostato il luogo della partenza. Le agenzie che collaborano con Ice, l'Immigration and Customs Enforcement, dall' Homeland Security Investigations, il braccio investigativo del dipartimento di sicurezza interna, all'Enforcement and Removal Operations, che invece gestisce le deportazioni, restano in stato d'allerta. After a slew of illegal immigrants were nabbed on this idyllic island by Immigration and Customs Enforcement for sex crimes and assault over the course of a month, many residents fear their home has changed forever. Five migrants from Guatemala and El Salvador were picked up by Enforcement and Removal Operations of Boston in separate actions this month. Elmer Sola and Bryan Daniel Aldana-Arevalo were charged for sex crimes against children, per the agency; Felix Alberto Perez-Gomez and Gean Do Amaral Belafronte were charged with sex crimes against adults; and Angel Gabriel Deras-Mejia was a documented member of the notorious gang MS-13. Immigrants – many who have obtained H2B visas for seasonal work – are a vital part of Nantucket's tourism industry and make up a large portion of the summer vacation spot's year-round population. Multiple local bars, like The Muse, host packed Latino nights each week; 41.5% of students in Nantucket's public schools speak a language other than English at home, per online school district data.

Hello Interactors,This post brings new meaning to the phrase ‘reading the tea leaves'. Watching my tea diffuse recently, I got to thinking about how humans diffuse around the globe like tea particulates in a teacup. Some migrate intentionally, others are forced, and some are lured across borders — as if by osmosis, like tea through a strainer.It's tea time somewhere in the world, so grab a cup and let's go… DRINKING DYNAMICS AND HUMAN DIFFUSIONI'm a tea drinker. I relish the ritual of tea-making, watching the clear water transform in hue, be it the gentle embrace of green tea or the profound depths of black. Hydrogen and its oxygen friends, in a fervent state, eagerly extract molecules from the tea elements, diffusing them throughout the cup until a balance or 'teaquilibrium' is reached.However, this seemingly simple diffusion reflects deeper laws of thermodynamics; it's not merely turning twigs into tea. This transformation is part of a grander system — from the tea leaf's growth in specific conditions, its journey through processing, to ultimately gracing my cup. The tea species' continued evolutionary existence and popularity can be attributed to its taste, aroma, and color. So much so that the fragile leaf bears historical weight — wars have been waged for such traits.Whether in a teacup, an ecosystem, or an economy, these processes reveal a system's tendency towards certain outcomes, showcasing nature's ceaseless drive for equilibrium and long-term persistence.This parallels the evolution of humans and how they interact with people and place. Over millennia, humans have been driven to seek better environments, whether they offer more food, safety, or other resources. This behavior, while not consciously directed toward the grand "purpose" of the species, has clear benefits in terms of survival and reproductive success.Kinetic agitation in the physical and social world is what lead humans to diffuse around the globe — to pass through permeable boundaries intent on achieving equilibrium and long-term persistence. And these days, the world is very agitated and humans are diffusing in record numbers.Wars and political conflicts, combined with economic hardships, are driving global migrations, including South and Central Americans north to the U.S. border. Political repression and discrimination are pushing individuals to search for more tolerant societies. Environmental challenges, from droughts to rising sea levels, are displacing both intra and intercontinental populations, including inhabitants watching their Pacific Islands become submerged. By the end of 2022 108 million people were forcibly displaced — and growing. That's up from 40 million in 2010.But it's not all crises driven. With some of the largest populations in the world rising out of poverty more and more migrate in search of better educational opportunities and the prospect of a brighter future.When I was hiring at Microsoft in the early 1990s, the U.S. government was issuing many more work visas than today. The increasing interconnectedness of the world, through technology and transportation, allowed me to hire skilled professionals from other nations. Today people are on massive waitlists hoping to migrate to tech hubs in the U.S., Canada, and Europe. Which can be cruel. Some are heavily recruited, offered jobs, and then forced to live in precarity; putting their lives on hold, they wait as the visa lottery unfolds.But many of those making their way to the U.S. border aren't being recruited. Not directly anyway. They're being drawn, through a semi-permeable legal membrane called a border, from areas of low job concentration to high. Agitated by a variety of circumstances, they seek goals and equilibrium in their lives in a quest to persist.CAPITALISM, MIGRATION, AND THE OSMOSIS OF LABORCompanies and corporations are also goal seeking. They seek to maximize profits. Just as cells have evolved mechanisms for osmotic balance, capitalism has evolved to maximize capital accumulation. And low-wage migrant workers have evolved as a mechanism to achieve this goal.Daniel Costa is the Director of Immigration Law and Policy Research at the Economic Policy Institute. In September of 2023 he testified in front of the U.S. House Subcommittee on Health, Employment, Labor and Pensions on the ‘The Impact of Biden's Open Border on the American Workforce'.He said, “Without immigrant workers, many sectors of the economy would cease to function adequately—whether it be the construction of buildings, crop production, or information technology services.”And according to the Immigration Research Initiative, the range of jobs is wide: “the majority of immigrants are in middle- or upper-wage jobs—with 48% employed in middle-wage jobs, earning more than 2/3 of median earnings for fulltime workers (or $35,000 per year) and 17% are in upper-wage jobs, earning more than double the median.” However, “immigrants are ‘disproportionately likely to be in low-wage jobs. In all, 35 percent of immigrants are in jobs paying under $35,000, compared to 26 percent of U.S.-born workers.”As throughout the history of the United States, America runs on immigrants. Even, or at times, especially, undocumented workers. Estimated at just 5% of the overall labor market, a 2017 report from the Institute on Taxation and Public Policy states “undocumented immigrants contribute significantly to state and local taxes, collectively paying an estimated $11.74 billion a year.” In California alone, there are an estimated three million undocumented workers accounting for $3.1 billion in state and local taxes.They estimate “immigrants nationwide pay on average an estimated 8 percent of their incomes in state and local taxes (this is their effective state and local tax rate). To put this in perspective, the top 1 percent of taxpayers pay an average nationwide effective tax rate of just 5.4 percent.”Despite the contributions of nearly eight million undocumented workers, they have no legal status making them ripe for exploitation by employers. And should these workers complain about unfair or unsafe working conditions or unpaid wages, they risk retaliation and deportation.A 2009 survey of 4300 undocumented workers revealed 37% were illegally paid below minimum wage compared to 16% of U.S.-born workers. And nearly 90% of them said they were not paid overtime wages — a crime that would likely trigger litigation by U.S.-born workers.One of the primary legal avenues for migrants seeking work in the U.S. is through temporary "nonimmigrant" visas. In 2019, over 2 million migrant workers, representing about 1% of the labor force, were in the U.S. under such programs. Despite their legal status, these workers are highly vulnerable to exploitation, often burdened by illegal recruitment fees that lead to debt bondage. Upon arrival, many find the promised job non-existent, and some even fall victim to human trafficking, including forced involvement in the sex industry.STEEPING IN THE OSMOTIC TENSION OF CAPITALISM AND MIGRATIONMeanwhile, there are companies across the nation calling on Biden and Congress to fast-track legal authorization of immigrant workers. Just last month, 100 New York CEOs signed an open letter to Biden calling on him to act, stating there is “a compelling need for expedited processing of asylum applications and work permits for those who meet federal eligibility standards.” This summer politicians in several states were also calling for the same to fill jobs.Meanwhile, congress would rather ‘build the wall'. They've allocated funding for immigration enforcement at a rate eight times greater than immigration court adjudications and asylum and refugee activities. $37 billion is directed towards Border Patrol and ICE's Enforcement and Removal Operations, compared to $3.5 billion for immigration courts and United States Citizenship and Immigration Services Refugee, Asylum, and International Operations Directorate.This only leads to more procedural lags that inadvertently promote workplace exploitation, leading to issues like the rise of illicit child labor. Immigrant children don't choose to work for little to no wages, the uncaring U.S. economic system draws them in — like hot water drawing molecules from a tea leaf.Some say the United States is ‘swamped' and can't accommodate immigrants. And yet Costa Rica has taken in over 270,000 forcibly displaced migrants accounting for 5% of their tiny, and relatively poor, country. Columbia has absorbed two million Venezuelans providing them legal status and a right to remain there for ten years.I think the immigrant situation in America and the exploitation of the disadvantaged, a hallmark and remnant of the slavery that is the foundation of this country, puts migration and cruel capitalism at a crossroads. The osmotic pull of the capitalist market is triggered by profit seeking maximization that draws vulnerable populations into exploitive roles.And we consumers are complicit. We have our own selfish maximizing intentions, like seeking and demanding the lowest price. The collective behavior of consumers shapes this market, leading to emergent outcomes like the exploitation of vulnerable populations.I think about that as I sip my tea. A product most likely grown and processed in unfavorable labor conditions filled with complications and contradictions. All to allow tea-making to be a simple and affordable act. One that also demonstrates an interplay of various forces and principles, from the immediate diffusion of flavor to the broader forces of evolutionary biology and even economics.These processes exemplify how systems, whether a cup of tea, an ecosystem, or an economy gravitate towards certain outcomes. Whether the actors in these systems act with intentionality or not, the drive towards these outcomes is unmistakable. As we witness people struggling to diffuse through membranes into or within countries, agitated by natural, political, social, or economic forces, I think about their immediate quest for equilibrium and their longer-term quest for persistence.And then I think about myself and my oxygen counterparts, molecules of the warm clear water, how much are we helping to create this osmotic tension? I fully recognize I am a participant in a form of cruel capitalism that has its own immediate quest for profit maximization and long-term persistence. I too am seeking equilibrium and a longer-term persistence. And it seems for now, in the U.S. anyway, that means more cruel capitalism as both political parties are swayed by this brand of capitalism —intent on maintaining their own equilibrium in their own longer-term quest for persistence. Abstract: Recently multi-voxel pattern analysis has verified the removal of information from working memory (WM) via three distinct operations replacement, suppression, or clearing compared to information being maintained (Kim et al., 2020). Univariate analyses and classifier importance maps indicate that some brain regions commonly contribute to these operations. This study aimed to use multivariate approaches to determine whether, within these commonly activated brain regions, each of these operations is being represented in a similar or distinct manner. To do so, we used Leiden community detection to identify brain networks that are characterized by similar multi-voxel patterns of activity with regard to these WM operations. Four networks were identified. The Visual Network shows similar multi-voxel patterns for maintain and replace, which are highly dissimilar from suppress and clear, suggesting this network differentiates whether an item is held in WM or not. The Somatomotor Network shows distinct multi-voxel patterns for clear relative to the other operations, suggesting that this network diff in clearing information from WM. The Default Mode Network has distinct patterns for suppress and clear, also suggesting that clearing information from WM is distinct from suppressing it. The Frontoparietal Control Network displays distinct multi-voxel patterns for each of the four operations, suggesting that this network has high involvement in regulating the flow of information within WM. These results indicate that how information is removed from WM depends on distinct brain networks that each have a particular manner in which their co-activation patterns represent these operations. Police Chief Eddie Garcia said in a statement that the woman "gets dropped off, goes inside" and heads towards the Southwest ticketing counters. She went into a restroom where she changed her clothing, "put on some kind of hoodie," and then when she walked out " produced a handgun and began firing about this point." A police officer was already in the area and saw the woman, who Garcia said started shooting at the ceiling. The officer shot the suspect and hit her in "the lower extremities." "She's taken into custody and is currently in Parkland Hospital. No other individuals were injured in this event, other than the suspect". Fox News reported that police did originally respond to an active shooter situation but Garcia said this is "not an active situation." Dallas Police told local news that they were called to an "officer assist" at the airport and that crowds and travelers have been removed from the building. "We want to make sure our community knows that there are no other passengers, family members or people in the airport that are victims," Garcia concluded. It's also possible that the White House is well aware that there will immediately be articles proclaiming a recession on Thursday if growth is negative, and this enables the so-called "fact checkers" to say "not so fast" and limit the spread of that narrative. Police Chief Eddie Garcia said in a statement that the woman "gets dropped off, goes inside" and heads towards the Southwest ticketing counters. She went into a restroom where she changed her clothing, "put on some kind of hoodie," and then when she walked out " produced a handgun and began firing about this point." A police officer was already in the area and saw the woman, who Garcia said started shooting at the ceiling. The officer shot the suspect and hit her in "the lower extremities." "She's taken into custody and is currently in Parkland Hospital. No other individuals were injured in this event, other than the suspect". Fox News reported that police did originally respond to an active shooter situation but Garcia said this is "not an active situation." Dallas Police told local news that they were called to an "officer assist" at the airport and that crowds and travelers have been removed from the building. "We want to make sure our community knows that there are no other passengers, family members or people in the airport that are victims," Garcia concluded. Ahead of their release, the Biden Administration posted an article to the White House blog answering the question "What is a recession?" where they veer from the traditional definition; "While some maintain that two consecutive quarters of falling real GDP constitute a recession, that is neither the official definition nor the way economists evaluate the state of the business cycle." Naturally, many are interpreting this seemingly out-of-nowhere blog post as being to soften the blow of negative growth numbers this Thursday. It's also possible that the White House is well aware that there will immediately be articles proclaiming a recession on Thursday if growth is negative, and this enables the so-called "fact checkers" to say "not so fast" and limit the spread of that narrative. Resources Public Knowledge The Case for the Digital Platform Act by Harold Feld   News Roundup   Supreme Court takes a bite out of Apple in app store case   In a 5-4 the decision, the Supreme Court dealt a blow to Apple in a class action lawsuit claiming that company’s app store is a monopoly. The case will now proceed in the district court. The issue was whether regular consumers have standing to sue Apple for antitrust violations, or whether it was just competitors who have standing to sue. Justice Kavanaugh sided with the court’s liberal justices, saying that if consumers didn’t have standing, that retailers would be able to evade antitrust enforcement, by structuring deals with suppliers and manufactures in a way that complies with the black letter of the law, but still effectively have a monopoly.   Uber driver allegedly locks two women in his car   Police in Pittsburgh arrested an Uber driver, Richard Lomotey, who is also an assistant professor at Penn State’s Beaver campus, for allegedly locking two female passengers in his car and telling them, “you’re not going anywhere”. Lomotey is charged with two counts of kidnapping.   Protests over Palantir   Protestors converged on Palantir’s headquarters around the country over the company’s $38 million contract with Immigration and Customs Enforcement. According to the Intercept, Palantir, which was founded by Trump adviser Peter Thiel, has been working with ICE to help them target and deport unaccompanied children and their families. Palantir says that it only helps ICE with investigations. But the Intercept found written documents, obtained via a FOIA request, that show Palantir pursued an “Unaccompanied Alien Children Human Smuggling Disruption Initiative” with both of ICE’s two major divisions: Homeland Security and Investigations and its other division, which is called Enforcement and Removal Operations.   Symantec: Chinese spies captured NSA’s hacking tools and used them against the U.S.   The New York Times reports that Symantec has discovered that Chinese spies hacked into the National Security Agency and stole its hacking tools. Then it took those tools and used them against the United States. Experts are now questioning what role the U.S. should now play in defining cybersecurity practices around the world. The New York Times describes what China did as being similar to a “ gunslinger who takes an enemy’s rifle and starts blasting away”, making cybersecurity, in a lot of ways, like the Wild West.   Justice Department charges Chinese Nationals in Anthem breach   The Justice Department has charged two Chinese nationals for hacking Anthem back in 2015 that affected some 78.8 million Americans. The DOJ says the hackers used “extremely sophisticated techniques” to hack into Anthem and three other companies. DOJ officials call it one of the worst attacks in U.S. history.   Amazon reports “extensive fraud” following merchant hack   Amazon reported that over 6 months last year, it was hit by what it termed an “extensive fraud” with hackers siphoning funds from merchant accounts.   Pew reports that Americans’ interest in social media is unchanged since 2018   Pew reports that despite all of the breaches, and hacks and problems in the tech sector and Facebook, in particular, Americans’ interest in tech remains unchanged compared to last year. Black and Hispanic adults’ use of YouTube exceeds that of Whites by 6 and 7 points respectively, with 78 and 77 percent saying they’ve ever used YouTube. Notably, Hispanic adults far outpace Whites on Instagram—by some 18 points, with 51 percent of Hispanics saying they’ve ever used the platform compared to just 33% of Whites. Blacks and Hispanics also far outpace Whites on WhatsApp, by 11 points and 29 points, respectively. You can find a link to the report in the show notes.   Uber drivers strike worldwide on day of IPO   Uber drivers around the world protested Uber and Lyft on the day of Uber’s IPO last week. The largest number of protestors, hundreds, appeared outside Uber’s headquarters in San Francisco. But the turnout in other cities around the world, were more modest. This underscores the difficulty of organizing in a company without a central company-wide email system that drivers can use to organize.   Oracle sues the Pentagon for offering jobs to DoD workers   Oracle is suing the Pentagon for eliminating it from a bidding process after Amazon allegedly offered a job to a Department of Defense employee for crafting the Joint Enterprise Defense Infrastructure in a way that benefitted Amazon.   Fight over Airbnb regulation in DC intensifies   DC City Council member Phil Mendleson threatened DC Mayor Muriel Bowser on Twitter, saying that he would withhold building permits for government projects if the Mayor fails to implement a law designed to regulate short -term rentals like Airbnb. The Mayor’s office is saying the law may be unconstitutional because it limits owners of units that don’t actually reside at their property from sharing with renters for more than 90 days per year. Within days of the inauguration, the Trump administration announced sweeping changes that are reshaping the immigration enforcement system in the U.S. interior by which removable noncitizens are arrested, detained, and deported.  In ways big and small, the administration is reorienting the enforcement system. At the same time, there is growing pushback, particularly from states and localities unwilling to cooperate with federal enforcement. How do arrests and deportations under the Trump administration compare to past administrations? How are state and local governments, civil society, and consulates responding? What are the impacts of new policies on federal enforcement, federal-state-local enforcement relationships, and immigrant communities?  To assess the changes and their impacts, Migration Policy Institute researchers visited 15 jurisdictions across the United States, both those cooperating, such as Houston, and those limiting cooperation, such Los Angeles. Their findings are contained in a major MPI report. It reflects interviews across a broad spectrum including ICE field leadership, senior local law enforcement and elected officials, immigration attorneys, community service providers, immigrant-rights advocates, consular officials, and former immigration judges. Immigration enforcement, always a central component of immigration policy, has received particular focus throughout President Obama’s administration. Regardless of who wins the presidential election in November, enforcement will likely continue to play a large—and contested—role for the next four years. In this panel discussion at the 13th Annual Immigration Law and Policy Conference, speakers Elizabeth Cedillo-Pereira, Senior Advisor to the Director of U.S. Immigration and Customs Enforcement, Department of Homeland Security; Dree K. Collopy, Partner at Benach Collopy LLP and Co-Director, Immigration Litigation Clinic, Catholic University School of Law; Thomas D. Homan, Executive Associate Director for Enforcement and Removal Operations at U.S. Immigration and Customs Enforcement, Department of Homeland Security; Stephen Manning, Partner at Immigrant Law Group PC and Director, Innovation Law Lab; and moderator Charles Wheeler, Director of Training and Legal Support, Catholic Legal Immigration Network, INC. examine three key aspects of current U.S. immigration enforcement: family detention and policies affecting unaccompanied children; the replacement of the Secure Communities federal-local immigration enforcement cooperation program with the Priority Enforcement Program (PEP) amid rising local resistance to cooperation with the federal government; and Department of Homeland Security (DHS) guidance on its use of prosecutorial discretion with regards to deportation decisions. Panelists evaluate the successes and failures of these policies, and consider what legislative and other change could happen in the upcoming year. The conference is organized annually by the Migration Policy Institute, Catholic Legal Immigration Network, Inc., and Georgetown University Law Center.
