We are now in pesukim of Perek Shira . Today's pasuk is the song of rain. It's from Tehilim 68,10 (סח י) גְּשָׁמִים אוֹמְרִים. גֶּשֶׁם נְדָבוֹת תָּנִיף אֱלֹהִים נַחֲלָתְךָ וְנִלְאָה אַתָּה כוֹנַנְתָּהּ The rains say, גֶּשֶׁם נְדָבוֹת / Rain of generosity ( nidava means gift , something you don't deserve). תָּנִיף אֱלֹהִים / God will wave נַחֲלָתְךָ וְנִלְאָה /your inheritance is thirsty ( or tired) אַ תָּה כוֹנַנְתָּהּ / You will establish In many texts, when we ask for rain it says we should be blessed B'Gshmei ratzon / rain of goodwill , beracha/blessing, U'nedava/ and generosity , and the Avudarham says that the source for the term Nedava comes from this pasuk - Geshem Nidavot / Rain of generosity . What does ' Rain of generosity' mean? The Radak tells us that in the previous pasuk it says " Eretz Rasha, the earth quaked and the heavens gave rain" - referring to a negative rain, falling on our enemies. Here, it says Geshem Nedavot , which means a rain of generosity, a positive rain. The Malbim says this refers not to the Jewish people at large, but to a specific event that occurred to David Hamelech when he was camping in the desert. They were extremely thirsty, and rain came down upon them. This was Geshem Nedavot , the rain of chesed, that came upon David Hamelech. The Emek Davar , in Vayikra 22,29 quotes this pasuk that uses the words rain of nidava and God should wave , and says that David Hamelech said (referring to when we had a Bet Hamikdash) that if we need rain, we should bring a Korban Nidava, which is a korban Toda/ a thank you offering that will bring rain. And when you wave it, that will also bring berachah . If we need dew, we'll wave it. So the activities that we did in the Bet Hamikdash is what brought the Beracha. Here the term Geshem Nedavot does not mean a rain that God is giving benevolently , but rather that the rain is coming to due to the benevolent acts of the Jewish people in bringing their korbanot. The Sefer Parashat Derachim , in his 21st derush offers an entirely different understanding of this term- rain of generosity. It says that every rain that comes to us is the rain of generosity. We shouldn't think that rain is something natural, that's just going to come upon us just like that. No. Every raindrop is an act of generosity on the part of God, that we don't necessarily deserve. It's not built into the system. We take it for granted, but rain is God's generosity to the world. Furthermore, he says the pasuk refers to נַחֲלָתְךָ /God's inheritance , and explains that when it comes to Nachlatcha , which is Eretz Yisrael, Attah / You God, give the rain that comes upon Eretz Yisrael . That means the rain that comes to other places comes through a Shaliach/ messenger , but when it comes to the rain of Eretz Yisrael , it comes directly from Hashem, and that's why it says, נַחֲלָתְךָ וְנִלְאָה אַתָּה כוֹנַנְתָּהּ / You establish it. As we said, rain is a general symbol for God's intervention/Hashgacha in the world. When Hashem becomes upset, as it says in Keriyat Shema, God stops the rain. But If you follow my statutes, the rain will come at the right time. This means that the Hashgacha that happens in Eretz Yisrael is handled directly by God. That's אַתָּה כוֹנַנְתָּהּ and its actually a pasuk in the Torah in Devarim יא,יב אֶ֕רֶץ אֲשֶׁר־יְהֹוָ֥ה אֱלֹהֶ֖יךָ דֹּרֵ֣שׁ אֹתָ֑הּ תָּמִ֗יד עֵינֵ֨י יְהֹוָ֤ה אֱלֹהֶ֙יךָ֙ בָּ֔הּ .. אַ חֲרִ֥ית שָׁנָֽהֶ A land that God is constantly checking on. The eyes of Hashem are on it. There is a special special Hashgacha Pratit , a special eye , so to say, that is given to Eretz Yisra'el. The song of the rain is that it understands the generosity of God and how God deals directly with Eretz Yisrael. That's the song of the rain.

We are fortunate today to have the great Gaon Rabbi Shemuel Pinchasi from Israel deliver the Daily Halacha. The audio clip contains Rav Pinchasi's oration which was in Hebrew. The explanation appears below. The Mechilta (Halachic work on the Book of Shemot from the Tanna'im), commenting on the verse, "No work shall be performed on them [Yom Tov]" (Shemot 12:16), writes, "It shall not performed by a gentile." The Mechilta thus understood this verse to mean that the Torah forbids a Jew from not only performing Melacha (forbidden activity) on Shabbat or Yom Tov, but even asking a gentile to perform Melacha on his behalf on Shabbat or Yom Tov. On the basis of this comment in the Mechilta, the Sefer Yerei'im (by Rabbi Eliezer of Metz, France, 1115-1198) and the Semag ("Sefer Mitzvot Gadol" by Rabbi Moshe of Couchy, France-Spain, 13th century) ruled that Amira Le'nochri – asking a gentile to perform Melacha on one's behalf on Shabbat – constitutes a Torah prohibition. Other Rishonim, however, including Tosafot, Rashi and the Rambam, maintain that this prohibition was enacted by the Sages, and this is the accepted position. Different explanations have been offered as to why the Rabbis enacted this prohibition of Amira La'nochri. Rashi, both in Masechet Shabbat and in Masechet Avoda Zara, suggests two reasons. First, he explains this prohibition on the basis of Shelichut (literally, "agency"), the notion that an action performed on behalf of another can be attributed to that other person. Hence, when a gentile performs a Melacha on Shabbat at a Jew's behest, Halacha considers the Jew to have performed the Melacha. (Although generally speaking a gentile cannot act as a Shaliach – an agent – for a Jew in the Halachic sense, on the level of Rabbinic enactment a gentile can act as a Shaliach when this would yield a stringency.) Secondly, Rashi suggests that instructing a gentile on Shabbat to perform a Melacha on one's behalf violates the law of "Ve'daber Davar" (based on Yeshayahu 58:13), which forbids speaking in weekday matters on Shabbat. When a Jew asks a gentile to perform a Melacha, he in essence speaks about forbidden activity, in violation of "Ve'daber Davar." The Rambam posits yet a third explanation, claiming that if Jews would be allowed to ask gentiles to perform Melacha on their behalf on Shabbat, they would eventually begin taking the Shabbat prohibitions lightly. Ultimately, this would result in Jews themselves performing Melacha on Shabbat, and the Rabbis therefore found it necessary to forbid Amira Le'nochri. These different approaches to the reason underlying the prohibition of Amira Le'nochri yield practical Halachic ramifications. According to Rashi's first explanation, that the Sages forbade asking a gentile to perform Melacha because the action would then be attributed to the Jew, it would make no difference when the Jew requested that the gentile perform the given act. It would thus be forbidden to ask a gentile even early in the week to perform a Melacha on one's behalf on Shabbat, since the action the gentile performs will be seen as the Jew's action. According to Rashi's second understanding, however, that Amira Le'nochri is forbidden by virtue of the prohibition against speaking of weekday matters on Shabbat, this prohibition would apply only on Shabbat itself. Since this approach focuses on the speech, rather than the action performed, it would restrict the prohibition to instructions given to a gentile on Shabbat itself. By the same token, Rashi's second approach would yield a more stringent ruling regarding an instruction given to a gentile on Shabbat to perform a Melacha after Shabbat. If the issue at hand is speaking mundane matters on Shabbat, then it would be forbidden to ask a gentile on Shabbat to perform a Melacha even after Shabbat. According to Rashi's first approach, however, that the prohibition stems from the concept of Shelichut, the prohibition applies only to actions performed by a gentile on Shabbat. Many Poskim (Halachic authorities), including Rabbi Yaakov Emden (Germany, 1697-1776), the Chida (Rabbi Chayim Yosef David Azulai, Israel, 1724-1806) and the work "Erech Ha'shulchan," ruled that Halacha accepts the stringent conclusions of both approaches. Hence, it is forbidden to ask a gentile even before Shabbat to perform a Melacha on one's behalf on Shabbat, and it is likewise forbidden to ask a gentile on Shabbat to perform Melacha on his behalf at some point after Shabbat. The Shulchan Aruch (307:5) rules that for purposes of a Mitzva, one may ask a gentile to perform on Shabbat an activity classified as a "Shevut," meaning, that is forbidden only by force of Rabbinic enactment (as opposed to Torah law). For example, if a Shofar was caught in a tree on Rosh Hashanah, it would be permissible to ask a gentile to climb the tree and retrieve the Shofar so that one could fulfill the Mitzva of Shofar blowing on Rosh Hashanah. Since climbing trees is forbidden on Shabbat and Yom Tov only on the level of Rabbinic enactment, one may – for the purpose of a Mitzva – ask a gentile to perform this act on Shabbat or Yom Tov. The Shulchan Aruch here disagrees with the view of Tosafot, who held that this provision applies only for purposes involving the Mitzva of Berit Mila (circumcision), but not for other Mitzvot. Summary: One may not instruct a gentile to perform Melacha (forbidden activity) on his behalf on Shabbat. This applies even to instructing a gentile before Shabbat to perform Melacha on his behalf on Shabbat, as well as instructing a gentile on Shabbat to perform a Melacha on his behalf after Shabbat. For the purposes of facilitating the performance of a Mitzva, one may ask a gentile to perform an action forbidden on Shabbat only on the level of Rabbinic enactment.

What happens if the shaliach for a get loses the get? It depends how much time passes before he finds it, assuming he does. Could the get have been replaced in the interim, for example? What happens if the players in the get have the same names as others who are getting divorced. Also, Rabbi Zeira finds a contradiction to our mishnah in a baraita. Which turns out to be a bit lesser as compared to a mishnah contradicting a mishnah... But the baraita is the clearer contradiction this time. Which helps clarify the halakhah here, including how long a get can be lost without it becoming problematic.

The Shulhan Aruch in Siman 450 permits giving money to a non-Jew on Pesah and instructing him to go buy himself something to eat, even if he is likely to buy Hames. However, he may not tell him explicitly to go buy Hames. Also, one may not tell the non-Jew to buy Hames on credit from the store and offer to pay for it later on his behalf, since that may be tantamount to the Jew owning the Hames. For example, if a person has a housekeeper working in his house on Pesah while he is away, it is preferable that he give her money to buy her meals before the holiday. He can also tell her to buy food and he will pay her back directly, but he may not tell her explicitly to buy Hames or that he will pay the store back.Conversely, it is prohibited for Jew to buy Hames for a non-Jew with the non-Jew's money. For example, if a Jew was standing online at the cashier and the non-Jew gives him money asking him to buy him a sandwich. This is prohibited for two reasons. First, there is a concern the Jew may eat some of the Hames before he passes it on to the non-Jew. For that reason, the Mishna Berura forbids even touching Hames on Pesah. Second, a non-Jew is not Halchically capable of appointing a Jew to be his Shaliach (agent). Therefore, when he buys the Hames, he is the one taking possession.

Zalman Wolowik and his wife Chanie arrived in the Five Towns with one goal in mind: to establish a Chabad Center to serve the Five Towns and surrounding communities. Rabbi Zalman Wolowik was born and raised in Montreal and pursued his post-high school studies in New York and Israel, where he received Rabbinic Ordination. He also received dayanut, the ability to serve in Beit Din (Rabbinic court) from Rabbi Hirschprung, Chief Rabbi of Canada. In 1994, after spending a year in Gorky, Russia, enriching the Jewish community, he married Chanie Kotlarsky who was born and raised in Brooklyn and also spent time in Russia. Born into a prestigious Chabad family, she always knew she would be involved in a Chabad Center, which they found themselves directing just a short year later. Filled with enthusiasm and inspired by the Lubavitcher Rebbe, Rabbi and Rebbetzin Wolowik began to assess the needs of the community and to determine how they could make a positive impact on Jewish life in the Five Towns. People wondered and asked what they were doing here and how long they'd stay. "It's a one-way trip we take,” explained Wolowik. “It's a lifetime investment that we do. There's no return." Rabbi Wolowik is the personal Rabbi of former Ambassador David Friedman and played a spiritual role in the inauguration of the US Embassy in Jerusalem in 2018.
